Black, City Administrator FOR: December 19, 2011 City Council Meeting RE: Amendment to Municipal Code Chapter 4, Alcoholic Beverages Background. The Mayor received a request from Bernice Zubrzycki, owner of CEC Events & Catering, Inc. d/b/a Route 31 Banquets and Conference Center for permission to offer alcohol off site in conjunction with her catering business. The City of McHenry liquor ordinance does not offer a classification for catering with alcohol service off site. The State of Illinois authorizes this type of license conditioned upon prior approval from the local municipal authority. Route 31 Banquets and Conference Center is located at 217 North Route 31 . In addition to catering, the business offers a special occasion facility with food service for business conferences, weddings, receptions, and special events open to the public. Ms. Zubrzycki holds a Class A liquor license that permits her to sell alcoholic beverages at retail only on-premises. Analysis. Ms. Zubrzycki wants to include liquor service as part of her catering business to be competitive with other caterers in the area. Her newly remodeled banquet facility is successful and she is receiving many requests for catering with alcohol service. Attached is an ordinance amending Municipal Code Chapter 4, Sections 4-1 Definitions, and Section 4-(6), License Classifications, for the creation of an A(2) liquor license. The proposed classification shall be issued only to a business that holds a City of McHenry Class A, Class G 1, or Class H liquor license. The annual fee for a Class A license is $1 ,400, Class G 1 and Class H is $700. Staff proposes an additional annual fee of $250 to include the service of alcoholic beverages by the drink for consumption as an incidental part of catering food service off site of the licensed premises. Woodstock, Cary, and Huntley offer a liquor classification similar to what is being proposed by staff. City Attorney McArdle has reviewed the proposed amendments and the Mayor concurs with staff's recommendation. Recommendation. To approve the attached ordinance as presented. ORDINANCE NO. AN ORDINANCE AMENDING CHAPTER 4 OF THE MUNICIPAL CODE, CITY OF McHENRY, ILLINOIS, REGARDING LIQUOR LICENSE CLASSIFICATIONS WHEREAS, the City Council of the City of McHenry, Illinois, has established license classifications and fees for persons and premises that sell alcoholic beverages at retail and has, from time to time, amended these license classifications and fees. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL of the CITY OF MCHENRY, McHenry County, Illinois as follows: SECTION 1 : Section 4-1 Definitions shall be amended to include CATERER RETAILER. A person who serves alcoholic liquor for consumption off site of the licensed premises, as an incidental part of food service, sold at a package price as agreed upon under contract. SECTION 2: Section 4-6, License classification and fees; limitation on number of licenses, of the Municipal Code, City of McHenry, Illinois, shall be amended to include the following liquor classifications: Class A(2) license shall be issued only to a business that is a caterer-retailer and who presently holds a Class A, Class G 1 , or Class H liquor license issued by the City of McHenry. The Class A(2) license authorizes the sale and delivery of alcoholic beverages by the drink for consumption as an incidental part of food service off site of the licensed premises. The annual fee for a Class A(2) license shall be Two Hundred, Fifty Dollars ($250.00). SECTION 3: If any section, paragraph, subdivision, clause, sentence, or provision of this ordinance shall be adjudge by any court of competent jurisdiction to be invalid, such judgment shall not affect, impair, invalidate or nullify the remainder thereof, which remainder shall remain and continue in full force and effect. SECTION 4: All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict. SECTION 5: This ordinance shall be in full force and effect upon its passage, approval, and publication in pamphlet form (which publication is hereby authorized) as provided by the law. The applicant, Sedky A. Samaan, is purchasing Shamrock Convenient Food & Liquor located at 4105 W. Shamrock Lane. Mr. Samaan will also manage the business. He has met with the Mayor, fingerprinted by McHenry Police, and is conversant with the State of Illinois liquor control regulations. The $250 transfer fee has been paid and all paperwork has been submitted. Recommendation. Sunrise Grocery & Liquor located at 3020 West Route 120 closed for business after a fire rendered the building uninhabitable last fall. The owners are demolishing the structure and do not intent to rebuild. Consequently, the F2-5 liquor license issued for the business is no longer valid. Analysis. Attached is an ordinance reducing the number of Class F2 liquor licenses in the City of McHenry from nine to eight. Recommendation: To approve the attached ordinance. ORDINANCE NO.MC-11- AN ORDINANCE AMENDING MUNICIPAL CODE CHAPTER 4: DECREASING THE NUMBER OF CLASS F2 LICENSES [Sunrise Grocery] WHEREAS, the City of McHenry, McHenry County, Illinois, is a home rule municipality as contemplated under Article VII, Section 6, of the Constitution of the State of Illinois, and the passage of this Ordinance constitutes an exercise of the City's home rule powers and functions as granted in the Constitution of the State of Illinois. ATT: Bid Document Background. The City Newsletter is printed and mailed in March and June and posted on the city website in September and December. Approximately 15,000 copies are printed and mailed in March and June. The Parks and Recreation brochure are mailed only to participants who were enrolled in programs over the past two years. Analysis. Anticipated cost of printing the documents is $14,100, based on the city's current contract with John S. Swift Company. Quotes for the repairs were solicited from three contractors: Charles Copley Roofing, Inc $6,500 Superior Roofing, Inc. $7,239 ARW Roofing, Inc $7,629 The base quotes range from $6,500 to $7,629 with each contractor quoting additional time and material for unforeseen conditions such as replacement of plywood, fascia boards, or rotted wood. IDOT RESOLUTION AUTHORIZING IMPROVEMENT BY MUNICIPALITY UNDER THE ILLINOIS HIGHWAY CODE; 2. PRELIMINARY ENGINEERING SERVICES AGREEMENT WITH HR GREEN FOR PHASE I OF THE PROJECT IN AN AMOUNT NOT-TO-EXCEED$50 000 In attendance was City Engineer Chad Pieper of HR Green. Director of Public Works Schmitt stated Council on January 18, 2010 authorized Staff to seek federal funding for Crystal Lake Road improvements through the Surface Transportation Program (STP) as distributed by the McHenry County Council of Mayors. The Council of Mayors awarded $1,500,000 in STP funds to the City of McHenry for the project. The STP funds will pay for approximately 80% of the project construction cost and Phase III engineering. The City is responsible for 100%of the cost of Phase I and II engineering. Director Schmitt noted Staff is seeking approval of an IDOT resolution authorizing the improvements and approval of an Engineering Services Agreement with HR Green for Phase I Engineering in the amount not-to-exceed $50,000. Alderman Wimmer inquired if the project would be comprised of solely grinding and surface overlay. Director Schmitt responded there could also be spot patching in specific Regular Meeting Page 5 December 5,2011 locations where required. In response to Alderman Wimmer's further inquiry, Mr. Pieper stated the cost for Phase II engineering would be comparable to that of Phase I. Alderman Peterson inquired if the lane configuration would remain substantially the same as it is currently laid out. Mr. Pieper responded the lane configuration would remain basically the same with the exception of modifications required due to drainage issues. He noted STP funding regulations must be followed. Consequently, the project procedures would include investigation of traffic counts, traffic signal lights and timing potential drainage issues, and roadway striping. . Alderman Condon inquired when the project would be implemented. Mr. Pieper responded the project is targeted for 2013. Alderman Santi requested Council be provided with breakout numbers regarding man- hour costs and estimated number of hours proposed for tasks contained within the engineering services agreement. Some discussion followed regarding the proposed cost of the project and the amount included in the proposed engineering services agreement. Director Schmitt noted IDOT specifies the amounts which can be charged for Phase I engineering for such a project. The engineering cost limits are specified in the IDOT resolution before Council for consideration this evening. Responding to further inquiry, Director Schmitt noted the Phase I engineering for the project is included in the 2011-2012 Capital Improvement Project Plan. Alderman Glab noted IDOT's limit for Phase I engineering for the project is 156% over the engineer's estimate of probable cost. Mr. Pieper responded that was correct. IDOT dictates the amount of profit allowed for such a project. Alderman Glab inquired why the City did not go out for bid for the engineering for the project. Director Schmitt responded by State law the City is not required to go out for bid for engineering services. Typically, municipal engineers provide engineering services for these types of projects. He further noted HR Green is the City's engineer appointed annually to fulfill these responsibilities. Alderman Glab continued, noting when Council appoints the engineer each year they should not have to accept whatever engineering costs are suggested by the engineering firm. He opined it is difficult to discern if the firm will provide the best quality of service for the cost of the engineering services agreement. Director Schmitt responded the City's engineer is only as good as the faith you have in them and their work. The reason HR Green is reappointed annually is because Staff has faith in the work they provide to the City. City Administrator Black noted if the City sought other providers of the engineering services for each product, it would seek Requests for Proposal for each product. The RFP's would merely ensure quality service and not ascertain the price/cost of said service in a specific Regular Meeting Page 6 • December 5,2011 agreement/contract. City Administrator Black further explained that it is typical of communities the size of McHenry to have an engineering firm annually appointed. Alderman Glab stated by utilizing the City's engineering firm for all projects it removes the element of competitiveness. Alderman Schaefer inquired as to the scope of the project. Mr. Pieper responded Crystal Lake Road improvements would occur between Route 120 and Bull Valley Road. Alderman Santi inquired if state approval would be required regarding the traffic signal timing, types of lights used, etc. Mr. Pieper responded in the negative. Alderman Santi requested Staff provide Council with breakdown of proposed man-hours for the agreement. Alderman Condon inquired if curb and gutter would be added to those areas which currently are not improved with them. Mr. Pieper responded curb and gutter would not be added unless required due to drainage issues. Motion by Schaefer, seconded by Condon, to accept Staff's recommendation regarding the Crystal Lake Road Improvement Project to: 1. Approve MOT resolution authorizing improvement by municipality under the Illinois highway code; 2. In conjunction with the St. Patrick's Day Volunteer Parade activities, the McHenry Rotary Club is requesting permission to once again host a 5K Shamrock Shuffle run on March 11 t' 2012 at 8:00 AM prior to the parade. Rotary has teamed with the Run Your Life running club to organize the event, which also assisted with initiating the annual Elementary Education Foundation Run in Park Ridge Estates and Trails of Winding Creek. All pre-raice preparations will take place in the area of East Campus High School. Runners will begin by running west on Waukegan Road, turning south on Green Street, and east on John Street. Once on John Street runners will wind their way through the Country Club Estates neighborhood and culminate at the finish line located in the bus lane of East Campus High School. A map of the course is attached. Analysis The event would require the temporary closure of a portion of Waukegan Road near East Campus High School when the race begins for no longer and a portion of Green Street between Waukegan Road and John Street for no longer than 15 minutes. Staff met with Police Department staff to analyze the course. Due to the brevity of the street closure, the department is recommending the use of two duty officers assigned to the neighborhood to provide traffic control when necessary. No other city services would be required. Last year, the event was held with no incidents reported or unnecessary burden placed on police services. Recommendation. To allow the McHenry Rotary Club permission to utilize city streets for a 5K run on March 11, 2012, from 8:00 AM to 9:30AM and the closure of Waukegan Road from the East Campus entry to Green Street and Green Street from Waukegan to John Street from 8:00 AM to 8:15AM on the above mentioned date. It was such a success,the McHenry Afternoon Rotary Club has asked us to repeat it every year! We are requesting the same route suggested by Bill Hobson, starting and ending at East Campus High School with the same locations at the comers of Green and Waukegan and Green and John in need of Police presence. We also agree with all recommendations of Bill Hobson in making this a very successful event. The date and times we are requesting are: Sunday,March 11,2012 Shuffle Start Time: 8am(daylight savings time). Our participants should be around and past the corners of Green Street by 8:15 at the latest. We will have our course marshals fielding the course back in the Country Club neighborhood as well as our Shamrock signs. Homeowners residing at 3324 W Golf View Road are seeking a 15-foot front yard building setback variance-to construct a 405 square foot addition to their existing garage. The required front yard building setback is 30' in accordance with the plat of subdivision for McHenry Golf Course subdivision and the subject property is zoned RS-4, High-Density Single-Family Residential District. Properties in the RS-4 district are required to maintain a minimum 25-foot front yard building setback however, when McHenry Golf Course subdivision was platted, a setback of 30 feet was established. Analysis. The subject property is located at the northwest corner of W Golf View Road and Golf View Terrace and the rear and side yard to the south are adjacent to the golf course. The property owner is seeking a 15' X 27' garage addition east towards W Golf View Road. A fifteen-foot front yard building setback variance would be required to build the addition as proposed. Physical constraints of the property due to roadway curvature and topography significantly impair the applicant. Maintaining a 30-foot setback would not allow expansion to the existing garage. An expansion of the garage to the north or west would inhibit the size of the addition due to the drop-off in grade from east to west. The proposed addition will enhance the site and allow the applicant to store personal property currently stored offsite indoors, and will not adversely impact adjacent properties. It will not create a vision clearance problem for vehicular traffic. . Recommendation. The Planning and Zoning Commission unanimously recommended approval of a 15-foot front yard building setback variance to allow the construction of a garage addition as presented. Public Hearing:Wm Tonyan and Sons File No.Z-778 3324 Golfview Avenue Minor Variance Chairman Schepler called the Public Hearing to order at 8:16 p.m. regarding File No Z-778 an application for minor variance to allow a garage addition for the property located at 3324 Golfview Avenue as submitted by Wm Tonyan and Sons for property owners David and Ruth Granger. Chairman Schepler stated Notice of the Public Hearing was published in the Northwest Herald on November 18, 2011. Notices were provided to all abutting property owners of record as required by ordinance. A Certificate of Publication and Affidavit of Compliance with notice requirements are on file in the City Clerk's Office. In attendance were Contractors Chuck and Donald Tonyan, and home owner David Granger, who were sworn in by Chairman Schepler. Mr. Chuck Tonyan explained the Grangers would like to construct an addition to their existing attached garage. The expansion would encroach on the required 30' front yard setback by 15 feet. Consequently, there is a request for a minor variance to allow a 15'front yard setback. Deputy City Administrator Martin provided the Commission with the Staff Report regarding this matter. He noted the homeowner would like to expand the existing attached garage by 405 square feet. Noting the cost to expand to the side or rear due to the topography of the property, the applicants are seeking a minor variance to allow the expansion to occur in front of the existing garage on the east side of the building. Staff has reviewed the request and supports the minor variance as presented. Chairman Schepler invited questions and comments from the Commission. In response to an inquiry, Mr. Chuck Tonyan stated the existing garage is located on the north side of the residence immediately behind the proposed addition. Mr. Tonyan noted the residents and their guests would still be able to park in the remaining driveway. Question was raised regarding the neighbors' approval of the proposed expansion. Mr. Chuck Tonyan responded all abutting neighbors had been advised of the minor variance request and there have been no objections voiced by them. Mr. Granger noted he expects to start construction in the spring of 2012. A question was raised as to the ability for guests to park along the roadway. Mr. Chuck Tonyan noted the street is wide enough to allow parking along one side of it. Chairman Schepler noted there was no one in the audience who wished to comment regarding the requested minor variance. Motion by Nadeau, seconded by Doherty, to recommend to city Council, with regard to File No. Z-778, a request for a minor variance to allow a 405' expansion of the existing attached garage located at 3324 Golfview Avenue to encroach 15' in the required front yard setback, be granted, and that Table 32, the Approval Criteria for Variances, of the Zoning Ordinance, has been met. The strict application of the provisions of the Zoning Ordinance would result in unnecessary and undue hardship upon the applicant, as distinguished from a mere inconvenience. 5. A Variance is necessary for the applicant to preserve and enjoy a substantial property right possessed by other properties in the same zoning district and does not confer a special privilege ordinarily denied to other properties in the district. 6. The granting of a Variance is necessary not because it will increase the applicant's economic return, although it may have this effect, but because without the variance the applicant will be deprived of any reasonable use or enjoyment of the property. 7. The granting of a Variance will not alter the essential character of the locality nor substantially impair environmental quality, property values, or public safety or welfare in the vicinity. 8. The granting of a Variance will be in harmony with the general purpose and intent of the Zoning Ordinance and of the Comprehensive Plan of the City, as viewed in light of any changed conditions since their adoption. 9. The Variance requested is the minimum required to provide the applicant with reasonable use and enjoyment of the property. SECTION 3: All Ordinances or parts thereof in conflict with the terms and provisions hereof are hereby repealed to the extent of such conflict. Approximately one-year ago the City Council approved amendments to the zoning ordinance addressing parking and/or storing commercial and recreational vehicles in residential districts. A one-year amortization was provided for property owners to comply with the provisions of the new ordinance and active enforcement of the regulations began at the end of September 2011. The Construction and Neighborhood Services Department received a complaint regarding a commercial vehicle parked overnight at 505 Brookwood Trail. After investigation it was determined the vehicle in question is prohibited from being parked and/or stored on the subject property and the property owners were notified. Kevin and Carol Harrington filed an application seeking a use variance to allow the unapproved commercial vehicle to be parked and/or stored on their driveway at 505 Brookwood Trail. Analysis. Mr. Harrington works for Aldridge Electric and is on-call 24 hours/day, 7 days/week 365 days/year to respond and repair traffic signals and lighting outages. Attached is a letter from John Wendel, Division Manager for Aldridge Electric describing the need for Mr. Harrington to maintain the vehicle at his residence. The truck has been maintained at the subject property for approximately 25 years. The commercial vehicle in question is a Ford F550 Class 5 medium-duty truck with a gross vehicle weight rating up to 19,000 lbs and has an attached bucket on-top of the vehicle. The vehicle parked on Brookwood Trail would be permitted if it was 10,000 pounds or less. It is in compliance with the height(9-foot maximum) and length(25-foot maximum)requirements. Staff believes a substantial hardship exists justifying the use of the subject property to park and/or store a commercial vehicle normally prohibited by ordinance. The applicant's occupation and use of the vehicle has a direct correlation with public safety and it is not practical for the vehicle to be kept at the headquarters of Aldridge Electric in Libertyville, IL. Staff believes there is a distinction between what this vehicle is used for in contrast to the primary function of a tow truck. Timeliness of response is more critical and can cause a greater adverse impact to health, safety and welfare of the public if traffic signals and/or lighting power outages are not addressed promptly. In addition, police personnel may be required in the interim. A tow truck provides valuable service however in staff s opinion, public welfare is not compromised to the same extent and unlike the applicant's vehicle, there are many tow trucks available to respond to accident situations. The subject property is located along a cul-de-sac and off a residential street a few hundred feet away from Bull Valley Road. Parked in the driveway, the vehicle does not impact or block adjacent sidewalk or right-of-way. Recommendation. The Planning and Zoning Commission unanimously recommended approval of an use variance to allow an unapproved commercial vehicle to be parked and/or stored at 505 Brookwood Trail subject to the following conditions. Staff concurs with thw recommendation. 1. One unapproved commercial vehicle, with dimensions, weight and characteristics generally consistent with those of a gross vehicle weight rating truck classification class five medium-duty truck and appearance in substantial conformance with the attached photograph, shall be permitted to be parked and/or stored at the subject property. 2. Commercial vehicle in question shall be permitted to be parked and/or stored at the subject property as long as the is to be on-call 24 hours/day/7 days/week 365days/year. 3. Commercial vehicle shall be parked on an approved surface, defined by the city's zoning ordinance, at all times while at the subject property. 4. Commercial vehicle shall not block sidewalk/right-of-way at any time. 5. Applicant shall observe all on-street parking restrictions. 6. No other commercial vehicle, approved or unapproved, shall be parked and/or stored on the subject property concurrently. 7. Applicant shall minimize noise and light impact to neighboring properties, particularly during late hours. 8. Use variance shall expire if and when applicants no longer utilize the subject property as their primary residence or applicant is no longer required to be on-call 24 hours/day 7 days/week 365 days/year for primary employment purposes. In order to meet the requirement that he respond to the location needing repairs within one hour, he parks his commercial vehicle at his residence. The vehicle is oversized and is prohibited from being parked in the residential district. He is seeking a use variance to allow him to park the vehicle at his residence. Deputy City Administrator Martin provided the Commission with the Staff Report regarding this matter. He noted in 2010 the parking restrictions governing the parking of commercial vehicles in the residential district were amended. The new restrictions were to be implemented at the end of September, 2011, Planning and Zoning Commission December 8,2011 Page 2 providing residents with a one-year amortization period to bring their property into compliance with the new regulations. Deputy Administrator Martin stated the commercial vehicle in question is a Ford F-550 bucket truck which exceeds the maximum 10,000 pound weight limit allowed by the ordinance. The truck actually weighs approximately 19,000 pounds. The truck design is that of a bucket truck. Staff believes there is substantial hardship to the applicant to allow parking of the vehicle at his residence. Mr. Harrington is required to respond to emergency callouts for traffic signal repairs and to be onsite within one hour of the call. In Staff's opinion there is a distinction between this type of vehicle and a tow truck. Response time for traffic signal repairs is critical to the general safety of the public. Additionally, Mr. Harrington is cognizant of the possibility of noise and light pollution due to the start-up of his vehicle, particularly during the cold winter months. He makes every effort to reduce adverse impacts on his neighbors. Deputy Administrator Martin stated Staff recommends approval of the use variance subject to the following conditions being met: 1. One unapproved commercial vehicle, with dimensions, weight and characteristics generally consistent with those of a gross vehicle weight rating truck classification class five medium-duty truck and appearance in substantial conformance with the attached photograph, shall be permitted to be parked and/or stored at the subject property; 2. Chairman Schepler invited questions and/or comments from the Commission. In response to an inquiry, Deputy Administrator Martin stated Staff responds to complaints as opposed to actively seeking violations regarding the parking of commercial vehicles in the residential district. Noting the many letters of support provided by the applicant, Commissioner Buhrman inquired if there were any letters received by the City which opposed the use variance. Deputy Administrator Martin responded in the negative. Planning and Zoning Commission December 8,2011 Page 3 Commissioner Thacker inquired as to Mr. Harrington's primary job function. Mr. Harrington responded he builds and maintains traffic signals. Commissioner Thacker inquired as to the number of trouble calls Mr. Harrington responded to within the last six months. Mr. Harrington answered he responded to at least twenty emergency calls. Commissioner Thacker then asked if Mr. Harrington had a radius area to which he generally responded to emergency call-out. Mr. Harrington answered the locations vary each time he receives a call to respond. Commissioner Thacker inquired how long the truck in question has been parked at this location. Mr. Harrington answered since 1991. In response to another inquiry, Mr. Harrington stated he takes the truck to his shop in Libertyville when he is on vacation. Chairman Schepler inquired if Mr. Harrington had a required response time. Mr. Harrington responded he is required to be onsite within one hour of the call. Commissioner Nadeau suggested Mr. Harrington could park his vehicle at a commercial site in town, such as Ace Hardware. Mr. Harrington responded he would need to find transportation to get to the remote site. He noted the family has only one vehicle and he would not be'able to use it to drive to the site and leave his personal vehicle.They are a one car family. Some discussion followed regarding the weight of the vehicle and how it compares to a Commonwealth Edison bucket truck. Question was raised that allowing the use variance could be precedent-setting. Deputy Administrator Martin noted each request for a use variance would be considered independently. Substantiation for the need to park an unapproved commercial vehicle would be required in each case and be considered on its merit. Commissioner Thacker, noting the applicant has temporarily moved his truck to the former Haystack Manor property across the street from his home, stated Mr. Harrington should be commended for taking measures to remove the vehicle from his premises while the matter is being considered. Chairman Schepler opened the floor to questions and comments from the audience. The following were sworn in by Chairman Schepler prior to their addressing the Commission. Anthony Lovorn, 1914 Oak Drive: Mr. Lovorn stated he drives a tow truck for Marathon Towing and would like to know if he could be accorded the privilege of parking his tow truck in his driveway. He noted he does work for the City and County and is required to respond quickly when called upon an accident or other scene where a tow is required. Deputy Administrator Martin responded Mr. Lovorn would have to apply for a use variance and state his hardship. The matter would be considered at a public hearing before the Planning and Zoning Commission. If Mr. Harrington is granted a use variance by the City, it does not automatically follow than other use variances would be automatically granted. Each case must be considered on its own merits. In the case of a tow truck, certainly the aesthetics of the vehicle must be taken into consideration when weighing the need for a use variance. Jeff McCaffrey, 306 Brookwood Trail: Mr. McCaffrey expressed his support of the requested use variance. Hr noted Mr. Harrington has been very respectful of his neighbors. It is important that he respond in a quick and efficient manner. He noted he supports the requested use variance. Gerald Cowen, 509 Brookwood Trail: Mr. Cowen noted he lives next door to the Harrington's. The truck has never been a problem due to aesthetic or noise. He stated his support of the request. Ramon Gregorio, 402 Brookwood Trail: Mr. Gregorio expressed his support of the request. He has never hear any noise generated by the truck which would bother his neighbors. A train horn blasts every morning at 5:50 and 6:50 AM. Several times a year, streets in our neighborhood have to be dug to repair old, broken water or gas lines. We should be counting our blessings to live in such a great small town and not complaining or trying to regulate such minor infractions as the size of a truck in one's own driveway on private property. We bend where we need to bend and where it seems reasonable. Reasonable discretion by enforcing bodies is sometimes overruled by a complaint that requires action and the law must be upheld, changed, or an exception granted for cause. That appears to be where the city and Mr. Harrington and some complainant find themselves today. So,the new law must be weighed as it pertains to one or to many. Is the benefit a law derives worth the inconveniences it causes others. Is the complaint substantial and does the violation cause enough burden on someone to require strict enforcement? Are the people waiting for a traffic light repair deemed less important than the view of Harrington's driveway? No discretion can have consequences, as well. I mentioned I was once a police officer and learned of this true story. In a nearby town, at one village board meeting, a trustee(alderman) lectured the police chief publically for not strictly enforcing the speed limit on a certain street(his own). The very next morning, the chief himself set up radar on that same street and promptly wrote a citation to the first speeder going 6 miles per hour over the limit.....the trustee who had complained was the driver. Mr. Harrington's work truck has been parked in his driveway without a complaint for well over 20 years and it was always deemed reasonable, to the best of my knowledge, by everyone involved, including the City of McHenry. Now, a new ordinance and a new attitude from a long time neighbor, scanning for violations, has suddenly made what was reasonable and acceptable for two decades a case to be brought before the city at great expense to the Harringtons. That seems unreasonable.That a working man who desires to comply with all laws should have to pay a great deal of fees to come before the city because, without notifying him, they made something he's done for many years suddenly illegal, seems unreasonable, as well. I urge the zoning commission and the city to find Mr. Harrington's need for a truck in his driveway as a reasonable exception to your rule. A more recent city ordinance has forbidden him from continuing his long time tradition of parking the vehicle by his house. I would request the city consider a minor variance to allow him to continue parking the vehicle in his driveway. I have known Kevin and Carol Harrington for many years and they are very considerate, faithful, and friendly people. Kevin's job is to maintain and repair traffic signals and lighting outages—a public safety job. He is"on-call"for emergencies on a 24-hour basis. He needs his truck to perform his job. The NEW city ordinance will cause undue financial strain on their family. Kevin may have to consider alternative jobs (which are difficult in this economy),storage of the truck(which impacts his response time and could cause him to lose his job),or cause him to purchase another vehicle and dramatically increase his response time or alter his route. In this time of economic slow down and so many people without jobs, I find this somewhat disheartening. Kevin uses his truck for his livelihood and the purpose of his job is public safety. How can that be a problem? I would certainly hope that the city sees a way for him to obtain the minor variance in order for him not to incur a hardship on his family and work.
