RE: Lease Agreement – Union Pacific Railroad Company
As the City Council may recall, the City of McHenry received a notice to terminate lease from
Union Pacific Railroad Company. This notice was presented after Union Pacific made
expensive repairs to the building heating system last winter. The lease between Union
Pacific Railroad and the City of McHenry obligated Union Pacific to make all necessary
repairs in excess of $5,000. After meeting with representatives from Union Pacific and Metra,
we were advised that Union Pacific had no desire to end the lease arrangement with the City,
but rather were interested in establishing a new lease which encumbers the City to make all
repairs and maintenance to the building. The new lease would be essentially unchanged
from the current lease except for maintenance responsibility. The rent is $1.00 per year.
To date, the City’s position with Union Pacific has been a willingness to accept maintenance
responsibilities but only if needed building repairs were made at no expense to the City. As
Union Pacific has minimal use of the building, they will not provide funds for the repairs.
Metra on the other hand, has an interest in maintaining the facility for their riders and has
verbally offered to pay for the repairs. Written verification has not been received as of this
writing, but is expected prior to Wednesday’s meeting.
A preliminary cost estimate for the repairs has been obtained with an estimated cost of
$80,000. These funds would be used for the following repairs:
Complete tear-off and replacement of roof
Replacement of HVAC system
Tuckpointing masonry
Carpentry work (replacement of rotted window sills, broken/rotted fascia board
and rafter tails, and rebuilding of gable ends)
Repainting of exterior wood surfaces
Although Metra would provide the funds and prepare any documents necessary to bid the
work the City would be responsible to manage the repair project.
If the City has an interest in accepting maintenance responsibilities with the understanding
that the needed repairs would be done at Metra’s expense (not to exceed $80,000), a review

the rent payment by the sub-lessee would be appropriate. Currently the tenant is paying
$350/month and accelerates to $375 in Year 2001 and $400 in Year 2002. Based on
discussions with local realtors, rent for commercial space of similar property would be $7.00
per square foot annually. The tenant presently occupies approximately 1,900 square feet.
This would raise the monthly lease payment to $1,108 per month.
By assuming the maintenance responsibilities of the facility, it would be fiscally prudent to
collect rent that is more in line with the current market. Accepting maintenance responsibility
for a structure of this age can lead to unanticipated costly repairs. In addition, this structure
would certainly meet the criteria for a landmark structure, which could raise the cost of
repairs.
If the City Council is interested in entering a new lease agreement with Union Pacific and the
current tenant based on the information in this supplement, new lease agreements would be
brought forward to the City Council for action at the next City Council meeting.

DEPARTMENT HEAD REPORT

RE: Inferior Roof Deck Insulation – Municipal Center
The City of McHenry received a Notice of Proposed Settlement from Manville
Insulation notifying the City of defective roof insulation material installed on the roof
of the Municipal Center. This material, Phenolic Foam Roof Insulation, releases an
acid that is corrosive to the metal roof deck when subjected to moisture.
The settlement offered by Johns Manville, Inc. is $100 per a 10’ x 10’ square. The City
would receive approximately $24,000.
I am seeking Council direction to proceed with filing the attached claim form. An
exclusion form is also attached; however, this is only relevant if the City intended to
sue the manufacturer on its own in the hopes of recovering a higher monetary
settlement.

RE: Salary Compensation for Elected Officials
From time to time, there has been discussion regarding salary compensation for elected
officials. You may or may not be aware that any increase in compensation must be fixed at
least 180-days before the beginning of the next term (May 1, 2001). Please note any
increase in compensation would become effective at the beginning of the elected official’s
new term. If the City Council is interested in reviewing their compensation, the Council will
have to take action before November 1 of this year.
Attached to this memorandum are three salary surveys of surrounding communities that
may help you in evaluating if you would like to initiate a review.
Below is the current compensation for the elected officials
Mayor: $12,000 annually
Aldermen: $75 per meeting (37 annual meetings)
Treasurer: $1,500 annually
City Clerk/Collector: $26,000 annually as City Clerk
$26,000 annually as Collector
