Engineering Services Agreement Background. The American Recovery and Reinvestment Act (ARRA) has earmarked approximately $4.7 million for transportation projects for local governments in McHenry County. The McHenry County Council of Mayors decided to divide the allocation equally between its members. As such, a call for projects was recently issued for members to submit one shovel ready project eligible for ARRA funding. One of the requirements for submittal is that the road is designated as a Federal Aid Urban (FAU) collector route. As City Council may recall, staff submitted Ridge Road for ARRA funding. The scope of the project is from 240 feet south of Deerwood Trial to 600 feet south of Route 120. ARRA funding will cover 100% of the total cost of construction and Phase III engineering. The city is responsible for 100% of the cost of Phase I and II Engineering. Analysis.Ridge Road resurfacing was approved for ARRA funding though the McHenry County Council of Mayors. SEC Group, Inc. estimates the total cost of construction including Phase III engineering at $262,105 (100% funding from the ARRA Program) and will be scheduled for an Illinois Department of Transportation(IDOT)June 2009 letting. SEC Group has submitted a proposal for Phase I and II engineering to include completing and submitting all required forms to IDOT and Chicago Metropolitan Agency for Planning (CMAP) as well as preparation of contract plans, specifications, and estimates. The engineering service fee for the contract is $20,000 which will be charged to the Motor Fuel Tax(MFT) account. Recommendation. Staff requests authorization to enter into an engineering service agreement with SEC Group, Inc. for Phase I and II engineering of the Ridge Road resurfacing project in an amount not to exceed$20,000 funded by the MFT account. The Federal funding is being utilized under Local Agency Pavement Preservation (LAPP) policy,therefore minimal amount of Phase I work will be required. The Phase II engineering work which consists of preparation of contract plans,special provisions and cost estimate will be completed in accordance with IDOT policy for LAPP projects and will be scheduled for an IDOT letting in Springfield. The improvements consist of milling and resurfacing the existing pavement,spot curb and gutter repairs,pavement patching,and pavement marking. Scope of Work Phase I Work: 1. Complete and submit a Job Number Request form to the Illinois Department of Transportation(IDOT). 2. Complete and submit a Local Agency Pavement Preservation(LAPP)Approval(BLR 33410) to IDOT which includes necessary exhibits(Location Map and Existing and Proposed Typical Sections). 3. Submit Sub-State Clearing House applications to Chicago Metropolitan Agency for Planning (CMAP)for approval. Phase II Engineering The Scope of Work will include preparation of Contract Plans, Specifications, and Estimates (PS&E)for the resurfacing of Ridge Road from approximately 240 Feet south of Deerwood Trail to approximately 600 Feet south of Illinois Route 120 within the City limits for a total distance of 4,975 Feet. Contract plans will be developed in accordance with IDOT requirements for a LAPP project.A field review of the project site will be completed to determine the location and quantity for patching, milling,pavement markings and other roadway related work, and as directed by the City to be included in the contract. Meetings 1. (3) To attend conferences at any reasonable time when requested to do so by representatives of the LA or the Department. (4) In the event plans or surveys are found to be in error during construction of the SECTION and revisions of the plans or survey corrections are necessary, the ENGINEER agrees that he will perform such work without expense to the LA, even though final payment has been received by him. He shall give immediate attention to these changes so there will be a minimum delay to the Contractor. (5) That basic survey notes and sketches, charts, computations and other data prepared or obtained by the Engineer pursuant to this AGREEMENT will be made available,upon request, to the LA or the DEPARTMENT without cost and without restriction or limitations as to their use. (6) That all plans and other documents furnished by the ENGINEER pursuant to this AGREEMENT will be endorsed by him and will show his professional seal where such is required by law. The LA Agrees, 1. Upon completion of detailed plans,special provisions, proposals and estimate of cost-being the work required by paragraphs 1a through 1g under THE ENGINEER AGREES-to the satisfaction of the LA and their approval by the DEPARTMENT,90 percent of the total fee due under this AGREEMENT based Pri the approvectestimate_of_cost. b. Upon award of the contract for the improvement by the LA and its approval by the DEPARTMENT, 100 percent of the total fee due under the AGREEMENT based on the awarded contract cost, less any amounts paid under"a" above. By Mutual agreement, partial payments, not to exceed 90 percent of the amount earned, may be made from time to time as the work progresses. 4. That,should the improvement be abandoned at any time after the ENGINEER has performed any part of the services provided for in paragraphs la, through 1 h and prior to the completion of such services, the LA shall reimburse the ENGINEER for his actual costs plus 162 percent incurred up to the time he is notified in writing of such abandonment-"actual cost"being defined as in paragraph 2 of THE LA AGREES. 5. That, should the LA require changes in any of the detailed plans, specifications or estimates except for those required pursuant to paragraph 4 of THE ENGINEER AGREEs,after they have been approved by the DEPARTMENT, the LA will pay the ENGINEER for such changes on the basis of actual cost plus 162 percent to cover profit, overhead and readiness to serve-"actual cost"being defined as in paragraph 2 of THE LA AGREES. it is understood that"changes"as used in this paragraph shall in no way relieve the ENGINEER of his responsibility to prepare a complete and adequate set of plans and specifications. It is Mutually Agreed, 1. That any difference between the ENGINEER and the LA concerning their interpretation of the provisions of this Agreement shall be referred to a committee of disinterested parties consisting of one member appointed by the ENGINEER, one member appointed by the LA and a third member appointed by the two other members for disposition and that the committee's decision shall be final. 2. This AGREEMENT may be terminated by the LA upon giving notice in writing to the ENGINEER at his last known post office address. Upon such termination, the ENGINEER shall cause to be delivered to the LA all surveys, permits, agreements, preliminary bridge design &hydraulic report, drawings, specifications, partial and completed estimates and data, if any from traffic studies and soil survey and subsurface investigations with the understanding that all such material becomes the property of the LA. The ENGINEER shall be paid for any services completed and any services partially completed in accordance with Section 4 of THE LA AGREES. 3. That if the contract for construction has not been awarded one year after the acceptance of the plans by the LA and their approval by the DEPARTMENT, the LA will pay the ENGINEER the balance of the engineering fee due to make 100 percent of the total fees due under this AGREEMENT, based on the estimate of cost as prepared by the ENGINEER and approved by the LA and the DEPARTMENT. 4. That the ENGINEER warrants that he/she has not employed or retained any company or person, other than a bona fide employee working solely for the ENGINEER, to solicit or secure this contract, and that he/she has not paid or agreed to pay any company or person, other than a bona fide employee working solely for the ENGINEER, any fee, commission, percentage, brokerage fee, gifts or any other consideration, contingent upon or resulting from the award or making of this contract. For Breach or violation of this warranty the LA shall have the right to annul this contract without liability. On April 23rd, the Mayor and staff met with the owner of the property-Allen Miller- to discuss the future of the Dobyn's House and the property commonly known as Miller's Point. Mr. Miller shared that renovation costs to restore the dwelling to a useable state have proven to be cost prohibitive. Insurance coverage.on the structure provides $1.0 million toward the renovation. However, total renovation costs are expected to exceed$1.25 million. As such, Mr. Miller has submitted an application for a demolition permit for the Dobyn's House as well as the two rental houses adjacent to the Dobyn's House property. At the conclusion of the meeting, Mr. Miller asked if the city were interested in purchasing the property. He offered that he would take down the three buildings and would provide approximately 2.3 acres of vacant land to the city for$1.2 million. While a current appraisal has not been completed on the land, staff believes that the current market value for the property exceeds $1.2 million. Mr. Miller recently had a contract in place for the sale of the property to a developer for$1.9 million. This sum included the three structures including the Dobyn's House. Staff is prepared to discuss Mr. Miller's proposal with the city council to determine if there is interest in pursuing this opportunity. Finance Director Black is currently assessing the status of the TIF as well as our financial capacity to make such an investment with the intent of redeveloping the site to finance continued downtown redevelopment efforts. The total contract amount approved by city council was $20,998 The netting portion of the renovation project for Field #2 is complete. During installation the contractor encountered, sandy unstable soils. Additional costs were incurred for additional excavation and for labor involved with the installation of the netting poles. This additional work amounted to an increase in the total cost of the project of $2,000, bringing the total contract price to $22,998. Analysis. During the course of the project, change orders were authorized for additional work to reroute antenna cables to the control panels along with the installation of explosion proof fittings at Broadway Drive, Willow Lane, East Dartmoor Drive, and Grove Avenue Lift Stations. CONSENT AGENDA ITEM A: ENGINEERING SERVICES AGREEMENT FOR SANITARY SYSTEM IMPROVEMENTS FOR CWWTP AND SWWTP — SEC GROUP, IN AN AMOUNT NOT-TO-EXCEED $521,709 In attendance was City Engineer Steve Cieslica of SEC Group. Alderman Peterson asked for an explanation of the proposed engineering services agreement for the improvements to the CVWVfP and SWWTP as proposed by SEC Group. Mr. Cieslica noted page 2 of the agreement outlined the scope of services, page 4 summarized the engineering and design services to be provided, and page 10 provided a breakdown of the man-hours required as well as a summary of the proposed fees to be incurred. City Administrator Maxeiner stated the City requested evaluation work be included in the agreement, particularly as the CVW TP equipment is obsolete and decaying. Alderman Peterson noted many companies do this type of work and inquired why no bids were sought to provide the work for the City. Mr. Cieslica responded there are perhaps five companies which could complete the work being requested. Alderman Glab inquired as to the estimated cost for the project. City Administrator Maxeiner responded approximately $3.5-$4 million. Alderman Glab recalled that data was previously accumulated regarding this project. He suggested the old data could be updated and thereby reduce the cost of the engineering services agreement. City Administrator Maxeiner responded previous data anticipated the March 30,2009 Page 5 abandonment of the CWWTP. The evaluation being sought at this time includes ten additional years of service for the CWWTP. Alderman Murgatroyd inquired if the agreement amount was a not-to-exceed figure. Mr. Cieslica responded in the affirmative. REQUEST FOR TEMPORARY USE FOR OUTDOOR PET ADOPTION EVENT ON MAY 2, 2009 AND MAY 3, 2009- PETSMART Deputy City Administrator Martin stated PetSmart, located at Shops at Fox River Shopping Center, has requested a temporary use to allow an outdoor pet adoption event on their premises. The event would be held on May 2 and 3, 2009. The event would offer dogs and cats for adoption. Approximately five to ten adoption agencies would participate. Deputy City Administrator Martin noted the applicant intends to utilize a 20' by 40' tent. Approximately 12 parking spaces would be impacted. Staff has reviewed the request and supports the event. SPECIAL USE APPLICATION FOR USE OF PETERSEN PARK ON JULY 21, 22, 23, 24 AND 26 FOR SIX PERFORMANCES OF SHAKESPEARE'S MUCH ADO ABOUT NOTHING- RIVERVIEW THEATER COMPANY Assistant City Administrator Hobson stated a request was submitted by Riverview Theater Company for a special use permit to host six performances of Shakespeare's Much Ado About Nothing at Petersen Park. The event would occur on July 21, 22, 23, 24 and 26, 2009. Assistant City Administrator Hobson noted the event was held for the first time last year and was enthusiastically received by the community. He suggested fees for temporary use in City parks be addressed at committee level. Alderman Murgatroyd noted current fees are based upon the number of people expected to attend an event. He opined once preparations to host the event have been completed, the number of days an event occurs is immaterial. Alderman Wimmer concurred with Alderman Murgatroyd. Alderman Condon inquired if there were any issues with the hosting of the event last year. Assistant City Administrator Hobson replied there were no issues brought forward due to the hosting of the event. AUTHORIZATION TO CONTRACT FOR REPAIRS OF ICE-DAMAGED PIERS AT RIVIERA MARINA— REINWALL REPAIRS, IN THE AMOUNT OF $8,000 City Administrator Maxeiner stated as Council will recall, D's Marine Service leases the City's Riviera Marina property on an annual basis. The owner of the business, Jerry Danko has informed the City there was substantial pier damage incurred as a result of the harsh winter. Staff solicited quotes for pier repairs with the lowest quote being submitted by Reinwall Repairs in the amount of $8,000. It is therefore Staffs recommendation to authorize Reinwall Repairs to repair the damaged piers in the amount not-to-exceed $8,000. Alderman Santi noted the repairs must be done. • March 30,2009 Page 7 Alderman Glab inquired if the piers were removed from the water during the winter would the repair costs be reduced. City Administrator Maxeiner stated Staff investigated and found the cost of removing the piers and replacing them for the spring/summer season would be about the same as providing new piers. Alderman Wimmer concurred with Staffs recommendation noting Reinwall Repairs has always done a good job in the past for similar projects. Motion carried FIELD LIGHTING AT PETERSEN PARK FIELD #2 CHANGE ORDER #1 IN THE AMOUNT OF $30,000 City Administrator Maxeiner stated the contract for lighting Petersen Park Field #2 was awarded to Ridgeview Electric by Council at its February 9, 2009 regularly scheduled meeting. Staff was notified on March 25th that the contractor has encountered difficulties in providing the needed 15' concrete base at existing locations. Consequently, with the relocation of the concrete base for standards, an additional $30,000 is anticipated for the complete of this portion of the project. City Administrator Maxeiner noted funding for the additional expense would come from the Parks Developer Donation Fund. Alderman Condon stated the City is committed to the project and expressed disappointment with the added cost, but acknowledged the City should continue to move forward with it. Alderman Santi inquired if the anticipated $30,000 could be a not-to-exceed amount. City Administrator Maxeiner responded if the cost exceeds $30,000, Staff would come back to Council for authorization. Alderman Murgatroyd reiterated that the Parks Developer Donation Fund must be used for park-related items. Alderman Peterson requested clarification regarding the need for the change order. Steve Cieslica of SEC Group detailed the engineering technique required for placement of light standards and the concrete base to be installed to support the standards. Bids were sought and opened on March 31, 2009. The lowest responsible bidder was Carmichael Construction Inc in the amount of$28,726. Assistant City Administrator Hobson noted the project includes the utilization of steel beams and support posts which will relieve the load on the natural stone foundation of the building. The stone walls will be tuck-pointed and will remain visible as an example of 1840's architecture. It is Staffs recommendation to award the bid for the repair and restoration of the Petersen Farm Homestead foundation to Carmichael Construction Inc., in the amount not-to-exceed $28,726. Alderman Murgatroyd stated he is pleased the work on the foundation is moving forward at this time. Alderman Peterson expressed pleasure that the bid came in lower than the anticipated cost of$47,150. April 6,2009 Page 4 Alderman Condon noted the building is a McHenry treasure which should be preserved and protected. Alderman Santi concurred with Aldermen Murgatroyd and Condon. He stated he is happy that at some point the building will be open to the public. Alderman Glab, referencing the current state of the economy, expressed surprise there were only two bids submitted for the project. Assistant City Administrator Hobson noted that although six bid packets were requested for the project, only two bids were submitted. According to the owner of the restaurant many customers have a hard time locating the restaurant. Request To remedy this dilemma, the owner of Toluca's restaurant is seeking a sign variance to allow an approximately 34 square foot projecting sign on the face of their building. However, projecting signs are only permitted in the C-4, Downtown Zoning District however. The subject property is zoned C-5, Highway Commercial District but is adjacent to the Main Street downtown district. Staff Analysis In accordance with the City's zoning ordinance Toluca's would be permitted to have a 66 square foot freestanding sign however a five foot setback is required for the sign. Currently, the building is only setback 11'6" from the property line. Given the current building setback and sign setback requirement it is not practical to place a freestanding sign on the property. The projecting sign provides a better opportunity for the restaurant to advertise and the style is compatible with the building. Staff recommends that this variance be tied to the existing restaurant use. If at some point another use locates on the property this variance would be considered revoked. IJ NORTH SHORE SIGN Community Development City of McHenry 333 S. Green St. McHenry, IL 60050 Dear Sir or Madame, North Shore Sign is applying for relief from the City of McHenry sign ordinance on behalf of Armando Lagunas proprietor of Toluca's Mexican Restaurant. We are proposing the installation of a projecting sign in lieu of a pole sign which would be allowed per code. The following hardships are the basis for the variance request. A sign that is perpendicular to the roadway would create significantly more visibility for Toluca's and allow customers and passersby to identify the property sooner and signal their intent to enter the parking lot. One of the major complaints Mr. Lagunas receives from customers and his website is that people have difficulty finding his establishment. The central issue is the buildings proximity to the property line (11' 6") coupled with the required setback of 5' for any sign. The engaged clay roof tiles that run the length of the building project another 2' 6". This leaves only 4' width for the installation of a pole sign. Assuming you do not want the pole sign touching the building, a 3' wide pole sign would be the limit. Secondly, the ground in front of the restaurant is composed of asphalt and concrete sidewalk. The installation of a pole and concrete foundation would be much more costly and require tearing up the existing walkways. This pole would then be an impediment to pedestrian traffic, snow plowing, etc. Thirdly, additional areas of sidewalk would have to be removed to create the required planting beds and electrical conduit would have to be trenched to the signs location. This of course would have to be done at considerable cost. Lastly, the projecting sign would look much more attractive and add flair to the building instead of having a pole out front. This translates to a $23,750 increase in average sales revenues for a typical store in the study group with annual sales of$500,000. On average, one additional on-premise sign increased the annual number of transactions by 3.93%. This translates into more than 3,900 additional transactions for a store with an annual average of 100,000 transactions. On average, one additional 36-square-foot wall sign added $0.06 per transaction, while one additional 144-square-foot pole sign added $0.78 per transaction. The addition of new signage to previously unsigned buildings, and the replacement of existing signage (generally, with larger signs) resulted in an average revenue increase of 5%. The addition of a pole sign, or a plaza identity sign including the store's name, resulted in an average increase in weekly sales of 5-10%. The applicant is requesting approval of a Zoning Map Amendment from E-Estate District to RM-2 High-Density Multi-Family Residential to construct two (2-story) multi-family residential buildings containing 12 dwelling units each for a total of 24 dwelling units. There will be a covered walkway connecting the two buildings so for zoning purposes it is considered one building. There will also be a multi-car garage that will accommodate 10 vehicles. An additional 54 open parking stalls will be provided for both residents and guests, totaling 64 parking spaces on-site. The property will have one access point onto Bull Valley Road. Analysis. The character of the area in close proximity to the site on Bull Valley Road and Charles Miller Road, a regional east-west major arterial, consists of different densities and types of residential land uses. The homes immediately to the south of the subject property are located in unincorporated McHenry County and zoned R-1, single-family residential. The lots are larger residential properties. The average lot size is approximately 28,000 square feet yielding a density of approximately 1.5 units per acre. The RS-3 City zoning to the southeast, within the McHenry Shores Subdivision, is a medium-high density single-family residential zoning district. Density in this district is approximately 4.5 units per acre and the average lot size is approximately 9,000 square feet. To the east of the subject property is a house that was annexed to the City in 2000 and zoned RS- 1. This property is approximately 1.5 acres and received a use variance for outdoor storage of vehicles and equipment and contractor's operation. To the west of the subject property is vacant land owned by McHenry County currently being used for stormwater detention for Charles Miller Road and not planned for future development at this time. To the north is property zoned RM-1, consisting of 154 senior age-restricted condominiums and a memory care facility. This density is approximately 12 units per acre. The actual density for the proposed development is 12.18 units per acre which is comparable to the senior living and memory care facilities. According to the Comprehensive Plan the subject property is designated medium-density residential. Staff believes this density is appropriate and an apartments acts as a transitional land use and buffer between the future expansion of Charles Miller Road to a five-lane highway and the single-family residential to the south. In addition, apartment land uses are appropriate in locations which are in close proximity to a major roadway. The applicant complies with all parking regulations required by the zoning ordinance. A total of 64 parking spaces, 10 of which are garage spaces, are provided in the proposed development, by code 56 parking spaces are required for this development. There is only one vehicle entrance planned for the development which will be located on the southeast side of the property allowing access to Bull Valley Road. In accordance with the studies compiled by the Institute of Transportation Engineers, Trip Generation, 6th Edition, the average number of trips generated by an apartment dwelling unit is 6.63 trips per unit on a weekday resulting in an estimated 159 trips per weekday for the 24 unit development. Existing road improvement plans sponsored by McHenry County and the city show Charles Miller Road is scheduled for improvement to a five-lane highway with turn lanes within the next few years. In 2004, approximately 10,000 vehicles daily traversed this section of roadway and that number is expected to more than triple to approximately 34,000 vehicles per day by 2030. An apartment land use, such as the one proposed, is more suitable to this type of traffic volume than a single-family residence. The term highest and best use refers to a land use which makes the most economic sense and is compatible with its surrounding environment. This is a redevelopment since there are existing structures on-site and, in staff's opinion, the highest and best use for this redevelopment is a multi-family land use. Recommendation. The Planning and Zoning Commission entertained a motion to recommend denial of the request. However, since the vote was a tie (3-3) there is no recommendation forthcoming from the Planning and Zoning Commission. Staff recommends approval of the Zoning Map Amendment from E-Estate District to RM-2 High-Density Multi-Family Residential at 3320 Bull Valley Road. Staff finds that the requirements in Chapter XVI, Table 33 of the Zoning Ordinance have been met. ORDINANCE NO. An additional 54 open parking stalls will be provided for both residents and guests, totaling 64 parking spaces on-site. The property will have one access point, onto Bull Valley Road. A large storm water detention basin is proposed for the northwest corner of the subject property and all stormwater will be flow to the detention basin prior to being release at a controlled rate. Background In October of 2001, the Planning and Zoning Commission considered a request by Avonlea Cottage to annex the subject property and construct a 16-bed assisted living facility. Several residents expressed concerns about the potential noise, traffic, and the perceived commercial nature of the activity. Subsequently,the City Council denied the request. In July and September of 2003, the Planning and Zoning Commission considered a request by the current applicant for a similar project, a three-story 24-unit apartment complex. The increasing number of forecloses and decreasing home values over the past year,along with credit reform show that real estate trends for the next few years will be towards a rental market. Density in this district is approximately 4.5 units per acre and the average lot size is approximately 9,000 square feet. To the east of the subject property is a house that was annexed to the City in 2000 and zoned RS-1. This property is approximately 1.5 acres and received a use variance for outdoor storage of vehicles and equipment and contractor's operation. To the west of the subject property is vacant land owned by McHenry County currently being use for stormwater detention for Charles Miller Road and not planned for future development at this time. To the north is property zoned RM-1, consisting of 154 senior age- restricted condominiums and a memory care facility. This density is approximately 12 units per acre. Density According to Chapter IV Table 4 of the Zoning Ordinance 3,111 sq. ft. of lot area is required for each two-bedroom unit within RM-2 zoning classification. The 24-unit apartment complex would be required to be located on a lot equaling 74,664 sq. ft. The subject property provides 85,813 sq. ft. which is 11,149 sq. ft. more than what is required for this density. The actual density is12.18 units per acre which is comparable to the senior living and memory care facilities located across the street which is also 12 units per acre. In chapter 4 of the Comprehensive Plan it states that, "the land use depicted does not necessary reflect the zoning of individual parcels or the desired specific zoning category, but the general use of the property based on the average uses and density in the area." Staff believes this density is appropriate and an apartments acts as a transitional land use and buffer between the future expansion of Charles Miller Road to a five lane highway and the single-family residential to the south. In addition, apartment land uses are appropriate in locations which are in close proximity to a major roadway. File#Z-738 Page 2 of 5 Community Development Department Report File# Z-738 February 19, 2009, Public Hearing Architectural Standards As a result of the site layout and having a two-story building, the mass and scale is visually related to the established roof line of the neighborhood. The architecture is of a Classic Revival Style with a hip roof, gable features and wall dormers.The windows are of a colonial style to allow for larger frames. The buildings will be 100%masonry material and the siding will be of a hardy plank made of concrete. A brick half wall will sound each building, as well as creating a center feature on each side. A covered walkway will connect the two building and covered porticos will be at opposite entrances. Each unit will have access to either a covered balcony or patio with column style supports. The multi-car garage will match in style and color to the principal buildings and the trash receptacles will be hidden by a fenced dumpster enclosure on the north side of the garage. Parking and Access The applicant complies with all parking regulations required by the zoning ordinance. A totally of 64 parking spaces, ten of which are garage spaces, are provided in the proposed development, by code 56 parking spaces are required for this development. There is only one entrance planned for the southeast end of the property allowing access to Bull Valley Road. McHenry County is limiting access points onto Charles Miller Road so any alternative access to the north is not an option. With the proposed expansion of Charles Miller Road the western connection of Bull Valley Road will be improved as a part of phase one and the eastern connection to Bull Valley Road off of McHenry Ave. will be improved as a part of phase two. In addition, staff has consulted with the City Engineer about possible land acquisition, from the subject property, for the proposed expansion and how that may affect the subject property. Some right-of-way from this property will be required. The applicant is aware of this and has been working with their engineer to see how this may impact the site layout. Traffic Analysis The Institute of Transportation Engineers, Trip Generation, 6di Edition, consists of a compilation of traffic and trip-related surveys for residential, commercial, industrial and other land uses over an extended time period, typically 20 years or more. The studies are performed throughout the United States and Canada. In accordance with the studies compiled by the Institute of Transportation Engineers, Trip Generation, 6th Edition, the average number of trips generated by an apartment dwelling unit is 6.63 trips per unit on a weekday. An apartment dwelling unit is described as a rental unit located within the same building with as least three other dwelling units. A trip is defined as a vehicle exiting or entering the site. In comparison to an apartment dwelling unit, the average number of trips generated by a single-family detached house is 9.57 trips per dwelling unit on a weekday. This rate was also taken using the same methods as the rate for apartment units. The proposed apartment complex for the site on Bull Valley Road would have 24 dwelling units which equates to approximately 159 trips per weekday. Charles Miller Road, as previously mentioned, will be improved to a five-lane highway with turn lanes. In 2004, approximately 10,000 vehicles daily traversed this section of roadway and that number is expected to more than triple to approximately 34,000 vehicles per day by 2030. An apartment land use, such as the one proposed, is more suitable to this type of traffic volume than a single-family residence. The term highest and best use refers to a land use which makes the most economic sense and is compatible with its File#Z-738 Page 3 of 5 Community Development Department Report File # Z-738 February 19, 2009, Public Hearing surrounding environment. This is a redevelopment since there are existing structures on-site and, in staffs opinion, the highest and best use for this redevelopment is a multi-family land use. Landscaping There is already natural vegetation existing on the site and the applicant will add additional landscaping in accordance with the landscape ordinance. The new landscaping will located be around the foundation base of each building, within parking inlands and to fill-in some of the existing vegetation to create a landscaping screening strip around the property. Utilities Water and electric will be run from the north side of the property under Charles Miller Road. By EPA regulations the water connection must be made with a main because it is supplying water to two buildings. Sewer will be run from the west along Bull Valley Road on the south side of the street. The connection that runs from the north side of Charles Miller Road will be brought through to the south end of the subject property and an easement will be given to the City for future maintenance. Lighting All lighting will be installed in accordance with the regulations in the municipal code and zoning ordinance. City Staff evaluated this request according to the requirements of Table 33: 1. Compatible with Use or Zoning of Environs. The proposed use or the uses permitted under the proposed zoning classification are compatible with existing uses or existing zoning of property in the environs. 2. Supported by Tread of Development. The trend of development in the general area since the original zoning of the affected property was established supports the proposed use or zoning classification. 3. Consistent with Comprehensive Plan Objectives. The proposed use or zoning classification is in harmony with the objectives of the Comprehensive Plan of the City as viewed in light of any changed conditions since the adoption of the Plan. 4. Furthers Public Interest. The proposed use of zoning classification promotes the public interest and not solely the interest of the applicant. Attorney Zanck stated Mr. and Mr. Kotiw are lifetime McHenry residents who are willing to invest in the community.Mr. Kotiw has been involved in the construction,rehab,and rental of homes in the community since the 1970's.Mr.Kotiw's building style is quality and efficiency. The proposal before the commissioners for consideration this evening is a $2.5 million two building 24-unit project which would be constructed on approximately 2 acres located at 3320 Bull Valley Road.The request is for a zoning map amendment from E Estate to RM-2 High-Density Multi-Family Residential District. Mr. Zanck provided the commissioners with land uses and zoning of parcels adjacent to the subject property. The project would have a density of 12 units/acre, similar to the density of the McHenry Retirement Community, located to the north of the subject property across Charles Miller Road. Mr. Zanck noted this area of the community has changed dramatically in the last 15-20 years. Bull Valley Road, which at one time was a major east-west connector,has now become a frontage road south of Charles Miller Road. He noted Mr.Kotiw is proposing to construct two buildings of 12-units each. Each unit would have two bedrooms. Monthly rental of the units would be between $1,000 and$1,200. Mr. Zanck stated the applicant is being required to bring City water and sewer to the site. Due to the nature of the project (multi- family units),Mr.Kotiw is required to install a main from the north of the site through to its southern boundary.Sanitary sewer will be secured from the southeast corner of the property. Additionally, Mr. Zanck stated Mr. Kotiw has not been contacted by McHenry County regarding a need to forfeit land for the potential expansion of Charles Miller Road.If that happens,the site plan for this proposal may change and the number of units might be reduced.However,there would be no impact on the zoning of the property once granted. For zoning purposes this would be considered one building. • All units would be two bedrooms; and include a washer and dryer within each unit. • Access to the buildings will be by secured keyed entrances. • The rental rate is expected to be approximately$1000-$1200 per unit per month. • There will be a multi-car garage that will accommodate ten vehicles;leased space will cost$75 per month. • An additional 54 open parking stalls will be provided for residents and guests,totaling 64 parking spaces on-site. • The property will have one access point onto Bull Valley Road. • A large storm water detention basin is proposed for the northwest corner of the property. All storm water will be piped from the parking lot to the detention basin prior to being released at a controlled rate. Background: In October of 2001, the Commission considered a request for a 16-bed assisted living facility on this property. The City Council denied the request. In July and September of 2003, the Commission considered a request by Mr. Kotiw to annex the property and construct a 3-story 24- unit apartment complex.The application was withdrawn prior to City Council's final consideration. In the past five years much has changed within the City. There has been substantial growth in the area causing the need for road expansions and new developments.Real estate trends for the next few years will move towards a rental market. Staff Analysis: Land Use and Character of the Area The character of the area in close proximity to the site consists of different densities and types of residential land uses. The homes immediately to the south of the subject property are located in unincorporated McHenry County and zoned A-1,Agriculture.The lots are larger residential properties.,with an average lot size of approximately 28,000 sq. ft.yielding a density of approximately 1.5 units per acre. The RS-3 City zoning to the southeast, McHenry Shores Subdivision, is a medium-high density single-family residential zoning district,with an average lot size of 9,000 sq.ft.yielding a density of 4.5 units per acre. To the east of the subject property is a house annexed to the City in 2000 and zoned RS-1. To the north is property zoned RM-1, consisting of 154 senior age-restricted condominiums(McHenry Retirement Community)and a memory care facility,with an overall density of 12 units per acre. Density According to the Zoning Ordinance a 24-unit apartment complex requires a lot size of 74,664 square feet. The subject property exceeds this requirement with an actual area of 85,813 square feet. The proposed density is 12.18 units per acre which is comparable to the senior living and memory care facilities located across the street. Consistent with the Comprehensive Plan Obiectives According to the Comprehensive Plan the subject property is designated medium-density residential. The Comprehensive Plan states "the land use depicted does not necessarily reflect the zoning of individual parcels or the desired specific zoning category, but the general use of the property based on the average uses and density in the area."Apartment land uses are appropriate in locations which are in close proximity to a major roadway. Architectural Standards The site layout and proposed two-story building visually relates to the established roof line of the neighborhood.The buildings will be comprised of 100%masonry material and the siding will be of a hardy concrete plank The multi-car garage will match the principal buildings in style and color;and the trash receptacles will be screened by a fenced dumpster enclosure on the north side of the garage. Parking and Access Planning and Zoning Commission February 19,2009 Page 4 The applicant complies with all parking regulations required by the zoning ordinance. A total of 64 parking spaces are proposed, which exceeds the required 56 spaces for this development. There is only one entrance planned for the southeast end of the property allowing access to Bull Valley Road. McHenry County is limiting access points onto Charles Miller Road; consequently, any alternative access to the north is not an option. With the proposed expansion.of Charles Miller Road the.western_connection._of.Bull Valley Road will be improved as a part of phase one and the eastern connection to Bull Valley Road off of McHenry Ave. will be improved as a part of phase two. In addition, staff has consulted with the City Engineer about possible land acquisition, from the subject property, for the proposed expansion and how that may affect the subject property. Some right-of-way from this property will be required.The applicant is aware of this and has been working with their engineer to see how this may impact the site layout. Traffic Analysis In accordance with the studies compiled by the Institute of Transportation Engineers, Trip Generation, 6th Edition,the average number of trips generated by an apartment dwelling unit is 6.63 trips per unit on a weekday. An apartment dwelling unit is described as a rental unit located within the same building with at least three other dwelling units. A trip is defined as a vehicle exiting or entering the site. Charles Miller Road will be improved to a five-lane highway including turn lanes. In 2004, approximately 16,000 vehicles daily traversed this section of roadway and that number is expected to increase to approximately 34,000 vehicles per day by 2030. An apartment land use, such as the one proposed,is more suitable to this type of traffic volume than a single-family residence. Staff does not believe that single family housing is appropriate for this property because of the proposed road expansion. Landscaping The applicant will provide landscaping and screening in accordance with the landscape ordinance. Landscaping will be provided around the foundation base of each building, within parking inlands and to fill-in some of the existing vegetation to create a landscaping screening strip around the property. Utilities - Water and electric will be run from the north side of the property under Charles Miller Road. By EPA regulations the water connection must be made with a main because water will be supplied to two buildings.The connection that runs from the north side of Charles Miller Road will be brought through to the south end of the subject property and an easement will be given to the City for future maintenance. Sewer will be run from the west along Bull Valley Road on the south side of the street. Lighting All lighting will be installed in accordance with the regulations in the municipal code and zoning ordinance. Staff Recommendation Prior to Public Hearing Staff evaluated the request according to the requirements of Table 33 of the Zoning Ordinance and recommends approval of the requested map amendment to RM-2 High-Density Multi-Family District. Chairman Howell invited questions and comments from the Commission. In response to an inquiry,Mr.Kotiw stated he is the owner of the subject property.Responding to a question as to why he is proposing 24 units,Mr.Kotiw stated it is a matter of economics.Following engineering of the site,and noting he would be required to bring both municipal water and sanitary sewer to the property, Mr. Kotiw stated 24 units make the project economically possible. Otherwise it would not be an equitable project. Noting it is possible the County could take some of the land for Charles Miller Road expansion,question was raised as to how many units would likely be lost.Mr. Kotiw responded it is not certain at this time that the County would take any of his land.He has not yet been advised by the County of this possibility. Responding to inquiries as to how the possible taking of land could impact the project site plan.Engineer Kamey stated the applicant would address the revised 30' setback from the Charles Miller Road(north)property line when the possibility becomes a reality. She noted the applicant would likely lose 10-15' if and when the right-of-way is tendered to the County. Ms. Karney noted the detention basin could be modified and/or underground detention means could be utilized if the size of the parcel is reduced and compensation is required to accommodate the site area reduction. Planner Kolner stated any land taken by the County would likely occur when this project has already been constructed.The applicant would not be required to wait for the possible land-taking prior to constructing the project. Planning and Zoning Commission February 19,2009 • Page 5 Commissioner Buhrman inquired if the applicant would be bringing City water to the site and, if so,could McHenry Shores residents ultimately tie-in to municipal water at this juncture. Ms. Karney replied if the City required oversized mains to be installed, the possibility exists that McHenry Shores residents could connect and the developer could possibly recapture the cost of over-sizing the main.The property is currently served with private well and septic. Responding to a question as to the possible time table for the project, Mr. Zanck stated the project construction is largely dependent upon the economy. The City of McHenry needs apartments at this time. The opportunity is right for quality tenants. Mr.Kotiw stated he is not certain if he wants to push the project forward during these difficult economic times. He noted if he can see the need for the apartments he will proceed. Responding to questions as to who would construct the project and who would maintain the apartments when completed,Mr. Kotiw stated he will build the project and maintain the property/apartments once constructed. Chairman Howell invited questions and comments from members of the audience. Prior to each addressing the Commission, they were sworn in by the Chairman. Paul Antens, 3321 Bull Valley Road: Mr. Antens stated it is inappropriate for these apartments to be constructed in a single-family neighborhood. He noted he has lived at his resident for 25 years. This type of proposal has been before the City Council on two previous occasions.Apartments are not a good fit at this location.He opined the apartments would not be a buffer between the single- family homes and Charles Miller Road, but would actually be more intrusive. He noted there are several large lots in the immediate neighborhood. If this project is approved,other neighbors will decide to sell their property and more apartments would be constructed in the area.Mr.Antens stated they bought their home expecting a single-family neighborhood to remain—with no more congestion or development in the area. All residents of the area already have to fight traffic. The residents want to retain the small-town feel. Mr. Antens expressed issues with the Staff Report. He stated Staff should not compare the proposed project to the McHenry Retirement Community across Charles Miller Road. The retirement community is located across Charles Miller Road and should not be considered to be a part of his neighborhood. Mr.Antens continued, stating when Charles Miller Road is expanded, the County would require 75-120' of right-of-way. This would result in a higher density for the apartment project. Apartment dwellers and visitors would not have direct access from the property to Charles Miller Road. They would only have access to Bull Valley Road and would have to cut through McHenry Shores Subdivision in order to go west. Mr. Antens also expressed concern regarding light radiating from the property. The lighting required for the apartments is not compatible with the residential neighborhood. He stated the residents will not benefit from this project. There is no need for more apartments in the community. This is a large apartment building. He requested the City shelve the project for a third time. Wes Johnson, 905 Hilltop Boulevard: Mr. Johnson stated he is a tradesman. Times are hard. This project would produce 24 units which would result in 50-80 more people in the neighborhood.This would burden the area.The current view is better than looking out on a brick building. He noted many people cannot sell their houses due to the bad economy. The construction of apartments at this location would hurt property values of McHenry Shores residents. Mr. Johnson stated there are many places in the City where this type of project would be more appropriate. He suggested the applicant could trade his property for property at another more appropriate location.Mr.Johnson noted the project is far outside the norm for this neighborhood.The apartment building is not a good fit; it will not blend into the neighborhood.The construction of the apartments would irreparably hurt the neighborhood. He suggested it is greed that is pushing this project. Mr. Johnson stated it would likely be more cost effective and create less risk to local native plant and animal species if the applicant were to build the project elsewhere in the City. George Kunzer, 1102 S. Hollywood Boulevard: Mr. Kunzer stated he agreed with everything that has been stated. To rezone the property to high-density multi-family is not appropriate. He inquired why the applicant did not request business zoning. The apartments are not a good fit in this area. He stated apartments are available on Veterans Parkway south of Tonyan Industrial Park. There is no need for apartments in this area. Tom Moore,602 S.Broadway:Mr.Moore stated he agreed with everything that has been said and noted McHenry Shores residents do not have sidewalks in their subdivision. He questioned how children would be able to go from place to place without a safe means to travel. Steve Lay, 710 S. Riverside Drive: Mr. Lay inquired if the applicant utilizes the existing detention pond upon the County taking a portion of his land for roadway expansion,would the pond be large enough to accommodate all of the area drainage.He suggested the detention pond was not engineered to accommodate runoff from the 2-acre apartment complex. Ms. Karney replied she would investigate whether the detention pond would be able to handle any additional flow. In any event,the applicant would have to comply with the McHenry County Storm Water Management Ordinance as recently adopted by the City. Ms. Kamey stated if the County takes some of the applicant's land,acceptable ways would be sought and found to accommodate surface water drainage from the site. Planning and Zoning Commission , February 19,2009 Page 6 Jeff Krajci, 3215 Stillhill Drive: Mr. Krajci stated he recently requested permission from the City to expand his driveway from 15' to 30' and was denied because he does not have the detention required for the additional runoff created by the driveway expansion. Mr. Krajci also noted the apartment complex would increase the number of children in area schools. Arnold Miller,3200 W.Terrace Drive: Mr.Miller asked how this project would benefit his neighborhood. Donna Munson, 2911 Gregg Drive:Ms.Munson stated she agreed with everything that has been stated thus far. Edward Ligeza, 1210 Capri Terrace: Mr. Ligeza inquired what was the minimum number of units required to make this a viable project for the applicant. Chairman Howell stated the applicant previously indicated it would take 24 units to make this project work. Mr.Ligeza asked if the County takes the land necessary for the roadway expansion,the applicant might not be able to erect the 24 unit complex. He suggested the applicant was trying to move forward as quickly as possible to complete the project prior to the County's taking of land. Andy Keenan,3217 Vista Terrace: Mr. Keenan stated he agreed with everything that has been stated thus far. He noted he is in the transportation business. He opined the quality of roads and traffic situations would deteriorate following the construction of this project.He inquired if McHenry is prepared to upgrade the roads which will be ruined by all of the additional traffic generated by this development.He also expressed concern regarding children going to and from school without benefit of sidewalks. Tom Cuzman, 2908 Bull Valley Road: Mr. Cuzman agreed with all comments made. He stated police activity will be higher than normal following the construction of this development. He stated there is currently minimal police presence in the neighborhood. If apartments are added into the mix,there would be more traffic,more visitors to the neighborhood,and ultimately more police activity. Mr. Cuzman also expressed concerned regarding education. The schools would have to change their program. There is already overcrowding in the schools and will increase following the development of this project.He inquired how the schools would be able to handle the influx of additional students. He has witnessed children trying to cross the road going to and from school and has noted many near-miss situations. Chris Komorous, 702 S. Broadway: Mr. Komorous inquired if the property north of Charles Miller Road is preserved wetlands. He stated if this is wetlands and must be preserved, the County would likely take more Iand from the south as utilizing wetlands for roadway is not permitted. Mr. Komorous also asked if this project would involve subsidized housing. Mr. Kotiw responded in the negative. Mike Benedeck, 3215 Vista Terrace: Mr. Benedeck agreed with everything that has been stated. He added that when a person drives into a neighborhood,the flavor of the neighborhood is defined by its entry. This apartment complex will now define and reflect upon the McHenry Shores neighborhood. James Theodore,718 McHenry Avenue: Mr.Theodore concurred with everyone. He cited the increased amount of construction traffic as causing safety issues, particularly for children in the neighborhood. He noted for 6-8 months there will be much additional construction traffic and inquired how children will be able to go anywhere,particularly as there are no sidewalks in the neighborhood. Linda Helgeland, 3103 Bull Valley Road: Ms. Helgeland noted there are very few fire hydrants in the neighborhood. This could present a serious problem. She concurred with all that has been stated. Ken Kus; 3207 Vista Terrace: Mr. Km agreed with all previous statements. He stated he wants to know what experience Mr. Kotiw has with constructing and managing apartment buildings. Mr. Kotiw responded he has experience with apartment buildings he owned in Salem, Wisconsin. He noted it was difficult to manage them as they were 35 minutes away. Mr. Kus inquired when the building gets older and the applicant decides to sell it,what assurances do the neighbors have that it would be sold to someone who cares about the building and property maintenance. Mr. Km suggested the applicant might be getting in over his head and would be unable to manage the apartments. Mr. Kotiw responded this is his job. This is what he does for a living. Mr. Kotiw stated he is planning to invest $2.5 million in this project. He intends to take care of his investment. If the apartments are sold in the future, the new owner would take care of them as well. Bernadette Powers,2911 W. Prairie: Ms. Powers agreed with all previous comments. She noted this is the third time residents of the area have come to the City for public hearings regarding the development of this property. She stated if the project is turned down this time,she hopes it is for the last time and that development of this land goes away and is forgotten. Gary Lechner,3108 Beach Drive:The board needs to take a hard look at this proposal.Do they want to have 500 happy residents and one unhappy developer,or 500 unhappy residents and one happy developer?Mr.Lechner concurred with everything stated thus far. Planning and Zoning Commission February 19,2009 • Page 7 Mike Brastad,601 S. Broadway:Mr. Brastad expressed concerns regarding the applicant sharing/utilizing the existing detention pond. He noted during the last few heavy rains his street has disappeared under water.He stated his sump pump runs constantly during rain. He is concerned there may be serious property damage if the applicant is allowed to share the detention pond. Ms. Karney stated the applicant would be required to adhere to the McHenry County Storm Water Management Ordinance.The applicant would be required to retain surface water runoff and release it at no greater rate than it currently flows. She also noted the applicant has not even investigated the possibility of a shared detention pond.The applicant's site plan indicates the site has its own retention facility. Sherry Ehredt, 3310 Bull Valley Road: Ms. Ehredt agreed with everything that has been said regarding the project. She noted she resides immediately to the east of the subject property. She stated the applicant's property has not been properly maintained during the last two years.Ms. Ehredt noted she already has water flooding difficulties and opined they will only get worse once this project is completed. She also expressed displeasure with looking out her window at the 10-vehicle garage. Jim Spears, 2908 Gregg Drive: Mr. Spears noted there is only one lane for traffic going from Bull Valley Road onto Charles Miller Road. There are already lengthy backups at this location. If this project is approved, there would be a single lane for people to exit onto Charles Miller Road. He noted this would be especially difficult if cars were waiting to make a west-bound turn. He suggested traffic backups would greatly increase once the 24 apartments are in place. He noted property values have already decreased 20% in the area due to the tough economy and the housing mortgage crisis. He stated the neighbors do not need their property values to decrease any further. Collin Lay, 710 S. Riverside Drive: Mr. Lay agreed with all previous statements. He noted he is a senior at McHenry High School East Campus where he there are at least 32 students per classroom.If this project occurs, the number of students per classroom would be increased. Mr. Lay stated whenever anyone asks where he lives, he currently stated he is from the"Shores", not what everyone thinks is McHenry Shores. He expressed concern regarding the identity of the McHenry Shores Subdivision if the apartments are constructed at this location. Mr. Lay also inquired what would prevent this project from becoming Section 8 Housing. Mr. Kotiw again stated this project will not include subsidized housing. John Cherone,3209 Terrace Drive:Mr.Cherone agreed with all that has been said regarding the project. Matthew Kus, 3207 Vista Terrace: Mr. Kus inquired as to the logic and ethics of constructing a large apartment complex in the midst of a single-family neighborhood. Joleen Brastad, 601 S. Broadway: Ms. Brastad stated the applicant has lived in McHenry all of his life approximately 800 yards from the McHenry Shores Subdivision. She stated he should know there are eighteen children who live in the first section of Broadway. When the applicant first proposed an apartment complex for this property in 2003,the public was told doctors and nurses would reside in the building. Now, the applicant is proposing a 24-unit apartment building in a multi-family district. The County is attempting to make it easier for residents to access the McHenry Shores Subdivision.They are proposing a stop light at the intersection of Broadway and Bull Valley Road. There are no sidewalks in the McHenry Shores Subdivision; there is no room to place sidewalks along the roadway. She opined this is very dangerous for the children of McHenry Shores. Ms. Brastad stated she does not want a stop light placed at the intersection of Bull Valley Road and Broadway. She also expressed concern that the apartment complex would generate students which would further overburden the City's schools.The stated there is no logic in moving forward with this project. Chairman Howell asked Ms. Brastad where sidewalks should be installed. Ms. Brastad responded there is no safe place to put the sidewalks. Mr.Moore(602 S Broadway) who previously testified, interjected it is difficult to install sidewalks in the subdivision due to the presence of drainage ditches and the lack of curb and gutter.Ms. Brastad went on to say that her residence has sustained serious flooding in recent years.For the past 5-6 years her sump pump is running non-stop. Julie Kunzer, 1102 S.Hollywood Boulevard:Ms.Kunzer agreed with all that has been stated. She inquired why the City Staff Report did not address the project's potential impact on schools. Planner Kolner responded the Naperville Study indicates the number of students realized from a 24-unit apartment complex is 8.4 students, which covers the span of kindergarten through high school. If single-family residences were constructed on the site,they would generate 12 students.Additionally,the developer would be required to pay more than$122,000 in Developer Donations for schools (both District 15 and District 156),Library District,Fire District,and Parks. Of that amount$23,000 would go directly to the school districts to help compensate for the increase in student population.Ms. Kunzer opined the 24 units would generate more than 8.4 students. Dale Brown, 602 S Hilltop Boulevard: Mr. Brown stated he resides about 100 yards away from the project and in his opinion this is not a good idea. In response to Chairman Howell's inquiry approximately 24 persons raised their hands indicating they had not chosen to speak but wished to go on record stating they agreed with all statements and comments made this evening by members of the audience. Planning and Zoning Commission February 19,2009 Page 8 • Donna Tobeck,917 S. Broadway:Ms.Tobeck stated a lot of heartfelt thoughts have been expressed this evening. She opined a traffic study of Charles Miller Road should be done. It is impossible to turn left onto Bull Valley Road from westbound Charles Miller Road. Ms. Tobeck stated she would like the City to reject the proposal as it would devalue all of the properties in McHenry Shores and the community at large.,. Chairman Howell,noting there was no one else wishing to be heard, closed the Public Comment portion of the hearing at 9:24 p.m. and called for a brief recess.The Public Hearing reconvened at 9:28 with all still in attendance. Chairman Howell inquired if there were any follow-up questions from the commissioners.There were none. Attorney Zanck provided a response to audience comments as well as closing remarks. Mr. Zanck noted during these difficult economic times, it is unusual to have a client willing to invest in the community. The applicant appreciates the comments and questions brought forth by the commissioners and members of the audience. He noted the great attendance by members of the community. Attorney Zanck stated the proposed complex is not located in McHenry Shores Subdivision. McHenry Shores is not a part of the neighborhood where the apartment complex would be constructed. Water drainage problems currently exist in McHenry Shores.This project will more than likely improve existing drainage issues.Mr.Zanck stated no credit has been given for the applicant's design of the building which will blend in with the adjoining residential elevations.It will integrate well with the neighborhood.He noted when he first viewed the architectural rendering he was shocked by its beauty and the thought that went in to make this a good blend in the neighborhood. He pointed out there is a very clear distinction of neighborhood lines— McHenry Shores northern boundary is Bull Valley Road. Attorney Zanck stated there would be at least one fire hydrant on the site. In conclusion, he urged the Commission to support the applicant's request to reclassify the subject property from E Estate to RM-2 High-Density Multi-Family District. He noted he has great empathy with the audience; however, the problems and issues discussed already exist and are not related to the project before the Commission for consideration this evening. While these matters need to be addressed, they should not be tied to the approval or lack thereof regarding this.project. He further opined any apartment or commercial project would not be welcomed by members of the audience. He noted the project is not part of the McHenry Shores neighborhood. He congratulated Mr. Kotiw for going out of his way to ensure this will be a quality project.He stated if this project goes away,what might come in the future may be even more undesirable to members of the McHenry Shores community.He stated there may be a need for crossing guards to facilitate students crossing roads to and from school,and fire hydrants should be installed.All in all this is a good project and he supports its approval. Commissioner Nadeau concurred with Commissioner Ekstrom. Commissioner Schepler concurred with Commissioners Ekstrom and Nadeau. Commissioner Thacker concurred with Chairman Howell. He stated if this project is not approved then what could be developed might be even less desirable to the area residents. He opined this has become a "not in my backyard" issue. He further stated that placing apartments in conjunction with a single-family neighborhood is appropriate. Projects of this nature represent progress and he supports its approval. Commissioner Buhrman concurred with Chairman Howell and Commissioner Thacker.He noted this is a difficult decision,but he has confidence the project will be a welcome addition to the area. Motion failed to carry 3-3.There will be no recommendation to Council regarding the application. Chairman Howell closed the Public Hearing at 9:45 pm. As you know, this proposal did not clear the Planning and Zoning commission at the Feb 19, 2009 meeting, and similar proposals have also been turned down by City Council in 2001 and 2003.However, it is my understanding that the same proposal will appear before the City Council in the near future. There is widespread opposition to this proposal by the residents of our neighborhood, not only by persons residing near 3320 Bull Valley Rd. but throughout the McHenry Shores subdivision. The 29 speakers at the Zoning Board meeting and many others in attendance who noted their opposition to this proposal show that this is not a small issue. In simple terms, I feel that Apartments are not consistent with our neighborhood of single-family homes. We chose to live here because we like the community, neighborhood and relative privacy of single-family homes. While development can be good and will continue in our City, there is no reason to push such a high-density project into our residential area. When the bridge was first proposed and then opened and all the traffic was coming down Bull Valley Road, a road that had once been a nice, quiet dead end...the people of the McHenry Shores subdivision were promised by the board and mayor that once Miller Road was completed that no multi-dwelling housing or businesses would be allowed on the south side of Miller Road. Two similar proposals have been turned down by the City Council (2001, 2003) for the reason that such development does not fit in with the nature of our neighborhood, which is comprised of single-family homes. Actually, it was my understanding after the last proposal was denied, that the city would take steps to ensure that such proposals would not occur again in the future, but obviously this did not happen. This proposal should also be denied for the same reasons. Our neighborhood is comprised of single-family homes,which people have purchased,with the expectation of a less dense community. An Apartment building on such a small property would bring congestion and alter the feel of our neighbor hood. There is also the strong possibility that if such a project were approved there will be additional projects on the surrounding properties along Bull Valley road. There are at least seven other properties in close proximity, which are similar or much larger than the proposed property,which if built to a similar density as the proposal,could produce an additional 250 units. In addition there is the development of Filer road to consider. It is my understanding that in the future the only access to Miller will be right in/right out from our neighborhood and that westbound traffic would need to travel the length of McHenry Shores to access Green street. So when my husband and I began looking for our first house, we wanted to look in an area that felt like. home. Our search began and ended with the city of McHenry. After looking at several areas of McHenry, we narrowed our search to the McHenry Shores neighborhood. One of the main reasons we moved into the neighborhood was that we felt this was a very friendly, safe and fresh neighborhood. It seemed like a good place for a first home and a place to start a family. I feel that these good qualities are going to be tarnished if multi family homes are to become a part of my neighborhood. If I knew that multi family homes were going to exist within the single family homes of my neighborhood, I would never have moved to this neighborhood. I have talked to several neighbors who have told me that if the zoning proposal is to pass, then they will be putting their houses up on the market. I feel the housing market is already flooded with homes on the market; this would just make things worse.
