RE: Code Enforcement Update
Background. Code enforcement and property maintenance continue to be at the forefront of duties for
the Construction and Neighborhood Services Department. The City currently has one person fully
dedicated to code enforcement in addition to the Assistant Director of Construction and Neighborhood
Services who oversees the area. Building inspectors also assist on an as-needed basis.
Staff Analysis. Attached to this supplement are graphs depicting the number of complaints received by
the city in the first nine months of the 2009 and 2010 calendar years. There is one graph/violation
category. The violations are categorized as one of the following: dangerous building, housing,
miscellaneous violation, nuisance violation and zoning. In addition the chart shows the number of
complaints and their disposition. Each violation is described on the respective graph, along with the
number of complaints for 2009 and 2010 for this particular category. Below are definitions describing
each status classification.
Unfounded cases: Cases determined to be without merit and with no basis for considering the
incident to be a violation
Abated Cases: Cases that have been removed from the caseload due to simply fixing the
problem. An example is a code inspector removing illegal signs from the right of way.
Voluntary Compliance: Cases that have been resolved by the violator after the jurisdiction has
issued a formal violation or another formal notice without going to adjudication.
Adjudication: Cases that have been brought in front of the city's adjudication officer.
Unresolved: Cases that are still open and actively being monitored for compliance.
Recommendation. No action by the Committee is needed. This is an annual update to give
the City Council a snapshot of code enforcement activities from that year, as well as the
previous year.

RE: Review of Fees for Residential Minor Permits
Background. It has been over ten years since the city reviewed minor permit fees. Minor
permits are issued for sheds, decks, driveway construction, swimming pools, siding, and
reroofing and are primarily sought by homeowners but can also be issued to businesses.
Staff suggests that the fees currently charged be updated to enable that the city to recover some
of the costs associated with review and inspections. It would be difficult to recover all costs due
to the unique circumstances associated with each permit.
Analysis. Attached is a spreadsheet outlining types of minor permits, costs for each, number of
permits issues in the past nine months, and recommended fee. The spreadsheet also depicts fees
charged for same in Algonquin, Crystal Lake, Lake in the Hills, and Woodstock. The proposed
fee updates are solely for residential development.
A plan review fee for new construction, additions, and alterations and a fee to issue a temporary
occupancy permit are also proposed. It is not unusual for permit applications to be withdrawn at
the plan review stage. A plan review fee would help to ensure that a person is seriously
considering the project. A plan review fee would not be assessed for minor permits.
Temporary occupancy permits are often issued for non-life safety and weather-related items such
as landscaping and concrete driveway approaches that cannot be completed during the winter
months yet the home habitable. At the time a temporary occupancy permit is issued, the owner
is required to sign an agreement stating that the outstanding items will be completed by a
predetermined date. Staff is proposing a fee of $50 to cover the cost to prepare the temporary
occupancy permit and additional inspections that must be conducted prior to issuing a certificate
of occupancy. Most communities charge a fee for occupancy permits but not temporary
occupancy permits however staff is of the opinion the cost of an occupancy permit is already
built in to the actual building permit fee therefore no additional fee is warranted.
Recommendation. Review and forward a recommendation to City Council to amend Municipal
Code Section 7-3 updating permit fees as presented. Staff also recommends reviewing fees
every two or three years.
