RE: Intergovernmental Agreement with the McHenry County Conservation District
RECOMMENDATION: Execute the Intergovernmental Agreement with the McHenry
County Conservation District
The McHenry County Conservation District (MCCD) and the City of McHenry have worked
cooperatively to provide bike paths through the city including the Prairie Trail that begins at
the McHenry County line south of Algonquin and north to the Wisconsin border. There is
interest to ensure that the Prairie Trail remains for the future, the city can connect future
paths to the Prairie Trail, and the Conservation District can add user amenities.
The attached Intergovernmental Agreement with the MCCD regarding the Prairie Trail
accomplishes these goals and incorporates the City Council’s feedback. The agreement
focuses on property immediately under and adjacent to the existing Prairie Trail. In addition
a clause was added that this agreement supersedes other agreements. Please note the
MCCD approved the agreement on February 20, 2003. Specifically, the intent is to
accomplish the following:
1. The agreement enables future bike paths that are non-district owned to be
constructed and connected to the Prairie Trail at no cost. Specifically, the city is
interested in securing bike path connections at Bull Valley Road and Dartmoor Drive.
2. The agreement enables the MCCD to ensure the bike path remains as long as it is
servicing the public.
3. The access to the paths for each entity is irrevocable.
4. The City of McHenry will provide land for the construction of a restroom facility,
maintenance/storage building, parking, shelter, and water fountain. The approximate
three-acre parcel is located in the Mill Stream Subdivision adjacent to the bike path
and west of Donovan Street. This use is good for this parcel since the best access is
from the bike path and McHenry residents will benefit from having a restroom along
the path. The agreement waives the water/sewer connection fees for the new facilities
and requires the enhancements to be built in a certain amount of time.
In addition to this agreement the MCCD approved an Intergovernmental Agreement with the
Village of McCullom Lake to permit the underground crossing of a sanitary sewer at the
approximate location of Lakewood Road in Petersen Park.
Recommendation: To authorize the Mayor’s signature of the attached Intergovernmental
Agreement and Resolution.
