RE: Resolution to Randy Christensen upon his resignation
from the Zoning Board of Appeals.
Randy Christensen has announced his resignation as a member of the City
of McHenry Zoning Board of Appeals. This became effective October 15,
1998. The attached Resolution in recognition of Mr. Christensen's seven
years of service will be presented to him at the start of the November 23,
1998 City Council Meeting.

RE: Transfer of Liquor License - Applebee's
RECOMMENDATION: To approve the recommendation to
transfer the Class A-25 Liquor license
from Apple South, Inc. d/b/a/ Applebee's
Neighborhood Grill and Bar to
APPLEIllinois, LLC d/b/a Applebee's
Neighborhood Grill and Bar.
A liquor license transfer request was received from representatives of
APPLEIllinois, LLC, who is purchasing Applebee's Neighborhood Grill and
Bar from its present owners, Apple South, Inc. They have provided all the
necessary paperwork and they have paid the $250.00 transfer fee.
The current manager of Applebee's Restaurant Mr. William Marvin Becker,
will remain as manager under the new ownership. Since the City of
McHenry already has Mr. Becker's fingerprints on file, it is not required that
he be printed again.
As Liquor Control Commissioner, Mayor Cuda recommends the Council
confirm his approval of the transfer of the Class A-25 liquor license from
Apple South, Inc. to APPLEIllinos, LLC.

RE: Amendment to Chapter 10, Article II, of the
Municipal Code Prohibiting Leaf Burning
RECOMMENDATION: To consider the attached ordinance
prohibiting the burning of leaves.
At the Mayor's request, an amendment to the leaf burning ordinance
prohibiting leaf burning at any time is attached. Currently leaf burning is
permitted on weekends only during the months of October and November;
and weekends only between April 15 and May 15.
In 1995, these limitations on leaf burning were established in response to
complaints about excessive smoke in the community, particularly during the
fall season. At the time, the city was reluctant to ban leaf burning entirely
because there were no viable alternatives available to the community.
Since 1995, the Staff investigated alternatives and ultimately, the City
elected to contract with Waste Management North for leaf vacuuming.
With the success of the leaf vacuuming program, the Mayor is requesting
the City Council consider the enclosed amendment prohibiting leaf burning
in the City of McHenry. All other sections relating to open burning of
twigs, branches, papers, etc., remain unchanged.

Subject: Diedrich Annexation - Draft dated 10/28/98
Monday, November 16, 1998, Roger Gerstad faxed to this office the
attached letter regarding the Diedrich Annexation. He has reviewed the
latest draft agreement, and has requested certain amendments.
In order to bring finality to this annexation, the City Council might consider
deferring this to a committee meeting to discuss these remaining issues and
any other issues the Council may have. A face to face meeting with Roger
Gerstad at the table is appropriate at this time.
