Lobaito, City Administrator FOR: April 21, 1999 Regular City Council Meeting RE: Amendments to the Alcoholic Beverage Ordinance RECOMMENDATION: To approve the enclosed Ordinance and Resolution amending Municipal Code Chapter 4, Alcoholic Beverages. Upon review of the City's liquor rules, and at the recommendation of the City's Corporate Attorney, it was determined that more specific rules of conduct for liquor license holders needed to be incorporated into the Municipal Code. Section 1 of the ordinance addresses specific violations of liquor rules of which may cause suspension or revocation of an entity's liquor license. In addition, Section 2 only permits the consumption of alcohol on the premises. Previously, the ordinance allowed the consumption of alcohol off premises. Also, enclosed is a resolution that provides for any appeals to orders by the local liquor commissioner to the state liquor board be limited to review of the official record of the proceedings. This will prevent a completely new hearing from occurring at this level and; consequently, be less costly to the city. Please note on April 5, 1999, the Mayor and City Administrator met with Class A liquor license holders to discuss these changes. Lobaito, City Administrator FOR: April 21, 1999 Regular City Council Meeting RE: Discussion with Roger Gerstad regarding the Diedrich Annexation As discussed by the City Council at the April 7, 1999 Regular City Council Meeting, I have invited Roger Gerstad to the meeting to discuss the Diedrich Annexation. Listed below are several points of discussion the City Council may wish to address at the meeting: 1. Annexation of the property. 2. Zoning of the property. 3. FAP-420 4. Desired parameters as it relates to density of the development. 5. Specific items in the annexation agreement either positive or negative that should be removed or added. 6. If a new design for subdivision is desired, what general parameters should be followed? mmg
