Vista Terrace)with a suggestion that parking regulations would be more effective if the fines levied for violators were higher than the existing amount. In particular,Mr. Benedek referenced overnight parking on city streets. Parking regulations are addressed in Article VI of the Traffic and Motor Vehicle Code for the City of McHenry while fines for violations of these regulations are addressed in Article X- Penalties. In researching this topic for the committee discussion, staff became aware of a conflict within the Traffic Code. Section 13-1004 states the following: "The penalty for all parking offenses with the exception of violation of fire lane(625 ILCS 5/11-209(h),fire hydrant(625 ILCS 5/11-1303(a)(2b),and unauthorized use of parking spaces reserved for persons with disabilities(625 ILCS 5/11-1301.3)shall be not less than$50.00 and not more than$500.00. The penalty for violation of a fire lane and violation of a fire hydrant shall be not less than$100.00 nor more than $500.00." However, Section 13-1008 identifies fines paid within 48 hours of the violation as being $5.00 increasing to $10.00 if paid later than 48 hours but less than 72 hours after the violation. The Deputy City Clerk provided minutes from a City Council meeting in October 1998 which states, "...City Administrator Lobaito also noted the penalty section of the City of McHenry's current Traffic Motor Vehicle Code was modified. The previous three-tier penalty payment schedule has been reduced to a two-tier schedule. In addition fine amounts for vehicle sticker violations,and illegal parking and handicapped parking stall,have been increased." The amount to which the illegal parking fines were increased is not identified in the minutes. Staff is asking for direction from the Public Works Committee on the level of parking fines. PENALTIES 13-1001 PENALTY. All Penalty provisions contained or referred to or incorporated in subsection 13-001 are also adopted and incorporated,including but not limited to those contained in the Unified Code of Corrections(730 ILCS 511-1-1 et seq.),as Subsection 13-001 of the Municipal Code,City of McHenry,Illinois,with the exception of the fine penalties listed forpersons found guilty ofviolating Subsection 13-001,pars.6-303,11-501(a)(1);11-501(a)(2); 11-501(a)(3);and 11-501(a)(4). 13-1002 DRIVING WHILE DRIVER'S LICENSE,PERMIT,OR PRIVILEGE TO OPERATE A MOTOR VEHICLE IS SUSPENDED OR REVOKED. Any person found guilty of violating Subsection 13-001,par.6-303 shall be fined not less than$250.00 normore than$2,500.00. 13-1003 DRIVING WHILE UNDER THE INFLUENCE OF ALCOHOL,OTHER DRUG,OR COMBINATION OF BOTH. Any person found guilty of violating Subsection 13-001,pars.ll-501(a)(1);11-501(a)(2);11-501(a)(3);and 11- 501(a)(4)shall be fined not less than$750.00 nor more than$2,500.00. 1j-Ib04 PARKING PENALTY. The penalty for violation of a fire lane and violation of a fire hydrant shall be not less than$100.00 nor more than$500.00 13-1005 UNAUTHORIZED USE OF PARKING PLACES RESERVED FOR PERSONS WITH DISABILITIES.(MC-07- 935) The penalty for the unauthorized use of parking places reserved for persons with disabilities shall be$250.00 in addition to any costs or charges connected with the removal or storage of any motor vehicle authorized under 625 ILCS 5/11-1301.3. 13-1006 GENERAL PENALTY. Unless otherwise provided,any person,firm or corporation violating any section of this Chapter 13 shall be fined not less than$75.00,nor more than$750.00 for each offense. Each day on which a violation occurs or continues shall be deemed to be a separate offense. -70- 12/08 13-1007 COST OF PROSECUTION. Director Batt outlined the differences between the "liquidated damages" clause in the proposed contractual agreement, as opposed to the previous contractual agreements used on Phase I and Phase II of this Project. He noted the new language was more consistent and reflective of Illinois Department of Transportation "liquidated damages" language. AMENDMENT TO THE TRAFFIC MOTOR VEHICLE CODE City Administrator Lobaito reported, in a cooperative effort between Staff, City prosecuting Attorney McAndrews, and City Attorney McArdle, Chapter 13 of the City of McHenry Municipal Code, Traffic and Motor Vehicles, was amended to incorporate specific sections of the Illinois Vehicle Code. Sections 5/1, 5/6, 5/11, 5/12, 5/15, 5/16, 5/20, and 25/1 will be adopted in their entirety. City Administrator Lobaito reminded Council Staff had been directed to review the existing City of McHenry snowmobile ordinance. Incorporation of Illinois State Statute Act 40, Snowmobile Registration and Safety Act, eliminates the need for any further action. City Administrator Lobaito also noted the penalty section of the City of McHenry's current Traffic Motor Vehicle Code was modified. The previous three-tier penalty payment schedule has been reduced to a two-tier schedule. In addition fine amounts for vehicle sticker violations, and illegal parking and handicapped parking stalls, have been increased. In response to Alderman Bolger's inquiry, City Administrator Lobaito noted the increased vehicle sticker penalty was for ticketed violations. It would not affect the $3/month late fee. Motion by McClatchey, seconded by Murgatroyd, to pass an ordinance amending Chapter 13 of the City of McHenry Municipal Code, Traffic and Motor Vehicles, Sections 5/1, 5/6, 5/11, 5/12, 5/15, 5/16, 5/20, and 25/1, as presented. Voting Aye: Bolger, Glab, McClatchey, Murgatroyd, Baird. Voting Nay: None. Absent: None. Motion carried. COMMITTEE MEMORANDUM TO: Public Works Committee FROM: Doug Maxeiner, City Administrator "✓ FOR: March 1,2010 Public Works Committee Meeting RE: Green Street Business District Parking During and after the discussion on the Riverwalk Center parking situation,the City Council expressed an interest in having a committee discuss parking in the Green Street Business District. The item is being referred to the Public Works Committee since this committee has historically overseen parking concerns. For discussion purposes, an inventory of existing and proposed parking in the Green Street District is attached. At the current time,there are 509 total spaces identified in the inventory with 208 spaces identified as part of the public inventory(173 existing and 35 in various stages of permitting/construction).
