RE: Amendments to the Alcoholic Beverage Ordinance
RECOMMENDATION: To approve the enclosed ordinance
amending Municipal Code Chapter 4, Alcoholic Beverages.
Upon review of the City's liquor rules, and at the recommendation of the
City's Corporate Attorney, it was determined that more specific rules of
conduct for liquor license holders needed to be incorporated into the
Municipal Code. Section 1 of the ordinance addresses specific violations of
liquor rules of which may cause suspension or revocation of an entity's liquor
license. In addition, Section 2 only permits the consumption of alcohol on
the premises. Previously, the ordinance allowed the consumption of alcohol
off premises.
Also, enclosed is a resolution that provides for any appeals to orders by the
local liquor commissioner to the state liquor board be limited to review of
the official record of the proceedings. This will prevent a completely new
hearing from occurring at this level and; consequently, be less costly to the
city.

RE: Proposed 1998 Tax Levy
RECOMMENDATION: To pass the Resolution determining the
amount of taxes to be levied for 1998, and set the Public
Hearing for Wednesday, December 2, 1998 at 7:30 PM.
The 1998 Tax Levy request is attached for your review. Each year the
corporate authorities of the City of McHenry must determine the estimated
amounts of money necessary to be raised by taxation. This procedure must
be done 20-days prior to the adoption of the aggregate levy.
The 1998 levy request is $2,434,989.00. The increase is $317,607.00,
and represents a 15% increase over 1997 taxes extended. The increase is
based upon an estimated 1998 Equalized Assessed Value (EAV) of
$393,540,000.00. This is an increase of $45,000,000.00 over 1997
EAV. The actual EAV will not be known until the County Clerk sends
notice in March 1999. At that time, the County Clerk will give us the
limiting tax extension and, if we have exceeded the tax cap (1.7% for
1998), the City will then reduce the levy amount accordingly. If we
underestimate our levy amount, we do not have the ability to levy more.
Consequently, it is critical we estimate high in order to capture the new
growth in the community.
Since the City intends to levy an aggregate tax in excess of 105% of the
previous years extension, a Public Hearing must be held. It is
recommended the Public Hearing required by the Truth-in-Taxation Law be
scheduled for December 2, 1998, at 7:30 PM, prior to the Regular City
Council Meeting.
For the Mayor and Aldermen's review, an historical comparison of the tax
rate, assessed valuation, and tax extensions is attached.

RE: Amendments to Personnel Manual
RECOMMENDATION: To pass the Resolution approving the
Assistant Administrator job description
and amend the City of McHenry
Personnel Manual.
At the October 14, 1998 City Council Meeting, the Council approved by
motion the Assistant Administrator job description and title.
I prefer all changes to the Personnel Manual be done by Resolution.
Therefore, it is recommended the City Council approve the attached
Resolution approving the job description and amending the Personnel
Manual to include the Assistant Administrator at pay grade 13.
Attached for your review is the revised job description and copy of the
October 14, 1998 City Council Meeting minutes.

FOR: November 23, 1998 Regular City Council Meeting
RE: Resolution to Randy Christensen upon his resignation
from the Zoning Board of Appeals.
Randy Christensen has announced his resignation as a member of the City
of McHenry Zoning Board of Appeals. This became effective October 15,
1998. The attached Resolution in recognition of Mr. Christensen's seven
years of service will be presented to him at the start of the November 23,
1998 City Council Meeting.
