AGENDA ITEM SUMMARY:
The City of McHenry models its eligibility for liquor licenses after the State liquor code.
The State of Ilinois has a clear definition for the requirements of a catering endorsement, and
our langauge must be changed to reflect that of the State.
Citizenship used to be a requirement for liquor license holders, but that requirement has since
been dropped by the State of Illinois. To match the State’s code, the City of McHenry now
needs to pass an ordinance to change that requirement.
RECOMMENDATION:
Therefore, if Council concurs, it is recommended a motion be made to pass an
Ordinance Amending Title 4, Chapter 2: Alcoholic Liquor, Section 4-2-1: Definitions; and
Section 4-2-4: Applications for Licenses, and Section 4-2-5: Ineligibility

ORDINANCE NO. 21-
Amending Title 4, Chapter 2: Alcoholic Liquor, Section 4-2-1: Definitions; and
Section 4-2-4: Applications for Licenses, and Section 4-2-5: Ineligibility
WHEREAS, the City of McHenry, McHenry County, Illinois, is a home rule
municipality as contemplated under Article VII, Section 6, of the Constitution of the State of
Illinois, and the passage of this Ordinance constitutes an exercise of the City's home rule
powers and functions as granted in the Constitution of the State of Illinois.
NOW, THEREFORE BE IT ORDAINED by the City Council of the City of
McHenry, McHenry County, Illinois, as follows:
SECTION 1: Section 4-2-1: Definitions: Catering Endorsement, shall be amended
to be defined as the following:
Catering Endorsement: Permits the service of alcoholic liquors for consumption,
either on-site or off-site, whether the location is licensed or unlicensed, as an incidental part
of food service. Prepared meals and alcoholic liquors are sold at a package price agreed upon
under contract.
SECTION 2: Subsection 4:2:4 B. Citizenship, shall be deleted in its entirety.
SECTION 3: Subsections 4:2:4 C through J shall be renumbered 4:2:4 B-I.
SECTION 4: Subsection 4:2: C. A Person who is not a citizen of the United
States, shall be deleted in its entirety.
SECTION 5: Subsections 4:2: D through R shall be renumbered 4:2:4 C through
Q.
SECTION 6: All ordinances, or parts thereof, in conflict herewith are hereby repealed
to the extent of such conflict.
SECTION 7: This ordinance shall be published in pamphlet form by and under the
authority of the corporate authorities of the City of McHenry, Illinois.
SECTION 8: This ordinance shall be in full force and effect from and after its
passage, approval and publication, as provided by law.

AGENDA ITEM SUMMARY:
Staff requests City Council to consider awarding a contract for the Knox Park Parking Lot
Rehabilitation Project to Chicagoland Paving of Lake Zurich, Illinois.
BACKGROUND:
The Fiscal Year 2021/2022 General Fund Capital Budget includes $580,000 in funding for City
Parking Improvements. This funding has been assigned specifically for parking improvements on
Main Street and for the rehabilitation of the parking lot at Knox Park. The resurfacing of the
North Main Street Parking Facility concluded in July and was completed for less than $25,000
leaving the remaining balance of the capital budget for the Knox Park Improvements.
Due to the complexity of the site work and drainage necessary to complete the improvements at
Knox Park, the City retained Christopher B. Burke Engineering to perform design and construction
engineering services for the project. Design work initiated in July of this year and final plans were
delivered to staff in early September. The project was released for bidding on September 20,
2021
The scope of the project includes full pavement removal, site regrading, installation of new
concrete curb and gutter, the realignment of the entrance with Turnberry Drive, landscape
restoration, pavement markings, and other necessary and incidental work. In order to reduce
impacts to access to the pool the project is currently scheduled to begin construction in late Fall
of this year and conclude in May of 2022.

On October 6, 2021, a total of ten (10) bids were received for the project. A summary of the bids

After a detailed review of the bids and line items, staff has concluded that Chicagoland Paving of
Lake Zurich, Illinois is the lowest responsible bidder with a bid of $320,000.00.
ANALYSIS:
Staff has analyzed and checked the bids for accuracy and recommends awarding the contract to
Chicagoland Paving of Lake Zurich, Illinois. This is a unit price contract and the final cost of
construction will be based upon final measured and documented quantities.
RECOMMENDATION:
Therefore, if Council concurs, it is recommended to award a contract for the Knox Park Parking
Lot Rehabilitation Project to Chicagoland Paving of Lake Zurich, Illinois in the amount of
$320,000.00. It is further recommended to approve a construction contingency in the amount
of ten percent (10%) of the awarded contract price ($32,000.00). The final contract price will
be based on final measured quantities and may vary from the original contract amount.

AGREEMENT
THIS AGREEMENT, made this 18th day of October, 2021, by and between The City of McHenry, hereinafter called
"OWNER" and Chicagoland Paving Contractors, Inc. doing business as (an individual) or (a partnership) or (a
corporation) hereinafter called "CONTRACTOR".
WITNESSETH: That for and in consideration of the payments and agreements hereinafter mentioned:
2. The CONTRACTOR will commence and complete the construction of Knox Park Parking Lot Rehabilitation
3. The CONTRACTOR will furnish all of the material, supplies, tools, equipment, labor and other services
necessary for the construction and completion of the PROJECT described herein.

of the NOTICE TO PROCEED and will substantially complete all work by May 13, 2022 as specified in the

AGENDA ITEM SUMMARY:
Staff requests that the City Council consider authorizing the Mayor’s execution of easement
agreements necessary for the construction of the Riverwalk Sanitary Sewer Realignment Project.
BACKGROUND:
The Fiscal Year 2021/2022 Water-Sewer Fund Capital Budget includes $100,000 in funding for
the realignment of the gravity sanitary sewer, which runs along the shoreline of the Boone Creek
west of Green Street. This location is still functional and in serviceable condition, however, due
to the failure of sheet piling adjacent to the sewer main, and potential conflicts with future
Riverwalk improvements, a relocation is necessary. Upon relocation, the sewer will have a
further setback from the creek shoreline, which will allow for the adjacent failed seawall to be
repaired and will be removed from conflict with future Riverwalk improvements. Because of this
setback, the existing sanitary sewer easements will no longer encompass the location of the
sewer, and new easements will need to be recorded. Design work for this project has been
ongoing throughout the last year concurrently with the securing of easements. Easement
agreements for sections of three separate parcels with three separate ownerships are necessary
for the construction and maintenance of proposed improvements.
Construction of improvements will commence upon recording of easements and the completion
of a bidding process. The proposed improvements are anticipated to be completed in winter of
this year.

ANALYSIS:
The language of the agreements has been reviewed and approved by each of the parties to the
agreements, has been prepared and approved by the City Attorney, and recommended for
approval by the City Council.
RECOMMENDATION:
Therefore, if Council concurs, it is recommended that a separate motion be made to authorize
the Mayor’s execution of an easement agreement between the City of McHenry and each the
following entities:

AGENDA ITEM SUMMARY: The lease with D’s Marina for the use of the harbor slips, property
and buildings expired on September 30, 2021. The following supplement and attached lease
detail and extension through May 1st as the city works toward a potential redevelopment of the
property as it is included with the former Central Wastewater Treatment Plant site RFP.
BACKGROUND:
The city of McHenry has had a long standing relationship with the operators of D’s Marine in the
leasing rights to the South Harbor boat slips, property and buildings. The current lease expired
on September 30, 2021. As this lease ended, the city had also issued a Request for Proposals to
developers for the former Central Wastewater Treatment site and the South Harbor Marina
property. These proposals were received and have been reviewed by the staff for a subsequent
proposal to the city council.
The timing of the proposals allow for a new lease to be put in place through May 1, 2022 that will
account for winter storage of boats on the site. The lease also sets asides provisions for the
accessibility of the site, for items such as general inspection of the property or soil samples as the
city and or the proposed developer require such.
The property is to be completely vacated by May 1, 2022.
ANALYSIS:
The proposed lease continues the relationship with the existing tenant while also retaining rights
to the property to further the ultimate goal of redevelopment of the one of the most desirable
locations on the Fox River and a key site within the Tax Increment Financing District.
RECOMMENDATION:
Therefore, if Council concurs, it is recommended that a motion be considered to approve the
mayor’s authorization of the attached lease for the South Harbor piers, property and buildings
through May 1, 2022.

Boat Storage Lease Agreement
This Boat Storage Lease Agreement is entered into by and between the parties hereto and is
effective commencing this day of , 2021.
Whereas, the City of McHenry, 333 South Green Street, McHenry, Illinois (“Lessor”) and
D’s Marine Service, Inc., 3308 W. Waukegan Road, McHenry, Illinois (“Lessee”) are parties to that
certain Lease Agreement dated relating to property owned by Lessor at 3302
W. Waukegan Road, City of McHenry, Illinois (“Existing Lease Agreement”).
Whereas, the Existing Lease Agreement is scheduled to expire on , 2021.
Whereas, Lessee desires to store boats on a portion of the Lessor’s Property for the winter of
2021-2022, in accordance with the terms of this Boat Storage Lease Agreement.
Whereas, Lessor desires to enter into this Boat Storage Lease Agreement.
Now, therefore, in consideration of the promises and agreements made by the parties herein,
the adequacy and sufficiency of which is acknowledged as being received by each party hereto, it is
agreed as follows:
1.The Existing Lease Agreement shall terminate no later than ,
2021 and all payments due to the Lessor shall be paid by the Lessee.
2.Lessor hereby leases to Lessee that portion of real estate owned by Lessor commonly
known as 3302 W. Waukegan Road, McHenry, Illinois and more specifically depicted on the
attached drawing (“Leased Premises”) for boat and personal watercraft storage purposes only,
commencing and terminating on , 2022. Storage of anything other
than boats and personal watercraft is not allowed; including equipment, and vehicles; recreational or
otherwise. Boats and personal watercraft on trailers shall be moved upon reasonable request of the
Lessor. Boats stored on blocks shall be specifically located on the Leased Premises with the pre-
approval of the City. No later than the termination date of , 2022, all boats, personal
watercraft and trailers stored on the Leased Premises shall be removed from the Leased Premises by
Lessee.
3.Lessee shall pay as rent to Lessor the sum of $ in a lump sum
upon execution of this Boat Storage Lease Agreement.
4.The Leased Premises shall be used for no other purpose. Lessee shall, at its own
expense, and at all times, maintain the Leased Premises in good and safe condition, and shall
surrender the same, at termination hereof, in as good condition as received, normal wear and tear
excepted. Lessee shall not, without first obtaining the written consent of Lessor, make any
alterations, additions, or improvements, in, to or about the Leased Premises or any structure thereon.
5.Lessee shall comply with all statutes, ordinances and requirements of the City of
McHenry, State of Illinois and Federal law, now in force, or which may hereafter be in force,
including, but not limited to any applicable environmental laws or regulations, pertaining to the
Leased Premises.

6.Lessee shall not assign this Boat Storage Lease Agreement or sublet, pledge, demise
or transfer any portion of the Leased Premises.
7.Lessee understands that Lessor is in the process of marketing the Leased Premises
and surrounding property for sale. To accommodate the needs of Lessor to market same, Lessee
acknowledges its use of the Leased Premises is not exclusive and Lessor retains the right to enter
upon the Leased Premises at any time and for any reason, with or without third parties to inspect,
take samples of soil as needed, and generally evaluate the Leased Premises and surrounding Property
for purchase/sale purposes during the term of this Boat Storage Lease Agreement.
8.To the fullest extent permitted by law, Lessee will defend, indemnify and hold the
Lessor harmless from all claims arising from or in connection with (i) any and all operations of
Lessee in connection with the possession or operation, of the Leased Premises, whatsoever done, or
any condition created on or about the Leased Premises; (ii) any act, omission or negligence of Lessee
or any of Lessor’s assignees, agents, licensees or the partners, directors, officers, agents, employees,
invitees or contractors of Lessee or of Lessee’s assignees, tenants or Lessee; (iii) any accident,
injury or damage whatsoever occurring on or at the Leased Premises; and (iv) any act or omission of
Lessor, its agents, servants and employees, pursuant to this Boat Storage Lease Agreement.
9.Lessee shall during the term of this Boat Storge Lease Agreement, maintain in full
force and effect, at its own cost and expense, insurance of the types and in the amounts described
below.
A.Workers Compensation Insurance. Lessee shall maintain workers
compensation and employers’ liability insurance, with Coverage A at statutory limits and Coverage
B (commercial umbrella and/or employers liability) limits not less than $1,000,000 each accident for
bodily injury by accident and $1,000,000 each employee for bodily injury by disease. This
insurance shall cover Lessee’s employees in compliance with the State of Illinois and all other states
having jurisdiction over each employee.
B.Commercial General and Umbrella Liability Insurance. Lessee shall maintain
commercial general liability (“CGL”) and, if necessary, commercial umbrella liability insurance with
a limit of not less than $1,000,000 each occurrence.
i. This CGL and umbrella (if any) insurance shall be written on an
occurrence basis and shall cover liability arising from premises, operations,
independent contractors, products-completed operations, bodily and personal injury,
property damage, advertising injury, liability assumed by Lessee under this Boat
Storage Lease Agreement (including the tort liability of another assumed in a
business contract).
ii. Additional Insured. The Lessor shall be named as an insured under
this CGL and umbrella (if any) insurance using an additional insured endorsement
acceptable to the Lessor. This insurance shall apply as primary insurance with
respect to any other insurance or self-insurance programs afforded to the Lessor.
There shall be no endorsement or modification of this insurance to make it excess
over other available insurance; alternatively, if the CGL and umbrella (if any)

insurance states that it is excess or pro rata, it shall be endorsed to be primary with
respect to the Lessor.
C.Proof of Insurance. Prior to the effective date of this Boat Storage Lease
Agreement, Lessee shall furnish the Lessor with copies of its current certificates of insurance
documenting each such policy, along with the additional insured endorsements required in this
section.
D.No Limitation on Liability. The minimum amounts set forth in this Boat
Storage Lease Agreement for such insurance shall not be construed as a limitation or satisfaction of
Lessee’s liability, including indemnification, to the Lessor under this Boat Storage Lease Agreement
to the amount of such insurance.
10.Lessee shall deposit with Lessor on the signing of this Boat Storage Lease Agreement
the sum of $3,000.00 Dollars ($3,000.00) as security for the performance of Lessee’s obligations
under this Boat Storage Lease Agreement, including without limitation the surrender or possession
of the Leased Premises to Lessor upon termination of this Boat Storage Lease Agreement.
11.In case suit should be brought for recovery of the Leased Premises, or for any sum
due hereunder, or because of any act which may arise out of the possession of the Leased Premises
by Lessee, or to enforce any portion of this Boat Storage Lease Agreement, the prevailing party shall
be entitled to all costs incurred in connection with such action, including its reasonable attorney’s
fees.
12.The foregoing constitutes the entire agreement between the parties and may be
modified only by a writing signed by both parties.

The City Council of the City of McHenry, Illinois, met remotely via Zoom on Monday, October 4,
2021, at 7:00 p.m. The meeting was held remotely due to the COVID-19 pandemic in accordance
with the Open Meetings Act guidelines.

Resolution requesting legislative assistance to increase the annual distribution of Township
Road District Tax Levies that is returned to Illinois Municipalities, and to authorize staff to
distribute the resolution to the City of McHenry’s State Representatives
Alderman Glab explained that the City of McHenry has been shortchanged over the years and we
should be asking for more than just $50,000 in return. We should ask to recuperate all of the
money that has been lost and not just fix things moving forward. Our residents recently paid in
$1.8 million and we only received $360,000 back. Although our residents use the township roads,
the township residents also use the City’s roads. The City should be able to control its own destiny
financially. Townships have reduced their levy and shifted that to an account that they don’t have
to share. We need to have our own road district so we can control the money that our taxpayers
put into the roads.
Public Works Director Strange explained that the last line in the resolution was a specific request
to have all of the collections be given back to the City. Alderman Glab stated that the resolution

is not strong enough. Alderman McClatchey asked how the money is collected and then
dispersed. Finance Director Carolyn Lynch explained that the County collects the money and then
sends the City its portion of the taxes. City Administrator Morefield explained that Council was
given a final draft of the resolution to provide feedback on September 10th, but no comments
were received. He also asked Alderman Glab what he wanted the outcome of the resolution to
be. It is unclear what exact changes are now being requested. Alderman Glab suggested that
instead of so many statistics, facts could be stated that show the negative impacts of what the
townships have done.
Alderwoman Miller’s belief is the purpose of the resolution is to get someone in Springfield to
introduce appropriate legislation to get motions to change the statutes. We could then produce
evidence or documentation they need to demonstrate what is not right or fair. She agrees with
Alderman Glab’s statements that the City needs to control the money that their taxpayers have
paid in, but until somebody is willing to carry the bill, we have no traction. A motion was made
by Alderwoman Miller and seconded by Alderman Strach to pass a resolution requesting
legislative assistance to increase the annual distribution of Township Road District Tax Levies
that is returned to Illinois Municipalities, and to authorize staff to distribute the resolution to
the City of McHenry’s State Representatives. Roll Call: Vote: 7-ayes: Alderwoman Miller,
Alderman Strach, Alderman Santi, Alderman Glab, Alderman McClatchey, Alderman Harding,

Individual Action Item Agenda
Motion to approve an Ordinance granting a Conditional Use Permit, and Zoning Variations, to
accommodate the operation of a transitional living shelter at 2116 N. Ringwood Road.
Director Polerecky explained that the property for Home of the Sparrow was recently annexed.
This ordinance will help them with their transitional shelter, keep compliant with landscaping,
the parking lot, and playground structure. The Planning & Zoning Commission heard this issue on
September 15th and unanimously recommended it along with the included condition.
Alderman Glab gave many examples of how multifamily developments would continue to make
traffic worse on Crystal Lake Road. Mayor Jett explained that he may have been citing examples
for the next item on the agenda. A motion was made by Alderman Santi and seconded by
Alderman McClatchey to approve an Ordinance granting a Conditional Use Permit, and Zoning
Variations, to accommodate the operation of a transitional living shelter at 2116 N. Ringwood

812 N. Mill Street – Conceptual Multifamily Redevelopment Presentation by North Pointe
Development.
Director Polerecky explained that the petitioners were online to show a 46-unit apartment
building with repurpose of the mill building and a four-unit townhouse. The developers are
presenting this conceptual plan to the Council prior to the October 20th Planning & Zoning
meeting and the subsequent November 1st City Council meeting.
Jake Victor of North Pointe Development was present at the meeting and shared his screen for
the presentation. The development includes 3.3 acres off Mill Street and Crystal Lake Road.
Although this is in the early planning stages, they wanted to hear feedback from the Council on
how they could improve the plan to make it stronger for the residents and the area. They looked
at strong multifamily sites to have opportunities that align with the City’s vision. Currently there
are several warehouse buildings on the property and the current land owner has struggled to sell
off the land. He gave a history of North Pointe Development and that they are a non-profit
community-based affordable housing developer.
Mr. Victor explained the site selection process and what made this a good area to develop for
multifamily. An overhead view of the property was shared that showed a community center
space on the southwest corner along with leasing space and a fitness center. To the north would
be a new 2-story construction with townhomes. Garages would be placed on the north side of
the property with a community garden, play area, and 110 parking stalls. Those parking stalls
would give about a 2-1 ratio for parking. Elevations were shown of the main building and the new
4-unit construction on Crystal Lake Road. He explained how they have won awards for developing
while keeping historic preservation in mind.
Mr. Victor explained that this project is not considered public housing, and he detailed the
financing source of the proposal. They would apply for housing tax credits through the Illinois
Housing Development Authority. This would be considered workforce housing that is priced
affordably where tenants receive no rent subsidy. The company would be long term owners with
guarantees that the property would be built, remain occupied, and in good physical condition. A
development timeline was shared that showed if they were awarded the tax credits, they could
start in late 2022 or early 2023.
Alderman Harding stated that this could be a nice improvement for that part of the downtown.
He asked if there would be an opportunity to incorporate more green space and if fire sprinklers
would be required. Mr. Victor explained that they had serious considerations for green space and
more could be added by eliminating some of the parking spots. Director Polerecky reported that
sprinklers would be required by code.
Alderwoman Miller explained that she and the developers met with area residents to see the
presentation beforehand to offer feedback. Most of the residents did not oppose the
construction of multifamily in the area, but were concerned about the traffic issues that could

come with it. A lot of traffic already cuts through their neighborhood to try and avoid Crystal Lake
Road, and adding that many more residents could make the problem worse. There was discussion
about having a better exit to the north instead of all of the traffic coming down to Mill Street.
Alderman McClatchey stated that he liked the concept for that area, and asked how the historical
buildings would be kept or if there would be changes to the exterior. Mr. Victor explained the
planned uses for those buildings and said they have not gotten into the details yet about changes
to the outside of those buildings. Alderman Devine asked how the tax credits worked and how
competitive this would be. Mr. Victor stated that tax credits are applied for in February and are
usually awarded around May. This project would only happen if tax credits were awarded. This
should be very competitive because they should score well and the State wants more of this type
of housing in McHenry. Alderman Glab asked why they were considering so many 3 bedroom
apartments when it would make sense for professional individuals to want a 1 bedroom
apartment. It was explained that the market study showed there was a need for 3 bedroom units,
and they wanted to be inclusive of all family sizes. The 3 bedrooms also work well in the
townhomes.
Director Polerecky explained that the development team needed direction on moving forward
and this was the time to let them know if the Council did not want to see this concept happen.
This is not for an approval but for a conceptual view. Alderman Glab explained his reservations
and that nothing he saw thrilled him at this point. Alderwoman Miller liked what she saw and
was encouraged by the feedback from the residents. Mayor Jett agreed with Alderwoman Miller
and was hopeful that something nice could be coming to that downtown area.
914 Front Street – Conceptual Multifamily Redevelopment Presentation by Commonwealth
Director Polerecky stated that this multifamily development would be financed similar to that of
the Mill Street presentation. This is on the site of the former roller rink with a proposed 50 unit,
3-story apartment building.
Tyler Sheeran was present from Commonwealth and shared his screen for the presentation. He
gave a background of the company and recapped the way the financing would work. He
reiterated that this is not a Section 8 housing development. They are proposing a 3-story midrise
style building with a clubhouse, leasing office, community room, exercise facility, business center,
bike racks, and in-unit washer & dryers. This is adjacent to the Center Street Park.
An overhead view of the proposal was shown with 100 parking stalls. A vast majority of the
building is brick with balconies or patios, green space in front, and a community patio coming out
of the community room. They would have an experienced staff with high quality housing and
would work directly with the City to bring the project to fruition.
Alderman McClatchey asked why the biggest portion of the building was on Route 31 and not in
the back. Mr. Sheeran explained that designers thought the building would be more aesthetically

pleasing than having the parking lot in front. Alderman McClatchey asked who would be
responsible for cleaning up the property. It was explained that the developers do not currently
own the property, and they have an option to purchase with the current owners responsible for
the cleanup.
Alderman Santi also stated that he thought the design may look better with the building turned
towards the back. He asked if there were safety concerns for children walking to school and if
there were sidewalks along Route 31 . Director Polerecky stated that there is a sidewalk the entire
length of Route 31 towards the South to get to Kane. It was also discussed that the Route 31
widening project called for a multipath along the east side.
Alderman Harding asked Staff if there was a fence or a way to get to the park to the east. Director
Polerecky suggested that part of the agreement may be to include a fence and access to the park.
Chief Birk stated that there is a fence and that they would request a gate or access to the park as
well. Alderman Glab stressed that the development would need to be held to the green space
standards as stated in our ordinances.
Mayor Jett asked the Council members if any of them did not support this concept moving
forward. Alderman Devine stated that he does not support it because of the location. Alderman
Glab had reservations and was not sure if there were other uses for that property. Alderman
Santi suggested that he wanted them to move forward but wanted a better look with the tight
fit of the building on the property. Alderman Strach is not opposed to the project and likes the
aesthetics. He also explained that just because the property surrounding this is currently zoned
commercial does not mean that it couldn’t change in the future. Mayor Jett explained that he
does not get a vote but would rather see a different use for the property due to the commercial
setting and a wider highway coming in soon.
Mayor’s Report
Mayor Jett reported that the Rise-Up concerts raised over $200,000 and will be able to fully fund
the splash pad. He thanked Council members and staff that helped with the event. There were
no major issues and another event is being planned for September 9-10 next year for another
project. A full report of the financials will be going out to the Council for full transparency.
City Council Comment
Alderman Glab suggested that the next project that could be funded by Rise-Up could be the
parking lot expansion for the park. Mayor Jett explained that he already has an excavating
company and paving company donating the work and materials at no cost to the City.
Alderman Glab stated that we need to look at our roads better and think about expansion for the

future. We already have problems with many of our residential streets, and in the future we may
need to widen Crystal Lake Road. This would come at a great expense. He also suggested we talk
about the possibilities of adding bike paths over the river and to Chapel Hill before the widening
from Bull Valley to Route 120. Veteran’s Parkway might also have to be widened if a new
apartment complex is to be built.

ORDINANCE NO. 21-
Amending Title 4, Chapter 2, Alcoholic Liquor, Section 6, License Classification
and Fees; Approval Authority; Limitation on Number of Licenses
WHEREAS, the City of McHenry, McHenry County, Illinois, is a home rule
municipality as contemplated under Article VII, Section 6, of the Constitution of the State of
Illinois, and the passage of this Ordinance constitutes an exercise of the City's home rule
powers and functions as granted in the Constitution of the State of Illinois.
NOW, THEREFORE BE IT ORDAINED by the City Council of the City of
McHenry, McHenry County, Illinois, as follows:
SECTION 1: Section 4-2-6, subsection D-1, of the Municipal Code relating to
liquor license classifications, shall be amended as follows:
D.1. Class A (Full Bar) License: Issuance of a Class A license shall authorize the sale of
alcoholic liquor for consumption on the premises, and the retail sale of packaged liquor.
The annual fee for such licenses shall be one thousand five hundred dollars ($1,500.00).
A Class A licensee shall be eligible to apply for a catering endorsement for an
additional fee of three hundred dollars ($300.00), which shall permit the servicing of
alcoholic liquor for off-site consumption as an incidental part of food service, sold at a
package price, as agreed upon under contract. Nonprofit organizations with a Class A
license shall be eligible to pay a reduced fee of five hundred dollars ($500.00) per year
to receive and maintain a Class A license. No more than thirty-nine (39) Class A
licenses shall be in force in the City at any time.
SECTION 2: If any section, paragraph, subdivision, clause, sentence or provision of
this Ordinance shall be adjudged by any Court of competent jurisdiction to be invalid, such
judgment shall not effect, impair, invalidate or nullify the remainder thereof, which remainder
shall remain and continue in full force and effect.
SECTION 3: All ordinances, or parts thereof, in conflict herewith are hereby repealed
to the extent of such conflict.
SECTION 4: This ordinance shall be published in pamphlet form by and under the
authority of the corporate authorities of the City of McHenry, Illinois.
SECTION 5: This ordinance shall be in full force and effect from and after its
passage, approval and publication, as provided by law.

Amending Title 4, Chapter 2, Alcoholic Liquor, Section 6, License Classification
and Fees; Approval Authority; Limitation on Number of Licenses
WHEREAS, the City of McHenry, McHenry County, Illinois, is a home rule
municipality as contemplated under Article VII, Section 6, of the Constitution of the State of
Illinois, and the passage of this Ordinance constitutes an exercise of the City's home rule
powers and functions as granted in the Constitution of the State of Illinois.
NOW, THEREFORE BE IT ORDAINED by the City Council of the City of
McHenry, McHenry County, Illinois, as follows:
SECTION 1: Section 4-2-6, subsection D-3, of the Municipal Code relating to
liquor license classifications, shall be amended as follows:
D.3. Class C (Packaged Retail) License: Issuance of a Class C license shall authorize the
retail sale of packaged alcoholic liquor only. No consumption of alcoholic liquor shall
be permitted on the premises. The annual fee for a Class C license shall be one
thousand one hundred dollars ($1,100.00). No more than twenty-four (24) Class C
licenses shall be in force in the City at any time.
SECTION 2: If any section, paragraph, subdivision, clause, sentence or provision
of this Ordinance shall be adjudged by any Court of competent jurisdiction to be
invalid, such judgment shall not effect, impair, invalidate or nullify the remainder
thereof, which remainder shall remain and continue in full force and effect.
SECTION 3: All ordinances, or parts thereof, in conflict herewith are hereby repealed
to the extent of such conflict.
SECTION 4: This ordinance shall be published in pamphlet form by and under the
authority of the corporate authorities of the City of McHenry, Illinois.
SECTION 5: This ordinance shall be in full force and effect from and after its
passage, approval and publication, as provided by law.

Staff Comments
The following comments and conclusions are based upon staff analysis and review prior to this hearing and are
to be considered viable unless evidence is established to the contrary. Staff may have additional comments
based upon the testimony presented during the public hearing.
BACKGROUND & REQUEST SUMMARY
The petitioners, Elizabeth Wagner-DeStefano and Basil DeStefano (“Owners of Record”), are requesting
approval of the following Zoning Variations to accommodate the construction of a new single-family
residence:
x A variance to allow a rear yard setback of 18.2’ in lieu of the required 25 feet; and
x A variance to allow an interior side yard setback of 4.7’ in lieu of the required 6 feet.
The site consists of 0.22 acres, more or less, and is located approximately 217 feet south of the intersection of
Lincoln Avenue and Freund Avenue, with a common address of 3719 W. Freund Avenue, McHenry, IL 60050
(“Subject Property”). The original principal residence was in a poor condition and was demolished earlier this
year. Staff was able to visit the site and speak with the adjacent neighbors while posting the sign on the
property. Overall, the neighbors to the north and south appear to be supportive of the request. The neighbor
to the south stated he would be happy once the project was completed and that it would be a good
investment in the neighborhood.
CITY OF MCHENRY ORDINANCES
x The petitioners must meet the Approval Criteria for Variances, listed in §11-19-5 of the City of
McHenry Zoning Ordinance.
STAFF ANALYSIS
FUTURE LAND USE MAP RECOMMENDATION
The future land use map recommends low density single-family land use for the subject property.
CURRENT LAND USE AND ZONING
The subject property, and surrounding neighborhood, is zoned RS-4 High-Density Single-Family Residential
District.
COMPREHENSIVE PLAN OBJECTIVES AND POLICIES
An objective listed in the Neighborhood Character chapter of the City’s Comprehensive Plan is to promote
attractive neighborhoods (p. 49). However, there is no policy listed under the objective that specifically relates
to this circumstance.
SITE PLAN ANALYSIS
The subject property is part of the A.P. Freund’s Mill Stream Park Addition,
Unit No. 1 Subdivision that was plated in 1949. Part of an older subdivision,
the subject property and surrounding lots vary in size from 33-60 feet in
width (see below screen shot). Adjacent to a stream in the rear yard, staff
does not believe the encroachment within the rear yard setback will cause
any adverse impacts. Due to the size and irregular shape of the lot, staff is
comfortable with the proposed side yard encroachment.

SSTAFF RECOMMENDATION & MOTION
In summary, staff is comfortable with the proposal and believes there is a hardship present due to the size and
shape of the lot. Conversations with the adjacent owners indicated they would be relieved once the site is
developed and welcome the investment into the neighborhood. Staff does not object to the petitioner’s
request and recommends approval.
If the Planning & Zoning Commission agrees with staff’s assessment, then the following motion is
recommended:
MOTION: I motion to approve the petitioner’s request for the following zoning variations:
1. A variance to allow a rear yard setback of 18.2’ in lieu of the required 25 feet; and
2. A variance to allow an interior side yard setback of 4.7’ in lieu of the required 6 feet.
AND by making said motion, I agree with staff’s assessment that the Approval Criteria for Variances have been
met as outlined in the Staff Report.

AGENDA ITEM SUMMARY: The petitioner, Jose Navarrete, is requesting approval of a Use
Variation to allow a Body Art Establishment in the C-5 Highway Commercial District at 4801 W.
Elm Street.
BACKGROUND: Body Art Establishments are currently not allowed as a permitted or conditional
use in any Zoning District in the City and must apply for a Use Variation. Body Art
Establishments are regulated by the Illinois Department of Public Health’s (IDPH) Body Art Code
which specifies the standards for operation, and requires registration and periodic inspections
by IDPH. The City has approved a total of six (6) Body Art Establishments with only two (2)
currently in operation – Art & Soul, and Crimson Peak. Along with the petitioner’s request, staff
is also proposing zoning text amendments to allow it as a permitted use within the C-4
Downtown Business District and C-5 Highway Commercial District for Council’s consideration.
PLANNING & ZONING COMMISSION DISCUSSION & RECOMMENDATION: The Planning &
Zoning Commission discussion was primarily in relation to the petitioner’s background
tattooing, hours of operations, and signage. No concerns were raised from the Commission.

A Use Variation to allow a Body Art Establishment in the C-5 Highway Commercial District.
Chairwoman Rockweiler called the hearing to order at 7:01 p.m. regarding File No Z-997 a Use
Variation to allow a Body Art Establishment in the C-5 Highway Commercial District at the subject
property, commonly known as 4801 W. Elm Street. Chairwoman Rockweiler confirmed all legal
posting requirements have been met.
Mr. Navarette was sworn in and stated he would like to open a tattoo shop in the retail space that
has been vacant at the subject property for some time and he’d like to enrich the community with
his higher end artwork.
City Planner Sheriff provided the Commission with the Staff Report regarding this file stating
Body Art Establishments (tattoo shops) are currently not an allowed use in any Zoning District in the
City of McHenry. Staff will be proposing text amendments to change this to an allowed use in the C-
4 Downtown Commercial District and C-5 Highway Commercial District later.
The subject property is currently zoned C-5 Highway Commercial District and has remained vacant
for several years. The subject property is surrounded by primarily commercial zoning and land use
with adjoining single-family residential land use to the south. The primary concern is how the
proposed use will interact with the adjoining properties. Body Art Establishments do not generate
adverse traffic nor noise. Staff does not believe approval of the request will generate any adverse
impacts. Overall, staff believes the proposed development is consistent with the City’s
Comprehensive Plan objectives and policies, and if the Planning & Zoning Commission agrees with
staff’s assessment, then a motion is recommended for approval of a Use Variation to allow a Body
Art Establishment in the C-5 Highway Commercial District as presented and outlined in the Staff
Report.
Chairwoman Rockweiler invited questions and/or comments from the Commissioners.

Commissioner Walsh inquired as to the hours and days of week the establishment would be open.
Mr. Navarrete stated he works for Aramark at his children’s school so the hours will be by
appointment only and will be evening hours only during the week.
Chairwoman Rockweiler inquired how Mr. Navarrete plans to advertise. Mr. Navarrete responded
he uses conventions and word of mouth. He added he has a following of clients who ask him to
repair their artwork done by other artists and that word spreads.
Commissioner Smale asked for confirmation that all required licensing and certifications are valid
and current. Discussion ensued regarding what is required for body art establishments. Mr.
Navarrete stated he has multiple awards and certifications and that he follows all standards with
sanitation and cpr training required by the State and local health department. Planner Sheriff
explained licensing is regulated by the state and local health departments.
Commissioner Lehman asked if there will be outside signage. Mr. Navarrete stated he would be
looking into simple window signage and knows he must follow all City signage requirements.
There were no questions from Commissioners Sobotta, Bremer, or Davis.
Chairwoman Rockweiler invited questions and/or comments from the Public. There were no
comments from the public. Chairwoman Rockweiler closed the public comment portion of the
hearing at 7:11 p.m.
Motion by Bremer seconded by Smale with regard to File No. Z-997, to recommend approval of the
petitioner’s request for a Use Variance to allow a Body Art Establishment on the Subject Property as
outlined in the Staff Report, as presented, and by making said motion, we agree with staff’s
assessment that the approval criteria for Use Variations have been met as outlined in the Staff
Report.

STREET
WHEREAS, the City of McHenry, McHenry County, Illinois, is a home rule municipality as
contemplated under Article VII, Section 6, of the Constitution of the State of Illinois, and the passage of
this Ordinance constitutes an exercise of the City’s home rule powers and functions as granted in the
Constitution of the State of Illinois; and
WHEREAS, a petition has been filed with the City by Jose Navarrete, “APPLICANT”, requesting
approval of a Use Variation to allow a Body Art Establishment at 4801 W. Elm Street and legally described
on “Exhibit A” attached hereto and incorporated herein, the “SUBJECT PROPERTY”; and
WHEREAS, a public hearing on said petition was held before the Planning and Zoning Commission
on September 29, 2021 in the manner prescribed by ordinance and statute, and as a result of said meeting,
the Planning and Zoning Commission did unanimously recommend approval of the request; and
WHEREAS, the City Council has considered the evidence and recommendations from the Planning
and Zoning Commission and finds that the approval of the requested Use Variation is consistent with the
objectives of the City of McHenry Zoning Ordinance to protect the public health, safety, morals and
general welfare of its residents.

McHenry. Although we have several in the City, those establishments also were required to seek approval of a
Use Variation. Staff is proposing text amendments to change this to an allowed use in the C-4 Downtown
Commercial District and C-5 Highway Commercial District.

approval of the request will generate any adverse impacts.
COMPREHENSIVE PLAN OBJECTIVES AND POLICIES
Overall, staff believes the proposed development is consistent with the City’s Comprehensive Plan objectives
and policies. Staff comments italicized.

x Objective: "Allow a mixture of land uses in appropriate areas to promote responsible growth while
providing a high quality of life to the residents." (p. 27)

Staff believes approval of the request is consistent with supporting and expanding areas of
commercial land use. Located on a state highway, but adjacent to a residential subdivision, staff
believes a Body Art Establishment will generate no adverse impacts and promote responsible
growth.

x Policy: "Locate intense commercial...uses where they will not negatively affect residential or open
space uses." (p. 28)
Body Art Establishments are a service-oriented use and generate relatively no negative externalities.
Staff does not believe the proposed use will negatively impact the adjacent residential properties.

x Policy: "Promote development that allows employment and a shopping base which is diverse and
affords the City with a sound economic base." (p. 29)
Approval of the request would be consistent with promoting economic growth in the City and allowing
a vacant site to be utilized.
SITE PLAN ANALYSIS
Due to Body Art Establishments generating few externalities, staff does not have any concerns with the site
plan.
SSTAFF RECOMMENDATION & MOTION
In summary, staff believes the proposed commercial use is in substantial conformance with the City of
McHenry Zoning Ordinance. The commercial land use of the subject property is consistent with the future land
use map recommendation. Body Art Establishments are a service-oriented use and do not generate much
traffic. Staff is proposing text amendments to allow Body Art Establishments as a permitted use within the C-4
Downtown Commercial District and C-5 Highway Commercial District. Staff does not object to the petitioner’s
request and recommends approval.
If the Planning & Zoning Commission agrees with staff’s assessment, then the following motion is
recommended:
MOTION: I motion to approve the petitioner’s request for a Use Variance to allow a Body Art Establishment
on the Subject Property.
AND by making said motion, I agree with staff’s assessment that the approval criteria for Use Variations have

APPROVAL CRITERIA FOR USE VARIANCES (§11-19-6)
A. Practical Difficulties or Particular Hardship.
Staff believes the strict application of the provisions of the Zoning Ordinance would result in an
unnecessary and undue hardship upon the applicant.
B. Reasonable Return.
Staff believes the subject property cannot yield a reasonable return if permitted to be used only under
the conditions allowed by the regulations.
C. Unique Circumstance.
Staff does believe the request is under special circumstances since the property has remained vacant for
several years and because Body Art Establishments are not permitted in any zoning district at this time.
D. Not Alter Local Character.

Staff does not believe approval of the request will generate any adverse impacts on the surrounding
property owners since it is a service-oriented use which generates minimal traffic.
E.Consistent With Title And Comprehensive Plan.
The developer is proposing commercial use and the Future Land Use Map recommends commercial land
use. Staff believes the overall request is consistent with the Title and Comprehensive Plan.

Table 32(A) of the City of McHenry Zoning Ordinance provides that in recommending approval or conditional approval
of a use variance, the Planning and Zoning Commission shall transmit to the City Council written findings that all of the
conditions listed below apply to the requested action.

Staff Analysis. Body Art Establishments (tattoo shops) are regulated by the Illinois Department of Public
Health Body Art Code and are required to register with the state. It is common knowledge that the
popularity of tattoos have risen substantially over the past decade. Surveys 1 have indicated that 36% of
US Citizens age 18-29 have at least one tattoo. Staff believes the biggest fear of allowing tattoo shops as
a permitted use is that they would overcrowd some of our commercial areas. Staff surveyed and
compared several neighboring cities. Of those cities surveyed that allow tattoo shops, they do not

appear to be overcrowding the market. Being a service-oriented use, tattoo shops generate minimal
externalities. Staff is proposing to allow Body Art Establishments as a permitted use in the C-5 Highway
Commercial District, and C-4 Downtown Commercial District.
If the Planning and zoning Commission agrees with staff’s assessment, then the following motion is
recommended: A motion to recommend approval of Zoning Text Amendments as presented and
outlined in the staff report.

AGENDA ITEM SUMMARY:
Staff is requesting that the City Council consider, for approval and adoption, an update to
Sections 9-2C-5(B) and 9-4B-1(F) of the City of McHenry Municipal Code. These updates will
reduce debt service fees associated with the Wastewater Treatment Plant (WWTP) Consolidation
project and increase Water and Sewer Fund Base Fees. The net result will be an overall increase
in base and debt service fees of $4.00 per bi-monthly billing period.
DISCUSSION:
At the August 16, 2021 City Council Meeting, staff presented an update of the financial status of
the Water and Sewer Fund, as well as a projection of future capital costs for both capital
maintenance projects and capital replacement projects. At this meeting, the City’s current
operating and base fees were compared with other comparable communities. These rates were
presented in conjunction with a set of options for potential base fees. Each base fee option was
associated with a specific set of capital items and an associated cash flow schedule.
Improvements to be considered included: capital maintenance and replacement for vehicles,
equipment, well and water plant equipment, lift station equipment, sanitary sewer lining, water
tower painting, and water main replacement.
Upon a review of all existing base fees and debt service fees by the Finance Department, it was
determined that the base fee options and associated capital improvements under consideration
can be accomplished with adjustments to existing State Revolving Loan Fund (SRF) loan

collections for the Wastewater Treatment Plant Consolidation project. These adjustments will
result in minimal net increases of overall base and debt service fees.
Two options for proposed base fees and debt service fee adjustments were presented to the City
Council for discussion and consideration at the September 20, 2021 City Council Meeting. At this
meeting, staff were directed to review capital projections and bring forward an adjusted 10-year
capital program and associated base fee. This base fee, in coordination with the proposed
reduced WWTP Consolidation debt service fee, was to result in a net increase of $4.00 per billing
cycle. By adjusting the previously considered 10-year water main replacement program, staff
was able to bring the total costs of the overall 10-year capital program to a level that coincided
with a net $4.00 per billing period increase. Therefore, staff are proposing the recommended
reduction in SRF loan debt service fees in coordination with updated Water and Sewer base fees.
The results of these adjustments will create a significantly lower net overall fee increase than
previously presented at the August 16, 2021 City Council Meeting. Based upon the consensus
drawn from the discussion at the September 20, 2021 City Council meeting, the following
recommendation is presented for adoption:

ANALYSIS:
Staff has prepared a listing of comparable communities’ water and sewer rates, which includes
all operating, base/capital fees, and debt service fees. Upon evaluation, staff has determined
that the proposed fee structure is competitive and representative of the local industry standard
municipal water and wastewater billing structures.
RECOMMENDATION:
Therefore, if Council concurs, it is recommended that City Council approve and adopt an
ordinance updating Sections 9-2C-5(B) and 9-4B-1(F) of the City of McHenry Municipal Code in
order to reduce debt service fees associated with the WWTP Consolidation project and increase
Water and Sewer Base Fees.

ORDINANCE NO. 21-
An Ordinance Amending Title 9, Subsection 9-2C-5 B: Waterworks User
Rates; and Title 9, Subsection 9-4B-1 F: Metered Users Service Charges of the
McHenry City Code
WHEREAS, the City of McHenry, McHenry County, Illinois, is a home rule
municipality as contemplated under Article VII, Section 6, of the Constitution of the State of
Illinois, and the passage of this Ordinance constitutes an exercise of the City’s home rule powers
and functions as granted in the Constitution of the State of Illinois; and
WHEREAS, Water and Sewer Rates are reviewed annually and may be adjusted based
on the actual operational, maintenance and capital improvement needs of the municipality.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of
McHenry, McHenry County, Illinois, as follows:
SECTION 1: Title 9-2C-5 Subsection B of the McHenry City Code is amended in it’s
entirety, to read as follows:
B. Rates: Water user rates shall be as follows on or after January 1, 2022:
Within the corporate limits of the City:
Class 1 uses: $3.82 per 1,000 gallons
Class 2 uses: $4.09 per 1,000 gallons
Outside corporate limits of the City:
Class 1 uses: $5.73 per 1,000 gallons
Class 2 uses: $6.14 per 1,000 gallons
In addition, on and after January 1, 2022, each user shall pay base charge with each bi-
monthly invoice, which shall be applied to operations and maintenance and capital costs
associated with the City’s waterworks system based upon the following table:

In the event that a user’s water account with the City is inactive, such user shall
nonetheless still be billed for such base charge even in the absence of any use of water.

than one category of user, the user category utilizing the largest percentage of water shall
be the applicable rate payable for all such water being utilized at such location.
SECTION 2: Title 9-4B-1 Subsection F.1. of the McHenry City Code is amended, in its
entirety, to read as follows:
F. User Rates: Basic user rates shall be reflected in the May billing year for metered service.
1. Effective on and after January 1, 2022, the sewer rates shall be as follows for
metered uses:
Within the corporate limits of the City:
Class 1 uses: $4.20 per 1,000 gallons
Class 2 uses: $4.06 per 1,000 gallons
Outside corporate limits of the City:

maintenance expenses associated with such system based upon the following table:

sewerage works, there is hereby established an adjusted “2015 IEPA fixed debt service charge”
in the following amount, to be paid bimonthly to the City, and the revenues received from this
IEPA fixed debt service charge shall be solely dedicated to the repayment of the loan received by
the City from the Illinois Environmental Protection Agency, pursuant to its Water Pollution
Control Loan Program, in accordance with City Ordinance 21- , dated October 18, 2021,
adopted by the City Council on October 18, 2021:

AGENDA ITEM SUMMARY:
The purpose of this agenda item is to discuss the 2021 Property Tax Levy and to provide City Staff
guidance on the levy amount to be requested.
Annually, prior to the end of the calendar year, the City must provide the amounts required for
the property tax levy so that the funds generated through this revenue mechanism will become
available during the 2022/2023 fiscal year. The levy request must be approved by the City Council
and submitted to the McHenry County Clerk by the last Tuesday in December (the 28th in 2021).
There are public notification timeframes also associated with this process. With this date as a
target, the 2021 Property Tax Resolution indicating the levy amount and Public Hearing will be
presented at the November 15th, 2021 Council meeting and, upon adoption of the resolution, the
Property Tax Levy Public Hearing and consideration/adoption of the levy amount is scheduled for
the December 20, 2021 City Council meeting.
BACKGROUND/ANALYSIS:
General Fund Revenues provide the funding source for operating and capital improvement costs
for all municipal departments except for the Water and Sewer Divisions of Public Works (water
and sewer receipts and base fees) and the Recreation Center (members fees). Examples of
capital improvement costs are facility maintenance and vehicle and equipment replacements.
The table below is provided as a reminder of the sources of revenue that comprise the General
Fund, along with the budgeted dollar amounts and corresponding percentages for Fiscal Year
21/22. Again, all General Fund revenues are accounted for in one of the line items below. As
Council can see, $18,919,122 (78.25%) of General Fund Revenues are comprised of four primary

sources – Property Tax, State Sales Tax, Local Sales Tax, and State Income Tax (shaded rows). Of
these four primary sources of funding, the municipality only has the ability and authority to adjust
two – Property Tax and Local Sales Tax. These two sources represent just 31.90% of General
Fund Revenues.

With this information, and as Council considers setting the Property Tax Levy amount moving
forward, it is important to identify that the City Administration has been conducting a
comprehensive analysis of General Fund operating and capital replacement and maintenance
needs for the purpose of developing a new Community Investment Plan strategic planning
document. This will be presented to Council in November. As part of this analysis, Staff has
identified that costs related to these needs will exceed revenues by FY25/26. This trend will
continue beyond FY25/26 and without introducing new or increased funding sources, capital
replacement and maintenance items will need to be deferred and services will most likely be
impacted.
Despite the fact that as a “Home Rule” community the City of McHenry is no longer subject to
the Property Tax Extension Limitation Law, or PTELL - which limits increases to residents’ property
taxes by preventing a local government’s property tax levy from growing at a faster pace than
the rate of inflation, or 5%, whichever is less - the City has continued to follow PTELL guidelines
for establishing the property tax levy. In fact, for the years 2011-2015 the City chose to maintain
a flat property tax levy request at the amount that was requested in 2010. In 2016, Council chose
to decrease the property tax levy request by 3%. And in 2017-2020 the levy was again maintained
flat from the 2016 reduced amount.

Unfortunately, while the City has attempted to have an impact on reducing property taxes
through these actions, a reduction to the City’s portion of the property tax levy has not resulted
in reductions to property tax bills. Change in EAV also drives change in the property tax bill.
When the EAV declines the tax rates must go up in order to fully fund the property tax levy
because the same amount of money needs to be collected across the new lower values as
requested by all taxing districts. For 2020, the EAV increased for the fifth consecutive year so the
tax rates for the City went down slightly lowering the City’s portion of the tax bill. In fact, in 2020
that portion of a resident’s tax bill directed to the City of McHenry was only 6.3% of the total
amount. However, this does not take into consideration actions taken by the other taxing
jurisdictions that comprise the total property tax bill. As an example, in 2015 the City of McHenry
kept its portion of the property tax bill the same as 2014, but the amount of property tax paid by
the owner of a $200,000 home actually increased by $43.51 due to levy increases by other taxing
bodies.
Of note, actions of the City to maintain a flat or reduced Property Tax Levey have resulted in a
net loss of revenue to the City between 2010 and 2020 of $6,439,383. If this practice is
maintained for the next 10 years (through 2031), revenue losses will be an additional $19,391,960
($25,831,343 total over 20-year period).
RECOMMENDATION:
For the 2021 tax year the inflationary rate is 1.4%. The Estimated Rate Setting EAV supplied by
McHenry County has not been received yet but has been estimated at 781,108,146 (an increase
of 5% over 2020) and new construction is estimated at 7,417,654. PTELL calculated with the
inflationary rate and the estimated EAV equates to an Estimated Limited Extension of $4,728,360,
or a $109,574 increase over last year. This increase would result in an increase in the City’s
portion of the Property Tax Bill a total of $2.68 for a home valued at $200,000, and $3.35 for a
home valued at $250,000. Again, total increases or decreases to the amount of property taxes
are dependent on the actions of all taxing bodies.
It is important to note with the issuance of the Pension Obligation Bonds the City will have a
separate levy for the annual bond costs. Once Council determines if there will be a change to the
Property Tax Extension, City Staff will make sure the Pension Obligation Bond Levy and the total
City Levy equal this Property Tax Extension dollar amount. The current estimated Pension
Obligation Bond Levy is $1,664,872, this leaves $2,953,914 for the Property Tax Extension (if the
levy remains flat). The final Property Tax Extension will be reflected in the ordinance that is
brought forward for approval.
It is the recommendation of Staff that Council direct the preparation of a property tax levy in the
amount of $4,728,360.

When people think of fall numerous things come to mind;
pumpkins, leaves, football, blessings and giving (to name a
few). As another turbulent year winds down it is important
to remember the things we are thankful for and pay it
forward to those less fortunate. The United Way payroll
deduction campaign is the perfect way to help the
community. By signing up to make a payroll deduction (the
amount could be as small as $2) you can help support dozens
of local charities throughout McHenry County. What can
takes a few minutes to sign up for can make a lasting impact
in someone's life.

Open Enrollment for plan year 2022 will be
November 1, 2021 - November 12, 2021
During this time you can elect
or waive benefits for 2022.
This is also the time to add/change
your voluntary life insurance.
No plan changes to health, dental or vision
The City provided life insurance will increase to $60,000.
New benefit! LightCare Coverage – You can now use
your frame and lens benefit to get non-prescription
eyewear from your VSP network doctor. (Non-
prescription sunglasses or blue light filtering glasses)

With jobs becoming more reliant on computers/tablets/smart
phones. It is important to take care of our eyes and work to
reduce eye strain from staring at a screen all day.
Combat Digital Eye Strain
The average American
13yr old owns 3 digital
devices & spends
70 hours a week
on screen time.
Get an eye exam
Talk to your VSP eye doctor about your
lifestyle and ask about the best options for
reducing eye strain.
Maintain your digital distance
This is highly important for kids since the
intensity of lights increase the closer our
eyes are to the source. Find a comfortable
viewing distance from your screen.
Limit screen time before bed
Turn devices off a few hours before going
to bed. Also, consider lowering the
brightness of your screen of downloading
an app that reduces blue light on your
phone or tablet as the sun goes down.
Follow the 20-20-20 rule
Give your eyes a break every 20 minutes,
and spend 20 seconds looking at something
at least 20 feet away.
According to VSP here are four tips to reduce your exposure:

health condition, including incapacity due to pregnancy and for
prenatal medical care;

For any qualifying exigency arising out of the fact that a spouse, son,
daughter, or parent is a military member on covered active duty or
call to covered active duty status.
FMLA stands for: The Family & Medical Leave Act. This is a federal law
that provides eligible employees of covered employers with 12 unpaid
workweeks of leave in a 12-month period for the following reasons:
What is FMLA and how does it benefit employees?
During FMLA leave, the employer must maintain the employee’s health
coverage under any “group health plan” on the same terms as if the
employee had continued to work.
Upon return from FMLA leave, most employees must be restored to their
original or equivalent positions with equivalent pay, benefits, and other
employment terms.
Use of FMLA leave cannot result in the loss of any employment benefit that
accrued prior to the start of an employee’s leave.
