CONSENT AGENDA
The Consent Agenda for the February 2, 2004 City Council meeting consists
of the following items:

RE: Lease Agreement for Riviera Marine, 3302 West Waukegan Road
RECOMMENDATION: To authorize the Mayor’s execution of the attached lease
agreement with D’s Marine Service, Inc. for Riviera Marine, 3302 West Waukegan
Road for a one-year term beginning March 1, 2004 and expiring February 28, 2005.
The current lease between the City of McHenry and Jerry Danko of D’s Marine
Service, Inc. for the Riviera Marine property expires on February 28, 2004.
As the City Council will recall, the property was purchased with the intent of using it
for improvements at the Central Wastewater Treatment Plant. Mr. Danko has
successfully operated the marina for the city since 2001.
Other than the dates on the agreement, no changes to the lease language are
proposed. The agreement requires Mr. Danko to pay the city 50% of the rent received
for leased slips and boat storage on the property. Approximately $50,096.28 has
been collected for the current term of the lease.

RE: Hickory Creek Farm Lease Agreement
RECOMMENDATION: To authorize the Mayor’s execution of the attached agreement
between the City of McHenry and Michael Sikula, Jr. for lease of Hickory Creek Farm
for a two-year term beginning February 1, 2004 through January 31, 2006.
The lease between the City of McHenry and Mickey Sikula for the Hickory Creek Farm
property expired on January 31, 2004. This is a two-year lease term established by
the City Council in 2002 to reduce administration time involved in an annual renewal.
Since there are no immediate plans to change the use of the property from its
present use, renewing the lease for an additional two years is recommended.
ACCESS TO PREMISES. As in the past, a list of activities developed to expand the use
of the barn for the public is incorporated into the lease agreement.
RENT. Since 1994, the original monthly lease amount of $1,650 has steadily been
increased to its current level of $2,035 per month. The methodology for calculating
the lease payment has changed over time, and for the past four years has been
adjusted on an annual basis using the Consumer Price Index of All Urban Consumers
(CPI-U) for Chicago-Gary-Kenosha, published by the U.S. Department of Labor.
Depicted below are the increases for the past two years and the proposed increase
for 2002.

RE: Various Farm Lease Agreements
RECOMMENDATION. Authorize the Mayor’s execution of Lease Agreements with:
1) James P. Finch for lease of 26-acres of the former Levy Property for one-year
term beginning March 1, 2004
2) Scott Chambers for lease of Petersen Farm for one-year term beginning March
1, 2004 and
3) Tom King for lease of former Cunat Property for one-year term beginning
March 1, 2004.
The city leases portions of the former Levy Property, Petersen Farm, and former
Cunat property to tenant farmers listed in the above recommendation. The
agreements for these properties expire on February 28, 2004 and all three tenants
wish to renew for another year.
The leases are brought before the City Council early in the year to allow the farmers
to complete any postseason land preparation necessary for next year’s growing
season.
Rent. A 2.1% increase in the lease payment for the Levy and Petersen properties is
incorporated in the attached agreements pursuant to the rate of inflation based on
the Consumer Price Index for Chicago, Gary, Kenosha published by the U.S.
Department of Labor.
Due to the planned Petersen Park expansion, staff is not requesting an increase in
rent for the former Cunat property.
