Martin, Deputy City Administrator FOR: February 4, 2008 Regular City Council Meeting RE: Farm Lease Agreements Recommendation: To renew the following lease agreements: 1) Approximately 20-acres of the former Cunat property to Tom King for a one- year term beginning March 1, 2008 through February 28, 2009 for $2,522.90 due on November 1, 2008 2) Approximately 24.5-acres of the former Levy Property to James Finch for a one- year term beginning March 1, 2008 through February 28, 2009 for $1,964.55 due on November 1, 2008. Former Cunat Property. The city purchased the Cunat property in 2002 to acquire easements for the McCullom Lake sewer extension project. At that time, a lease to farm the property existed between the Cunats and Mr. King. Staff recommends renewing the lease with Mr. King to farm approximately 20-acres for an annual payment of $2,522.90. Former Levy Property. The city has leased approximately 26-acres of the former Levy property located off Curran Road to James Finch since 2003. Due to improvements near the site, the farmable area of the property has been reduced by 1.5 acres. Staff recommends renewing the lease with Mr. Finch to farm approximately 24.5 acres for an annual payment of $1,964.55. CONSENT AGENDA TO: Mayor and City Council FROM: Douglas P. Martin, Deputy City Administrator FOR: February 4, 2008 Regular City Council Meeting RE: Hickory Creek Farm Lease Agreement Recommendation: To enter into a two-year lease agreement with Michael Sikula Jr. for the Hickory Creek Farm beginning February 1, 2008 through January 31, 2010. Since 1994, the City of McHenry has leased the Hickory Creek Farm to Michael Sikula Jr. Mr. Sikula operates a horse boarding and training stable and farms a hayfield on the north side of McCullom Lake Road as described in the attached lease and site plan. The term of the lease is two-years, established by the City Council in 2002 to reduce administration time involved with an annual review. As with past agreements, the lease ensures the city access to the farm for hayrides, tours, advertisement in the city’s seasonal brochures, and McHenry Landmark Commission and County Historical Society tours and open houses. In addition, public access is available to McCullom Lake and the pond located on the property adjacent to the lake for public enjoyment provided that the access does not interfere with the operation of Mr. Sikula’s business. The cost to lease the property is adjusted annually based on the Consumer Price Index of All Urban Consumers (CPI-U) for Chicago-Gary-Kenosha, as published by the U.S. Department of Labor. In 2007 the CPI-U increased by 2.6%, which translates to $2,834.00 per month for year 2008. Rent will be adjusted again on February 1, 2009 based on the CPI-U for 2008. Maxeiner, City Administrator FOR: February 4, 2008 Regular City Council Meeting RE: Transfer of Class B-3 Liquor License RECOMMENDATION: To approve the request to transfer the Class B-3 Liquor License from 7-Eleven, Inc. to MAAI Corporation, d/b/a 7-Eleven located at 3808 West Elm Street. The city was notified by 7-Eleven, Inc. that Mr. Inayat Pradham, President of MAAI Corporation is the new franchisee for the store located at 3808 West Elm Street. As a result, 7-Eleven, Inc. is requesting a transfer of the Class B-3 liquor license. A $250 transfer fee has been paid and all city requirements have been met. The Mayor recommends approval of this request subject to satisfactory fingerprint results and BASSET training for all employees involved in the retail sale of packaged beer and wine.
