RE: Request for Class F2 Liquor License – Eagle Food Stores
Recommendation: To approve the request by Eagle Food Centers, Inc. d/b/a Eagle
Food Center #223, for a Class F-2 Liquor License. In addition, approve the attached
Ordinance increasing the number of Class F-2 liquor licenses to eight, and to
decrease the number of Class B licenses to four.

The Mayor received a letter from Eagle Food Centers, Inc. requesting a change in the
current liquor license at their store located at 4400 West Elm Street from Class B to
Class F-2.
A Class B liquor license allows for the retail sale of beer and wine in packages only. A
Class F-2 license allows for the retail sale of not only beer and wine but also alcoholic
liquors in packages only where 50% or more of the public sales area for said
premises is devoted to goods and commodities other than alcoholic liquor. Other
grocery stores in the city such as Jewel, Sullivan’s, and Dominick’s currently posses
Class F-2 liquor licenses.
A completed application has been submitted along with the required $800 license fee.
As Liquor Control Commissioner, Mayor Cuda recommends the City Council to
approve the request from Eagle Food Centers, Inc. d/b/a Eagle Food Center #223
located at 4400 West Elm Street to issue a Class F2 liquor license at this location.
In addition, it is recommended to approve the attached Ordinances increasing the
number of F2 licenses from seven to eight, and decreasing the number of Class B
licenses from five to four.

The City of McHenry has received notice that a decrease in assessed value of what
may finalize at $100,000 or more, is being sought by Chicago American National
Bank, Trust 120090-007 (Cooper Brothers Property) involving the property at 1111 –
1116 S. Route 31(map attached). This property is currently developed with a
farmhouse and accessory buildings.
As done in the past relating to similar requests, Staff recommends the City Council to
direct the Corporate Attorney to file Papers of Intervention with the McHenry County
Board of Review.

RE: Main Street Commuter Station Improvement Grant Agreement
Recommendation: Authorize the City Administrator to execute the Grant
Agreement between the Commuter Rail Division and the City of McHenry subject to
review and approval by the City Attorney.
This past year, Union Pacific Railroad initiated changes to the lease agreement on the
Main Street Commuter Station that required the city to assume maintenance
responsibility on the building. As you may recall, the city was reluctant to accept
maintenance responsibility unless certain repairs were made to the building. Upon
evaluation of the building and discussions with METRA, Staff was successful in
securing an $80,000 capital improvement grant through the Commuter Rail Division
(CRD) of the Regional Transportation Authority.
The enclosed agreement specifies the obligations of the CRD and the City of
McHenry. Generally, the funds will be used for replacement of the roof, replacement
of the HVAC system, tuckpointing of masonry, replacement of rotted/broken window
sills, fascia board and rafter tails, rebuilding of gable ends, and scraping and painting
of exterior wood surfaces. Upon execution of the agreement, the city must complete
the project within 18-months. It is anticipated that this project will begin in the
summer of 2001.

RE: Year 2001 Hickory Creek Farm Lease Agreement
Recommendation: Discuss the information provided
Attachment: Current Lease Agreement between City of McHenry and Mickey Sikula
The current lease between the City of McHenry and Mickey Sikula expires on January 31,
2001. Renewal of the lease will be brought to the City Council at the January 16, 2001
meeting. Prior to renewal of the lease, decisions need to be made regarding the use of the
facility and monthly rent.
Since 1994, McHenry has leased the Hickory Creek Farm to Mickey Sikula. In 1998, the city
entered the lease agreements on a year-to-year basis. Annually, the Director of Parks &
Recreation establishes uses by the general public in cooperation with Mr. Sikula. The
planned uses for the following year are listed below.
Hayrides: Use of the grounds for storage of the hay wagon and for trips through
the property north of McCullom Lake Road;
Tours: Park Department tours for educational purposes including summer day
camps and preschool field trips (information on care of horses with riding/rodeo
demonstrations);
Open House Program: Scheduling of one open house program in the fall of the
year to allow for public viewing and historical tours; and
Advertisement: Information to be included in one of the city’s seasonal brochures
about the horse boarding facilities at the park.
Currently, the city is collecting $1,907 monthly for rent or $22,884 annually. A history of the
monthly rent payments are listed below:

Last year, the rent increase was based on the rate of inflation for the Chicagoland area; using
the same methodology the increase in rent for 2000 would be 2.7% or $1,958 per month.
It is recommended that the City Council discuss the proposed uses and establish rent for the
following year.

RE: Reduction in Class A Liquor Licenses
Recommendation: To approve the attached Ordinance reducing the number of
Class A Liquor Licenses from Twenty-six to Twenty-five.
As previously reported to the City Council, several complaints for various liquor violations
were filed against the Club Viper located at 2314 W. Route 120 and its owner Anthony
McCarty.
Since the charges were filed, the City became aware that the lease interest in this property
has ended and that the business is no longer being conducted at 2314 W. Route 120.
The Mayor in his capacity as Local Liquor Commissioner sent a letter to Mr. McCarty
notifying him that he is forfeiting his liquor license for fiscal year 2000-2001 effective
immediately in exchange for the Police Chief dismissing the pending liquor charges. Mr.
McCarty’s has agreed to these terms. Therefore, it is necessary to reduce the number of
Class A liquor licenses in the City of McHenry from twenty-six to twenty-five.
