RE: MFT Resolution for State Purchase of Rock Salt
RECOMMENDATION: Adopt the attached Resolutions appropriating funds for the
purchase of rock salt pursuant to Illinois MFT Fund Distribution Statute requirements.
Background. Annually, the city purchases rock salt for ice control through the Illinois Department
of Central Management Services. A blanket order on an as needed basis is submitted and paid for
through Illinois Motor Fuel Tax (MFT) funds. Each month the city is issued warrants pursuant to
the MFT Fund Distribution Statute.
Expenditures for the purchase of rock salt require the adoption of a Resolution appropriating the
funds. While preparing the 2004 submittals, it was discovered that since 1996, resolutions allocating
MFT funds for the purchase of rock salt were never executed. Adoption of the attached Resolutions
will bring the city into compliance of the Illinois MFT Fund distribution statute.
Recommendation. Staff recommends the execution of the attached Resolutions allocating MFT
funds for the purchase of rock salt from 1996 through 2004.

RE: Engineering Service Agreement Hunterville Park Water & Sewer
RECOMMENDATION: Approve the Engineering Service Agreement from Baxter and
Woodman, Inc. for construction observation of the Hunterville Park Subdivision Sanitary
Sewer and Water Main construction not to exceed $104,000.00.
Background. Attached is a copy of the Baxter and Woodman, Inc. Engineering Service
Agreement for construction observation services for the Hunterville Park Subdivision Sanitary
Sewer and Water Main construction. As the City Council is aware, at the January 31, 2005 meeting
the construction contract was awarded to Thelen Sand and Gravel, Inc.
Analysis. The attached agreement from Baxter and Woodman, Inc. provides a full-time, onsite
Resident Project Representative to observe the contractor’s work and assure that it conforms to the
approved design documents.
The fee for construction observation is $104,000.00 or approximately 8% of the $1,290,721.10
construction cost. The cost is well within the typical fees for this type of construction.
Recommendation. Due to the complexity of the project, and the variety of skills necessary to
perform construction services, staff recommends approval of the attached Engineering Service
Agreement from Baxter and Woodman, Inc. for construction observation of the Hunterville Park
Subdivision Sanitary Sewer and Water Main construction not to exceed $104,000.00.

RE: Lease Agreement for Riviera Marine, 3302 West Waukegan Road
RECOMMENDATION: To authorize the Mayor’s execution of the attached lease
agreement with D’s Marine Service, Inc. for Riviera Marine, 3302 West Waukegan
Road for a one-year term beginning March 1, 2005 and expiring February 28, 2006.
The current lease between the City of McHenry and Jerry Danko of D’s Marine
Service, Inc. for the Riviera Marine property expires on February 28, 2005.
As the City Council will recall, the property was purchased with the intent of using it
for improvements at the Central Wastewater Treatment Plant. Mr. Danko has
successfully operated the marina for the city since 2001.
Other than the dates on the agreement, no changes to the lease language are
proposed. The agreement requires Mr. Danko to pay the city 50% of the rent received
for leased slips and boat storage on the property. Approximately $58,365.95 has
been collected for the current term of the lease.
