Request from Windsor Development for release of Irrevocable Subdivision Bond No. BE0944941 - $260,233.10; B. Final request for reimbursement from Lanco Development Co. for construction of the last four piers at Riverwalk Place - $8,000; C. Picnic/Special Use Permits; and D. March 31, 2005 City Council meeting minutes. Attachments CONSENT AGENDA TO: Mayor and City Council FROM: Bill Hobson, Management Assistant for Community Relations FOR: April 4, 2005 Regular City Council Meeting RE: Riverwalk Place Townhome Development – Request for Reimbursement Recommendation: To approve the final request for reimbursement from Lanco Development Co. for construction of the last four piers at the Riverwalk Place Development in the amount of $8,000. Pursuant to the redevelopment agreement with Lanco Development Co., the city agreed to reimburse the developer $20,000 for the cost of constructing ten piers (two slips/pier, $1,000/slip) for the Riverwalk Place Townhome Development. The final four piers have been installed at Riverwalk Place and a request was made by the developer for reimbursement of $8,000. City staff inspected the piers and recommends approval of the request. mmg AGENDA SUPPLEMENT TO: Mayor and City Council FROM: Daniel J. Marcinko, Director of Public Works FOR: April 4, 2005 Regular City Council Meeting RE: Washington Street Right-of-Way Seawall at the Fox River ATTACHMENTS: Location Map and Pictures of the Site RECOMMENDATION: Approve the proposal from Reinwall Marine Service for the installation of a seawall at the Washington Street right-of-way and the Fox River for an amount not to exceed $9,800.00. Background. A portion of seawall along the Fox River does not extend across the Washington Street right-of-way. However, both lots adjacent to the right-of-way have seawalls, causing a gap at the right-of-way. Analysis. Staff received two proposals for the installation of approximately 80 feet of steel seawall that would connect to the adjacent seawalls. Reinwall Marina Service provided the lowest quote at $9,800.00. To minimize the cost of the project, once the proposed seawall has been installed, the Street Division will backfill the area and restore the landscaping. Marcinko, Director of Public Works FOR: April 4, 2005 Regular City Council Meeting RE: Windsor Development – Village Green Bond Release RECOMMENDATION: Authorize the release of Windsor Development’s Village Green Irrevocable Subdivision Bond No. BE0944941 in the amount of $260,233.10. Background. In accordance with a request from Windsor Development for the release of the Irrevocable Subdivision Bond No. BE0944941, staff completed a review of the public improvements at the Village Green Development to assure they have been installed in conformance with the approved plans and specifications. The underground infrastructure has been properly installed and tested within the Village Green Development. This is the final release of the Irrevocable Subdivision Bond for the development prior to acceptance by the city. Based on inspections performed by Public Works and Baxter and Woodman, staff recommends granting the request made by Windsor Development for release of the Village Green Irrevocable Subdivision Bond No. BE0944941. AGENDA SUPPLEMENT TO: Mayor and City Council FROM: Douglas Martin, Assistant to the City Administrator FOR: April 4, 2005, Regular City Council Meeting RE: Lease Agreement with McHenry Savings Bank In 1995, the City and McHenry Savings Bank entered into a Sale and Lease Back Agreement. The terms were such that the City sold McHenry Savings Bank property at 1209 N. Green Street to allow for the possible expansion of the bank. The lease Agreement restricts McHenry Savings Bank’s use of the property solely to its business. McHenry Savings Bank agreed to lease back the parking area (parking lot exhibit is attached) to the City for $1.00/year until April 15, 2005. At the City Council meeting on November 29, 1995, the Council agreed to permit employees and customers of McHenry Savings Bank to utilize Area “C” on the attached parking lot exhibit. McHenry Savings Bank cannot sell the property to a third party until the first of the following occurs: McHenry Savings Bank constructs an additional building, they expand their existing facility, April 15, 2005 or the property is offered to the City and the City does not exercise their right of first refusal to purchase the property. A copy of the agreement is attached for your reference. McHenry Savings Bank is interested in extending the lease with the following provisions: 1) the City pays the real estate taxes on the property; 2) the term of the lease is two-years; and, 3) remove the City’s option to purchase the property. Currently the taxes are approximately $2,600/year. The municipal parking lot contains approximately 103 spaces. In Staff’s observations, the parking area directly behind the Green Street Mall is utilized by members of the public on a daily basis. It is used by people who patronize the Green Street Mall and other businesses on Green Street, particularly the restaurants, including: Michael’s Bistro, the Green Peapod and the Green Street Cafe. In addition, during larger community events, such as the Toys for Tots Parade and Fiesta Days, the extra parking is needed. The parking lot serves as overflow parking for patrons of the downtown theater. While this property will most likely be redeveloped in the future, the parking would also be beneficial for people who come to the riverwalk. Staff is seeking direction from the Council about the renewal of the lease with McHenry Savings Bank.
