Background
July 11, 2001, the City Council authorized the Mayor and staff to negotiate with the
Village of McCullom Lake on an Intergovernmental Agreement for Wastewater
Treatment. Attached is a copy of the proposed agreement.
Overview
The Village of McCullom Lake spent the last year designing the extension, acquiring
easements, and negotiation with the Mayor and staff. The agreement effectively
provides for McCullom Lake to build a sanitary sewer system for wastewater
collection. A pipe will be extended from the village to the Donovan Lift Station
(located at the north end of Donovan Street). A metering device will be installed to
measure the daily flows and the Village of McCullom Lake will be billed monthly
based on the flow passing through the meter. The monthly fees for wastewater
treatment are the obligation of the village and not the individual users. In the event
of default on its payment, McCullom Lake is obligated to establish a special service
area (SSA) to ensure the collection of fees and charges from users of the sanitary
sewer service.

Intergovernmental Agreement Summary
The Village of McCullom Lake will be provided 1,800 P.E. This is sufficient to
provide sanitary sewer service to the present corporate limits of the village.
Additional P.E. is subject to City of McHenry approval.
McCullom Lake residents have an obligation to connect to the new sanitary sewer
system based on a written policy of the village and incorporated as an exhibit to
the agreement (enclosed).
The Village of McCullom Lake is obligated to pay the City of McHenry $56,700 for
the city making available an additional 700 P.E. in capacity at the Donovan Lift
Station as a result of the North Interceptor Sewer Project. Also, the village is
obligated to share in the future cost of upgrading the lift station to meet upcoming
pumping needs.
The City of McHenry Maintains review and approval of all future commercial and
industrial users requesting connection to the Village of McCullom Lake Sanitary
Sewer System. The purpose of the review is to determine compliance with the
city’s municipal code and the type of waste that will be generated from the
commercial or industrial user.
The agreement provides for payment of fees for sewer usage and sewer capital
development fees based on City of McHenry ordinance for non-resident charges.
Non-resident sewer rates and capital development fees are one and one-half
times the resident sewer rate and capital development fee.
In the event that the Illinois Environmental Protection Agency places the City of
McHenry on a restrictive status, the Village of McCullom Lake is prohibited from
permitting additional connections to the sanitary sewer system.
The Village of McCullom Lake is required to permit the discharge of wastewater
from the Perry Farm Limited Partnership and the Timothy O’Malley properties into
the village’s sanitary sewer system. The agreement further provides for the
village to be compensated (from the developer) for the upsizing of the pipes to
accommodate the development. In addition, the village is required to pay for the
user fees relative to the individual users of the two properties. The village may
also charge an administrative fee to the users for the cost associated with the
collection of fees.
If the Johnson or Voss properties elect to disconnect from the Village of
Johnsburg, the Village of McCullom Lake may request that these parcels be
provided with sanitary sewer service. In no event does the city guarantee
capacity. Additionally, the Village of McCullom Lake shall pay the costs
associated with amending the FPA.
Easement Compensation
At the Village of McCullom Lake Board meeting on June 11, 2002, the Board
approved a $17,000 payment to the City of McHenry as compensation for the
easement through the Cunat parcel. As part of the village’s financial planning for the

was allocated for the acquisition of easements. To date, McCullom Lake has spent
$3,500 for easements from Union Pacific Railroad and the McHenry County
Conservation District, the remaining funds ($16,500) plus an additional $500 is being
used to compensate the city for its granting of easement. This amount is the original
estimate by staff for the value of the easement, which was based on the easement
acreage and value of land.
Outstanding Issues for City Council Consideration
Sewer Rate: The agreement provides for the Village of McCullom Lake to pay the
non-resident sewer rate. The Village of McCullom Lake has requested that the city
consider charging the resident rate. The non-resident rate is one and one-half the
resident rate. A spreadsheet is attached that shows the present cost difference
between the two rates. Pursuant to city ordinance, this rate is subject to change
annually.
Sewer Capital Development Fees: As with the sewer rate, the agreement provides for
the village to pay the non-resident sewer capital development fee. The village is
requesting that they be charged the resident fee. Again, the difference in fee is one
and one-half times higher for non-residents. The enclosed spreadsheet compares the
cost difference between the two fee structures based upon the Village of McCullom
Lake’s estimate as to the number and type of user. This fee is also subject to change
annually.
Recommendation
It is recommended that the City Council discuss the Intergovernmental Agreement
and the remaining issues. Representatives from the Village of McCullom Lake will be
in attendance to discuss the agreement.

Staff Recommendation
Pursuant to the Annexation Agreement Paragraph 12 for Riverside Hollow, the owner is
obligated to provide “storm water management facilities and pipes of sufficient size to
accommodate anticipated storm water runoff from the development, subject to review and
approval by the city engineer.”
As of the time of this writing the city engineer is not satisfied with the design of the
storm water management facility; specifically, the pipe size and the absence of an
access easement over Orchard Beach Road and the storm sewer pipe. Consequently,
staff is recommending that the City Council not approve the final plat until these
issues are resolved.
