RE: Amend Municipal Code, Chapter 23,Taxation, Article IV Home Rule Municipal
Retailer's Occupation Tax and Municipal Home Rule Service Occupation Tax,
Section 23-37 and 23-38.
The Illinois Department of Revenue (IDOR) acknowledged receipt of our ordinance
implementing the local sales tax rate of 0.5%. The ordinance is in compliance with state
statutes and the State of Illinois will begin applying the tax on January 1, 2011.
IDOR has requested that the City make a few language "clean up" changes. Attached is
the ordinance providing for the amendment of the Municipal Code replacing the
referenced sub-sections of Municipal Code Chapter 23, Taxation. The changes included
the following:
1. In Section 23-37, line 4, delete the words "selling price of the"prior to
"gross receipts"in the original ordinance.
2. In Section 23-38, line 2, insert the words "engaged" and"the business of."
3. In Section 23-38, line 4, replace the word "in" prior to "an incident"
with the word"as."

An Ordinance Amending Chapter 23 Taxation Article IV Home Rule Municipal Retailer's
Occupation Tax and Home Rule Municipal Service Occupation Tax of the City of McHenry
Municipal Code,within the City of McHenry, Illinois
WHEREAS,the City of McHenry, McHenry County, Illinois, is a home rule municipality as
contemplated under Article VII, Section 6, of the Constitution of the State of Illinois, and the passage
of this Ordinance constitutes an exercise of the City's home rule powers and functions as granted in the
Constitution of the State of Illinois; and
WHEREAS, pursuant to 65 ILCS 5/8-11-1 and 5/8-11-5 of the Illinois Municipal Code, the
City of McHenry imposed a %2 of 1% Home Rule Municipal Retailers Occupation Tax and a %z of 1%
Home Rule Municipal Service Occupation Tax within the City of McHenry by Ordinance No MC-10-
1016.
NOW, THEREFORE, BE IT ORDAINED, by the Mayor and City Council of the City of
McHenry, McHenry County, in the State of Illinois, that the McHenry Municipal Code be amended, as
follows:
SECTION 1: Chapter 23 Taxation Article IV Homes Rule Municipal Retailer's Occupation
Tax and Municipal Home Rule Service Occupation Tax be and shall be amended as follows:
A. Delete Section 23-37 and replace it in its entirety with the following:
Sec. 23-37. Home Rule Municipal Retailers' Occupation Tax. A tax is hereby imposed upon all
persons engaged in the business of selling tangible personal property (other than an item of
tangible personal property titled and registered with an agency of this State's government) at
retail in the City of McHenry at the rate of 1/2 of 1% of the gross receipts from such sales made in
the course of such business. Such"Home Rule Municipal Retailers' Occupation Tax" shall not be
applicable to the sale of food for human consumption that is to be consumed off the premises
where it is sold (other than alcoholic beverages, soft drinks and food that has been prepared for
immediate consumption) and prescription and non-prescription medicines, drugs, medical
appliances, and insulin, urine testing materials, syringes and needles used by diabetics.
B. Delete Section 23-38 and replace it in its entirety with the following:
Sec. 23-38. Home Rule Municipal Service Occupation Tax. A tax is hereby imposed upon all
persons engaged in the City of McHenry in the business of making sales of service at the rate of
1/2 of 1% of the selling price of all tangible personal property transferred by such servicemen
either in the form of tangible personal property or in the form of real estate as an incident to a
sale of service. Such "Home Rule Municipal Service Occupation Tax" shall not be applicable to
the sale of food for human consumption that is to be consumed off the premises where it is sold
(other than alcoholic beverages, soft drinks and food that has been prepared for immediate
consumption) and prescription and non-prescription medicines, drugs, medical appliances, and
insulin, urine testing materials, syringes and needles used by diabetics.
SECTION 2: Said Home Rule Municipal Retailer's Occupation Tax and Home Rule
Municipal Service Occupation Tax shall be effective January 1, 2011.
SECTION 3: The City Clerk is hereby directed to file a certified copy of this ordinance with
the Illinois Department of Revenue as soon as practicable after its passage.
SECTION 4: This ordinance shall be in effect upon its passage, approval and publication as
provided by law.

Pizza Hut of America, Inc. d/b/a Pizza Hut Store # 405189 has sold the restaurant
located at 4401 West Elm Street to Franchise Management Investors US, LLC.
Consequently, the new owners are requesting approval for the transfer of the Class
H-1 liquor license for this establishment.
The new owners are conversant with the State of Illinois liquor control regulations
and the restaurant manager will not change. A $250 transfer fee has been paid and
all paperwork has been submitted.
Recommendation: It is the Mayor's recommendation to authorize the transfer of
the Class H-1 liquor license to Franchise Management Investors US, LLC d/b/a Pizza
Hut Store #405189 located at 4401 West Elm Street, and all employees involved
in the sale of alcohol obtain BASSET certification.

to the property where the licensed premises is located.
7. Allow patrons to serve or distribute alcoholic beverages to minors on the licensed premises or allow minors to drink alcoholic
beverages on the licensed premises.

license to serve beer and wine for "A Chicago Bears Talk with Brian
McCasky" event on Friday, October 22, 2010 from 6:00 PM to 10:00
PM.
The Church of Holy Apostles is hosting "A Chicago Bear Talk with Brian McCasky"
event in the church Bell Tower room on Friday, October 22n1. The church is
requesting permission to serve beer and wine at the event from 6:00 PM to 1 1 :00
PM.
Attached is a letter from Michael Schneider, Business Manager for the church and
special event liquor license application. The $25 license fee has been paid and all
required information has been submitted to the city. If approved, this would be the
church's fifth special event license this year. The Municipal Code currently allows
no more than eight special event liquors licenses in a calendar year.
Recommendation: To grant a special event liquor license to The Church of Holy
Apostles to serve beer and wine on church property for a church event on Friday,
October 22nd from 6:00 PM to 1 1 :00 PM.

RE: Authorization to Purchase a Portable Truck Scale
Background. State law prohibits trucks over 80,000 pounds on designated local roads and
streets. Overweight vehicles present several traffic safety issues, including diminished braking
capabilities, fatigued structural components, and potentially fatal equipment violations, that pose
a threat to other motorists. In addition, overweight trucks cause damage to roads and streets that
increase maintenance costs and decrease the useful life of roadway surfaces.
The Police Department's truck enforcement unit consists of seven patrol officers, which have all
received at least 40 hours of specialized training on truck enforcement. The unit's enforcement
efforts are focused on Route 120 and other main arteries of the city designated for trucks. The
vast majority of the traffic citations issued by officers in the unit are for safety violations that
endanger the well being of other motorists.
Analysis. Currently, the Police Department does not have a scale to weigh vehicles when doing
enforcement details. As a result, patrol officers conducting stops must take vehicles to Meyer
Material in order to be weighed. This takes up to an additional thirty minutes of officers' time
and,at certain times, scales are not available for city use thus preventing enforcement.
Portable scales are used by many communities to weigh a vehicle at the point of the traffic stop.
If the department receives authorization to obtain a scale, it will continue to allocate the same
number of officers to enforcement on day shifts and weekends. However, additional time will be
devoted to enforcement since officers will not be spending time taking vehicles to get weighed at
Meyer Material.
The Police Department received three price quotes for portable scales. Staff is seeking
authorization to purchase a portable scale for$8,895 (including$500 for initial certification)from
Walz Scale, the company providing the lowest quote for the item. The scales are required to be
recertified annually at a cost of$720 per pair. If approved, this purchase will be charged to the
Police Department budget for the 2010/11 fiscal year.
Recommendation. Staff seeks authorization to purchase a portable scale for overweight truck
enforcement.

Background. Based on difficulties experienced by the Construction and Neighborhood Services
staff with enforcing certain sections of the sign ordinance, staff has reevaluated the regulations
for removal of unsafe, abandoned, or unlawful signs.
Regarding illegally posted or damage signs, the current ordinance provides property owners 14
days to remove said sign after which the council may authorize a judicial process to cause the
sign to be removed. Staff is of the opinion that the 14-day provision is impractical due to the fact
that it allows the sign to be posted an additional 14 days. Staff recommends the timeframe to
remove the illegally posted or damaged sign be reduced to three days.
Regarding abandoned signs, the ordinance currently provides property owners 120 days to
remove abandoned signs advertising a business or service no longer located at the site. Staff
recommends that this provision be reduced to 60 days.
The Community Development Committee and Planning and Zoning Commission concur with
staff s recommendations.
Analysis. Staff is proposing the attached amendment reducing the notice period from 14 days to
three days for unsafe signs or signs posted without a permit; and, reducing the 120 day time
frame to remove abandoned signs to 60 days. In addition, language in the amended ordinance
has been added to reflect the use of the administrative adjudication process as the method of
enforcement for these matters.
Recommendation. Approval of the attached text amendment to Chapter IX of the McHenry
Zoning Ordinance as presented.
ORDINANCE NO.
AN ORDINANCE ADOPTING A TEXT AMENDMENT TO THE
CITY OF MCHENRY, ILLINOIS ZONING ORDINANCE
WHEREAS, a petition has been filed by the City of McHenry requesting a text
amendment to the City of McHenry Zoning Ordinance; and
WHEREAS, a public hearing on said petition was held before the Planning and Zoning
Commission on August 19, 2010 in the manner prescribed by ordinance and statute, and as a
result of said hearing, the Planning and Zoning Commission did recommend to the City Council
the granting of the requested zoning text amendment; and
WHEREAS, the City Council has considered the evidence and recommendation from the
Planning and Zoning Commission and finds that the approval of the zoning text amendment
currently requested and approved by this ordinance are consistent with the objectives of the City
of McHenry Zoning Ordinance to protect the public health, safety, morals and general welfare of
its residents.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF MCHENRY, MCHENRY COUNTY, ILLINOIS, AS FOLLOWS:
SECTION 1. That Chapter IX Signs (C) Administration is hereby amended by deleting
the following language:
"d. Removal of Unsafe, Abandoned, or Unlawful signs Any sign as defined herein
that no longer identifies a business, activity, event, or service conducted or product, service, or
entertainment sold on the premises where the sign is located shall be considered abandoned. An
abandoned sign shall be removed entirely by the property owner within 120 days after such
business, activity, event, or service ceases operation, or product, service or entertainment is no
longer sold on the premises. In lieu of removing an abandoned sign in its entirety, a property
owner must remove the sign all identification pertaining to the former business and shall install a
blank, white panel in the area containing the sign's message.
If upon inspection the Zoning Administrator finds that a sign is abandoned, unsafe, or in
any way not in compliance with City ordinances, he or she shall issue a written order to the
permittee stating the nature of the violation and requiring the repair, replacement, or removal of
the sign within 14 days of the date of the order.
If after 14 days of issuance an order has not been complied with, or if a sign constitutes
an immediate hazard to the public safety, the Zoning Administrator may recommend to the City
Council that it authorize judicial process to causes the sign to be removed or repaired pursuant to
the provisions concerning Unsafe Buildings of Chapter 24, Article 11, of the Illinois Revised
Statutes.
After any removal of a sign through judicial process, the Zoning Administrator shall send
a notice to the sign owner stating the nature of the removal work performed and demanding
payment of the cost thereof plus 10 percent for inspection and administration costs. If said
amount is not paid within 30 days of the notice, it shall become a lien against the property of the
sign owner"
And replacing it with the following language;

SECTION 2: All Ordinances or parts thereof in conflict with the terms and provisions
hereof are hereby repealed to the extent of such conflict.
SECTION 3: This Ordinance shall be published in pamphlet form by and under the
authority of the corporate authorities of the City of McHenry, McHenry County, Illinois.
SECTION 4: This Ordinance shall be in full force and effect from and after its passage,
approval, and publication in pamphlet form as provided by law.

Discussion: Temporary Signs and Banners
Deputy City Administrator Martin noted Staff has had an issue with businesses posting temporary signs
and banners without benefit of a building permit. The ordinance currently provides for a 14-day window
during which unlawful or non-permitted signs must be removed. It is Staff s recommendation that the
14-day period be reduced to five days in order to secure compliance within five days of the violation. He
noted Staff has encountered various businesses who post a temporary sale banner, Staff sends a violation
notice, the business maintains the offending sign for 14 days, and then removes it. However, the event
has already been advertised with an unlawful sign for 14 days. Staff is seeking approval to recommend
amending the Zoning Ordinance to require compliance within five days.
Chairman Condon opined the sign should be removed or brought into compliance within three days.
Alderman Santi concurred.
Alderman Peterson inquired if the reference is to commercial signs only. Deputy City Administrator
Martin responded the temporary signs being discussed are used when people want to draw attention to
something or a specific event(sale, etc). He noted the signs or banners are posted in both commercial or
residential districts.
Motion by Santi, seconded by Peterson, to recommend to City Council that a proposed amendment
relating to the period of compliance for unlawful and/or non-permitted temporary signs be reduced from
14 days to three days be sent to the Planning and Zoning Commission for Public Hearing.

Test Amendment—Illegal Signs
Interim Chairman Schepler called the Public Hearing to order at 8:23 p.m. regarding File No Z-757, an
application for text amendment relating to illegal signs as submitted by the City of McHenry.
Interim Chairman Schepler stated Notice of the Public Hearing was published in the Northwest Herald
on July 30, 2010.A Certificate of Publication is on file in the City Clerk's Office.
Deputy City Administrator Martin provided the Commission with the Staff Report regarding this matter.
He noted Staff has noted great difficulty in enforcing the City's sign ordinance, particularly as it relates to
temporary signs or illegal signs. The ordinance currently provides for a 14-day window in which these
signs must be removed. The matter was recently discussed at the Community Development Committee
where a recommendation was made to amend the ordinance to provide for removal of such signs within
three days of notice of violation.
Deputy City Administrator Martin noted currently if an illegal sign is posted Staff must provide 14 days
for the sign to be removed or otherwise brought into compliance. In many instances the business is
provided with a fourteen-day free advertising mechanism due to the latitude granted by the 14-day
compliance factor. He noted initially it was Staff's recommendation to require compliance within five
days of notification. Following discussions at the committee level, the recommendation was made to
require compliance within three days of notification. This is the recommendation before the
Commission for consideration this evening.
Interim Chairman Schepler opened the floor to questions and comments from the Commission.
The question was raised as to how the issued would be addressed if the violator claimed they "never
received notice of the violation". Deputy City Administrator Martin responded it would be handled in
the same manner as any other code violations. The goal is compliance with the Municipal Code and
Zoning Ordinance.
Clarification was sought as to what would happen if a sign is posted without benefit of securing a
permit. Deputy City Administrator responded the sign would have to be removed within three days of
notification of the violation. In response to an inquiry, Deputy City Administrator Martin noted the
Construction and Neighborhood Services enforces code compliance.
When asked if violations would be instigated by Staff observation, Deputy City Administrator noted the
violations would typically be complaint driven as well as noted by Staff observation during the course of
performing their daily inspections. He further noted the proposed amendment from fourteen-day
compliance to three-day compliance is due to abuse of the sign ordinance, particularly as it relates to
posting of temporary signs and banners.
Discussion occurred regarding signs left in place following a company going out of business. Deputy City
Administrator Martin noted the ordinance currently stipulates that these "abandoned" signs must be
removed within 120 days of the company going out of business. Discussion continued regarding the
need to remove abandoned signs more quickly.

Question was raised as to an annual renewal of approved signs. Deputy City Administrator Martin
responded the ordinance does not currently require annual permit renewal.
Interim Chairman Schepler noted there was no one in the audience who wished to comment on this
matter.

request for text amendment relating to removal of illegal signs within three days of notification be
approved

Administrator Martin noted the Public Notice informs the public that the application being considered
by the Commission is available for viewing in the Office of the City Clerk in advance of the Public
Hearing.
Thacker noted the last time there was a large audience present for a Public Hearing the people moved
to a place where they could view the exhibits along with the Commission.The members of the audience
can always relocate so they can see the Petitioner's exhibits.

RE: Award of Bid for Holiday Tree Lighting in Veterans Memorial Park
RECOMMENDATION: To award the bid for installation, maintenance, and removal of
holiday lighting in Veterans Memorial Park to Temple Display, Inc. in the amount of
$14,699.82.
Background. For the past five years, the city has hired a professional contractor to install
holiday lighting in a number of trees throughout Veterans Memorial Park. The goal of installing
lights in the park was part of an overall strategy to promote the downtown area and to attract
residents to the area during the holiday season. The lights were well received by residents,
several of which called the city to express their gratitude.
Due to the success of the park lighting over the past several seasons, $17,500 was included in the
2010/11 budget and staff put together specifications to competitively bid the project for the
2010/11 season. Three bids were received for the project as follows:

Temple Display, who installed Holiday Lighting in Veterans Park last year, is again the low
bidder. The project is scheduled to be completed by Saturday, November 20, 2010, in
preparation for the Downtown Christmas Walk and Annual Toys for Tots Parade scheduled for
Sunday,November 21, 2010. At that time, there will also be a brief lighting ceremony to turn on
the lights for the season.
In addition, the contract includes maintenance throughout the holiday season and removal of the
lights on or after January 31, 2011, and no later than February 4, 2011.
