Lobaito, City Administrator FOR: Wednesday, September 5, 2001 Regular City Council Meeting RE: Discharge of Firearms Recommendation: Approve the ordinance amending Chapter 14, Sec. 14-64 of the Municipal Code. Enclosed for the City Council’s consideration is an ordinance amending Chapter 14 of the Municipal Code relating to the discharge of firearms within the corporate limits. Presently, the ordinance prohibits the discharge of firearms within the city limits by any person. The ordinance amendment modifies the language to permit the discharge of firearms by sworn police officers acting in the line of duty or during training. In addition, because this code was drafted prior to the popularity of paint ball guns, it is presently not included in the definition of firearm. The proposed amendment adds this type of gun to the definition. The specific amendment relating to officer training is being requested to provide officers with experience in firing their weapon. The Chief of Police is requesting that the City Council consider these amendments. A memorandum from the Police Chief to me regarding this matter is enclosed for your review along with a copy of the current section from the Municipal Code. mmg
