RE: Garage Sale Ordinance Update
Background
Recently garage sales have become more popular within the City. Specifically, there are more of them
in recent times and often they include multiple families and/or entire subdivisions. In addition other
versions of garage sales such as: trunk sales, rummage sales, yard sales, moving sales, attic sales and
estate sales have become more popular. Often parking becomes an issue as well as the safe passage of
cars and emergency vehicles when there is parking on both sides of a street. Further, churches which
are typically zoned residential have been hosting these trunk sales and rummage sales. The City's
Municipal Code regulates garage sales within the City (see attached regulations). Currently a garage
sale permit is required; however, there is no fee for the permit.
Staff Analysis
Staff has reviewed garage sale ordinances from other communities and has put together an outline of
what language a revised ordinance may include. Staff is also recommending that a garage sale permit
fee be instituted.
Recommendation
Staff recommends reviewing the attached ordinance and providing alternative provisions/restrictions
where applicable.
GARAGE SALE REGULATIONS
Garage Sale-includes any occasional sale of personal property at a residence or non-
commercial property by one or more families in a neighborhood or by a group, including but not limited
to rummage sales, yard sales, attic sales, auctions, estate sales, moving sales and trunk sales.
Permitted-two(2)garage sales shall be conducted on the same premises within any calendar
year; each sale can last no more than three(3)days;
There shall be a minimum of thirty(30)days between each sale;
In the event of rain occurring during the hours of sale on any day within a three(3)day sale
period such sale period may be extended one additional day on any of the subsequent seven(7) days for
each such day of rain; no such sale shall exceed a total of three(3)dry days;
Garage sale signs shall not exceed five(5) square feet in area with a maximum height of four
(4) feet; one sign is allowed for each zoning lot, except any lot with more than one frontage may have
two(2) signs, one displayed on each frontage. Off premise directional signs may be displayed in the
public right-of-way a minimum of five(5) feet from any roadway on the days when the garage sale is
being conducted. No more than two (2)off-premise signs shall be permitted for each garage sale; an
additional 20 square foot sign shall be permitted, to be located at the subdivision entrance, for any
neighborhood, association or group garage sale with three(3)or more participants within the same
general area; garage sale signs may only contain the following information: days of the sale, hours of
the sale and address/location where the sale is to take place;
All garage sale signs authorized by this ordinance shall be removed no later than seven o'clock
(7:00)p.m. on the last day of the sale;
Use of loudspeakers and/or amplifiers is prohibited; no sale held pursuant to this chapter shall
be conducted with the use of outdoor loudspeakers or other amplification equipment;
No attachments, including but not limited to: balloons, streamers, pendants, etc. may be
attached to any street poles, fire hydrants, sign poles, light poles or similar structures or located within a
landscape bed or flower bed.
A garage sale, as provided herein, shall be conducted from residentially-zoned property only;
A garage sale permit shall be obtained from the Administration Dept. not less than 48 hours
prior to the start of any garage sale; a permit fee of$10 shall be charged to any resident person upon
compliance by such person within the provisions of this ordinance; the permit shall be posted in the
front yard area so as to be easily seen by city officials and shall be nontransferable; a fee of$20 shall be
charge for any subdivision, association or group of three(3) or more garage sales in the same general
vicinity;
Sales conducted in accordance with the provisions of this ordinance shall be conducted only
during the periods from nine o'clock(9:00)a.m. to five o'clock(5:00)p.m.
Any person, group or association violating any provision of this ordinance shall upon
conviction be fined not less than$25 nor more than$100 for each offense; each day that such a
violation occurs or continues shall be deemed to constitute a separate offense.
When a subdivision, neighborhood or group of more than three(3) separate sales at the same
location is conducted parking shall be restricted to one side of the street.

GARAGE SALES
Sec. 10.50-1. Purpose.
It is the purpose of this Chapter to provide for the regulation of the nature and frequency of garage sales, in
order to insure public safety, provide proper parking control and to prevent any annoyance or harm which might
otherwise occur from the uncontrolled operation of such sales in districts not zoned for commercial use.
Sec. 10.50-2. Definition.
For purposes of this Chapter, the term "garage sale" shall mean and include all sales of tangible personal
property conducted on premises in the City that are zoned for residential use, regardless of the name by which
such sale may be called.
Sec. 10.50-3. License required; fee; display.
It shall be unlawful for any person, firm or corporation to conduct any garage sale in the City of McHenry
without first filing with the City Clerk the information hereinafter specified and obtaining from the City Clerk a
license to do so, to be known as a "garage sale license." Each license issued pursuant to this Chapter shall be
prominently displayed on the premises upon which the garage sale is conducted throughout the entire period of
the licensed sale. No fee shall be charged for such license.
Sec. 10.50-4. Information to be filed.
The information to be filed with the City Clerk pursuant to this Chapter shall be as follows:
(a) Name of the person, firm, group, corporation, association, or organization conducting said sale.
(b) The address at which said sale is to be conducted.
(c) The date(s) of the sale.
(d) The number of days of the proposed sale.
(d) The hours of the sale.
(e) The number of garage sales held on the premises during the current calendar year.

Sec. 10.50-5. Number of sales.
No more than two garage sales shall be conducted on the same premises by the same household within any
calendar year.
Sec. 10.50-6. Time limitations.
No garage sale shall be conducted over a period of more than three consecutive calendar days, nor shall any
such sale begin before 8:30 a.m. or continue later than 5:00 p.m. on any given day.
Sec. 10.50-7. Types of merchandise.
Garage sales shall be limited to the sale of household goods and furnishings which have been in use in the
dwelling unit located on the premises on which such sales are conducted. No person, firm or corporation shall,
at any garage sale, sell at retail any goods purchased or acquired in wholesale lots.
Sec. 10.50-8. Signs.
Any person, firm or corporation licensed under the provisions of this Chapter may erect two signs advertising
the licensed sale. One such sign shall be located on the premises where the sale is to take place, and the other
shall be located at the nearest major intersection to the sale premises, giving directions to the sale. All signs
shall be removed no later than three hours after conclusion of the sale.
Sec. 10.50-9. Persons and sales excepted.
The provisions of this Chapter shall not apply to or affect the following persons or sales:
(a) Persons selling goods pursuant to an order or process of a court of competent jurisdiction.
(b) Persons acting in accordance with their powers and duties as public officials.
(c) Any persons selling or advertising for sale an item or items of personal property which are
specifically named or described in the advertisement and which separate items do not exceed five
(5) in number.
(d) Any sale which falls within the provisions of ILCS.
(e) Any sale conducted by a charitable or religious organization where the sale is being held entirely as a
fund-raising activity for said organization.

2. All Other Zoning Variations: In the event the person charged with administering the
provisions of this Section determines that a requested variation is not based solely on
the provision for adequate reception, a recommendation from the Plan Commission
and a zoning variation approved by the Mayor and Board of Trustees must be granted
prior to a building permit being issued to install said antenna.
F. APPEALS:
The Village Board shall hear and decide appeals from and review any order, requirement,
decision or determination made by the person charged with the enforcement of this
Section. (amd. entire section 6-3-13 Ord. 95-1380-10, eff. 2/13/95)
6-3-14: SALES ACTIVITIES; VENDING AND ICE MACHINES: All salesactivities
conducted in all zoning districts, including sales from vending machines and ice
machines, shall be conducted within completely enclosed buildings. In addition, no vending
machine or ice machine shall be stored or displayed outside a completely enclosed building in
any zoning district. The restrictions of this Section shall not apply to news racks which are
covered by the provisions of Chapter 5 of Title 8 of this Code. (Ord. 90-1178-62) The
restrictions of this Section shall not apply to farmers markets which are covered by the
provisions of Chapter 14 of Title 6 of this Code. (Ord. 97-1538-62)
6-3-15: GARAGE SALES
A. LIMIT ON LENGTH AND FREQUENCY OF SALES: Garage sales shall be permitted
for three (3) consecutive days between the hours of 8:00 a.m. and 5:00 p.m. each day.
Not more than two (2) garage sales shall be conducted on the same premises within any
calendar year and there shall be a minimum of thirty (30) days between each such sale.
Notwithstanding the foregoing, in the event of rain occurring during the hours of sale on
any day within a three (3) day sale period such sale period may be extended one
additional day on any of the subsequent seven (7) days for each such day of rain;
however, no such sale shall exceed a total of three dry days.
B. SIGNS: Garage sale signs shall not exceed five (5) square feet in area and a maximum
height of four (4) feet. One sign is allowed for each zoning lot, except any lot with more
than one frontage may have two (2) signs, one displayed on each frontage. Off-premise
directional signs may be displayed in the public right-of-way a minimum of five (5) feet
from any roadway between the hours of 7:00 a.m. and 6:00 p.m. on the days when the
garage sale is being conducted. Off-premise directional signs are limited to the minimum
number required to direct motorists from the nearest major arterial street. The display of

is strictly prohibited. No attachments, including but not limited to, balloons, streamers,
pendants, etc. may be attached to any garage sale or off-premise directional sign. No
signs may be attached to any street polies, tree, fire hydrants, sign poles, light poles or
similar structures or located within a landscape bed or flower bed.
C. LOCATION OF SALE: A garage sale, as provided herein, shall be conducted from
.residentially zoned property only.
D. PERMIT REQUIRED: A Garage Sale Permit shall be obtained from the Department of
Community Development not less than 48 hours prior to the start of any garage sale.
E. PENALTY: Any person violating any provision of this article shall upon conviction be
fined not less than $25.00 nor more than $100.00 for each offense. Each day that such a
violation occurs or continues shall be deemed to constitute a separate offense. (Ord. 96-

6-3-16: OUTDOOR LIGHTING:
A. APPLICATION
These regulations shall govern the design and operation of all outdoor luminaires in all
non-residential zoning districts and by all non-residential uses in all residential zoning
districts. However, to promote safety in the ordinary and intended use of rights-of-way
these regulations shall not apply to any luminaires owned and operated by a State or local
highway authority for the purpose of illuminating the right-of-way.
B. LIGHT INTENSITY
Any permitted outdoor luminaire shall be so designed, arranged and operated so as to
mitigate the amount of light and glare being cast onto any adjacent property or street. No
outdoor luminaire, regardless of the zoning lot onto or from which it causes illumination,
shall produce an intensity in excess of one-half (0.5) footcandles, as measured at the
property line at a height of 60 inches above grade in a plane at any angle of inclination.
C. INSTALLED LUMINAIRE HEIGHT
The installed height of any luminaire used for outdoor lighting on any zoning lot shall not
exceed 25 feet from the established grade.

section relating to "Special Events" is Title 9, Chapter 109. It's kind of
lengthy, so to specifically address the question about garage sales and
truck sales/flee markets......
In Schaumburg each residence is permitted 2 garages sales per year, and
each one can be 2 days. We allow neighborhood garage sales, but each house
that participates is still limited to 2 garages sales per year and
participation in the neighborhood sale counts.
Arts/crafts fairs are allowed, for 10 days, 2 times per year.
Flee markets are not allowed. The code doesn't specifically address flee
markets, but it does state that all outdoor sales must be "conducted only
on the premise of a business where the same products are sold and as an
accessory use to an existing business that sells the product". We use this
section of the code to deny permits for flee market type outdoor sales.
The only exception to this requirement is that temporary outdoor sales can
take place at "regional malls" (i.e. Woodfield Mall) even if that business
isn't in the mall; however, all sales for the events at the mall must occur
at the mall or at the business' Schaumburg location (if that business has a
location in the village)....so if they don't have a location in Schaumburg,
then they have to ring up all sales at the mall premise.

Montgomery allows 2 garage sales per year per lot. We also coordinate a
community wide garage sale once a year, which was just held over Memorial
Day weekend.

CHAPTER 6 HOUSE AND GARAGE SALES
SECTION:
3-6-1: Permit Required; Exception

3-6-1: PERMIT REQUIRED; EXCEPTION:
No person shall sell, offer for sale or conduct the sale of any junk, secondhand, antique or other used or discarded items
of personal property from any residence in the Village or from any area classified as residential in the Zoning Ordinance of
the Village without first obtaining a permit therefor. Included within the terms of this Section shall be sales commonly
known as"house sales", "attic sales", "garage sales"and "basement sales". The provisions of this Section shall not apply
to bankruptcy, estate or other sales under judicial process and sales conducted from church, school, homeowner
association or civic property by not-for-profit organizations. (Ord. 85-11, 4-4-85)
3-6-2: ISSUANCE OF PERMIT; LIMITATION ON NUMBER:
(A) The Village Clerk is authorized to issue a permit required by this Chapter,for a fee of$5.00 to any resident person
upon compliance by such person with the provisions of this Code. Said permit shall list, in addition to the applicant, all
other persons participating in such sales by name and address, and the Village Clerk shall keep a record of all
participants which shall be checked prior to the issuance of a permit.
(B) Limitation on Number of Permits Per Year: No person shall be permitted to conduct a house or garage sale from
his premises or participate in a garage or house sale conducted by another resident more than twice during any calendar
year. No more than four(4) permits shall be issued to any person as a permit holder or permit participant during any
calendar year for the purpose of conducting or participating in such house or garage sale. (Ord. 77-76, 11-17-77, Ord.
2002-81,10/3/02)
3-6-3: PERMIT RESTRICTIONS:
(A) Permit Valid Only For Sale Designated on Permit; Permit to be Posted; Nontransferability: A permit issued
pursuant to this Chapter shall be valid only for the particular sale and premises designated on the permit. The permit shall
be posted in the front yard area so as to be easily seen by the police and shall be nontransferable.
(B) Person Conducting Sale to be Owner or Occupant of Premises: It shall be unlawful for any person to conduct a
sale pursuant to this Chapter who is not the owner of the premises where such sale is held. (Ord. 76-16, 4-4-72)
(C) Operation of Retail Selling Business Prohibited: It shall be unlawful for anyone to conduct a retail selling business
pursuant to a permit issued under this Chapter or to engage in any sales other than those of junk, secondhand, antique or
other used or discarded items of property. (Ord. 77-76, 11-17-77)
(D) Restrictions on Location of Sales Activities: No sales regulated by this Chapter and no sale items shall be located
in the front yard area of any residence or on any public sidewalk or parkway area. (Ord. 72-16, 4-4-72)
(E) Length of Sale; Hours: Sales regulated by this Chapter shall be limited to a period of three (3) consecutive days
and shall be conducted only during the periods from nine o'clock(9:00)A.M. to five o'clock(6:00) P.M. (Ord. 77-76, 11-17-

(F) Advertising Sale Restricted:
(i)All signs advertising any sale held pursuant to this Chapter shall be located on private property or on the
parkway and shall comply with all pertinent ordinances of the Village relating to signs. No such sign or other advertising
matter shall be located or posted in any public park, or building in the Village.
(ii)The garage sale signs must contain the following information:
(a)The days of the sale:
(b)The hours of the sale; and
(c)The address where the sale is to take place.
(iii)All garage sale signs authorized under this Chapter shall be removed no
later than 8:00 p.m. on the last day of the sale.

(G) Use of Loudspeakers and Amplifiers Prohibited: No sale held pursuant to this Chapter shall be conducted with the
use of outdoor loudspeakers or other amplification equipment. (Ord. 72-16, 4-4-72; Ord. 85-11, 4-4-85)
(H) Penalties: In the event all garage sale signs authorized under this Chapter are not removed prior to 8:00 p.m. on the
last day of the sale as provided for in Title 3, Chapter 6, Section 3(F) hereinabove, the Village shall impose a fine of
Twenty-Five($25.00) Dollars per sign for each day the sign is displayed beyond the last day of the sale on each garage
sale permit applicant. (Ord. 2002-81, 10/3/02)
3-6-4: REVOCATION OF PERMIT OR RIGHT TO PERMIT:
Any person who violates any of the provisions of this Chapter shall be subject to the immediate revocation of the permit
under which said person is a permit holder or permit participant, and shall be further subject to the loss of the privilege of
obtaining a permit or of having the right to participate in such permit in the future. (Ord. 77-76, 11-17-77)

In Moline, for a temporary, non-residential, community-wide sale like you mention, we would probably classify the event
as a general outdoor sale, as fellows. 'These are permitted by right in all commercial districts, but not office or industrial.
(h)OUTDOOR SALES,GENERAL. Description: Includes the display of any items outside the
confines of a building which is not otherwise permitted as a permitted or special use,or a special event otherwise
regulated by the City of Moline Code of Ordinances.Examples of this land use include but are not limited to: seasonal
garden shops,tent sales,parking lot sales, food stands,and vendors.
(1)Temporary Use Regulations:
a. Display shall be limited to a maximum of 12 days in any calendar year.
b. Display shall not obstruct pedestrian or vehicular circulation,including vehicular sight
distances.
c. Signage shall comply with the requirements for temporary signs in the sign code.
d.Adequate parking shall be provided.
e. If subject property is located adjacent to a residential area,sales and display activities shall
be limited to daylight hours.
A typical residential garage/yard,/rummage sale would be classified and regulated as follows.
(1)RUMMAGE SALES,PERSONAL. Description: Includes any occasional sale of personal property
at a residence or non-commercial property by one or more families in a neighborhood or by a group,including,but not
limited to garage sales,yard sales,attic sales,auctions,estate sales,and moving sales.
(1)Temporary Use Regulations:
t
a. Sales shall be limited to a maximum of 2 occurrences per year.
b. Each sale shall not last more than 72 consecutive hours.
c. Sales must only include excess goods which have been generated from within the household
and not acquired or produced specifically for resale.
d. Sales shall be conducted on the owner's property except that multiple family sales are
permitted if they are held on the property of one of the participants and any such sale shall be
considered to be a sale for all participants.
e.Merchandise and display units shall be removed or placed indoors at conclusion of sales.
We use these regulations for outdoor sale of agricultural products (i.e. farmer's markets and produce stands):
(g)OUTDOOR SALES,AGRICULTURAL PRODUCTS. Description:Includes any outdoor display
or sale of agricultural products not otherwise regulated by the City of Moline Code of Ordinances. Examples of this

GARAGE SALE REGULATIONS AS FOUND IN TITLE 3,CHAPTER 7,SECTION 3.7.1 OF THE WOODSTOCK CITY CODE
Garage sales are permitted in all residential zoning districts between the Fours of eight o'clock(8:00)A.M.and eight o'clock(8:00)P.M.
No person conducting a garage sale shall sell or offer for sale any food or beverage for consumption on the premises.Food or beverage may
be provided for such consumption at no cost to the consum er,subject to compliance with applicable McHenry County departm ant of health
requirements and regulations.
No fee or other charge shall be imposed upon members of the public attending a garage sale.
The sale of items purchased elsewhere for resale at a garage sale is prohibited.
Items intended for sale shall not be displayed in a front yard or side yard of a dwelling except on the day or days of the sale,and shall not
remain outside a building or enclosed structure before or after such sale hours.In no instance shall such items be displayed in a public right of
way.
Signage advertising a garage sale shall be limited to one on premises sign and a maximum of two(2)off premises signs,each of
which shall not be larger than two and one-half(2112)square feet in area or have a height of more than three feet(3')above grade.
Such signage shall be affixed with a sticker supplied by the city Indicating that the required garage sale permit has been issued.
The content of such a sign shall be limited to the time,date(s),and location of the garage sale.In addition,such signage shall be
self-supporting and not attached to any utility pole,light pole,or street sign,and shall be removed within twenty four(24)hours of
when the garage sale ends.Attention getting devices,including balloons,streamers,special lighting,noise making devices and

The Village does not require a permit to have a garage sale.However, each property is limited to no more than three sales per year.
Sales shall not be longer than four consecutive days.Signs are limited to three and must have their own support/pole. Please do not

RE: Highway Overlay District Ordinance
Background
At the June 2nd Community Development Committee meeting the Committee discussed the
possibility of creating a special type of zoning district which could be used to regulate
development in certain areas of the city. Specifically, this ordinance would apply to certain areas
along major roadways. This discussion came about as the result of the proposed Richmond Road
widening and how these properties should be zoned upon a roadway widening and potentially
how they should be redeveloped and to what zoning classification.
Staff Analysis
Staff has drafted a Highway Overlay District Ordinance(HOD). This ordinance is patterned after
the City's Downtown Overlay District ordinance. An overlay ordinance is an ordinance in
addition to the underlying zoning where it is applicable. The boundaries to which this ordinance
is applicable are included in addition to specific development-related guidelines along these
roadway corridors. The proposed HOD boundaries are listed below:
• Richmond Road from Illinois Route 120 north to Washington Street;
• Front Street from Bull Valley Road north to Illinois Route 120;
• Crystal Lake Road from Dartmoor Drive northeast to Illinois Route 120;
• Ringwood Road from Illinois Route 120 north to Flanders Road;
• Illinois Route 120 from Ringwood Road to Chapel Hill Road.
Recommendation
Staff recommends discussing and determining the boundaries of what areas in the City should be
included as part of this proposed overlay district and reviewing the attached ordinance and
providing any comments and/or concerns with any of the specific provisions.
HIGHWAY OVERLAY DISTRICT
A. PURPOSE, INTENT AND GOALS
The purpose of the Highway Overlay District (HOD) is to preserve and protect the
existing historical and neighborhood character of areas along major transportation routes
in the City. The HOD seeks to provide guidance for those exterior alterations and
encourage new infill development. The HOD augments design guidelines for residential,
commercial and mixed-use development with special criteria designed to create a
cohesive and attractive roadway corridor while preserving the integrity of the existing
surrounding neighborhoods. The primary goals of the HOD ordinance are as follows:
• Plan for new commercial, residential and mixed-use infill development that is
compatible to the character and function of the neighborhoods surrounding these
highway corridors;
• Encourage the use of appropriate building materials and facades so as to enhance the
character and continuity of these areas;
• Continue to maintain the historical fabric of these neighborhood areas;
In order to accomplish these goals, the City recognizes that new development,
redevelopment, and building modifications within the boundaries of the HOD is more
likely to require relief from strict compliance with Zoning Ordinance requirements.
Instead of using the traditional zoning and variance processes to consider this relief, the
HOD provides a mechanism, the site plan review process, for allowing flexibility from
the Zoning Ordinance requirements. Through the site plan review process, development
proposals in the HOD can be reviewed on a more comprehensive level to ensure the goals
and objectives of the district are met.
B. OVERLAY BOUNDARIES
The HOD boundaries are listed below:
• Richmond Road from Illinois Route 120 north to Washington Street;
• Front Street from Bull Valley Road north to Illinois Route 120;
• Crystal Lake Road from Dartmoor Drive northeast to Illinois Route 120;
• Ringwood Road from Illinois Route 120 north to Flanders Road;
• Illinois Route 120 from Ringwood Road to Chapel Hill Road.
C. APPLICABILITY
The requirements of the HOD are applicable to all parcels falling within the established
HOD boundaries.
D. SITE PLAN REVIEW
Site plan review shall be applicable to all development, as defined in the Zoning
Ordinance, and any other activity requiring a building permit.
1. Administrative Site Plan Review. Administrative site plan review shall be required
for all development and other activities requiring a building permit that comply with
the regulations for permitted and conditional uses, bulk requirements such as lot area,
width and coverage, required yards, building height, and floor area ratio, as provided
in the underlying zoning district in which said property is located; and all other

applicable requirements of the Zoning Ordinance, including parking, accessory uses
and structures, landscaping, lighting, signage, etc.
2. Expanded Site Plan Review. Any development and any other activity requiring a
building permit that is unable to meet any of the requirements of the underlying
zoning district or other applicable requirements of the Zoning Ordinance shall be
subject to the expanded site plan review procedures.
E. PROCEDURE FOR ADMINISTRATIVE SITE PLAN REVIEW
The procedure for administrative site plan review shall be as follows:
1. Application. Applications for administrative site plan review shall be made on forms
provided by the City.
2. Required Submittals. The following information shall be submitted with all
applications for administrative site plan review:
a. Narrative description of the proposal describing the request and how it meets the
purpose, intent, goals, and Criteria for Review of the HOD.
b. Completed building permit application.
c. Recent plat of survey of the subject property, indicating all existing
improvements on the site.
d. Two (2) copies of detailed plans of the proposed construction or activity, sign,
awning, etc., including but not limited to site plan, elevations, materials, method
of construction and landscaping.
e. Any other information deemed necessary by City Staff to perform a complete
analysis of the request in accordance with the HOD requirements.
All required information shall be submitted to the Department of Construction and
Neighborhood Services for processing. The Director of Construction and
Neighborhood Services, in his/her sole discretion, may waive the submittal of one or
more of the required submittals if it is determined that such information is
unnecessary or irrelevant to the review.
3. Administrative Review. Each request for administrative site plan review shall be
reviewed independently by City Staff based on conformance with the purpose and
intent, goals, and criteria for review of this Chapter.
4. Administrative Decisions. Within twenty-one (21) days after receipt of all required
submittals, the Director of Construction and Neighborhood Services shall approve,
approve with modifications or deny the request. Approval shall be in the form of
issuance of a valid building permit. Denials will be provided to the applicant in letter
form explaining the reasons for denial.
5. Appeals. Any person aggrieved by the decision made by the Director of
Construction and Neighborhood Services in conjunction with this Section may file an
appeal in accordance with the provisions of Chapter XVIII of the Zoning Ordinance.
F. PROCEDURE FOR EXPANDED SITE PLAN REVIEW
The procedure for expanded site plan review shall be as follows:
1. Application. Applications for Expanded Site Plan Review shall be made on forms
provided by the City.

2. Required Submittals. The following information shall be submitted with all
applications for expanded site plan review:
a. Narrative description of the proposal describing the request and how it meets the
purpose, intent, goals,.and criteria for review of the HOD, and describing all
departures from the underlying zoning requirements.
b. A plot plan/site plan depicting setbacks, the relationship of buildings on the site,
parking areas, driveways, walkways, landscaping and lighting.
c. Building plans for all proposed buildings.
d. Exterior elevations with material designations and exterior color descriptions,
including fagade improvements.
e. Plans for all signs, their dimensions, size and location on the property.
f. Recent plat of survey of the subject property, indicating all existing
improvements on the site.
g. Any other information deemed necessary by City Staff to perform a complete
analysis of the request in accordance with the HOD requirements.
All required information shall be submitted to the Community Development Director
for processing.
3. Review. All applications for expanded site plan review shall be required to obtain a
conditional use permit and shall follow the conditional use permit process in the
City's Zoning Ordinance. Each application shall be reviewed by the Planning and
Zoning Commission for conformance with the purpose and intent, goals, and criteria
for review of this chapter. The Planning and Zoning Commission may require that
additional information be provided by an applicant in order to perform a complete
analysis of the request in accordance with the HOD requirements.
4. Planning and Zoning Commission Recommendation. Within thirty (30) days after
the close of the public hearing, a recommendation to approve, approve with
conditions, or deny the application shall be rendered by the Planning and Zoning
Commission and forwarded to the City Council for final action.
5. City Council Action. The City Council shall take final action on an application for
expanded site plan review at a regularly scheduled meeting. The City Council shall
not approve any application unless it finds that the criteria for review in this Chapter
have been met. The City Council may make its approval subject to any conditions or
restrictions it deems necessary to ensure the viability of the development and its
compatibility with the downtown.
G. CRITERIA FOR REVIEW
All applications for administrative site plan review and expanded site plan review shall
.be reviewed for compliance with the following criteria.
• Harmony and compatibility of proposed uses with neighboring properties and
structures;
• Providing cross-access easements to reduce/limit the number of curb cuts onto
the adjacent roadway;
• Locating on-site parking to the rear of the buildings;
• Architecture and construction materials which are in keeping with the character
of the neighborhood;
• Hip and gable roofs; roofs which are not flat are encouraged;

• Additional noise considerations to minimize impact on surrounding residents;
• Increased buffer yards or screening adjacent to single-family residential land
uses;
• Design and orientation of new buildings preserving and enhancing existing
views;
• Relationship of the proposed activity to the existing site characteristics, e.g.:
topography;
• Relationship of the proposed activity to existing vehicular and pedestrian
circulation;
• Adverse impacts on the health, safety and welfare of the general public;
• Harmony and compatibility of proposed materials and colors with neighboring
properties and structures;
• Benefit associated with the development of the property, related to but not
limited to the following:
1) Economic benefits to the City.
2) Elimination of blighted conditions.
3) Enhancements to city tax base

RE: Main Street Programs
Background
At the June 2"d Community Development Committee meeting the Committee directed staff to
research Main Street Programs. Main Street is a volunteer-driven preservation-based community
revitalization program that promotes historic preservation and economic development within a
community's downtown business district(s). There are 69 Illinois Main Street communities and
1,600 nationwide. Both Crystal Lake and Marengo are designated Main Street communities.
Woodstock is classified as an associate member and Harvard was formerly a Main Street
community which folded. Currently in addition to the McHenry Area Chamber of Commerce
there is a Riverwalk Area Business Association, formerly the Downtown Business Association.
Both of these organizations promote business within McHenry's downtown and other areas and
both are concerned with the relative success of the downtown business districts.
Staff Analysis
The first step towards achieving the Main Street designation is to form a working group of
stakeholders who are actively involved and interested in promoting the downtown business
districts. This is essential as Main Street programs are volunteer-based. Typically; the Main
Street organization is a 501(C) 3 not-for-profit organization. Partial funding for the Main Street
program is provided by the local community and there is a paid Main Street Coordinator who
oversees the daily operations of the program along with a broad-based governing board. Crystal
Lake uses their hotel/motel tax to partially fund their Main Street program; however, this is only
partial funding. Events and fundraising are very standard parts of a Main Street organization.
The average-sized Main Street program includes 40-60 active volunteers and many other"part-
time"volunteers.
I spoke at length with the Main Street coordinator from Crystal Lake. She stressed that in order
to be a Main Street community your community has to be very preservation-minded. The
chamber and any other downtown organization have to work together to achieve a sustainable
Main Street designation. She is a full-time administrator who coordinates several hundred
volunteers. She believes that the support from the state, architectural assistance from the state for
fagade and building improvements and networking abilities are key advantages to the program.
With a Main Street program your community is promoting the geographic area of downtown
which is different from the chamber of commerce.
The four-point Main Street approach includes the following: design, organization, promotions
and economic restructuring. Typically four committees are set-up each focusing on one of the
four points of Main Street programs.
Design: enhancing the design and appearance of downtown through historic preservation
Organization: building an effective, volunteer-driven, managed, downtown organization, guided
by professional staff
Promotion: establishing promotion strategies that bring people to downtown
Economic Restructuring:revitalizing downtown businesses through restructuring local
economies
The local coordinator manages the program, organizes the volunteer initiatives and acts as the
primary spokesperson for the organization.
Recommendation
