RE: Request for Transfer of Class A-5 Liquor License
Recommendation: To approve the transfer of the Class A-5 liquor license from
Brinker Restaurant Corporation to ERJ Dining IV, LLC d/b/a Chili’s Grill & Bar.
ERJ Dining IV, LLC is purchasing the assets and business of Brinker Restaurant
Corporation, d/b/a Chili’s Grill & Bar located at 2409 North Richmond Road. The closing for
the property sale is scheduled for November 1, 2007. As such, ERJ Dining is requesting
permission to transfer ownership of the current Class A-5 liquor license issued to Chili’s
Grill & Bar.
The new owners will make no changes to the name of the restaurant or its
managerial staff. All required paperwork has been submitted and a $250 transfer fee
has been paid.

Background. On Sunday, November 18, the McHenry Area Jaycees and the Downtown

Business Association (DBA) will be hosting their 20 annual Toys for Tots Parade and
Downtown Christmas Walk at 11:00 AM. The parade will begin at 1:00 PM and follow the
same route as the Fiesta Days parade. It will begin on Main Street and proceed north on Green
Street, east on Pearl Street, north on Riverside Drive, and wet on Broad Street concluding at
Veterans Memorial Park. For approximately one hour after the conclusion of the parade, the
Jaycees are asking to close both Court and Park Streets between Pearl and Broad Streets to allow
for the parking of motorcycles and disbandment of the parade. A presentation of toys will be
made to the Marines for local children on behalf of the local Harley Owners’ group followed by
an appearance by Santa Claus in the gazebo to take pictures with the children. The Jaycees will
also setup tables to sell refreshments and provide some craft activities for children after the
parade.
The DBA’s Christmas Walk will be held in conjunction with the parade. The DBA is proposing
horse drawn wagon rides from Riverside Drive to Veterans Memorial Park and pony rides in the
vacant lot on the southwest corner of Route 120 and Riverside Drive. Finally, the DBA is also
requesting a temporary use for a petting zoo. This has been held in Neumann Park in previous
years. The DBA is currently finalizing their plans for the location of the attraction for this year.
Other attractions throughout the day include McHenry High School choral groups, band
ensembles, and drama students that will wear character costumes.
The DBA is also requesting permission to install temporary signs similar to those used to
promote band concerts and craft shows. There is one larger sign that the DBA had created and
would like placed at the vacant lot on the corner of Riverside Drive and Route 120 that will
require a temporary sign permit. A list of sign locations is attached.
Recommendation. To approve the closure of Court Street and Park Street after the parade, a
temporary use permit for horse drawn wagon rides, pony rides and a petting zoo and the request
for temporary signage.
