HomeMy WebLinkAboutMinutes - 05/12/2008 - City Council REGULAR MEETING MAY 12, 2008 A Regular Meeting of the McHenry City Council was called to order by Mayor Low at 7:30 P.M. on Monday, May 12, 2008 in the Council Chambers of the Municipal Center. At roll call the following Aldermen were present: Santi, Glab, Schaefer, Murgatroyd, Wimmer, Peterson, and Condon. Absent: None. City Staff in attendance were: City Administrator Maxeiner, City Clerk Jones, City Attorney McArdle, Deputy City Administrator Martin, Assistant City Administrator Hobson, Director of Public Works Schmitt, Director of Construction and Neighborhood Services Schwalenberg. Voting Nay: None. Absent: None. Motion carried. May 12, 2008 Page 3 REQUEST FROM OLIVE GARDEN LOCATED AT 3451 SHOPPERS DRIVE FOR: 1. CONDITIONAL USE PERMIT TO ALLOW THE SERVING OF ALCOHOLIC BEVERAGES IN CONJUNCTION WITH A RESTAURANT: AND 2. SIGN VARIANCE Deputy City Administrator Martin stated Energy Development Fields on behalf of Olive Garden Restaurant has submitted an application for a conditional use permit to allow the serving of alcoholic beverages in conjunction with the restaurant to be located at 3451 Shoppers Drive. Olive Garden typically serves beer, wine and specialty drinks, as well as beverages from a full-service bar. Deputy City Administrator Martin noted the application was presented before the Planning and Zoning Commission at a Public Hearing held on May 1, 2008. The Commission unanimously recommended approval of the request. Deputy City Administrator Martin stated the applicant is also requesting a sign variance to allow an additional 45.40 square foot wall sign to provide signage on the building's north, south and west elevations. Staff has reviewed the application and supports the request for variance. Alderman Glab opined the application was complete and he would support the request. Alderman Condon expressed her pleasure in seeing the project coming to fruition. Motion by Glab, seconded by Wimmer, to: 1. Accept the unanimous recommendation of the Planning and Zoning Commission to pass an ordinance granting a conditional use permit to Energy Development Fields on behalf of Olive Garden Restaurant to allow the serving of alcoholic beverages at the restaurant located at 3451 Shoppers Drive; and 2. Accept Staffs recommendation to allow a sign variance permitting three wall signs (45.40 square foot each) on the Olive Garden Restaurant facility. Voting Aye: Santi, Glab, Schaefer, Murgatroyd, Wimmer, Peterson, Condon. Voting Nay: None. Absent: None. Motion carried. REQUEST FOR A TEMPORARY USE PERMIT TO ALLOW THE OUTDOOR DISPLAY OF MULCH —EXXON MOBIL, 1901 NORTH RICHMOND ROAD Deputy City Administrator Martin stated a request was received from Exxon Mobil to display mulch in a four-stall exterior site at its facility located at 1901 North Richmond Road. The temporary use would be permitted by the Zoning Ordinance for a maximum of 120 days per calendar year. The proposed site is located on the southeast corner of the site, adjacent to the fuel pumping islands. Staff has reviewed the site and supports the request. Responding to an inquiry, Deputy City Administrator Martin noted the site would be monitored on a complaint-type basis. May 12, 2008 Page 4 Motion by Schaefer, seconded by Santi, to accept Staffs recommendation to approve the request by Exxon Mobil for a temporary use permit to allow the outdoor display of mulch on their property located at 1901 North Richmond Road, subject to the condition the display area conforms to the approved site plan and does not exceed a four parking stall area. ENGINEERING SERVICE AGREEMENT IN THE AMOUNT NOT-TO-EXCEED $124,004 FOR: REMOVAL OF FREUND AVENUE LIFT STATION; REPLACEMENT OF MILLSTREAM DRIVE LIFT STATION; AND OTHER SANITARY SEWER IMPROVEMENTS In attendance was Robert Wegener, City Engineer with SEC Group Inc. City Administrator Maxeiner stated Council at its October 15, 2007 regularly scheduled meeting authorized an engineering services agreement with SEC Group to conduct a feasibility study for the Boone Creek sanitary sewer improvements and associated lift stations. The analysis has been completed providing three alternatives to be considered by Council. SEC Group is recommending the alternative which includes the removal of the Freund Avenue lift station and the Millstream Drive lift station and requires the construction of a new duplex sanitary sewer line and force main on Third Street. City Administrator Maxeiner noted the cost of engineering for this project was included in the 2008/2009 Fiscal Year budget in the amount of $185,000. It is Staffs recommendation to authorize the Mayor's execution of the Engineering Services Agreement with SEC Group in the amount of$124,004. Responding to Alderman Murgatroyd's inquiry, City Engineer Wegener explained why SEC Group is recommending the stated alternative. Alderman Santi inquired as to the proposed timeframe for beginning the project. City Engineer Wegener responded the project would commence approximately two weeks following authorization. Alderman Glab expressed his pleasure that the engineering for this project came in at 66% of the budgeted amount. Responding to Alderman Wimmer's inquiry, City Engineer Wegener stated the project would go out for bid in approximately two months, pending EPA permitting. Alderman inquired when construction would begin. City Engineer Wegener responded approximately two months following bid award. City Administrator Maxeiner noted it is Staffs goal to have everything in order when Council is ready to approve the project. COMMITTEE RECOMMENDATION: ORDINANCE AMENDING MUNICIPAL CODE CHAPTER 7, BUILDING PERMIT EXTENSIONS Deputy City Administrator Martin stated the Community Development Committee considered implementing building permit extension fees at its April 22, 2008 meeting. The permit extension fees would be implemented for both residential building permits and non- residential (commercial, industrial, office, etc.) permits. Deputy City Administrator Martin stated building permits are designated either major (new construction, alteration, remodel or addition) or minor (all other permits granted). The proposed building permit extension fees are: Residential Minor Permits 1 Y2 times the cost of the original building permit fee 6-month extension Residential Major Permits %the cost of original building permit fee 6-month extension Cost of original building permit fee one-year extension Non-Residential Minor Permits 1 Y2 times the cost of the original building permit fee 6-month extension Non-Residential Major Permits %the cost of original building permit fee 6-month extension Cost of the original building permit fee one-year extension Responding to an inquiry, Director of Construction and Neighborhood Services Schwalenberg stated the onus would be on the developers to complete the project on time or to seek a permit extension. In response to an inquiry from Alderman Glab, Director Schwalenberg stated the exterior of the building would have to be wrapped so that it would be aesthetically pleasing before a permit extension could be granted. Motion by Murgatroyd, seconded by Santi, to accept the Community Development Committee's recommendation to pass an ordinance amending Municipal Code Chapter 7, implementing building permit extension fees as follows: Residential Minor Permits 1 Y2 times the cost of the original building permit fee 6-month extension Residential Major Permits Y2 the cost of original building permit fee 6-month extension Cost of original building permit fee one-year extension Non-Residential Minor Permits 1 Y2 times the cost of the original building permit fee 6-month extension Non-Residential Major Permits '/2 the cost of original building permit fee 6-month extension Cost of the original building permit fee one-year extension. COMMITTEE RECOMMENDATION: DESIGNATED 15-MINUTE PARKING STALLS IN THE MUNICIPAL CENTER PARKING LOT Assistant City Administrator Hobson stated the Public Works Committee recently investigated the implementation of 15-minute parking stalls in the Municipal Center parking lot. In light of increased parking lot use it is difficult for Municipal Center visitors/customers to find a parking space, especially on court days, when park programs are in progress, and/or when police classes are taking place. The committee considered Staffs request to create 15-minute parking spaces in the Municipal Center parking lot. The committee recommended the establishment of four 15-minute parking stalls in front of the main entrance to the Municipal Center. Responding to an inquiry by Alderman Condon, City Administrator Maxeiner noted the 15-minute parking stalls would only provide parking during regular business hours from 8 a.m. until 5 p.m. on Monday through Friday. Alderman Glab suggested the timeframe be extended to include the hours between 8 a.m. and 5:30 p.m. Motion by Schaefer, seconded by Santi, to accept the recommendation of the Public Works Committee to direct Staff to prepare and authorize the Mayor's execution of an ordinance establishing four 15-minute parking stalls directly in front of the main entrance of the Municipal Center for the hours between 8 a.m. until 5 p.m. on Monday through Friday. Voting Aye: Santi, Glab, Schaefer, Murgatroyd, Wimmer, Peterson, Condon. Voting Nay: None. Absent: None. Motion carried. COMMITTEE RECOMMENDATION: DESIGNATED 15-MINUTE PARKING STALLS IN DOWNTOWN BUSINESS DISTRICTS Assistant City Administrator Hobson stated the Public Works Committee considered a request submitted by the Downtown Business Association to establish 15-minute parking stalls in the downtown business districts. The Downtown Maintenance Division Superintendent worked with the Downtown Business Association to determine the placement of the proposed 15-minute parking stalls. Based on Staff review, the committee recommendation is as follows: (3)spaces at 1307-1309 Riverside Drive George Thompson Insurance, Riverside Bakery, Reese's Barkery and Pawtique,Accountant and Old World Coin (2)spaces at 1325 Riverside Drive Riverside Shop N Go (2)spaces at 1214 N Green Street Clock Shop, La Esperanza Bakery, Alley Buys, McHenry Favorite Sports, Wrinkled Pages Book Store (2)spaces at 1245-1249 N Green Street Green Street Cleaners, Some Other Nuts, Sunshine Quilt Shoppe, Resale Shop, Chamber of Commerce, NW Driving School (2)spaces at 3923 Main Street Plum Garden, Mar-Ray Dance Studio, McHenry Printing. May 12, 2008 Page 7 Council complimented the Committee and the Downtown Business Association on working together on this project. r Motion by Schaefer, seconded by Santi, to accept the recommendation of the Public Works Committee to direct Staff to prepare and authorize the Mayor's execution of an ordinance establishing 15-minute parking stalls between the hours of 8 a.m. and 6 p.m. on Monday through Saturday at the following locations: (3)spaces at 1307-1309 Riverside Drive (2)spaces at 1325 Riverside Drive (2)spaces at 1214 N Green Street (2)spaces at 1245-1249 N Green Street (2)spaces at 3923 Main Street. MAYOR— STATEMENT AND REPORT Mayor Low officially welcomed Ryan Schwalenberg to his new position as Director of Construction and Neighborhood Services. COMMITTEE REPORTS Chairman Alderman Peterson announced the Parks and Recreation Committee meeting has been rescheduled from Wednesday, May 14, 2008 to Wednesday, May 21, 2008 at 7 p.m. in the Aldermen's Conference Room. Chairman Alderman Murgatroyd announced a Finance and Personnel Committee meeting has been scheduled for Monday, May 19, 2008 at 6:30 p.m. in the Aldermen's Conference Room. STAFF REPORTS There were no Department Head Reports. FUTURE AGENDA ITEMS There were no Future Agenda Items discussed.
