RE: Intersection of Burning Tree Drive and Ridge Road
A petition from the residents of Deerwood and Burning Tree Subdivisions requesting
modification to the Ridge Road and Burning Tree Drive intersection is attached. This was
originally delivered to the Council via the April 14 Friday Report. Due to the recent accident at
this intersection, they have asked for the following:
The trimming of trees and bushes in the right-of-way
Reduction in speed limit
Posting of warning signs
To date, the trees have been trimmed and the bushes have been removed from the adjacent
property creating a better sight line for traffic.
The speed limit on Ridge Road is set by McHenry County and is currently 45-mph. The
petition requests that there be a reduction to 40-mph. Upon speaking with the County Highway
Engineer, a reduction in the speed limit would only be done if a speed study was performed
and the results justified a reduction. You may recall the Council faced this very issue before
with the County. Most recently, the County denied the City’s request to reduce the speed limit
on Bull Valley Road. A speed study was performed at that time, which resulted in no
justification for a reduction.
The criteria used by the County to set speed limits are modeled after IDOT’s regulations. The
philosophy used by IDOT is concisely stated in a recent letter (attached) from John Kos,
District Engineer of IDOT regarding the posted speed limit on Route 120 at Valley View School.
Based on this information, it is not likely a reduction in the speed limit would be warranted, nor
would a reduction in the speed limit improve the safety of the intersection. Pursuant to the
investigation of the accident, the rate of speed of the vehicle was not the cause of the accident.
I also spoke with the County regarding the installation of “warning” signs. There is presently
one sign for northbound traffic notifying motorists of the intersection and one sign for
southbound traffic (sign pictures attached). I was also advised that the County has
discontinued the installation of “warning” signs advising motorists of potentially hazardous
intersection.
It is recommended the City Council discuss this issue in order to bring this matter to a close.

RE: Request from Illinois Municipal League– E-Commerce Equity
In 1998 Congress passed the Internet Tax Freedom Act establishing a moratorium on
Internet access fees, new taxes, and multiple and discriminatory taxes. This Act due to
expire in October 2001, essentially provides for a tax-free retail market over the Internet.
Currently, bills are being introduced in the House and Senate to extend and expand
the Internet Tax Freedom Act. The Illinois Municipal League is requesting all member
municipalities to pass the attached Resolution opposing any move in Congress to
extend or expand the current moratorium. The continuation of this tax-free
environment could potentially have a negative effect on McHenry’s future sales tax
revenue. As the general public becomes more comfortable with purchasing products
on the Internet, fewer purchases will be made from the traditional “brick and mortar”
retailer.
As McHenry receives over 50-percent of its revenue in the general fund from sales
tax, it is important that the City support the Municipal League in its efforts.
