On February 6, 2006, the City Council authorized a contract with CornerStone Material
Recovery, Inc. for demolition of the former Wahl Appliance building located at 1209 Court
Street for $23, 870.
The building has been demolished, and a temporary level gravel parking area was
installed.
Recommendation: To approve the final pay request from CornerStone Material
Recovery, Inc. for $23,870 for demolition of the former Wahl Appliance building
located at 1209 Court Street.

Riverwood Rummage Sale
ATTACHMENT: Letter from Diana Lucas,PTO Chairperson
STAFF RECOMMENDATION: To approve the request.
Background: A letter was received from Diana Lucas, PTO Chairperson at Riverwood
School. The PTO will be hosting a rummage sale on Saturday, May 6*', from 8 a.m. to 3
p.m. in the school's gymnasium, and is requesting permission to install temporary signs at 4
locations in the City (see attached letter for locations). The signs would be removed upon
the conclusion of the event. They are also requesting that the $30 permit fee be waived.
Analysis
Staff has no concerns with this request and would recommend approval. The Council has
granted similar requests in the past. A representative will be in attendance at the meeting to
answer any questions that the Council may have.

at 7:30 P.M. on Monday, April 24, 2006 in the Council Chambers of the Municipal Center.

FISCAL YEAR 2006/2007 ANNUAL BUDGET
City Administrator Maxeiner provided Council with a brief overview and summary of
the proposed Fiscal Year 2006/2007 Budget. He noted the budget reflects maintaining City
services and programs while preserving status quo. City Administrator Maxeiner stated the
Budget includes a few capital projects such as the Riverwalk Phase I. No additional
personnel have been added.
City Administrator Maxeiner reported revenues have increased at the rate of 6.6%.
In conclusion, City Administrator Maxeiner provided highlights from each department's
significant changes from last year's budget.
Finance and Personnel Committee Chairman Alderman Murgatroyd acknowledged
much work went into preparing a balanced budget for Council consideration. He noted
Staff exhibited good fiscal restraint in developing the budget before Council this evening.
Alderman Peterson encouraged review of municipal fees across the board in order
to increase revenue to support City services and programs.
Aldermen Condon and Santi commended City Administrator Maxeiner and Finance
Director Shields for their efforts in creating the 2006/2007 Budget.
Motion by Murgatroyd, seconded by Santi, to accept the recommendation of the
Finance and Personnel. Committee to approve the 2006/2007 Fiscal Year Budget as
presented.

YEAR 2006/2007 ANNUAL LIQUOR LICENSE RENEWALS
Mayor Low stated the owners of all establishments serving and/or selling liquor in
the City have completed application requirements, paid all fees, and have been
fingerprinted as required according to the City's Municipal Code. Mayor Low stated it is her
recommendation to grant liquor license renewals for the 2006/2007 Fiscal Year as follows
subject to receipt of satisfactory fingerprint results:

STAFF RECOMMENDATION:To approve a variance to allow the applicant to relocate the existing
5-foot high wood fence to a distance of 5' from the Overland Trail property line.
Background/Request
A letter was received from Henry Dolecki, who resides at 159 Glenbrook Trail. Mr. Dolecki has a
corner lot and is requesting a variance to relocate an existing 5-foot high, wood fence. The fence is
currently setback 15 feet from the Overland Trail property line and Mr. Dolecki would like to move
the fence to have a 5-foot setback. The reason for moving the fence is to enclose three existing fruit
trees. The applicant has had some problems with kids climbing these trees,picking and throwing the
fruit. Having the trees enclosed by the fence would help to eliminate this problem.
The City's fence regulations state the following:
1) If a comer side yard abuts the comer side yard of an adjoining property, all fencing must be
setback no less than 5 feet from the right-of-way line.
2) If a corner side yard abuts the front yard of an adjoining property, all fencing must be setback
15' from the right-of-way line.
Mr.Dolecki's lot meets the second criteria and therefore,a variance is necessary.
Analysis
Upon review of this request, Staff has no concerns and would recommend approval of the variance.
The applicant has presented some unique circumstances that relate only to his property. Granting a
variance to allow the fence to have a 5-foot setback would address the problems experienced by the
applicant. Due to the shape of the lot, the relocated fence will have no impact on vehicular or
pedestrian sight lines for adjacent property.

1 live at 159 Glenbrook trail which is on a comer lot, in the Trails of Winding
Creek subdivision. I have lived here for the last 12 years. 11 years ago I installed a
fence following the guidelines that were required at that time. Since then, some of the
guidelines have changed. The changed guideline that I am referring to is the "l5 feet
rule" from a comer side lot toward the street side. The guideline was changed to 5
feet instead of 15 feet. I would like to move my fence out towards the street staying 5
feet from the side lot line, but I don't qualify because there are houses with driveways
behind my property.
At this time I would like to request a Variance to the 15 feet rule" I'm
requesting the variance because I would like to fence in the fruit trees that are
currently outside the fence. I want to fence in the trees because I have had issues
with some kids climbing the trees along with picking and throwing the fruit that comes
from the trees. With the trees being inside the backyard it can only help deter the kids
from this action.
I understand the 15 feet rule exists because of a safety issue of sight.
(Neighbors backing out of the their driveways or the public turning the comer as they
drive) I believe safety will not be compromised in my case because of the shape of
my property. It convex outward towards side front corner.
My neighbors who live behind, across the street, and next to me would not
oppose a Variance.
I've attached some pictures, a survey and my neighbor's signatures not
opposing a Variance to help you make your decision. Please feel free to contact me

STAFF RECOMMENDATION: To accept the recommendation of the Planning and Zoning Commission
and approve the attached ordinance approving a building setback variance at 3516 Waukegan Road
Description of Request
The City has been working with property owners along Boone Creek to secure the necessary property to
construct the first phase of the riverwalk. The owner of McHenry Villa,Maureen Annamarie,has generously
agreed to dedicate 15' of her land for this purpose. However, this land conveyance will place the existing
building in a nonconforming situation with regards to the rear yard setback. The 0-1 District requires a 15-
foot rear yard setback. After the conveyance,the building setback would be reduced from 17.5' to 2.5' at the
northwest comer. On the northeast comer,the building setback would be reduced from 20'to 5'. In order to
place the existing building in compliance with Zoning Ordinance setback requirements,the City,on behalf of
the property owner,is requesting approval of a building setback variance for the existing building.
Staff Analysis
No changes to the building or site are proposed. In fact,the proposed variance will have little, if any impact
or change on the character of the area. The variance will merely bring the existing building into
conformance with the Zoning Ordinance,upon conveyance of the 15 feet.

Chairman Howell at 7:34 p.m. called to order the Public Hearing for File No. Z-67169, a request
for variance for building setbacks for the McHenry Villa as requested by the City of McHenry on
behalf of Maureen Annamarie, to allow the dedication of 15 feet along Boone Creek Lagoon to
the City of McHenry to be used for the McHenry Riverwalk.
Chairman Howell stated notice of the Public Hearing appeared in the Northwest Herald on
March 31, 2006. A Certificate of Publication is on file in the City Clerk's Office. Certified
notices were mailed to all abutting property owners. Receipt of mailing and an affidavit of
posting property are on file in the Clerk's Office.
Planner Zeller presented the staff report. She explained the need for the variance was due to the
fact the City needed 15 feet of land adjacent to Boone Creek Lagoon to facilitate construction of
the Riverwalk on the south side. The reduction of 15 feet along the McHenry Villa property
creates a setback which is less than that required by the Zoning Ordinance. The City on behalf of
McHenry Villa is requesting a variance so that the dedication of the 15 feet does not result in a
non-conformity for the Villa.
Some discussion occurred regarding liability issues regarding skateboarders, bikes and roller
bladders running into McHenry Villa walls. Question was raised regarding similar variances
being required in other properties adjacent to the Riverwalk.
General discussion also followed regarding potential Riverwalk plans and potential use of the
former Medical Arts Building property.
There was no further discussion or questions by the Commission. There was no Public Comment
regarding the application.

A REDUCTION IN THE REAR YARD BUILDING SETBACK
AT 3516 WAUKEGAN ROAD
IN THE CITY OF MCHENRY,MCHENRY COUNTY,ILLINOIS
WHEREAS, a petition has been filed by the City on behalf of property owner Maureen Annamarie
requesting a Building Setback Variance to allow a reduction in the rear building setback for the existing
building at 3516 Waukegan Road, which property is legally described on "Exhibit A", attached hereto and
incorporated herein;the"SUBJECT PROPERTY", and
WHEREAS, a public hearing on said petition was held before the Planning and Zoning Commission
on April 20, 2006, in the manner prescribed by ordinance and statute; and
WHEREAS, as a result of said hearing, the Planning and Zoning Commission unanimously
recommended approval of the requested Variance by a 5-1 vote; and
WHEREAS, the City Council has considered the evidence and recommendations from the Planning
and Zoning Commission and finds that the approval of the requested Variance is consistent with the
objectives of the City of McHenry Zoning Ordinance to protect the public health, safety, morals and general
welfare of its residents.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF

SECTION 1: That the SUBJECT PROPERTY be granted a Building Setback Variance to allow a

SECTION 2: In granting said Variance, the City Council finds that requirements of Table 32 of the

STAFF RECOMMENDATION:To approve the requested temporary use permit.
Background/Request
Meijer Fresh Store,2253 N.Richmond Road, is requesting a temporary use permit to allow an evening
concert by country music recording artist Craig Morgan, and another as of yet unnamed artist. This
event will be sponsored by Crisco and the Country Music Association, which have held hundreds of
similar concerts throughout the country. The event would take place in the Meijer parking lot on
Thursday, May 18, 2006. Two other concerts are proposed at Meijer stores in Rolling Meadows and
St. Charles.
Set up for the event would start at 8:30 a.m. in a 150' x 175' (approximate)area of the parking lot, see
attached site plan. Approximately 80 parking spaces would be used during the event. There would be
1-2 tour busses, a temporary stage, and three, 10' x 10' tents to house sponsors' activities. Activities
would include giveaways, karaoke, and children's games. The applicant is currently talking to
WUSN (US99) about doing a live remote from the site. The area would be open to the public at 5:00
p.m. The concert would run from 7:00 p.m. to 8:30 p.m. After the performance, the artist will sign
copies of his CD inside the store. Expected attendance is around 500 to 1000 persons. Security would
be provided by Meijer.
Analysis
Meijer and other stores in the City have held outdoor events in their parking lots. Last year, Meijer
had a NASCAR simulator in their parking lot,where persons were able to simulate driving a race car.
The proposed concert is a larger event, but Staff believes the site can accommodate the expected
crowds. Meijer has 882 parking spaces and with the loss of 80 for the event, there will still be 800
parking spaces available. The event would occur on a Thursday in the evening, which should have a
lesser impact on the site than if the event were held on a weekend. There are three points of
ingress/egress to the site,two of which are signalized, so access to and from the site should not pose a
significant problem. To ensure that access through drive aisles will be maintained, Staff has requested
and the applicant has agreed to place temporary"No Parking" signs along the drive aisles.

Staff is seeking authorization to enter into a contract with American Demolition for the demolition of the
Medical Arts Building for $110,000. A total of 7 contractors bid the project. The three low bids are
listed below:

The Council may recall that when the asbestos abatement contract was awarded, a budget amendment for
$485,000 was approved to cover the remaining expenses associated with preparing the site for

The lowest responsible bidder is American Demolition; therefore, Staff recommends awarding the bid to
American Demolition in the amount of $110,000. Staffs original estimate for the demolition was

STAFF RECOMMENDATION:To authorize Staff to issue the attached Request for Qualifications.
The next step in preparing the Medical Arts site for redevelopment is to issue a request for
qualifications (RFQ). The purpose of the RFQ is to assist the City in compiling a short list of four to
six qualified candidates from which the City can select to partner with in the redevelopment of the
property. After the RFQ process is complete,a request for proposal(RFP)will be sent to those four to
six developers. The Council will recall that this is the same process being used to solicit contractors
for the Riverwalk Phase I project. Once such a list is developed,the selected candidates will be asked
to submit specific development proposals for consideration. The RFQ will narrow the list down to
those developers that have the vision,experience and financial capabilities to complete the project on-
time and within the City's development guidelines.
Staff has prepared the attached RFQ and is seeking authorization from the City Council to make it
available to interested developers and other parties. The RFQ will be made available to the public on
Wednesday,May 3`d and interested parties will have until Friday,June 3,2006 to respond. In addition,
Staff has received numerous requests from developers to have the RFQ sent to them. Upon receipt of
the RFQs,a review committee will analyze the submittals and narrow the list of prospective
developers to approximately five. At that time,the RFP will be sent to those five to submit a detailed
development proposal which is financially realistic,marketable and consistent with the vision of the
City. Staff will bring forth a request to the City Council to authorize the issuance of an RFP prior to it
being distributed. Upon receipt of the request for proposals,the review committee will narrow the list
of proposals down to two. At that time,the two finalists will be brought to the City Council for
consideration.
Staff is recommending that a review committee consisting of the following members be established:
Mayor Low, Doug Maxeiner, Joe Napolitano, Kit Carstens (Riverwalk Foundation President) and
Anne Rodenkirch. Anne Rodenkirch was a member of the Downtown Plan Technical Advisory
Committee and currently is employed by Prime Commercial Corporation. Staff believes that this
group is appropriate and diverse in background and will provide a solid recommendation to the City
Council.

Introduction
The City of McHenry ("City") is seeking the services of a qualified developer to partner in the
redevelopment of property located at the northeast corner of Green Street and Waukegan Road,
commonly known as 1110 N. Green Street (the "Redevelopment Site,"see Exhibit A). Pur-
chased by the City in December of 2005, this prime site contains nearly 48,000 square feet with
frontage on Boone Lagoon, along the path of the City's future Riverwalk. The Redevelopment
Site is also within an existing Tax Increment Financing (TIF) District.
A high-quality, mixed-use development is envisioned for the Redevelopment Site, with first
floor retail/restaurant uses, and upper level office or residential units. The development com-
munity is invited to respond to this opportunity by submitting a creative, market-based develop-
ment proposal that meets the objectives of the City and serve as a catalyst for future develop-
ment and redevelopment in the downtown.
With the preparation of this Request for Qualifications (RFQ) the Mayor and City Council
have reaffirmed their commitment to redevelopment of the downtown and the realization of the
long-awaited McHenry Riverwalk. This commitment started several years ago when City lead-
ers realized that it's waterfront and downtown areas could be valuable assets, both economi-
cally and aesthetically. To capitalize on these assets, several steps were taken. In December of
2000, the City adopted a Master Plan for a 0.8 mile long riverwalk along the shores of the Fox
River and Boone Lagoon. This Master Plan laid the groundwork for the future design and loca-
tion of the riverwalk (see Exhibit A). In April of 2002, a TIF District was created to provide
financial assistance to downtown property owners seeking to improve their property. The TIF
District encompasses a portion of the downtown, from Third Street, east to the Fox River (see
Exhibit A). A Downtown Master Plan was adopted in December of 2003 and is the City's offi-
cial policy guide for physical improvement and development in Downtown McHenry. And
finally, a Downtown Overlay District, with specific design guidelines for new development and
redevelopment was established in early 2005. Its boundaries are the same as the TIF District.
In order to "jump start" redevelopment activity in the downtown, the City Council endorsed a
Downtown Redevelopment Business Plan in September of 2005. The Business Plan outlined a
strategy for the City to: 1)take a more active role in attracting redevelopment projects through
land acquisition and partnerships with developers; and 2) construct a short segment of the
planned McHenry Riverwalk. This strategy is currently playing out with the purchase of the
subject property,preparation of this RFQ and the commitment by the Mayor and City Council
to construct the first phase of the riverwalk, from Green Street to Riverside Drive, in spring of
2006.

Despite this growth, McHenry has been able to retain its small town character. Veterans Park,
in McHenry's downtown, continues to draw in crowds during the summer band concerts,
farmer's market, and various special events. Petersen Park, McHenry's community park site,
hosts several festivals during the year, including the annual Fiesta Days celebration. The Soap
Box Derby, Watercross Snowmobile Event, Miss McHenry Pageant, and Tractor Show have
become annual events attracting persons from throughout the county, state and nation.

Site Facts
The Redevelopment Site is located at the northeast corner of Green Street and Waukegan Road,
adjacent to Boone Lagoon. An aerial view of the Site is found in Exhibit C. The property con-
sists of 47,916 square feet; however, the City will retain a 15-foot wide corridor across the
north side of the property, adjacent to Boone Lagoon for the Riverwalk. The current zoning is
0-1 Local Office District. Parallel parking is available on Green Street across the property
frontage.
There is currently a 33,000 square foot,two-story medical building and paved parking area on
the site. The City will be clearing the structure and parking lot and will offer a clean site for
development. A topographic survey will be prepared by the City after the removal of all struc-
tures and re-grading of the site.
A Phase 1 Environmental Site Assessment has been conducted on the property. The Assessment
found no evidence of recognized environmental conditions in connection with the Site and con-
cluded that further environmental study is unnecessary. Soil borings were taken at eight(8) lo-
cations on the property and revealed no unusual conditions. The soils report includes criteria
for use by the design engineers and architects in preparing the foundation, site, and pavement
designs. Interested parties are welcome to review a copy of the Phase 1 Assessment and the
soils report,which are available by contacting the City.
Information in this RFQ is considered reliable but is not guaranteed. The developer is responsi-
ble for making its own analysis and decisions regarding the conditions of the Redevelopment
Site. The City will not reimburse the developer for any surveys, title insurance or investigations
of the site.

Neighborhood Context
McHenry has three distinct downtown areas: 1) Riverside Drive; 2) Main Street; and 3) Green
Street. Each has different characteristics and serves different functions in the community. The
Redevelopment Site is located at the south end of the Green Street downtown area. Green
Street is a heavily traveled north-south road in the City, with average daily traffic volumes of
9,700 vehicles, and is considered a traditional downtown street with various retail, service, of-
fice, banking and restaurant uses. Buildings along the street date from the late 1800's up to the
1970's. Angled parking is available in front of buildings on both sides of the street north of
Boone Lagoon. There are two municipal parking lots in the area, one owned by the City behind
buildings on the east side of Green Street by Court Street, and the other leased by the City be-
hind the Green Street Market building. The City owns two park sites along the east side of
Green Street, Walsh Park, which is just north of Boone Lagoon, and Neumann Park, which is
just south of the Some Other Nuts building. In the late 1990's, the City invested in new side-
walks, brick work and landscaping along Green Street.
The character of the area near the Redevelopment Site is mixed. Adjacent to the site, along
Waukegan Road on the east is the McHenry Villa, a 114-unit assisted living facility. Further
east on Waukegan Road is the Riverwalk Place Townhome development. When completed,
Riverwalk Place will contain 20 luxury townhomes, each with a two-car garage and a boat slip.
Riverwalk Place was the first project developed in the TIF District.
On the south side of Waukegan Road is McHenry High School East Campus, single-family
homes and an electrical contractor's business. At the east end of Waukegan Road,there are two
marinas, one of which is owned by the City, and the City's Central Wastewater Treatment
Plant, which is in the process of being abandoned in approximately five (5)years.
To the west of the Redevelopment Site, along Waukegan Road is a parking lot for the former
City Hall building, now utilized as a multi-tenant office. West of the parking lot is Landmark
School, currently a year-round elementary school, a 6-unit apartment building and single fam-
ily-homes. Along the south side of Waukegan are older homes, some of which have been con-
verted to two-flats.
As previously noted, Green Street contains a diversity of uses. The McHenry Downtown Thea-
tre is located north of the Redevelopment Site on the east side of Green Street. Other uses on
the east side of the street are a diner,used merchandise store, sporting goods store, clock store,
various specialty boutiques, a tavern, a party goods store and a Chinese Restaurant. The west
side of Green Street includes: a bank, a family restaurant, a Thai restaurant, a quilt shop, a dry
cleaners, a Bistro, the Chamber of Commerce offices and various specialty stores.

Procedure for Submitting Qualifications
Contents
In order to facilitate review and evaluation by the City, responding developers are requested to
structure their response in conformance with the outline presented below. Any additional infor-
mation that responding developers wish to submit may be attached to their responses in the
form of appendices. Responses should be complete but concise as possible. Responses to the
RFQ shall include the following:
1) Development Team Identification. Identification and general description of the develop-
ment entity, including identification of the head of the development team with which the
City will negotiate agreements for implementation of the proposed project and identification
of the licensed architect and builder/contractor that will be responsible for the design and
construction, respectively. List the roles and responsibilities of the developer and/or indi-
viduals who will be directly involved in the development team to be utilized on the project,
including any legal counsel, engineering consultants, etc., to the extent these are known.
2) Development Experience. The development team's previous relevant project experience
including photographs and brief project descriptions (dates, locations, development con-
cepts, land uses, sizes, construction costs, roles of development entities and market accep-
tance as shown by absorption rates, etc.). Include projects receiving public financial assis-
tance. Provide appropriate governmental references (names, addresses, and telephone num-
bers). Include status of projects currently in planning or under construction.
3) Project Financing/Management Experience/Financial Capability. The development entity's
previous experience in financing, construction and managing projects similar to that pro-
posed. Include sources of construction and permanent financing and identify appropriate
references (names, addresses, telephone numbers); and evidence that the responding devel-
opment entity has the financial capability to complete the proposed development project.
The City shall treat all financial information as confidential to the extent allowed by law.
4) Organization/Management Approach. The development entity's proposed organizational
and management approach for development and marketing of the project, including a de-
scription of the roles and responsibilities of each development partner or major participant
in the development process.
5) Key Project Participants. Identification and description of key project participants. For
each organization comprising the development team, identify size of staff and length of op-
eration as a company. Identify key individuals likely to be involved and their respective
roles and responsibilities. Include key characteristics of their backgrounds and experiences
which qualify them for participating in the proposed development.
6) Consultant Qualifications. Identification and description of qualifications and experiences
of key planning, design and other consultants expected to participate as members of the de-
velopment team(if any), with special emphasis on planning, architecture and urban design.
Response should provide examples of previous relevant experience, descriptions of compa-
rable projects and particular roles and responsibilities of the identified participants in the
project(if in-house staff,provide similar detail).

7) References. Developer references, other than financial references, from key individu-
als and governmental officials with whom the responding development entity has
worked in similar situations (names, addresses, and telephone numbers).
The City reserves the right to request additional information which might be deemed nec-
essary after RFQ's have been received and opened. The City reserves the right to request
interviews with developers that have submitted a RFQ.

Evaluation Criteria
A selection committee will be established to serve as the Evaluation Team. The Evaluation
Team will review all qualifications. Some or all of the developers may be requested to present
their qualifications to the Evaluation Team. The Evaluation Team shall compile a"short list" of
no less than four finalists who will be asked to submit Request for Proposals.
The criteria used to evaluate submitted qualifications includes, but will not be limited to, the fol-
lowing listed items:
• Understanding of the Project
- The ability to understand and implement the City's goals and vision for the site.
• Qualifications and Past Experience of the Development Team.
- The successful planning and completion of development projects of a similar type and
scale, on-time and within budget.
- The backgrounds and experiences of the development team.
• Financial Capacity
- Availability of sufficient financial resources to complete project in a timely manner.
• References
- Reputation in regard to character, integrity, skills,judgment and competence.
- Public acceptance of previous developments, in terms of design, timing of work and
functional relationships.
The City is under no obligation to proceed with this project and reserves the right to reject any
and all qualifications, waive defects in qualifications, enter negotiations with any developer, and
to re-solicit for qualifications. The City will not be responsible for any costs or fees associated
with the preparation of a response to this RFQ.
