At roll call the following Aldermen were present: Santi, Glab, Schaefer, Murgatroyd, Wimmer, Peterson, and Condon. Absent: None. City Staff in attendance were: City Administrator Maxeiner, City Clerk Jones, City Attorney McArdle, Deputy City Administrator Martin, Assistant City Administrator Hobson, Director of Finance Black, Director of Public Works Schmitt, Chief of Police O'Meara, Director of Parks and Recreation Merkel. REQUEST FROM THE MCHENRY GARDEN CLUB TO POST TEMPORARY SIGNS_IN MUNICIPAL RIGHTS-OF-WAY TO ADVERTISE THE ANNUAL CONTAINER GARDEN GALA EVENT ON APRIL 24 2008 AT MCHENRY HIGH SCHOOL WEST CAMPUS Deputy City Administrator Martin stated a request was received from the McHenry Garden Club to post temporary advertising signs announcing their annual Container Garden Gala Event scheduled to take place on Thursday, April 24, 2008 at West Campus High School. The signs would be posted at the following locations for one week prior to the event: Route 31 and Bull Valley Road Front Street and Elm Street Front Street and Lillian Street Richmond Road and Elm Street Richmond Road and McCullom Lake Road Richmond Road and Blake Boulevard Route 120 and Chapel Hill Road Route 120 and Curran Road Crystal Lake Road and Bull Valley Road Crystal Lake Road and Royal Drive Crystal Lake Road and Elm Street Charles Miller Road and Green Street. Deputy City Administrator Martin stated the request includes waiver of all associated fees. He noted Staff has reviewed and supports the request. Motion by Condon, seconded by Schaefer, to accept Staffs recommendation to waive all associated fees and approve the posting of temporary advertising signs for one week announcing the annual Container Garden Gala event scheduled for Thursday, April 24, 2008 at McHenry High School West Campus; with the signs to be posted at the following locations: Route 31 and Bull Valley Road Front Street and Elm Street Front Street and Lillian Street Richmond Road and Elm Street Richmond Road and McCullom Lake Road Richmond Road and Blake Boulevard Route 120 and Chapel Hill Road Route 120 and Curran Road Crystal Lake Road and Bull Valley Road Crystal Lake Road and Royal Drive Crystal Lake Road and Elm Street Charles Miller Road and Green Street. April 14, 2008 Page 4 REQUEST FOR TEMPORARY USE TO HOLD A GRAND OPENING EVENT AT 1720 NORTH RICHMOND ROAD— GIGI'S PLAYHOUSE �`- Deputy City Administrator Martin stated a request was received .from Gigi's Playhouse located at 1720 North Richmond Road to host a grand opening event in its parking lot. The event would include a moonwalk, games for children, and a presentation of emergency vehicles from the McHenry Township Fire Protection District. The applicant has indicated approximately 100 volunteers would be assisting with the event scheduled to take place on Saturday, April 26, 2008. Deputy City Administrator Martin noted Gigi's Playhouse is a not-for-profit organization which provides activities, resources and educational programs for children and adults who have Down's Syndrome. The applicant has modified their site plan in light of Staffs concerns. Staff has approved the site plan which is before Council for consideration this evening. Deputy City Administrator Martin stated Staff supports the request. Alderman Condon stated she is excited to have a Gigi's Playhouse become a part of the community. Alderman Santi concurred noting the grand opening would be a positive event for the community. Alderman Glab expressed concern regarding the parking lot being cleaned up at the conclusion of the event. A representative of Gigi's Playhouse assured Council the parking lot would be cleaned up no later than 5 p.m. on the day of the event. Motion by Wimmer, seconded by Santi, to accept Staffs recommendation to approve a grand opening event at Gigi's Playhouse located at 1720 North Richmond Road on Saturday, April 26, 2008, as outlined on the site plan attached to the Agenda Supplement for Council's review and consideration. Voting Aye: Santi, Glab, Schaefer, Murgatroyd; Wimmer, Peterson, Condon. Voting Nay: None. Absent: None. Motion carried. ORDINANCE GRANTING ZONING MAP AMENDMENT AND VARIANCES FOR CONSTRUCTION OF TWO SINGLE-FAMILY HOMES ON THE EAST SIDE OF RINGWOOD ROAD (LOT 29) In attendance was applicant Jake Neulist, property owner of Lot 29 of Westshore Beach Subdivision, located on the east side of Ringwood Road adjacent to Brittany Park Subdivision. Deputy City Administrator Martin stated the applicant is seeking the following zoning relief from the City: 1. Reclassification from C-1 Commercial District to RS-3 Medium-High Density _ Single-Family Residential District; 2. Variance to allow two single-family homes on a single zoned lot; 3. Variance to allow a reduction in the required lot frontage along an arterial roadway from 200' to 175'. April 14, 2008 Page 5 Deputy City Administrator Martin noted the applicant filed a Plat of Consolidation in 2006 resulting in the consolidation of seven sliver lots into one larger lot, now known as Lot y— 29. The application was presented before the Planning and Zoning Commission at a public hearing held on April 3, 2008. The Commission unanimously recommended approval of the applicant's request. Deputy City Administrator Martin noted the requested zoning is consistent with the existing zoning in the area. Staff supports the Planning and Zoning Commission's recommendation. Motion by Santi, seconded by Wimmer, to accept the unanimous recommendation of the Planning and Zoning Commission to grant the following to Jake Neulist for his property located on the east side of Ringwood Road, Lot 29 of Westshore Beach Subdivision: 1. Reclassification from C-1 Commercial District to RS-3 Medium-High Density Single-Family Residential District; 2. Variance to allow two single-family homes on a single zoned lot; 3. Variance to allow a reduction in the required lot frontage along an arterial roadway from 200' to 175'. Discussion on the Motion: Mr. Neulist addressed Council stating the McHenry Township Assessor considers his property as seven lots, each 25' wide. He stated the Assessor does not consider the lots consolidated into one single lot, Lot 29. Alderman Santi inquired if the site plan and engineering of the site have been reviewed. Mr. Neulist responded the Army Corps of Engineers have visited the site and noted the property was not located in a wetlands and there was no flooding evident. Alderman Glab inquired which of the seven lots would be built upon. Attorney McArdle responded from the City's perspective all seven lots are being considered as one lot. Alderman Glab stated the lots are not adjacent to Westshore Beach; the lots are actually part of Westshore Beach Subdivision. Alderman Glab stated he has concerns with the seven individual lots. He stated he would like to see the zoning changed to RS-3, but he would like to see the applicant subdivide his property into two lots and then come back before Council with his requests for zoning relief. Attorney McArdle explained to the applicant that he would have to come back to Council when he is ready to develop the property to ensure that he complies with the Subdivision Control and Development Ordinance of the City. April 14, 2008 Page 6 Motion by Santi, seconded by Wimmer, to withdraw the motion on the floor regarding the Jake Neulist property, Lot 29 of Westshore Beach Subdivision, located on the east side of Ringwood Road adjacent to Brittany Park Subdivision. Voting Aye: Santi, Glab, Schaefer, Murgatroyd, Wimmer, Peterson, Condon. Voting Nay: None. Absent: None. Motion carried. The motion was withdrawn. ORDINANCE GRANTING A CONDITIONAL USE PERMIT TO ALLOW AN AUTOMOBILE SERVICE STATION IN THE C-5 COMMERCIAL ZONING DISTRICT AND SIGN VARIANCES — FIRESTONE TOTAL CAR CARE, NORTHGATE WEST SHOPPING CENTER In attendance was Project Manager Sharon Jones, representing the site developer Amcon Design and Construction. Deputy City Administrator Martin stated a request was received from Amcon Design on behalf of Firestone Total Car Care for a conditional use permit to allow an automobile service station on Lot 2 of Northgate West Shopping Center. The applicant appeared before the Planning and Zoning Commission at a public hearing held on April 3, 2008. The Commission voted 4-1 to grant the request. Deputy City Administrator Martin noted the applicant is also seeking a sign variance to allow three wall signs totaling 171.9 square feet. Due to the layout of the site, and the fact that the applicant does not have frontage on Route 31 and the limited amount of street frontage along Diamond Drive, Staff recommends the sign variances be granted as follows: 1. To allow three wall signs on the building (one located on the south frontage and two along the east side of the building facing Route 31); and 2. To allow an area of 171.9 square feet of wall signs on the applicant's building. Alderman Glab noted the site plan is well done and very tastefully mapped out. Alderman Murgatroyd noted he believes the use is a good fit for the site. Alderman Peterson inquired if the Superintendent of Forestry has reviewed the plans. Deputy City Administrator Martin responded in the affirmative. Ms. Jones addressed Council stating the developer is willing to work with Staff regarding the recommended tree plantings. Alderman Condon stated she would typically not override the sign ordinance, but _ noted she can see how in this instance the variances would be appropriate. Alderman Santi concurred with Alderman Condon, stating he appreciates the developer's willingness to work with Staff regarding tree preservation issues on the site. April 14, 2008 Page 7 Motion by Glab, seconded by Murgatroyd, to accept the recommendation of the Planning and Zoning Commission to approve the following: 1. Conditional Use Permit to allow the construction and operation of an automobile service _ station on Lot 2 of Northgate West Shopping Center; 2. Variance to allow three wall signs on the Firestone Total Car Care building on Lot 2 of Northgate West Shopping Center: one on the south elevation; two on the east elevation; 3. Variance to allow a total area of 171.9 square feet of wall signage on the Firestone Total Car Care building on Lot 2 of Northgate West Shopping Center. Voting Aye: Santi, Glab, Schaefer, Murgatroyd, Wimmer, Peterson, Condon. Voting Nay: None. Absent: None. Motion carried. MAYOR— STATEMENT AND REPORT Mayor Low stated Fire Chief Wayne Amore provided the City with the Annual McHenry Township Fire Protection District Report which would be made available to Council. COMMITTEE REPORTS Chairman Alderman Murgatroyd announced a Finance and Personnel Committee Meeting was scheduled for Wednesday, April 16, 2008 at 7 p.m. in the Aldermen's Conference Room. STAFF REPORTS City Administrator Maxeiner announced there would be a controlled burn at the Wheeler Fen located across from the Municipal Center on Green Street on Tuesday, April 15, 2008 beginning at 10:30 a.m. The Fire District has been notified. The McHenry Retirement Community located just east of the proposed burn has also been notified. FUTURE AGENDA ITEMS There were no Future Agenda Items discussed.
