At roll call the following Aldermen were present: Santi, Glab, Schaefer, Murgatroyd, Wimmer, Peterson, and Condon. Absent: None. Voting Nay: None. Absent: None. Motion carried. REQUEST FOR A FENCE VARIANCE— MARK CONNING, 1425 NORTH RIVER ROAD In attendance was Mark Conning, property owner of 1425 North River Road. Deputy City Administrator Martin stated a request was received from Mr. Conning who is seeking a variance to allow a 42" high French-gothic style fence in his front yard. The applicant is requesting fence installation along his eastern and southern property lines. Deputy City Administrator Martin stated the applicant currently has a chain link fence installed on three sides of his property. The applicant intends to leave the chain link fencing on the north side of his lot. The lot has frontage on North River Road and along the Fox River. Deputy City Administrator Martin noted the Municipal Code prohibits the installation of fencing within 30' of the right-of-way or closer than the existing building line. The sole exception is a 42" high split rail fence. Staff has reviewed the application and supports the request for variance to allow the 42" high French-gothic fence installation along the east and south property lines. �-- Alderman Glab requested clarification as to the proposed height of the fence. Mr. Conning responded the fence is 42" high. May 5, 2008 Page 4 Motion by Santi, seconded by Schaefer, to accept Staffs recommendation to grant a .� variance to allow a 42" high French-gothic style fence to be installed in the front yard along the east and south property lines at 1425 North River Road as requested by Mark Conning. REQUEST FOR A TEMPORARY USE PERMIT FROM THE MCHENRY PUBLIC LIBRARY DISTRICT—849 NORTH FRONT STREET In attendance was Executive Director Jim Scholtz of the McHenry Public Library. Deputy City Administrator Martin stated Mr. Scholtz has requested a temporary use to allow storage of snow removal equipment on the Library's newly-acquired property located at 849 North Front Street. The sole building on the property is a garage, formerly utilized as an automobile body shop, which would be used to house the equipment. Staff recommends granting a temporary use for one year subject to annual consideration and renewal by Council. Alderman Condon noted the City has always maintained a good relationship with the Library and would support the request. Responding to an inquiry from Alderman Schaefer, Mr. Scholtz stated the building would be utilized solely for the storage of the equipment. Motion by Condon, seconded by Santi, to accept Staffs recommendation to approve a temporary use as requested by the McHenry Public Library to allow the storage of snow removal equipment in the garage located at 8:49 North Front Street for a period of one year, subject to annual consideration and renewal by Council. Voting Aye: Santi, Glab, Schaefer, Murgatroyd, Wimmer, Peterson, Condon. Voting Nay: None. Absent: None. Motion carried. REQUEST FOR SIGN VARIANCES — MCHENRY COMMONS SHOPPING CENTER Deputy City Administrator Martin stated the leasing agent for the McHenry Commons Shopping Center, Regency Centers, has requested sign variances to locate an additional commercial real estate advertising sign for the Dominick's vacancy as well as an additional freestanding sign for the shopping center. The freestanding sign would require variance as to height and square footage. Deputy City Administrator Martin noted there are currently two commercial _ advertising signs on the subject property. The property is being leased by Regency Centers (on the north) and Mid America (on the south). The development entrance has a freestanding sign. Deputy City Administrator Martin stated the shopping center is permitted two shopping center signs as there is frontage on two streets (Richmond Road and McCullom Lake Road). Maximum sign height permitted by ordinance is 8' with a maximum May 5,2008 Page 5 area of 100 square feet. The applicant is seeking a second freestanding sign with a height of 15'8" and 100'6" square foot area, both of which require a variance. '— Deputy City Administrator Martin stated Staff has reviewed the request and supports the variances. Alderman Schaefer stated he initially had reservations regarding the request, but the development needs to be re-established. The installation of the signs should assist in securing new tenants and revitalizing the center. Alderman Murgatroyd inquired about the style of the proposed freestanding sign. He noted the City has furthered the installation of monument signs in recent years. Deputy City Administrator Martin stated the applicant is requesting the taller sign in order to provide better visibility. Alderman Murgatroyd opined the sight lines to the north should not be affected. Alderman Peterson wondered if the sign was appropriate. He stated he thought commercial leasing was typically handled by a broker. City Administrator Maxeiner responded Staff frequently receives calls from brokers who see signs and make inquiries regarding available retail space. Alderman Condon inquired if discussion has taken place regarding the connecting of the two properties. City Administrator Maxeiner stated he believes it has been worked out between the property owners. Alderman Glab stated he would like to see a time limit of six months be placed on the real estate advertising sign. He expressed uncertainty regarding support of the variance requests. Mayor Low stated she feels McHenry Commons must be given the opportunity to lease the space. Motion by Schaefer, seconded by Murgatroyd, to accept Staffs recommendation to grant the following to the property owners of the McHenry Commons Shopping Center: 1. variance to allow a second commercial real estate advertising sign on the premises; 2. variance to allow a second freestanding shopping center sign with a height of 15'8" and an area of 100'6" square feet. Voting Aye: Santi, Schaefer, Murgatroyd, Wimmer, Peterson, Condon. Voting Nay: Glab. Absent: None. Motion carried. May 5, 2008 Page 6 STAFF RECOMMENDATION TO CONSIDER: 1. PRELIMINARY PLAT FOR GRAND DEVELOPMENT SUBDIVISION LOCATED AT THE NORTHWEST CORNER OF THE INTERSECTION OF CRYSTAL LAKE ROAD AND BULL VALLEY ROAD: 2. CONDITIONAL USE PERMIT FOR A DRIVE-THRU FACILITY ON LOT 1 OF GRAND DEVELOPMENT SUBDIVISION Mayor Low announced the request for Preliminary Plat approval and conditional use permit for Lot I of Grand Development Subdivision has been removed from this evening's Agenda at the applicant's request. MAYOR— STATEMENT AND REPORT Mayor Low announced the Character Counts! pillar for May is Responsibility, COMMITTEE REPORTS There were no Committee Reports STAFF REPORTS There were no Department Head Reports. FUTURE AGENDA ITEMS Alderman Glab reported some of his constituents on a fixed income reported unduly large utility bills from NiCor. He stated NiCor appears to have estimated the bills for three months resulting in the issuance of larger than normal actual bills when the meters were — actually read. City Administrator Maxeiner stated Staff will contact NiCor and investigate the issue. EXECUTIVE SESSION: PERSONNEL Motion by Glab, seconded by Santi, to go into Executive Session to discuss Personnel at 7:54 p.m. Voting Aye: Santi, Glab, Schaefer, Murgatroyd, Wimmer, Peterson, Condon. Voting Nay: None. Absent: None. Council went back into Open Session at 7:56 p.m. May 5,2008 Page 7 OPEN SESSION REGARDING MATTERS DISCUSSED IN EXECUTIVE SESSION Motion by Murgatroyd, seconded by Glab, to accept Staffs recommendation to offer the position of Director of Construction and Neighborhood Services to Ryan Schwalenberg at a grade 21, step 6, effective May 6, 2008. Voting Aye: Santi, Glab, Schaefer, Murgatroyd, Wimmer, Peterson, Condon. Voting Nay: None. Absent: None. Motion carried.
