Alderman Glab has requested that the committee reconsider action taken by the City
Council regarding the building project at West Campus. On March 14, 2001, Mayor
Steven J. Cuda reported to the City Council the opinion of the City of McHenry
Corporate Attorney regarding the issue of whether the city had legal authority to
control the improvements on the school property. A copy of the relevant page of the
minutes and a copy of Attorney McArdle’s opinion is attached for your review along
with a copy of the ordinance (O-65-32.5) referenced in McArdle’s letter.
At the March 21, 2001 City Council meeting, Alderman Glab distributed a letter to the
City Council regarding this matter along with pertinent sections of the zoning
ordinance. A copy of the letter, attachments, and minutes of this meeting are also
included for your convenience.
It is the opinion of Alderman Glab that Ordinance O-65-32.5 gives authority to the City
Council to review adjustments to the school site (Sec. 5(G), pg. 4). Furthermore, this
review would include landscape screening requirements, lighting standards and
vehicle access points to the property.
At this time, staff has not formed an opinion on the merits of Alderman Glab’s
position. Before proceeding on additional research on a subject that has already
been addressed by the City Council, it was decided that the committee should discuss
this matter. The corporate attorney and staff will be in attendance to discuss this
matter further.
