RE: Decrease in Assessments Sought through Appeal to the McHenry
County Board of Review by Inland Real Estate Corporation
RECOMMENDATION: Direct the City’s Corporate Attorney to file Papers of
Intervention with the McHenry County Board of Review.
The City of McHenry has received notice that a decrease in assessed value of what
may finalize at $100,000 or more, is being sought by Inland Real Estate Corporation.
The property involved is 4512-4518 Garden Quarter and 4502-4508 Garden Quarter,
which is the Garden Quarter apartment complex.
Should the City of McHenry participate in the appeal process, papers of intervention
must be filed with the McHenry County Board of Review within 10-days of the postal
mark of this letter. I have contacted Mike Kelly of District 156 and he informed me
that as a matter of policy, the District would be filing papers of intervention with the
county.
The continued reduction of property taxes shifts the burden to other revenue sources
available to the city such as sales tax. It is not prudent for the city to allow a shift in
revenue from property tax to sales tax.
As this appeal proceeds, there may be an opportunity to join financially with the
School Districts and McHenry Township in opposing the tax appeal. If the matter
reaches this point, further direction will be sought from the City Council.
Therefore, I recommend that the City Council direct the Corporate Attorney to file
papers of intervention with the McHenry County Board of Review.
