Lobaito, City Administrator FOR: July 5, 2000 Regular City Council Meeting RE: No Left Turn Prohibition - Intersection of Green Street and Elm Street At the June 30, 1999 City Council meeting, an ordinance was passed prohibiting left turns at the intersection of Green and Elm Streets between the hours of 7:00 A.M. and 7:00 P.M. At that time, the Council requested a review of the ordinance in November 1999; however, this was inadvertently overlooked. I have asked Chief Kostecki to review the policing action and accidents at this intersection. His memorandum is attached. I agree with the Chief’s personal experience that traffic does seem to move more quickly through this area. It is recommended that City Council discuss the merits of the no left turn prohibition at the intersection of Green and Elm Streets. A G E N D A S U P P L E M E N T TO: Mayor and City Council FROM: John A. Lobaito, City Administrator FOR: July 5, 2000 Regular City Council Meeting RE: Diedrich Property Annexation RECOMMENDATION To approve the following in the order presented: 1. Ordinance authorizing the Mayor to Execute the attached Annexation Agreement between Gerstad Builder’s and the City of McHenry; 2. Ordinance Annexing the 100-acre Diedrich Property; and 3. Ordinance Granting the Zoning Map Amendment for the 100-acre parcel to RS-2 Medium Density, Single Family Residential Attachments: 1. Ordinance authorizing the execution of an annexation agreement. 2. Ordinance annexing the property. 3. Ordinance rezoning the 100-acre parcel 4. Annexation Agreement August 24, 1998, a Public Hearing was held to consider the annexation of the Diedrich Property located on the north side of Lincoln Road and west of Chapel Hill Road. The Public Hearing was closed on this date. Originally, the property consisted of approximately 118-acres. Subsequent to filing the petition for annexation, the State of Illinois purchased a portion of the property for roadway purposes thus reducing the acreage of the property to 100-acres. The enclosed concept plan depicts 219-lots however the annexation agreement restricts the development to a maximum of 191-lots. There are also limited representations relative to the concept plan that is binding on both parties. This will allow for greater flexibility when considering future preliminary plats. In addition, the concept plan depicts areas at the rear of the lots as greenbelts. This area was originally proposed with a conservancy overlay. This has been struck from the concept plan and will not be used for common open space but rather kept as private property. The owners are obligated to provide a minimum of 2-acres of parkland and develop the park in accordance with a plan submitted by the owners and approved by the City Council. In conjunction with the park development, the owners will also pay a park donation fee per housing unit pursuant to the schedule referenced in Paragraph C (1), page 9 of the agreement. These fees and all other cash donations are subject to annual increases based on the Chicago Area Consumer Price Index Attached are the ordinances necessary to annex and rezone the proposed Diedrich Property development. mmg
