Recommendation: Approve Purchase of`Power DMS' CALEA Management and
Training Software from Innovative Software Solutions at a cost
not to exceed $7,325.00
As you know,the Department has recently been accredited by the Commission on Accreditation
for Law Enforcement Agencies, Inc (CALEA). One of the tasks before the Department is to
maintain the accreditation files and to train its members in the newly established policies. In this
effort,the Department proposes to purchase and install a software package called Power DMS
developed by Innovative Data Solutions of Brookville, Florida. The software will provide for
the creation of a database that will contain all the CALEA standards, all the Departments policies
and will allow the Department management staff to create tests to be taken by all Department
personnel in order to assure that they have read and understand the policy. The system also
provides for an electronic signature provided by staff personnel after completing the policy
review and test.
The Council appropriated funding in the amount of$7,500.00 for this software package in the
FY 2006 Information Technologies Operating Budget. Innovative Data Solutions is the only
source for this product and they have quoted the City a$7,325.00 for the software package

RE: 2006 McHenry Township Mosquito Management Program
Recommendation: Authorize the Mayor to execute the attached agreement with
McHenry Township for Mosquito Management not to exceed $11,750.
Historically, the city has entered into contracts with McHenry and Nunda Townships to
provide residents with mosquito abatement. The agreement with Nunda Township is a
two-year agreement that expires next year. The agreement with McHenry Township is
renewed annually.
Four other municipalities enter into an agreement with McHenry Township to benefit
from a large-scale program. As depicted on the attached breakdown, McHenry's
proportionate share of the contract for year 2006 is $1 1 ,750.

for professional services for the 2006 Unified McHenry Township Environmental
Mosquito Management Program. Enclosed is the Intergovernmental Agreement for those

Agreement
THIS AGREEMENT made the 15"' day of March, 2006 by and between McHenry
Township located in McHenry County, Illinois, a unit of local government as established under
the laws of the State of Illinois and hereinafter referred to as the"Township"; and the City of
McHenry located in McHenry County, Illinois, a municipality as established under the laws of the
State of Illinois and hereinafter referred to as the'Village/City" and
WHEREAS, the Township and Village/City as adjoining units of local government wish to
cooperate in providing mosquito control benefits to the electors or voters of their respective units
of local government pursuant to the State of Illinois Constitution of 1970. Article VII, Section 10
of the State of Illinois and III. Rev. Stat. 1983, Chapter 127, Section 741 et al; and
WHEREAS, in order for both parties to benefit in the economies of large scale mosquito
abatement programs; and
WHEREAS,the Village/City is located within the Township so that effective mosquito
abatement for the Township is possible only if the adjoining areas within the municipality are
effectively treated; and
NOW, THEREFORE, for the consideration as hereinafter contained, the Township and
Village/City hereby agrees as follows:
1. The Township has solicited bids for a contract or contracts for providing mosquito
abatement service by larviciding for the 2006 season for the Township including areas
within the boundaries of the Village/City. Said contract shall be substantially the same as
the attached Exhibit"A."
2. The Village/City agrees to be liable for fifty(50%) per cent of the cost of said contract for
mosquito abatement by larviciding for the services provided within the boundaries of the
Village only up to a ceiling amount of$11,750.00 for the 2006 season.

3, The Village/City shall within thirty (30)days of invoicing by the successful bidder, pay
said share of the cost of said service subject to the cost limitations as set forth above.
4. The rights and obligations of each party under this Agreement shall not be transferable
or assignable without the prior written consent of the opposite party.
5. This Agreement contains the entire agreement of the parties and any amendment or
modification, in order to be effective, must be in writing signed by the party against
whom any waiver, charge, extension or discharge is sought.
IN WITNESS WHEREOF, the parties have executed this Agreement mentioned and
attached hereto a copy of the Resolution or Ordinance passed by the local government
unit authorizing the execution of this Agreement by the proper officer of the local
government unit.

the number of Class H Liquor Licenses from four to three.
"Horsin Around Karaoke Kafe" located at 3421 West Elm Street is no longer open for
business. Consequently, the Class H liquor license issued to the owner is no longer valid.

AN ORDINANCE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF McHENRY, McHENRY
COUNTY, ILLINOIS, as follows:
SECTION 1. Section 4-6 (4) of the Municipal Code relating to
liquor license classifications is hereby amended by decreasing the number
of Class "H" Liquor Licenses from four (4) to three (3) .
SECTION 2. All ordinances, or parts thereof, in conflict with the
terms and provisions hereof, be and the same are hereby repealed to the
extent of such conflict.
SECTION 3. This ordinance shall be published in pamphlet form by
and under the authority of the corporate authorities of the City of
McHenry, Illinois.
SECTION 4. This ordinance shall be in full force and effect from
and after its passage, approval and publication, as provided by law.

APRIL 3, 2006
A Regular Meeting of the McHenry City Council was called to order by Mayor Low at
7:30 P.M. on Monday, April 3, 2006 in the Council Chambers of the Municipal Center. At
roll call the following Aldermen were present: Santi, Glab, Schaefer, Murgatroyd, Wimmer,
Peterson, and Condon. Absent: None. City Staff in attendance were: City Administrator
Maxeiner, Assistant City Administrator Martin, City Attorney McArdle, Chief of Police
O'Meara. City Clerk Jones, Director of Community Development Napolitano, Director of
Public Works Marcinko, Director of Finance Shields, Director of Parks and Recreation
Merkel, and Community Relations Management Assistant Hobson. Absent: None.
PROCLAMATION
Mayor Low expressed the importance of tissue and organ donations and read into
the record a proclamation declaring April 2006 as National Donate Life Month in the City of
McHenry. Mayor Low then introduced two recipients of organ donation.
Resident Donna Frett thanked Mayor Low and Council for recognizing the
importance of tissue and organ donation and supporting the national program.
Mayor Low presented the signed proclamation to Ms. Frett.
TEN MINUTE PUBLIC INPUT SESSION
Ms. Linda Peel of 2003 Bull Ridge expressed gratitude to Mayor Low and Council
for support of the McHenry Elementary School District 15 referendum.

REQUEST FOR HONORARY STREET SIGN
Mayor Low recognized Dr. and Mrs. Wilt who are requesting the designation of a
portion of Waukegan Road with the honorary street name of"Gladstone Way".
Assistant Administrator Martin reminded Council an Honorary Street Sign Program
was implemented in 2005. Dr. and Mrs. Wilt have submitted an application requesting that
a portion of Waukegan Road east of Green Street be designated as "Dr. Lee Gladstone
Way" in honor of Dr. Lee Gladstone who was responsible for initiating the establishment of
McHenry's first hospital on Green Street. Dr. and Mrs. Wilt are seeking Council approval to
honor Dr. Gladstone through the Honorary Street Sign Program.
Motion by Santi, seconded by Schaefer, to accept Staffs recommendation to
authorize the Mayor and City Clerk's execution of a resolution establishing that portion of
Waukegan Road east of Green Street as "Dr. Lee Gladstone Way".

REQUEST FOR ZONING MAP AMENDMENT - RANDY LIVELY 2623 LINCOLN ROAD
Mayor Low announced the Request for Zoning Map submitted by Randy Lively for
his property located at 2623 Lincoln Road was removed from this evening's agenda and
will be addressed at a later date.
ORDINANCE AMENDING COMPREHENSIVE PLAN TO INCLUDE CRYSTAL LAKE
ROAD SUB-AREA PLAN
Mayor Low recognized numerous attendees in the audience who expressed
concern regarding the ordinance amending the Comprehensive Plan to include the Crystal
Lake Road Sub Area Plan. Mayor Low requested respectful attention while Director of
Community Development Napolitano explained the necessity for implementing the
proposed amendment to the City's Comprehensive Plan to include the Crystal Lake Road
Sub-Area Plan.
Director Napolitano summarized the process utilized in the creation of the proposed
Crystal Lake Road Sub-Area Plan. He noted the Plan has been reviewed and modified
extensively by Staff and the Community Development Committee. The Plan provides a
vision for this area. It is not a blueprint, but merely conceptual in nature, and is open to
modification and amendment as the area changes and is redeveloped. Director Napolitano
stated the Planning and Zoning Commission at a Public Hearing held on March 16, 2006
voted 3-3 and did not recommend the adoption of the proposed Comprehensive Plan
amendment.
Mayor Low reiterated the Plan is conceptual and the City does not intend to invoke
eminent domain to secure property to implement the Plan. There are no immediate plans
to initiate the establishment of the Plan.

Alderman Schaefer stated the Plan is conceptual and provides direction to
developers who express interest in redeveloping in this area.
Aldermanh Murgatroyd stated having a plan with options provides a starting point for
future discussions. He noted not all points of the Plan are feasible, but implementing the
Plan offers direction to Staff and developers. Alderman Murgatroyd expressed
disappointment in the Planning and Zoning Commission's lack of recommendation
regarding the Plan.
Alderman Wimmer commended Staff and the Community Development Committee
on the Plan.
Alderman Peterson stated he likes parts of the Plan but does not care for the
proposed cut-thru of neighborhood roads. He noted although the Plan is conceptual, he
acknowledged he has difficulty in supporting it.
Alderman Condon concurred with Alderman Wimmer. She expressed surprise in the
number of attendees at this evening's meeting, particularly as there was little public input
during the preparation of the Plan at numerous Community Development Committee
meetings. Alderman Condon opined the Crystal Lake Road Sub-Area Plan is compatible
with the City's Comprehensive Plan. She stated she approves of the vision of having a
Plan in place.
Alderman Santi concurred with Aldermen Wimmer and Condon. He expressed a
comfort level in having the Plan in place. He noted nothing is set in stone. The City is
attempting to be visionary by incorporating the Crystal Lake Road Sub Area Plan into the
Comprehensive Plan.
Alderman Glab stated it was his understanding the Crystal Lake Road Sub Area
Plan was being presented to Council for input, not necessarily for ordinance approval. He
acknowledged he has reservations regarding traffic in the area. He also has concerns with
safety issues. He stated Council should be looking at reduction of traffic on Crystal Lake
Road and Royal Drive.
Alderman Glab continued stating there are still a number of issues to be addressed.
A new plan should be created. Alderman Glab stated it would be an injustice to persons
living in the area to approve the ordinance amending the Comprehensive Plan this
evening.
Alderman Condon declared the decision before Council this evening. was
recommended by the Community Development Committee for Public Hearing before the
Planning and Zoning Commission and ultimately to be presented to full Council for
consideration. Alderman Condon stated all committee meetings are posted for
informational purposes. The public is provided with an opportunity to participate in
discussions at the committee level.
Alderman Murgatroyd stated he likes aspects of the Plan, and other portions of it

are not current. Alderman Murgatroyd opined overall there are enough positive aspects of
the Plan to move forward with its inclusion in the Comprehensive Plan. He noted actual
development and redevelopment in this area would come before the Community
Development Committee, Planning and Zoning Commission and Council many times
before the area is actually redeveloped. Residents in the area will have ample opportunity
to become knowledgeable and express their opinions prior to redevelopment of the area
and aspects of the Plan are actually implemented.
Motion by Schaefer, seconded by Wimmer, to pass and approve an ordinance
providing for an amendment to the City`s Comprehensive Plan to include the Crystal Lake
Road Sub Area Plan.

In attendance representing the McHenry Area Jaycees were Kevin Kutz and Naomi

Alderman Glab departed the meeting at 8:28 p.m.
City Administrator Maxeiner stated the Jaycees are seeking Council approval to
host their Annual Jaycee Days on Saturday, July 1, 2006 at Petersen Park Beach Area. In
conjunction with the event, the Jaycees are requesting City support services from the
Police Department, Parks Department and Public Works Department. The Jaycees are
requesting waiver of all associated fees. City Administrator Maxeiner also stated the
Jaycees are seeking Council approval of a 50/50 contract to provide Fireworks Display at
the event with Melrose Pyrotechnics in a total amount not-to-exceed $20,000.
Motion by Condon, seconded by Santi, to accept Staffs recommendation to approve
the following:
1) Use of Petersen Park for Annual Jaycees days Fourth of July event;
2) City support services;
3) Waiver of all associated fees;
4) Award of a 50/50 contract for fireworks program to Melrose Pyrotechnics Inc, in a
total amount not-to-exceed $20,000.

ORDINANCE APPROVING FINAL PLAT OF RE-SUBDIVISION FOR A PORTION OF
LOTS 1. 8. 9 AND 10 IN MEUER/HOME DEPOT SUBDMSION
Director Napolitano explained the Final Plat for the Re-Subdivision of a portion of
Lots 1, 81 9 and 10 of Meijer Home Depot Subdivision was approved on August 29, 2005.
One of the conditions of approval was the plat being recorded within six months. As the six
month time limit has expired, the Plat must once again be submitted to Council for
approval.
Alderman Glab returned to the meeting at 8:33 p.m.
Motion by Schaefer, seconded by Peterson, to approve the Final Plat of Re-
Subdivision for a potion of Lots 1,8,9 and 10 of Meijer Home Depot Subdivision prepared
by Ruediger, Tonelli and Associates last revised 2/1/06 subject to its recordation within six
months of Council approval.

REQUEST FOR QUALIFICATIONS FOR CONSTRUCTION OF RIVERWALK PHASE I
Management Assistant for Community Relations Hobson stated Staff is seeking
authorization to request qualifications from potential companies for the construction of
Riverwalk Phase 1. Staff is concerned that potential project bidders be qualified to
complete a project of this magnitude which involves competent structural work and results
in exemplary aesthetic product completed on time and within the project's budgetary
constraints. Staff is suggesting a pre-qualification process be utilized and is seeking
Council authorization to advertise to begin this process for potential project contractors.
Alderman Glab stated he is withdrawing his support for the Riverwalk. He noted he
cannot support the Riverwalk when neighborhoods near the Crystal Lake Road Sub-Area
Plan are going to be destroyed.
Motion by Wimmer, seconded by Schaefer, to accept Stafrs recommendation to
approve the following:
1. use of the proposed pre-qualification process for potential Riverwalk Phase
contractors;
2. Release of RFQ for the construction of Riverwalk Phase I for the purpose of pre-
qualifying contractors for the bid process for the Riverwalk.

COMMITTEE RECOMMENDATION: AMENDMENT TO MUNICIPAL CODE, SECTION 16-
48 RELATING TO PARKS AND RECREATION FACILITY RENTAL FEES
Director of Parks and Recreation Merkel stated the Parks and Recreation
Committee recently reviewed the facility rental fees contained in Chapter 16 of the
Municipal Code. In addition Staff recommended that recreation program and daily
admission fees be deleted from the Municipal Code as they change year to year. Director
Merkel stated the ordinance before Council for consideration this evening amends Chapter
16 of the Municipal Code as recommended by the Committee.
Alderman Murgatroyd stated he could not support the proposed amendments to the
Municipal Code. He noted some of the special uses held in park facilities are onerous and
the proposed fees would not cover Staff time or services needed to facilitate them.
Motion by Schaefer, seconded by Santi, to accept the Parks and Recreation
Committee recommendation to amend the Municipal Code Chapter 16, Section 16-48
relating to Parks and Recreation facility rental fees.

PROPOSED REVISIONS TO NORTHERN ILLINOIS SPECIAL RECREATION
ASSOCIATION (NISRA)ARTICLES OF AGREEMENT AND BYLAWS
Director Merkel stated several revisions are being proposed to the Northern Illinois
Special Recreation Association (NISRA) Articles of Agreement and Bylaws. The result will
be the elimination of the Board of Trustees. Staff supports the proposed revisions.
Alderman Peterson stated it is redundant to have a Board of Trustees as well as a
Board of Directors and supports the proposed revisions.
In response to Alderman Glab's inquiry, Director Merkel explained the process by
which the Board of Trustees was chosen. Alderman Glab then concurred with Alderman
Peterson.
Motion by Peterson, seconded by Condon, to accept Staffs recommendation to
approve the proposed revisions to NISRA Articles of Agreement and Bylaws and thereby
eliminating the Board of Trustees.

MAYOR— STATEMENT AND REPORT
Mayor Low reported she was in attendance when the City of McHenry was
presented its CALEA accreditation at an award ceremony held on Saturday, March 25,
2006 in Jacksonville, Florida. She noted this is a great achievement for the McHenry
Police Department.
COMMITTEE REPORTS
Finance and Personnel Committee Chairman Murgatroyd announced Finance and
Personnel Committee Meeting to discuss the 2006/2007 Budget is scheduled for April 5,
2006 at 7 p.m. in the Aldermen's Conference Room.
STAFF REPORTS
City Administrator Maxeiner announced the City Yard Waste Drop Off Program
begins this Saturday, April 8, 2006 at Knox Park.
FUTURL AGENDA ITEMS
Alderman Murgatroyd stated the Pigtail League and Little League have requested
the installation of a well at Petersen Park to be used for wetting down ball fields prior to
games. He noted the leagues are willing to fund the project. They have researched the
cost and would prefer to have this accomplished this spring before this year's league play
begins. Alderman Murgatroyd requested this matter be brought before Council for
consideration.

STAFF RECOMMENDATION: To deny the requested Zoning Map Amendment from E, Estate to
RS-2,Medium Density Single-Family Residential District,for 1.3 acres located at 2623 Lincoln Road.
To reimburse applicant for any relevant City fees that he may have incurred as a result of the
application review process.
Background
At the March 13, 2006 meeting, the City Council discussed the applicant's request for a Zoning Map
Amendment from E,Estate to RS-2,Medium Density Single-Family Residential District,for the subject
property. The applicant indicated that if the map amendment is approved, he would split the property
into two lots. This split is allowed without a subdivision plat by an exception in the State Plat Act. The
lot with the existing home would be approximately 154' x 193' (30,426 sf.). The new lot would be
approximately 81' x 193'(15,209 sf.). Both would conform to the RS-2 bulk requirements.
Although there were concerns about aesthetics,the Council directed Staff to meet with the applicant to
discuss possible driveway locations for the second home. Staff met with the applicant and developed
three options for driveway locations(see attached).
• Option 1 shows a new driveway serving the new lot. It would be approximately 90' from the
Hilltop School driveway.
• Option 2 shows a new driveway entering the site at the middle of the existing home and then
"T-ing" to the east and west to serve both lots. This driveway would be approximately 140'
from the Hilltop School Driveway. Also,the existing east driveway would be closed.
• Option 3 utilizes the existing driveway and adds an extension to the east to serve the new lot.
This driveway would be approximately 195'from the Hilltop School driveway.
Due to the circumstances surrounding this petition,Staff is recommending that any relevant City fees be
reimbursed to the applicant.
Staff Analysis
Regardless of where a driveway is located, Staff still believes that the proposed map amendment should
be denied. Aesthetically,another house on this lot would look inappropriate. Using a shared driveway
may result in the loss of mature trees and would add considerable impervious surface to the site.

REQUEST FOR ZONING MAP AMENDMENT FROM RANDY LIVELY, 2623 LINCOLN
ROAD
Director of Community Development Napolitano summarized the request for zoning
map amendment as requested by Randy Lively for his property located at 2623 Lincoln
Road. He stated the applicant is requesting RS-2 Medium Density Single Family Zoning for
his 1.3-acre parcel. The applicant would like to split the property into two lots as permitted
by the State Plat Act. The lot containing the existing home would be approximately
154'X193' (30,426 sf) and the new lot would be 81'X193' (15,209 sf).
Director Napolitano noted the Planning and Zoning Commission at a Public Hearing
held on 1/5/06 unanimously recommended denial of the request as it did not meet all of the
zoning map amendment criteria for approval. Director Napolitano stated Staff has struggled

with the request and has expressed concern with the access to Lincoln Road together with
the aesthetics of the unusually configured lots in relation to the existing neighborhood.
Ultimately, Staff has recommended denial of the request.
Applicant Randy Lively addressed Council and provided a written statement in
support of his request. A copy of Mr. Lively's written statement is on file in the City Clerk's
Office. In summation, Mr. Lively stated he needed the City to work with him to allow the
zoning request. He stated he would do whatever the City recommends in order to make
that happen. He is well aware of the safety and welfare concerns expressed by Staff. He
respectfully asked the Council to favorably consider his request for zoning map
amendment.
Motion by Murgatroyd, seconded by Condon, to consider the unfavorable
recommendation of the Planning and Zoning Commission, but to approve the zoning map
amendment request to RS-2 Medium Density Single Family Residential District as
submitted by Randy Lively for his property located at 2623 Lincoln Road.
In response to Alderman Murgatroyd's inquiry, Director Napolitano provided Council
with the current uses and zoning of the property surrounding Mr. Lively's parcel.
Responding to Alderman Wimmer's inquiry, Director Napolitano stated the driveway
for the new lot could access onto Lincoln Road or the Hilltop School driveway. Alderman
Wimmer stated he does not support the zoning map amendment. The division of the
property appears to be an afterthought as the second lot would be awkward in size and
shape.
Alderman Peterson noted it would be difficult to support the request unless he could
learn more regarding the proposed two-lot subdivision.
Alderman Condon inquired if City requirements and ordinances could facilitate a
driveway for the second lot. She also inquired if there would be sufficient building set back
from all property lines on the second lot. Director Napolitano responded the Applicant
would have to locate the building as far to the west as possible.
Responding to Alderman Santi's inquiry, Mr. Lively stated the property was annexed
due to his need for connection to municipal water and sewer. Alderman Santi stated he
sympathized with Mr. Lively's circumstances, but concurred with Alderman Wimmer.
Alderman Glab inquired as to City ordinances regarding placement of driveways on
residential lots. Director Napolitano responded the issue of driveways not having direct
access onto Collector Roads is specified in the City's Subdivision Control and Development
Ordinance. Alderman Glab stated he is undecided with regard to the Applicant's request at
this time.
Alderman Schaefer asked whether Mr. Lively's current residence is for sale. Mr.
Lively responded his home is currently for sale, and he intends to build a new residence on
the second lot.

Alderman Condon stated she cannot support access onto Hilltop School driveway as
it would present an unsafe situation. Alderman Condon noted she has aesthetic issues with
how the property was originally divided. She opined it is unfortunate money was spent by
Mr. Lively and he was encouraged to proceed with his request.
Alderman Glab inquired about the access easement and the ownership of the Hilltop
School driveway. Director Napolitano responded School District 15 owns Hilltop School and
its driveway. Attorney McArdle interjected eventually the Hilltop School easement will revert
back to the school district and Mr. Lively would be required to access his property from
Lincoln Road.
Alderman Glab suggested a more creative approach be sought to facilitate the
project for Mr. Lively.
Responding to Alderman Condon's inquiry, Attorney McArdle stated property access
will be implied if the zoning map amendment is granted.
Mayor Low stated there appears to be insufficient support for Mr. Lively's request,
but Council has expressed interest in the project. Mayor Low offered to table the discussion
until a later date.
The motion was withdrawn.
City Administrator Maxeiner suggested Mr. Lively meet with Staff to consider plan
alternatives before Mr. Lively incurs any additional expense.

STAFF RECOMMENDATION: To approve the request for a new freestanding sign with a setback of
3'-6"from the Front Street right-of-way.
Background
A letter was received from Ralph Hayward, owner of the Southgate Business Center, 810 North Front
Street. Mr. Hayward is requesting a variance in order to replace the existing freestanding sign for his
shopping center. He plans on re-using the foundation of the existing sign for the new sign. The new
sign would have the same setback as the existing sign(3'-6"). However,the required setback is 7'.
Allowable Signs
A shopping center is allowed one freestanding sign,not to exceed 200 sf. and 25' in height. Minimum
required setback is 7'. The existing sign is 87.5 sf, in size,21' in height and is setback 3'-6".
Proposed Sign
The proposed sign is 85 square feet in size,and 22' in height. The proposed setback is 3'-6".
Analysis
Staff has no concerns and would recommend approval of the requested variance. Although the new
sign is slightly larger and higher than the existing sign, the setback would remain the same. To move
the new sign back to meet the required 7' setback would adversely impact the parking lot and vehicular
access aisle for the shopping center.

I respectfully request a variation hearing before the City Council of The City of McHenry
for the proposed replacement shopping center sign at my property at 810 N. Front St.
The exception I am seeking is for the setback. The ordinance requires a 7' setback. I am
asking for a 3'-6" setback. I am planning on using the foundation of the existing sign for
the new sign. As you know,this shopping center has been in existence in McHenry for
many years. Due to the parking lot configuration,we do not have room for the 7'
setback.

STAFF RECOMMENDATION: To approve the attached ordinance authorizing a Major Adjustment
to the Circulation and Land Use Plan for Centegra Northern Illinois Medical Center.
To authorize Staff to enter into an agreement with Northern Illinois Medical Center and contribute
$750,000, to be drawn from the annexation fund, for the Medical Drive Extension, South Drive
Extension and the Shamrock Lane Connection and in return the City would receive approximately 4.7
acres of right-of-way along Bull Valley Road and Route 31.
Background
NIMC is seeking a Major Adjustment to their previously approved Circulation and Land Use Plan in
order to complete a ring road around the campus and construct vehicular connections to Ridgeview
Drive and Shamrock Lane. The layout of these proposed improvements differs from the layout
indicated on NIMC's Circulation and Land Use Plan,which was approved by the City in 1997.
Per the Zoning Ordinance, a Circulation and Land Use Plan may be modified after its initial approval
by the Council.There are two types of adjustments: Minor Adjustments and Major Adjustments.
• Minor Adjustments are defined as: 1) altering the location of the public streets shown on the
Plan by a distance which is 20 feet outside of the parameters shown on the plan; or 2) Changing
the boundary of the permitted and conditional land use groupings by a distance of less than 50
feet. Minor Adjustment may be made with the approval of the Zoning Administrator.
• Major Adjustments are defined as: any alternation not defined as a Minor Adjustment. Major
Adjustments require the approval of the City Council and may be referred back to the Planning
and Zoning Commission for review and recommendation.
Analysis
Because the location of the roads has moved by more than 20 feet, a Major Adjustment is required.
Although these changes are defined as major, Staff believes they are consistent with the intent of the
original Circulation and Land Use Plan. In addition,they are consistent with the draft Bull Valley Road
Corridor Access Study and would create a `ring road" around the central hospital campus, which is
consistent with the intent of the original NIMC Plan. Also, an access to Ridgeview Drive is proposed,
which follows the original Plan as well.
These improvements will allow hospital traffic and emergency vehicles to have access to a traffic signal
at Bull Valley Road and Ridgeview Drive which will greatly improve safety. The Plan eliminates the
full access point to Bull Valley Road at Lawrence Drive and creates a right-in right-out, as well as
reduces the Medical Center Drive access to Route 31 to a right-in/right-out. A new access to Shamrock
Lane is proposed which will allow hospital traffic and emergency vehicles to have access to a
signalized intersection and more direct access, for emergency vehicles, to the hospital coming from the
South. During the discussions, NIMC also stated that the medical building at the southwest corner of
Bull Valley Road and Route 31, along with the associated access points, would be eliminated in the
future. Overall, Staff supports the proposed changes.
Agreement with NIMC
NIMC requested that the City participate in the cost of the improvements. In return, Staff asked that
NIMC dedicate 4.7 acres of right-of-way and 2.3 acres in additional easements for the future Bull
Valley/Route 31 intersection improvements, as well as the widening of Bull Valley Road and Route 31.
The right-of-way is estimated to be valued at approximately $4 million. NIMC has agreed to dedicate
all of the right-of-way requested; however they want to retain the ownership of the easements and
receive a $750,000 contribution from the City for the road improvements. The cost of the
improvements is estimated at $1.5 million. Staff believes that the right-of-way dedication is crucial to
future area roadway improvements and will also reduce the cost and time associated with property
acquisition when these improvements occur. In addition, the proposed roadway improvements are
important for public safety and will benefit the general population.
Staff recommends that the City Council approve the attached ordinance authorizing a Major
Adjustment to the Circulation and Land Use Plan for Centegra Northern Illinois Medical Center.
Staff is also seeking authorization to enter into an agreement with Northern Illinois Medical Center to
contribute $750,000, to be drawn from the annexation fund, for the Medical Drive Extension, South
Drive Extension and the Shamrock Lane Connection improvements and in return, the City would
receive 4.7 acres of right-of-way for future area roadway improvements.

TO ALLOW A REVISED CIRCULATION AND LAND USE PLAN
FOR CENTEGRA NORTHERN ILLINOIS MEDICAL CENTER
IN THE CITY OF MCHENRY,ILLINOIS
WHEREAS, in 1997, the City Council approved Ordinances 0-97-818 and 0-97-821,
which approved a Circulation and Land Use Plan for Healthbridge Corporation, Northern Illinois
Medical Center,NIMED Corp.; and
WHEREAS, changes to the previously approved Circulation and Land Use Plan have
been proposed and said changes are defined as a Major Adjustment per the Zoning Ordinance
of the City of McHenry; and
WHEREAS, the Zoning Ordinance of the City of McHenry states that Major
Adjustments to a Circulation and Land Use Plan may be approved by the City Council, or they
may be referred back to the Planning and Zoning Commission for review and recommendation;
and
WHEREAS, the Mayor and City Council have considered the proposed Major
Adjustment and finds that the proposed changes are consistent with the intent of the previously
approved Circulation and Land Use Plan and therefore, do not require review and
recommendation by the Planning and Zoning Commission.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF MCHENRY,MCHENRY COUNTY, ILLINOIS,AS FOLLOWS:
SECTION 1: That City of McHenry Ordinance 0-97-818 is hereby amended to delete
that part of Exhibit D referred to as "Circulation Plan" and in its place, the plan attached hereto

SECTION 2: That City of McHenry Ordinance 0-97-821 is hereby amended to delete
that part of Exhibit B referred to as "Circulation Plan" and in its place, the plan attached hereto
and incorporated herein as Exhibit A shall be inserted.
SECTION 3: All Ordinances or parts thereof in conflict with the terms and provisions
hereof are hereby repealed to the extent of such conflict.

STAFF RECOMMENDATION: To approve the requested temporary use permit to allow a sales center
for Town and Country Homes.
Description of Request
Town and Country Homes is the developer of the Oaks at Irish Prairie Subdivision located on the west
side of Barreville Road, east of the Morgan Hills development. The annexation agreement allows Town
and Country to construct a sales center on their property to allow sales of home sites prior to final
engineering approvals.Presently,no roadways have been constructed into their site because they have not
received final approvals from the City. In addition, Veterans Parkway has not yet been extended to the
boundary of the Morgan Hill property so there is no paved access to the Town and Country property.
This temporary use permit would allow them to construct an off-site sales center at the southeast corner of
Veteran's Parkway and Route 31. This is the site where Concord Homes had their sales center trailer for
Morgan Hills. Town and Country would improve the site and locate a new sales trailer surrounded with
paved parking and landscaping. The applicanf has provided a site plan and color photo showing what the
site will look like. The temporary signage shown is permitted per the annexation agreement and approval
of the Community Development Director.
Staff Recommendation
Staff is recommending approval of the Temporary Use Permit to allow the off-site sales center for a
period not to exceed 364 days.

STAFF RECOMMENDATION: To approve the attached Ordinance adopting the revised Chapter VII. Landscaping
and Screening into the Zoning Ordinance.
Background
On January 17,2006 the Community Development Committee recommended that the revised Chapter VII.Landscaping
and Screening proceed to the full City Council for consideration. On February 6,2006,the City Council recommended
that a Public Hearing be held before the Planning and Zoning Commission to discuss the revised chapter of the Zoning
Ordinance. The Public Hearing was held on March 16,2006.
Description of Request
The existing Landscape and Screening chapter in the Zoning Ordinance has done a sub-standard job of requiring
sufficient and well-designed landscape areas. The required screening strips are too small to provide adequate space for
plantings, there is no required landscape around signage and parking lots are dotted with small inefficient landscape
islands. Also,it is very difficult to coordinate the requirements in the Zoning Ordinance with those in the Subdivision
Control Ordinance and with those in the Municipal Code.
The revised chapter removes the redundancy from the various codes and puts all information into the Zoning Ordinance,
with reference to supplemental information in the other Ordinances. The revised chapter also increases the size of
required screening strips, interior landscape islands and on-site landscape. Staff has added new requirements for
landscape around free-standing signs and buildings. The revised items are explained in more detail below.
Screening Strips, The existing code requires a 5-foot screening strip between commercial,office or industrial
to any residential district and between multi-family residential to single-family residential. It also requires a 5-
foot screening strip.between parking lots to adjacent roadways. Staff believes that 5-feet is inadequate to
sufficiently provide well-designed and sustainable landscape material. The revised language requires a 10-foot
strip from multi-family residential to single-family residential and a 15-foot strip from commercial, office or
industrial to any residential district. The increased width will allow a variety of plant materials arranged in
groups to provide a more natural appearance. Hedge rows and solid walls are discouraged.
• Parking Island Strip. The existing code requires a 5-foot wide landscape island every 15 parking stalls in
parking lots containing more than 45 stalls. The revised code requires an 8 x 15 landscape island every 15
stalls in all off-street parking lots. In addition, parking lots containing more than 200 stalls must provide
additional landscape improvements, which include center landscape strips to further break up the expanse of
asphalt.
• Site Landscape. This new section requires landscape improvements surrounding the building pad and overall
site design landscape. Foundation base is the combination of paving and landscape materials to provide a
finished appearance around a building. The paving provides a safe walkway to doorways and the landscape
complements the architecture of the building to enhance aesthetics. Foundation base requirements are based
on the size of the building and access into the building. Also included in site landscape is screening of
mechanical equipment and landscape treatment around detention and natural areas.
• Landscape Plan. The revised code will require a landscape plan by a certified landscape architect containing
certain content. Previously, some landscape items were shown on a site plan and it was difficult for staff to
determine what the actual plant materials were.
• Maintenance of Landscape. The revised code will require a Letter of Credit in order to provide a 2-year
guarantee for all landscape material on site. The property owner will also be responsible for replacing dead
mature trees with larger caliper saplings, depending on the caliper of the tree that was lost. This requirement
should help new landscape material fill into existing areas quicker.
• Planting List. An extensive list of acceptable plant material is included in Exhibit A of the proposed
language,along with a list of unacceptable species.
Staff believes that the proposed revisions will greatly enhance all new sites in the City. The new requirements will not
create a substantial hardship or financial burden on any development but will cause sites to look more natural, retain
more on-site water and reduce heat.
Planning and Zoning Commission Recommendation
The Planning and Zoning Commission unanimously recommended approval of the revised Chapter VII. Landscape and
Screening.

Zoning Code Text Amendment to update Chapter VII. Landscape& Screening
Background
City Staff felt that the landscaping requirements were very minimal and did not require substantial high-
quality landscaping. Staff brought the idea of amending the Landscape and Screening chapter to the
Community Development Committee on August 16, 2005. After several meetings, Staff refined the text
and developed a draft which is presented here for consideration.
Description of Request
The revised landscape and screening section of the Zoning Ordinance focuses on requiring more
landscaping on site and making the requirements clearer and easier to read. There are currently four types
of landscaping and screening required: screening between adjacent uses, screening of headlights in
parking lots,parking lot landscape islands and general screening. Staff believes that the current standards
did not require the applicants to install sufficient screening. Staff updated the current standards and added
foundation base landscaping and sign landscaping. Staff has listed a summary of the changes between the
existing chapter requirements and the revised proposed requirements below:
Residential Screening Strip
The current chapter requires a screening strip between commercial or office and residential property and
high-density residential and low-density residential property. An applicant would need to find Table 16
to verify if this was needed and the size requirement could be found in Table 15. It is required to be 5-
feet wide and 50% opaque. The minimum width of 5-feet did not allow a sufficient area for large tree
plantings and the opacity requirement meant that a wall or solid hedge row was the only thing that would
be acceptable. This did not allow for creative landscape solutions.
The revised residential screening strip requires 10-feet between high-density residential and low-density
residential and 15-feet between commercial or office and residential properties. The new screening must
have planted trees that will provide a continuous canopy, which will actually provide screening between
the uses. It also requires that if a wall is proposed that it undulates and be combined with landscape
materials. The increased width requirement will allow for more flexibility with the design.
Parking Screening Strip
The current requirement is for a solid wall or landscape screen to shield the parking area from an adjacent
roadway and again you have to find the requirements in Tables 14 and 15. It only applies to parking areas
with over 25 spaces, is only 5-feet wide and 50% opaque. These requirements did not allow for creative
landscape solutions.
The revised chapter requires a 10-foot landscaped areas consisting of groups of shrubs, trees and berms.
The parking screening strip would be required for all parking lots containing more than 5 spaces including
vehicle or equipment storage or sales lots. More screening will need to be provided and instead of getting
a solid hedge row the landscape architect will need to combine plants, berms and walls to create an
interesting landscaped area.

Parking Island Stria
The current chapter defines it as a landscape strip in the center of an off-street parking area and is only
required if the parking lot has more than 45 spaces. The landscape island is required to be 100 square feet
and so could be shaped anyway the applicant wanted.
The revised chapter requires an 8 x 15 landscape island placed every 15 parking spaces. Also Staff added
that parking lots with over 200 spaces require additional landscape island strips.
Screen
This is currently required for outdoor storage, open service and refuse areas, electrical and mechanical
equipment and off-street loading spaces.
The revised chapter puts this general screening into site landscaping, which covers foundation base,
mechanical equipment, detention areas, and natural areas. Foundation base is landscape and paved
material that is required around a building to give it a more finished appearance. A table and several
examples have been provided on how that should be accomplished. The revised chapter still requires
screening of mechanical equipment, service areas and around detention ponds.
Sign Landscape
There are no requirements for an applicant to plant landscape under or near their sign.
The new chapter will require 2-square feet of landscape planting for each foot of sign area. This
requirement will make the sign more aesthetically pleasing and allow it to be more incorporated into the
site rather than just a free-standing pillar out near the roadway.
Landscape Plan and Plantings List
The current chapter did not require a landscape plan to be submitted by a Landscape Architect nor did it
specify the acceptable plantings for a site. The only previous planting list was in the Subdivision Control
Ordinance for street trees.
The revised chapter requires a landscape plan by a registered Landscape Architect and specifies the
content required in that plan. Staff has also established a Plantings List, which breaks the materials out by
recommended, acceptable and undesirable.
Staff Analysis
The new code chapter will greatly enhance future sites constructed in McHenry. Staff recommends
adopting the revised Chapter VII. Landscaping and Screening.

VIII. LANDSCAPING & SCREENING
A. PURPOSE
The purpose of the requirements in this section is to provide for landscaping and screening of
parking and other outdoor areas that will: (MC-91-553)
1. protect residential environments from effects of more intensive adjacent uses,
2. protect users of parking areas from excessive wind, glare, and temperature extremes,
3. reduce the adverse effects on public streets and adjacent properties of noise,blowing dust
and debris, and motor vehicle headlight glare,
4. discourage unsafe access to and circulation within off-street parking areas,
5. contribute to improved community appearance and maintenance of property values,
6. promote environmental conservation, and
7. be functional with deciduous trees providing natural shading for windows in the summer
and evergreen trees provided year round screening and protection from the winter wind.
B. TYPES OF LANDSCAPING AND SCREENING REQUIRED
1. RESIDENTIAL SCREENING STRIP
A landscaped strip including trees and shrubs, which may be combined with a solid fence or
wall located along the length of all lot lines (excluding the width of access ways) that abut an
adjacent residentially-zoned parcel on a parcel devoted to a more intensive residential, office,
commercial,or industrial land use, whether or not an off-street parking, loading, or refuse area
is present. If a solid wall is proposed it shall undulate by a minimum of 2-feet forward and
back for each 25-feet in length.

Screening to adjacent residential shall provide a continuous canopy connection at maturity.
For example, if the tree species selected will have a 20-foot canopy at maturity, the trees will
need to be spaced every 20-feet.
*Applies also when yard is adjacent to an improved or unimproved alley
right-of-way that is adjacent to property in these districts.
2. PARKING SCREENING STRIP
A 10-foot landscaped strip which shall consist of densely clustered groups of varying species
and size of shrubs and trees, and berming, which may include a solid wall or fence all which
shall not exceed 4-feet in height at installation or maturity and shall not be less than 3-feet in
height or minimum as determined by Community Development Department to affectively
provide screening except for trees which must maintain a minimum 7-foot trimmed canopy off
the ground as to not obstruct views into and out of the site. This shall be located around the
perimeter of the parking lot to screen vehicles and vehicle headlights from adjacent public
ways. The clustering of the groups of plants shall allow for plowing and snow storage. A
solid row of hedges, one type of plant or solely a solid wall shall not be permitted unless it is
determined by the Community Development Department that this would be the only way to
affectively screen vehicle headlights. The parking screening strip is required for all off-street
parking lots containing more than 5 parking spaces and any vehicle or equipment storage lots
or vehicle or equipment sales lots.
3. PARKING ISLAND STRIP
A landscaped island is an 8 x 15 island in the interior of an off-street parking area to be
provided every 15 parking spaces and at the ends of parking rows. The intent of the parking
islands is to provide shade trees on hot summer days, reduce the effects of the urban heat
island by reducing paved surfaces and visually breaking up the expanse of asphalt.
For parking lots containing more than 200 parking spaces more unique design should be
incorporated. This should include adding a center landscape strip between the parking spaces,

4. SITE LANDSCAPING(Interior site landscape in addition to any screening strips).
a. Foundation Base
Foundation Base is the combination of curbing and landscape materials which help
to break up the base of a building. It also incorporates pedestrian walkways and a
safe waiting area outside the main entry doors. Some examples of how Foundation
Base may be incorporated into a site are included below. Foundation Base is not
required at loading areas.

* For on-site plantings each building shall include a minimum of one (1) shade tree in frontage
areas with a minimum 4" caliper(at maturity) for each thirty (30) l.f. of building frontage. It is
recommended that trees be grouped in clusters. Other landscape materials such as shrubs,
grasses and turf shall make up the remainder of the required area.
Drive-Thru window locations.
Any building or suite which has a drive-thru or drive-up window shall not be required to meet
the above foundation base requirements for that side. Every effort shall be made to meet the
requirements on that side and then taper down to the window location. At the window location a
minimum 6" curbing shall be provided to distinguish the edge of the building from the pavement.

b. Mechanical Equipment
All mechanical equipment on site shall be screened, this includes;heating,
ventilation, air-conditioning, refrigeration equipment,plumbing lines, ductwork,
transformers, satellite dishes, smoke exhaust fans, service entry section and similar
utility panel boxes. A 3-foot clearance shall be provided around all equipment to
allow access and maintenance.
C. Detention Areas
Detention areas shall be designed per the City's Subdivision Control and
Development Ordinance in terms of retaining or detaining water and all engineering
requirements. However, it shall be noted that detention areas should be designed to
appear as natural as possible. Landscaping shall be required around the perimeter of
all retention and detention basins,which shall consist of trees, shrubs and emergent
plantings in a quantity, species and arrangement that will create an aesthetically
pleasing and ecologically functional environment. All landscaping shall conform
with the approved landscape list. Plantings around basins shall be salt tolerant. Such
landscaping shall be in conformance with Best Management Practices as determined
by the City.
d. Natural Areas
Natural areas shall be maintained and protected by all applicable local, state and
federal laws and requirements.
5. STREET PLANTINGS
Street plantings must conform to the Subdivision Control Ordinance Section 6.12 Landscaping
and the Technical Specifications Manual Section I. Parkway Trees.
6. BUSINESS PARK and HEALTH CARE DISTRICT LANDSCAPE
REQUIREMENTS. (MC-91-553; MC-97-672)
a. Curbing in Parking Areas:
All parking island strips and parking perimeters shall be separated on all sides from
the parking surface by concrete curbing.
b. Uses Requiring Landscaping or Screening:
A minimum of five(5)percent of the parking area in Industrial Uses and ten(10)
percent in all other uses shall consist of landscaping. Any landscaped strip required
hereunder may be credited toward this requirement. A screen for off-street loading
shall be a minimum of six(6) feet high.
C. Sizes of Minimum Plant Materials at Planting:
1. Shade Tree: a deciduous tree with a minimum caliper of three (3) inches.
2. Conifer: a coniferous tree with a minimum six (6) foot height.
3. Ornamental: a deciduous tree or large shrub with a minimum caliper of two
(2) inches or minimum height of six(6) feet.
d. Foundation Base:
1. In addition to any before mentioned foundation base requirements for the
building, Health Care Buildings shall provide a minimum 6-foot walk and 7-
foot wide landscape area for safe drop off for patients.

7. SIGN LANDSCAPING
An effective monument sign not only draws the public's attention to the business located at
that site,but also adds to the aesthetic appeal of the site. Monument signs attract a significant
amount of attention so the use of strong landscape design principles,which incorporate a
variety of plant materials and provide visual interest throughout the year, should be used.
A sign landscaping plan drawn to scale must be submitted as part of a sign permit application
for all monument signs.
For every one (1) square foot of gross sign area, there shall be provided a minimum of two (2)
square feet of landscape planting area including both plant material and grasses and shall be
located within 5-feet of the base of the sign.
C.LANDSCAPE PLAN SUBMITTAL REQUIREMENTS
A Landscape Plan shall be filed with an application for:
1. Rezoning
2. Conditional Use Permit
3. Any variance from landscaping or screening requirements
4. Planned Unit Development Preliminary or Final Plan approval
5. Preliminary or Final Plat approval as provided in the Subdivision Control Ordinance
6. And Development as defined in the Subdivision Control Ordinance
7. Building Permit or Certificate of Occupancy
8. Use Variance. (MC-94-614)
9. Free-standing Monument Sign application
The City Council may waive or defer this requirement in any instance in which the specific use of
the premises, and therefore the specific landscaping and screening requirements applicable, are not
yet determined, such as in the case of a rezoning for an industrial subdivision.
1. Content of Landscape Plan
a. The location and dimensions of all existing and proposed structures,parking lots and
drives,roadways and right-of-way, sidewalks,bike paths, ground signs,refuse
disposal areas,bicycle parking areas, fences, freestanding electrical equipment,
utility easements, conservation easements, lighting, tot lots and other recreational
facilities,proposed locations of storm water inlets, valve vaults, hose bibs,manholes,
hydrants, fire department Siamese connections and other structural features as
determined necessary by the Community Development Department;
b. The location, quantity, size,root ball condition and name,both scientific and
common of all proposed plant materials, and existing plant materials to be preserved
as well as boundaries of all planting beds;
C. The location of all proposed berming and drainage swales, indicating contours at one
foot(1') intervals,percent of slope and the location of all proposed drainage features
with natural vegetation including,but not limited to rain gardens and other storm
water detention and infiltration areas;
d. Specification and boundaries of all natural landscaping areas,including prairie,
woodland, and wetland plant communities, identified by specific community type
and by scientific and common names of all species;
e. Elevations and details of all fences,bridges,retaining walls or other decorative
features proposed for location on site shall be included. The details shall include,but
are not limited to materials, colors, styles and sizes;
f. Landscape data box which shall include the required and proposed calculations for
the following:
1. total area in square feet of the lot or tract to be developed;
2. total square feet and percentage of landscape area between the buildings and
any public or private street;
3. total square feet and percentage of the area being landscaped;
4. total number of trees required and provided, their common and scientific
names and their type; evergreen, shade or ornamental;
5. total number of shrubs required and proposed, their common and scientific
name and their type; evergreen or deciduous;
6. total area to be turf;
7. total area to be non-living material;
g. Delineate the different landscape and screening areas, i.e.: parking lot screening
strip,residential screening strip and right-of-way landscaping.
D. TREE PRESERVATION
The City has adopted a Tree Preservation Ordinance, Section 24-40 through 24-50 of the City's
Municipal Code.
The City Council may reduce the number of new trees required in response to preservation by a
developer of any existing trees on the site as follows:

To ensure that existing trees are not damaged during development:
1. Protective physical barriers shall be maintained around such trees that prevent the passage
of heavy machinery under the drip line.
2.No equipment materials, fill, or debris shall be stored under the drip line except as may be
necessary for a reasonable time if no other storage area is available.
E. LANDSCAPE MATERIALS
The City has compiled a list of recommended, acceptable and prohibited landscape.
The Plantings List is included as Exhibit A attached to this Code section.
All on-site required trees must be a minimum of 2" caliper(dbh) or 6' coniferous. All street planting
must conform to the Subdivision Control Ordinance.
Living landscape materials used shall be healthy, hardy and drought-resistant;be
suitable for the climate and environmental influences on the site, such as exposure to sun, wind,
water,heat, automobile exhaust fumes and road salt; be compatible with the slope of the site,
existing vegetation to be preserved and utilities above or below ground level. Where appropriate,
landscape materials shall be protected from damage from pedestrian or vehicular traffic
by tree grates,pavers or other measures. Proposed plant materials shall be compatible with Zone 5
Conditions as defined by the United States Department of Agriculture(USDA)Hardiness Zone
Designations.
All "Parking Island Strips" and"Parking Screening Strips" shall be separated on all sides from the
parking surface by curbing.
F. INSTALLATION PROCEDURES
All living landscaping materials shall be installed in conformance with the most current procedures
established by the American Association of Nurserymen.
G. MAINTENANCE OF LANDSCAPING
The owner, occupant, tenant and the respective agent of each, if any, shall be responsible for the
maintenance,repair and replacement of all landscaping and screening so as to preserve at least the
same quantity and quality as the remainder of the existing material onsite. If a mature tree is lost a
replacement tree of at least 1/"per 1" of caliper lost,but shall not be less than a 4"minimum. For
example, a 20"tree requires a replacement by a 5" caliper tree.
All living and non-living landscaping, including fences, walls, and ornamental lighting, shall be
maintained in a good condition at all times, so as to present a healthy, neat and orderly appearance
and shall be kept free from refuse and debris. Any dead vegetation shall be promptly replaced with
healthy living plantings. The developer shall provide to the City a 2 year guarantee on all landscape
materials in the form of a Letter of Credit.
H. CONDITIONAL USES
Certain conditional uses may be required to provide landscaping or screening that exceeds the
requirements of this section. Special screening requirements for surface mining operations shall be
as provided in the Surface Mining section of this Zoning Ordinance.
I. DEFINITIONS
The City has established some common definitions:
a. Berm: An uncompacted soil raised above the surrounding finished grade with side
slopes no steeper than 4:1.
b. Caliper: The diameter of a tree trunk six inches above the existing grade or proposed
planted grade and in conformance with provisions of the Code of Standards or latest
version published by the American Association of Nurserymen, Inc.
C. Cluster: Plant material installed as a group, as within two feet (2') of each other.
d. Deciduous: Plants which do not retain leaves or needles during the winter season of
the year.
e. Diameter Breast Height: dbh or Diameter at Breast Height is the measurement used
to determine the caliper of the tree. It is measured at 54-inches above the ground.
f. Evergreen: Plants that maintain leaves and needles year round.
g. Foundation Base: An area designated around the building for curbing and landscape
improvements.
h. Landscaping: Any of the following combination thereof,material such as,but not
limited to: grass, ground cover, shrubs, vines,hedges or trees; and non-living durable
material, such as: rocks,pebbles, sand, walls or fences but excluding pavement.
i. Ornamental: Plants that add aesthetically to the site.
j. Turf. Lawns, sod and grass areas designed to be maintained by regular watering,
mowing and raking.

Plantings List
This list is not an exhaustive list of all plant materials that will be allowed in the City. A
registered Landscape Architect may propose additional species to staff as long as they detail
the plants specific properties. This list is broken out into three sections; recommended
species, approved species and undesirable species. The recommended species were selected
to be used in areas along roadways or detention areas because they are salt tolerant and root
friendly. The approved species were selected because they are native plants which grow well
in the Illinois climate and may also be salt tolerant. The undesirable species are listed because
they have problems such as spines, or are an invasive species.

VIII.LANDSCAPING&SCREENING
A.PURPOSE
The purpose of the requirements in this section is to provide for landscaping and screening of
parking and other outdoor areas that will:(MC-91-553)
1.protect residential environments from effects of more intensive adjacent uses
2.protect users of parking areas from excessive wind,glare,and temperature.extremes
3.reduce the adverse effects on public streets and adjacent properties of noise,blowing dust
and debris,and motor vehicle headlight glare
4. discourage unsafe access to and circulation within off-street parking areas
5, contribute to improved community appearance and maintenance of property values.
S TYPES OF LANDSCAPING AND SCREENING REQUIRED
1.RESIDENTIAL SCREENING STRIP (Adjacent to Residentially Zoned ProperW. A
landscaped strip including a solid fence,wall,or landscape screen located along the length of
all lot lines (excluding the width of access ways)that abut an adjacent residentially-zoned
parcel on a parcel devoted to a more intensive residential, office, commercial,or industrial
land use,whether or not an off-street parking,loading, or refuse area is present.
2.PARKING SCREENING STRIP (On Perimeter of Parking Lot).
A landscaped strip which may include a solid fence,wall,or landscape screen and which is
located along the length of front and comer side lot lines (excluding the width of access

4. SCREEN (Around Other Open Uses).
A solid fence,wall,berm,hedge, or landscape screen of sufficient height to conceal a use
from view from the ground floor level on adjoining properties and with a continuous opacity
of 50 percent when viewed horizontally from grade level to the top of the Screen starting no
later than 12 months after installation.

C WHERE LANDSCAPING AND SCREENING ARE REQUIRED
Landscaping or screening shall be required as provided in Tables 14 and 16.
D LANDSCAPE PLAN REQUIRED
For any use required to provide any screening strip or island strip,a Landscape Plan shall be filed
with an application for:
1. Rezoning
2. Conditional Use Permit
3. Any variance from landscaping or screening requirements
4. Planned Unit Development Preliminary or Final Plan approval
5. Preliminary or Final Plat approval as provided in the Subdivision Control Ordinance
6. Building Permit or Certificate of Occupancy.
7. Use Variance. (MC-94-614)
The City Council may waive or defer this requirement in any instance in which the specific use of
the premises,and therefore the specific landscaping and screening requirements applicable,are not
yet determined, such as in the case of a rezoning for an industrial subdivision.
The Landscape Plan shall conform to the requirements of Table 2 in the Filing Procedures section
herein. No Plan shall be required for uses required to provide only a Screen as provided in Table
14. The application shall,however,describe the dimensions,materials,and location of the Screen.
E.TYPES OF LANDSCAPING MATERIALS PERMITTED
Varieties of living landscape materials used shall be healthy, hardy, and drought-resistant; be
suitable for the climate and environmental influences on the site, such as exposure to sun,wind,
water,heat,automobile exhaust fumes,and road salt; and be compatible with the slope of the site,
with existing vegetation to be preserved,and with utilities above or below ground level. Where
appropriate,landscape materials shall be protected from damage from pedestrian or vehicular traffic
by tree grates,pavers,or other measures.
F. GROUND COVER IN LANDSCAPED STRIPS
Grass or other ground cover shall be planted over all landscaped strips including berms,except in
areas planted in flowers, shrubs, or trees, so as to present a finished appearance and reasonably
complete coverage within three months after planting. Non-living landscaping materials such as
sand, stone,rocks,or barks may be substituted for living cover over a maximum of 30 percent of
the landscaped area.

G.INSTALLATION PROCEDURES
All living landscaping materials shall be installed in conformance with the most current procedures
established by the American Association of Nurserymen.
H.BERMING
For optimum screening effectiveness and improved landscape design, Parking Screening Strips
shall be bermed so as to largely conceal parked cars from view of the street except where in the
judgment of the City Council the size,configuration,or existing or proposed topography of the lot
makes this infeasible or unnecessary or where erosion,drainage,or maintenance problems might
result. Berms where installed shall be a minimum of 2 feet high at all points.
I.EXISTING TREES
The City Council may reduce the number of new trees required by Table 15 in response to
voluntary preservation by a developer of any existing trees on the site as follows:

The owner,occupant,tenant,and the respective agent of each,if any,shall be jointly and severally
responsible and liable for the maintenance,repair,and replacement of all landscaping and screening
so as to preserve at least the same quantity and quality as initially approved. (MC-91-553)

maintained in a good condition at all times so as to present a healthy,neat,and orderly appearance
and shall be kept free from refuse and debris. Any dead vegetation shall be promptly replaced with

K.CONDITIONAL USES
Because of their special characteristics, certain Conditional Uses may be required to provide
landscaping or screening that exceeds the requirements of this section. Special screening
requirements for surface mining operations shall be as provided in the Surface Mining section of
this Ordinance.

All Parking Island Strips and Parking Screening Strips shall be separated on all sides from the
parking surface by curbing.
M. ADDITIONAL AND/OR DIFFERENT LANDSCAPING REQUIREMENTS FOR
BUSINESS PARK AND HEALTH CARE DISTRICT. (MC-91-553;MC-97-672)
1. Curbing in Parking Areas:
All parking island strips and parking perimeters shall be separated on all sides from the
parking surface by concrete curbing.
2. Uses Requiring Landscaping or Screening:
A minimum of five(5)percent of the parking area in Industrial Uses andten(10)percentin
all other uses shall consist of landscaping. Any landscaped strip required hereunder maybe
credited toward this requirement.
A screen for off-street loading shall be a minimum of six(6)feet high.
3, Sizes of Minimum Plant Materials at Planting-
(1) Shade Tree: a deciduous tree with a minimum caliper of three(3)inches.
(2) Conifer: a coniferous tree with a minimum six(6)foot height.
(3) Ornamental: a deciduous tree or large shrub with a minimum caliper of two (2)
inches or minimum height of six(6)feet.

The standards are expressed in terms of shade trees required per lineal foot of roadway,
easement, or buffer strip, and include the full width of each. For determining numbers of
conifers and ornamentals applicable to the standard,a conifer at least ten(10)feet in height
shall equal a shade tree,and two(2)ornamentals as specified above shall equal a shade tree.

inventory and locational survey of all existing trees in excess of six(6) inches in

(4) Building Site Plantings: Each building shall include a minimum of one(1)shade tree
in frontage areas for each fifty(50)1.f. of building site frontage. It is recommended
that trees be grouped in clusters.
All exterior on-site utilities, including but not limited to drainage systems, sewers,

Planner Zeller presented the staff report. She noted the Crystal Lake Road Sub-Area Plan before
the Commission this evening is the result of several months of hard work between Staff and
members of the Community Development Committee. Planner Zeller stated this plan is not a
development proposal, but a guide for future possible redevelopment of this area. The primary
area of focus is east of Crystal Lake Road between Lillian Street and Dartmoor Drive.
Planner Zeller noted the majority of the area in question is not incorporated within McHenry and
has begun to change considerably in recent years. The property uses have gradually changed
from residential to commercial/office uses. The commercial/office uses seem compatible with
the traffic and noise associated with Crystal Lake Road.
Planner Zeller stated traffic congestion on Crystal Lake Road is exacerbated by all of the narrow
lots with entry/exit to and from Crystal Lake Road in this area. The numerous driveways cause
traffic to drastically slow down when vehicles enter or leave these drives. One of Staffs main
goals was to provide a means to reduce traffic congestion on this road. The proposed Sub-Area
Plan addresses the reduction of the curb cuts upon redevelopment of property in this area.
Planner Zeller stated Staff proposes that Kelter Street be developed as the main connection into
the redeveloped property to the east of Crystal Lake Road. Kelter Street would tie into a
proposed internal collector street which would parallel Crystal Lake Road. Properties to the west
of the collector street would be commercial/office, while properties east of the collector street
would remain residential.
Planner Zeller reminded the Commission this is not a development proposal. The purpose of this
Crystal Lake Road Sub-Area Plan is to guide the possible redevelopment of this area. Adoption
of this Plan does not change land uses or zoning. It will also not change the status of any City
roadways. Staff finds that this Plan is the most responsible way to plan for the future growth of
the area.
Vice Chairman Buhrman asked all members in the audience who wished to comment or ask
questions regarding this matter to be sworn in at this time. The following addressed the
Commission:
Jerome Buch: Mr. Buch stated he is a long-time resident of McHenry. He stated there is a high
amount of pedestrian and vehicular traffic on Royal Drive. He is afraid if this Plan is approved,
traffic congestion will be increased on Royal Drive.
Marlene Sorenson: Ms. Sorenson stated she used to live on Highway 12 and she had a hard time
selling her home when she decided to move to McHenry. She stated she has great difficulty
exiting her driveway onto Royal Drive. As she lives near the stop sign, she asked if the schools
could re-route the buses, so that they would not be on Royal Drive. She is opposed to more
traffic which would be created on Royal Drive and Front Royal Drive if this Plan is approved.

Mark Nielsen: Mr. Nielsen stated he lives at the intersection of Hanley and Royal Drive. When
Route 120 was being renovated, traffic was flying through the Whispering Oaks neighborhood.
Mr. Nielsen also noted there are many families with young children in the neighborhood. There
are also many older youth who run through the streets. Mr. Nielsen noted if Maryetta Boulevard
is improved to Crystal Lake Road, traffic congestion would be drastically increased in
Whispering Oaks. He expressed concern regarding his property values decreasing if the Plan is
adopted. He also noted there are many accidents at the intersection by his home. He suggested
the City should investigate the traffic which is already speeding through the neighborhood.
Henry Kenyon: Mr. Kenyon stated he has lived in the area for more than fifty years. He opined
adding more commercial development would not increase the quality of life for residents in his
neighborhood. He suggested the City really needs to plan for the future, but must look at the
ramifications of the plan being proposed.
Carmella Dobler: Ms. Dobler stated from Front Royal Drive to Royal Drive there is intense
traffic. She stated she is not able to leave her driveway during school bus route times. The stop
signs in the neighborhood are not obeyed. She inquired if the City had done its homework and
noted that Whispering Oaks is a single-family residential neighborhood, predominantly for first
time home buyers. These families have small children. Residents of Garden Quarter walk on
Front Royal Drive to Jewel. Walkers in the neighborhood will not be safe if this Plan is
implemented. The property values in the area will be decreased. She stressed she wants to keep
her neighborhood nice.
Dottie Thurlwell: Ms. Thurlwell stated she is a resident of Northfox Condominiums. She noted
there were several other residents from this complex in attendance as well. She stated if the City
brings more traffic through on Royal Drive, residents of Northfox will not be able to access
Royal Drive from their complex. She also noted the great number of walkers in the
neighborhood. She stated this used to be a quiet area. However, between buses and cars, the area
is very busy. It is impossible to make a left turn onto Royal Drive from Northfox Lane. Residents
of the area take pride in their homes. Traffic should not be allowed to fly by causing safety
concerns to the residents.
Linda Freund: Ms. Freund stated the City Council has previously stated they were not interested
in opening up Maryetta Boulevard. If the Plan is implemented, it would not be a thoroughfare.
Pioneer Center Home residents use the street for walking and exercise. She inquired if Ponca
Street would be blocked off or remain accessible. Planner Zeller responded it could be tee'd into
the proposed roadway. Ponca Street would not be converted into a thoroughfare.
Steve Bjorkman_Mr_Bjorkman, co-owner of Ace Hardware, stated between his two driveways,
the First Midwest Driveway and the two Post Office driveways, there is much congestion in this
area along Crystal Lake Road. Mr. Bjorkman stated he is willing to work with the City to
improve traffic congestion in any way possible. It is important to rectify this situation.
Andrew Glab: Mr. Glab stated he moved into the community fifteen years ago. He is concerned
with the number of curb cuts on Crystal Lake Road. No one is thinking about the number of curb
cuts on Royal Drive. When the City looks at the Crystal Lake Road Sub-Area, it should realize
the Plan will affect not only the road but the entire area surrounding it. There should be more
research and engineering studying the area as a whole before implementing such a Plan. The

impact of such a Plan on the Whispering Oaks Subdivision will be tremendous. Mr. Glab stated
regarding the Comprehensive Plan should take into consideration the integrations of a residential
neighborhood and to preserve its integrity. The City's Comprehensive Plan does not correlate to
this proposed Crystal Lake Road Sub-Area Plan. Mr. Glab inquired as to the status of the Crystal
Lake Road Corridor Study which was ordered and paid for by Council. The Corridor Study was
done by professionals. Why does the City need to look at this Sub-Area Plan? Why not just
adhere to the results of the Corridor Study?
Alderman Glab stated children can not play in their front yards as their safety is a major concern,
particularly along Royal Drive. The plan to extend Lillian Street across to the First Midwest
entry is a good idea. However, the Sub-Area Plan would promote more traffic in the area. It will
impact everyone in this subdivision, not just those who live along Royal Drive and Front Royal
Drive. The possible access road which would split the long narrow lots on the east side of Crystal
Lake Road might be a good idea. Parts of this Plan are good. However, the Plan should limit
access onto Hanley from Garden Quarter and Whispering Point Center.
Dennis Harms: Mr. Harms, owner of Harms Farm and Garden Center since 1962, addressed the
Commission noting splitting his property in half in order to create the parallel collector road
would not be possible. He stated he uses all of his land for his business. He also noted the high
number of accidents caused when students are entering/leaving the West Campus.
Mike Bartolone: Mr. Bartolone stated he lives next to Harms Farm. On many occasions he has
had vehicles crashing into his yard from West Campus. He also noted he uses Kelter Street as his
driveway. With the proposed Plan there would be another access point at Kelter Street and he
would lose his driveway. Mr. Bartolone noted he has lived in this location for twenty years.
Cutting his property in half is not possible. He stated he does not understand what the City has
planned. How will this Plan benefit him? Mr. Bartolone inquired if and when there would be a
traffic signal at Dartmoor Drive.
Director of Community Development Napolitano reminded the Commission and audience this is
a Plan for the future. The City does not intend to construct any roads at this time. The City is
planning for the future and what would be good for the City if and when this area is redeveloped.
Responding to the second inquiry, Director Napolitano stated the Dartmoor Traffic Signal will be
installed this year.
Dave Boger: Mr. Boger expressed his concern and opposition to the proposed Plan. He stated it
sounds like the City is making a Crystal Lake Road Bypass through Whispering Oaks
Subdivision. He noted there is rush hour traffic beginning at 3 p.m. daily. Residents cannot get
out of their driveways. There is bike traffic due to the bike path. With Fort McHenry nearby,
there is traffic going to and coming from the park. Mr. Boger stated the residents do not want
more traffic in this area. People disobey stop signs and speed through the neighborhood. This
Plan will not help ease traffic congestion but increase vehicular traffic in the subdivision.
As there was no further comment, Vice Chairman Buhrman closed the Public Comment portion
of the hearing at this time.

Cadotte noted in the early 1950's, Whispering Oaks was a senior citizen community. It has since
been converted into a multi-aged community. Traffic congestion has increased considerably. He
opined traffic will get worse before it gets better.
Thacker stated the City has learned ways to ease traffic congestion in residential neighborhoods.
Initially, when Dartmoor Drive was constructed, numerous driveways accessed onto it. In recent
years, as growth and development expanded, curb cuts onto Dartmoor Drive were prohibited. He
stated the Commission can not control the way people drive, nor can it dictate the school bus
routes through the neighborhoods. He reaffirmed this Plan is for the future so that the City is
ready when this area is considered for redevelopment. Thacker also stated he does not see any
way that by approving this Plan traffic will be increased.
Brief discussion occurred regarding when the traffic signal will be installed at Dartmoor Drive
and Crystal Lake Road, its possible cost, and subsidized contributions/donations from developers
for its installation.
There was no further discussion or questions by the Commission.
Motion by Cadotte, seconded by Ekstrom, to recommend to City Council with regard to File No.
Z-669, to amend the Comprehensive Plan by adopting the Crystal Lake Road Sub-Area Plan as
presented.

Comments from Commissioners:
Buhrman: There are too many concerns and unanswered questions at this time. He does
appreciate Staff s work on the Plan,however.
Ekstrom: This is a concept plan for use if the area is redeveloped. Individual site plans would be
reviewed at the time of submittal. This represents an amendment to the Comprehensive Plan, not
a zoning or use change.
Nadeau: The proposed plan looks to the future commercial/office development along Crystal
Lake Road. More research is needed before this matter is sent to Council for consideration.
Schepler: He appreciates Staffs work on the Plan. A new look at the Comprehensive Plan and
how this Sub-Area Plan fits into it is necessary. This Plan needs further review. He objects to the
potential traffic impact on the area.
Thacker: Concurs with Ekstrom and views this Plan as a safeguard for the City's development of
this area in the future. He has concerns regarding commercial development along Crystal Lake
Road prior to the redevelopment of this segment of Crystal Lake Road.

Zoning Text Amendment to Chapter VIII Landscape and Screening
Vice Chairman Buhrman at 8:44 p.m. called to order a Public Hearing regarding File No. Z-668,
an application for a Zoning Text Amendment to Chapter VIII Landscape and Screening
Requirements of the Zoning Ordinance as requested by the City of McHenry.
Vice Chairman Buhrman stated notice of the Public Hearing was published in the Northwest
Herald on February 28, 2006. A Certificate of Publication is on file in the City Clerk's Office.
Planner Zeller presented the staff report. She noted the current Landscape and Screening
requirements are minimal. While working with developers, Staff noticed the difficulties they
experienced in attempting to follow the provisions of this portion of the code. It was also
difficult to coordinate these requirements with the Subdivision Control and Development
Ordinance and Municipal Code.
Planner Zeller noted Staff has worked extensively with the Community Development Committee
to revise and update the landscape and screening requirements of the Zoning Ordinance. The
result for consideration before the Commission this evening provides more clarity and specificity
regarding the City's landscaping and screening requirements. It also provides clear direction for
developers in conjunction with coordination with existing Subdivision Control and Development
Ordinance and Municipal Code requirements.
Nadeau suggested consideration be given to including parkway trees on the approved list which
are resistant to salt. Planner Zeller stated salt-tolerant trees have been included on the list.
Buhrman inquired why the caliper of trees has not been indicated on the new approved tree list.
Thacker complimented Staff on the proposed amendments to the landscape and screening
provisions. He expressed a desire to improve curb appeal.
Schepler opined the amendments would increase aesthetics in the community.
Motion by Cadotte, seconded by Nadeau, to recommend to City Council with regard to File No.
Z-668, a request for Text Amendment to the City's Zoning Ordinance, Chapter VIII Landscape
and Screening, be amended as presented.

AN ORDINANCE AMENDING CHAPTER VII. LANDSCAPING AND
SCREENING IN THE CITY OF MCHENRY,ILLINOIS ZONING ORDIANCE
WHEREAS, a public hearing on said petition was held before the Planning and Zoning Commission on
March 16, 2006, in the manner prescribed by ordinance and statute, and as a result of said hearing,the Planning
and Zoning Commission made a unanimous recommendation of approval; and
WHEREAS, the Mayor and City Council has considered the evidence and recommendation from the
Planning and Zoning Commission and finds that the approval of Chapter VII. Landscaping and Screening
currently requested and approved by this ordinance is in the best interest of the health, safety and general
welfare of the citizens of McHenry.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
MCHENRY,MCHENRY COUNTY,ILLINOIS, AS FOLLOWS:
SECTION 1: That Chapter VII. Landscaping and Screening, of the City of McHenry Zoning
Ordinance is hereby deleted in its entirety and shall be replaced with the attached language incorporated
herein as Exhibit A.
SECTION 2: All Ordinances or parts thereof in conflict with the terms and provisions hereof are
hereby repealed to the extent of such conflict.
SECTION 3: This Ordinance shall be published in pamphlet form by and under the authority of
the corporate authorities of the City of McHenry,McHenry County,Illinois.
SECTION 4: This Ordinance shall be in full force and effect and after its passage, approval and
publication in pamphlet form as provided by law.
