Attachments AGENDA SUPPLEMENT TO: Mayor and City Council FROM: John A. Lobaito, City Administrator FOR: July 29, 2002 Regular City Council Meeting RE: Request for a Class F2 Liquor License Recommendation: To approve Mayor Althoff’s recommendation and grant a Class F2 Liquor License for the retail sale of alcoholic liquors in packages only to Chandra, Inc. d/b/a Riverside Shop-N-Go located at 1325 N. Riverside Drive and to approve the attached Ordinance increasing the number of Class F2 Liquor Licenses from nine to ten. The Mayor received a request from Chirag Patel and Deven Patel of Chandra, Inc. for a Class F2 Liquor License at the Riverside Shop-N-Go, 1325 N. Riverside Drive. This convenient store, scheduled to open in early August, is located in the former McHenry Drugs site. The applicants request permission to sell at retail, packaged alcoholic liquors. Chirag Patel and Deven Patel currently own and operate Kaleidoscoops Ice Cream Parlor on Elm Street in McHenry and in downtown Barrington, as well as the Island Mart, a convenience/liquor store located on Route 176 in Island Lake. Property owner Ron Bykowski along with Messrs. Patel and Patel are completing major upgrades to this building contributing to the economic development of our community and the downtown business district revitalization. Chirag Patel and Deven Patel have met with Mayor Althoff, submitted all required information, paid the $800 annual license fee, and were fingerprinted. In addition, all employees of the Riverside Shop-N-Go will attend the next available Beverage Alcohol Sellers & Servers Education Training (BASSET) class. As Liquor Control Commissioner for the City of McHenry, Mayor Althoff is recommending the City Council to:  approve the request for a Class F2 Liquor License from Chandra, Inc. d/b/a Riverside Shop-N-Go at 1325 North Riverside Drive, subject to the receipt of a satisfactory fingerprint results; and  authorize the Mayor’s execution of the attached ordinance increasing the AGENDA SUPPLEMENT number of Class F2 Liquor Licenses from nine to ten. mmg TO: Mayor and City Council FROM: John A. Lobaito, City Administrator FOR: July 29, 2002 Regular City Council Meeting RE: Semi-Annual Distribution of Developer Donations to Taxing Entities RECOMMENDATION: To approve the Semi-Annual Distribution of Developer Donation Fees to McHenry School Districts 15; McHenry School District 156; McHenry Public Library District; and McHenry Township Fire Protection District and direct the City Clerk to distribute these funds. Attached is a chart depicting the developer donation fees collected from January 2002 through June 2002. As outlined in the City of McHenry Subdivision Control Ordinance, the City Council must direct the City Clerk to distribute these funds to the appropriate taxing entities. The amount of distribution to each is: McHenry School District 15 $232,612.90 McHenry School District 156 $125,253.10 McHenry Public Library District $27,779.00 McHenry Township Fire Protection District $27,779.00 In 2001, Mayor Althoff established that all affected taxing districts would be asked to appear at the July meetings only; each January, distribution checks will be mailed to the taxing entities. Newly appointed District 156 Superintendent Phillip Hintz will attend the meeting and take the opportunity to introduce himself to the City Council. For City Council information, the amount of developer donation fees collected for the Parks & Recreation Department is $320,032.00. Lobaito, City Administrator FOR: July 29, 2002 Regular City Council Meeting RE: Final Plat Approval, Riverside Hollow Subdivision Attachments: 1. Correspondence from Orchard Beach Homeowners Association 2. Development Agreement. 3. Ordinance approving the Final Plat of Annexation Recommendation: It is recommended that the City Council approve the enclosed ordinance for the Final Plat of Subdivision for Riverside Hollow Subdivision and to authorize Mayor Althoff’s execution of the Development Agreement between the City of McHenry and Kennedy Construction, Inc. Background Pursuant to City Council direction, the request for final plat approval for the Riverside Hollow Subdivision has been added to the Special City Council meeting agenda (Item No. 6). The materials were originally distributed to the City Council for its June 17, 2002 meeting. Only the meeting date on the attached supplement has been changed. At that time, staff was recommending that the City Council defer decision on the final plat until the offsite storm water issues were resolved. Subsequent to the meeting, the Mayor and staff have been working with Kennedy Homes and the Orchard Beach Homeowners Association to resolve these issues. In summary, the following items are unresolved: 1. Kennedy Homes must provide a storm water pipe of 24-inches in diameter from their development to the Fox River. This may be accomplished by either upgrading the existing 21-inch pipe to a 24-inch, or installing a new 24-inch pipe in a different location. 2. Kennedy Homes shall provide an access easement along the entire length of the offsite storm water pipe. Recently, the Orchard Beach Homeowners Association Steering Committee met to discuss the access easement over Orchard Beach Road. The result of the meeting was a recommendation to the full association for approval of a permanent easement with 17-conditions. A copy of the correspondence outlining the conditions is attached. Concurrently, Kennedy Homes has negotiated an easement with Mrs. Troka for the installation of a 24-inch storm sewer pipe. The tentative agreement is subject to the City of McHenry and Mrs. Troka’s execution of a pre-annexation agreement. The public hearing is scheduled at the Monday, July 29, 2002 City Council meeting. Kennedy Homes has requested that the city allow the development of the subdivision to proceed with certain limitations and obligations. These conditions are memorialized in the attached Development Agreement. In essence, the agreement limits Kennedy Homes to the construction of 45-houses until a 24-inch storm sewer pipe is installed and an access easement is obtained over Orchard Beach Road and private property. To ensure the obligations in the agreement are met, Kennedy Home is required to submit a Letter of Credit for $100,000 to the city. In addition, the city is obligated to initiate condemnation proceedings for the storm water drainage easement should the city’s negotiation attempts fail. mmg -2- MEMORANDUM To: Mayor and Aldermen From: John A.
