RE: Resolution Supporting the Extension of Route 53 from
Lake Cook Road to Route 120
Karen Patel President of the McHenry County Economic Development Commission
will be present along with Charlie Eldridge Chairman of the McHenry County
Economic Development Commission Committee on Transportation and
Infrastructure, to elicit support for the extension of State Route 53. The extension as
proposed (reference attached map) is supported by the Lake County Transportation
Improvement Project as one of the options to improve motorists travel. Ms. Patel will
be asking for support from all the communities in the Northeast Council of President
& Mayors of McHenry County.
A resolution supporting the extension through Lake County is enclosed. If approved,
a copy of the resolution will be delivered to the Lake County Division of
Transportation, Illinois Department of Transportation, Illinois Toll Highway Authority,
and Lake County Transportation Improvement Project.

CONSENT AGENDA
TO: Mayor and City Council

FOR: December 3, 2001 Regular City Council Meeting
RE: Reimbursement to Windsor Development Corp. for Traffic Signal at
Dartmoor and Crystal Lake Road.
Pursuant to the 1991 Annexation Agreement for Albert’s Park Ridge Estates, the
owner agreed to pay the City of McHenry a deposit $17,000 for the construction of a
traffic signal at the corner of Dartmoor and Crystal Lake Road. As the City Council is
aware, a traffic signal at the corner of Dartmoor and Crystal Lake Road was never
constructed.
The agreement further states that if a traffic signal was not constructed within 10-
years from the date of the agreement, the City of McHenry would reimburse the
deposit to the owners including interest earned. As Of November 30, 2001, the total
amount owed to Windsor Development including interest is $26,607.94.
Attached is a letter from Stan Sumner of Windsor Development requesting the
reimbursement of these funds and the pertinent section of the Annexation
Agreement.
Since the traffic signal was not constructed, it is recommended that the City Council
authorize the reimbursement of $26,607.94 to Windsor Development pursuant to the
1991 Annexation Agreement for Albert’s Park Ridge Estates.

RE: Stormwater Utility
The Mayor received information from Baxter & Woodman discussing the funding
option of placing a storm water utility fee on all water/sewer bills as a way to finance
storm water improvements in the city. Mayor Althoff directed me to investigate this
possibility.
The result of my investigation found that non-home rule communities have no
authority to create such a fee. In fact, home rule municipalities that have installed
such a fee are facing legal challenges in the courts.
Enabling legislation for stormwater utilities will be introduced in Springfield to the
general assembly spring 2002. A draft version will be made available in January. At
this time, evidence to determine if the new legislation would alter the requirement
that a community must be home rule is not available.
