Lobaito, City Administrator FOR: March 15, 2000 Regular City Council Meeting RE: Petersen Park Improvements, Preliminary Design Pursuant to City Council action at the January 12, 2000 meeting, engineering services for the Petersen Park Waterfront Improvement Plan will be completed by Marquette University students as a senior design project in conjunction with Smith Engineering Consultants, Inc., at no cost to the City. The three students working on the design project have requested to attend a City Council meeting to present a preliminary design of these improvements. A copy of the letter sent to Mayor Cuda is attached to this supplement. Elizabeth Blair, Matt Glisson and Josh Roden of Marquette University as well as Scott Smith of Smith Engineering Consultants, Inc. will be available for questions and comments. Lobaito, City Administrator FOR: March 15, 2000 Regular City Council Meeting RE: Amendments to Municipal Code - Chapter 4, Alcoholic Beverages The Chief of Police has brought to my attention several deficiencies in the liquor control ordinance. David McArdle has reviewed the current ordinance and has drafted the attached ordinance amending certain sections. In summary, the following amendments are proposed: Sec. 2: Defines the term ”Manager.” Sec. 3: Stipulates that persons making false statements on the liquor license application are ineligible for a license. Sec. 4: When businesses discontinue operations for 30-consecutive days, the license becomes void (some exceptions, refer to ordinance). Sec. 5: Change in ownership, any changes in partnership, officers, directors, persons holding more than 5% of the stock or ownership interest, or managers of the business shall report such change within 10-days. Sec. 6: Allows for revocation of license if application contains false or misleading statements. Sec. 7: Clarifies the prohibition of the sale and distribution of alcoholic beverages after closing hours. Sec. 8: Additionally requires containers of alcohol to be removed from areas accessible to customers after closing hours. Sec. 9: Provides for the admittance of police officers into an establishment upon request by the officer to ensure compliance with rules relating to closing hours. For reference, the alcoholic beverages section of the Municipal Code is enclosed. It is recommended that the City Council approve the proposed ordinance amending Chapter 4 of the Municipal Code relating to Alcoholic Beverages. mmg Attach. Lobaito, City Administrator FOR: March 15, 2000 Regular City Council Meeting RE: Police Liaison Officer Agreement with McHenry School District 156 At the November 10, 1999 City Council meeting, the City Council authorized Alderman Murgatroyd and Alderman Glab to negotiate an agreement with School District 156 for school year 2000-2001. On December 29, 1999, Alderman Murgatroyd reported to the City Council that a tentative agreement had been reached. The following recommendations were made: 1. School District 156 will pay two-thirds and McHenry will pay one-third of the annual compensation cost of a 5-year police officer. 2. The annual wage of a 5-year police officer will automatically adjust annually pursuant to the wage schedule in the current and subsequent collective bargaining agreements. 3. Employee benefit costs as outlined in Exhibit A shall be included in the annual wage calculation. 4. Employee benefit costs shall be reviewed and adjusted if necessary, at the end of each collective bargaining agreement. The current collective bargaining agreement expires April 30, 2002. The remainder of the agreement is unchanged in comparison to the current agreement with the school district. If approved, the agreement will be sent to the School District 156 for their execution. mmg Attach.
