CONSENT AGENDA
The Consent Agenda for the February 19, 2007 City Council meeting consists of
the following items:
A. Farm lease agreements between City of McHenry and 1) Scott Chambers, Petersen Farm
property; 2) Tom King, former Cunat property; and 3) James P. Finch, former Levy property;
B. IDOT Resolution for repair work in state right of ways;

RE: Amendment to Municipal Code Chapter 4, Sec 4-6(5)
Recommendation: To approve the attached ordinance
Due to the recent closing of Michael’s Bistro restaurant located at 1249 North Green
Street, the Municipal Code should be amended to reflect one less Class G liquor
license.
Attached is an ordinance amending Municipal Code Chapter 4, Sec 4-6(5) reducing
the number of Class G liquor licenses from four to three.

RE: IDOT Resolution
Recommendation: To authorize the Mayor’s execution of the attached resolution
Illinois State Statute requires any person, corporation, or government agency to
obtain a written permit from the Illinois Department of Transportation prior to
performing any work, maintenance, or repairs in state right-of-ways. Municipalities
are required to submit a resolution pledging that all work performed by the
municipality will be in accordance with the conditions of the permit.
In emergencies such as water main breaks, IDOT will provide verbal approval for
repairs.

RE: Farm Lease Agreements
Recommendation: To authorize the Mayor’s execution of:
1) Lease agreement between the City of McHenry and Scott Chambers for approximately
64-acres of Petersen Farm property, for a one-year term, beginning March 1, 2007
through February 28, 2008 for $5,727.36 due on November 1, 2007;
2) Lease agreement between the City of McHenry and Tom King for approximately 20-
acres of the former Cunat property, for a one-year term, beginning March 1, 2007
through February 28, 2008 for $2,522.90 due on November 1, 2007; and
3) Lease agreement between the City of McHenry and Jim Finch for approximately 26-
acres of the former Levy Property, for a one-year term, beginning March 2, 2007
through February 28, 2008 for $2,084.88 due on November 1, 2007.
Attached are three lease agreements to farm the Petersen, former Cunat, and former Levy
properties.
Petersen Farm Property. Scott Chambers has leased approximately 64-acres of the Petersen
Farm property located on the north side of McCullom Lake Road since 2003. Staff
recommends renewing the lease with Mr. Chambers for an annual payment of $5,727.36.
Former Cunat Property. The city purchased the Cunat property in 2002 to acquire easements
for the McCullom Lake sewer extension project. At that time, a lease to farm the property
existed between the Cunat and Mr. King. Staff recommends renewing the lease with Mr.
King to farm approximately 20-acres, for an annual payment of $2,522.90.
Former Levy Property. The city has leased approximately 26-acres of the former Levy
property located off Curran Road to James Finch since 2003. Staff recommends renewing
the lease with Mr. Finch for an annual payment of $2,084.88.

RE: Recognition of City Employees Gary Mertz and Pat Gorniak
The Mayor and City Council will officially recognize city employees Gary Mertz and
Pat Gorniak for their actions on the morning of Tuesday, February 6 for coming to the
assistance of a woman in need of medical attention. Gary and Pat’s quick attention
and composure in a highly stressful situation are responsible for saving her life.
At the meeting, both employees will also be presented with a Proclamation from the
City of McHenry CHARACTER COUNTS! Coalition.
