OCTOBER 13, 2008
A Regular Meeting of the McHenry City Council was called to order by Mayor Low at
7:30 P.M. on Monday, October 13, 2008 in the Council Chambers of the Municipal Center.
At roll call the following Aldermen were present: Santi, Glab, Schaefer, Murgatroyd,
Wimmer, Peterson, and Condon. Absent: None. City Staff in attendance were: City
Administrator Maxeiner, City Clerk Jones, City Attorney McArdle, Deputy City Administrator
Martin, Assistant City Administrator Hobson, Director of Finance Black.
PUBLIC INPUT SESSION: 10 MINUTE LIMITATION
There was no one who signed in to speak during the Ten Minute Public Input
Session.

ORDINANCE AMENDING MUNICIPAL CODE CHAPTER 4, SECTION 4-6(8)
INCREASING THE LIMIT ON THE NUMBER OF SPECIAL EVENT LIQUOR LICENSES
ISSUED PER CALENDAR YEAR AT ONE LOCATION FROM THREE TO EIGHT
City Administrator Maxeiner stated, during a prior Council discussion on a request
from the Church of Holy Apostles for a one-time waiver as to the limitation of special event
liquor licenses to three at any one location within a given year, Council asked Staff to revisit
the limit currently specified in the Code. As Staff previously noted, the special event liquor
license limit of three per location appears to have been arbitrarily selected.
City Administrator Maxeiner stated the limitation as to the number of special event
licenses needs to be balanced so as to allow organizations to hold events and functions
essential to their organizational purpose while working to limit the potential for the abuse of
land use activities. Staff suggests Council consider a limitation of eight special event liquor
licenses at one location in any one year. It should be noted that each special event liquor
license would still require Council consideration and approval. If Council concurs with
Staffs recommendation, an ordinance has been prepared providing for the amendment to
Municipal Code Chapter 4 Section 4-6(8) increasing the number of special event liquor
licenses issued per year at one location from three to eight.
Responding to an inquiry from Alderman Peterson, City Administrator Maxeiner
noted that all events regarding the Church of Holy Apostles would be parish-related. City
Administrator Maxeiner further stated that all special event liquor licenses are issued at the
applicant's request, depending on the event.
Motion by Murgatroyd, seconded by Condon, to accept Staffs recommendation to
pass an ordinance amending Municipal Code Chapter 4, Section 4-6(8) increasing the
number of special event liquor licenses issued per calendar year at one location from three
to eight.

ORDINANCE AMENDING MUNICIPAL CODE CHAPTER 18, ARTICLE II, SECTION 18-
28, BOARD OF POLICE COMMISSIONERS POWERS OF DUTY
City Administrator Maxeiner stated Municipal Code Chapter 18, Section 18-28
currently specifies "the Board of Police Commissioners shall appoint all officers of the

McHenry Police Department, except the Chief of Police..." The second paragraph states
"the Mayor's appointment of the Chief of Police shall be made from among one or more
candidates recommended to the Mayor by the Board of Police Commissioners. If the Mayor
declines to appoint a Chief of Police from among the recommendations so made to the
Mayor, the Board of Police Commissioners shall recommend other candidates to the Mayor
until such time that an appointment is made by the Mayor..."
City Administrator Maxeiner stated Staff is of the opinion that an amendment to the
Municipal Code is warranted to correct deficiencies and to eliminate onerous provisions not
required by state statute. The deficiencies relate to the lack of direction in the Code on the
promotion of the Deputy Chief(s) of Police. Illinois State Statute provides for the promotion
of up to two individuals to the position of Deputy Chief of Police by the Chief of Police
through approval of an ordinance by the City Council. The City's Municipal Code should be
amended to reflect the statutory authority provided to the Chief.
Regarding the Police Commission's role in the selection process of the Chief of
Police, Staff believes this requirement is onerous, adding steps and time to the recruitment
and selection process for the Chief of Police.
City Administrator Maxeiner stated if Council concurs with Staff `s recommendation,
modifications to Chapter 18 Section 18-28 should be made by passing the ordinance
presented for Council consideration at this evening's meeting.
Motion by Glab, seconded by Wimmer, to accept Staffs recommendation to pass an
ordinance amending the Municipal Code Chapter 18, Section 18-28 to have the Police
Commission powers and duties reflect those provided by Illinois State Statute 65 ILCS
5/10-2.1-4.

CITY OF MCHENRY LOGO AND SLOGAN
In attendance was Sue Dobbe of Dobbe Marketing and PR.
Assistant City Administrator Hobson stated Council, at its August 4, 2008 regularly
scheduled meeting, approved a contract with Dobbe Marketing and PR for the refinement
of the City logo and slogan, as well as developing an overall marketing strategy. The
current logo and "Heart of the Fox" slogan were adopted in 2001 following a community
contest. Several meetings have occurred with the Dobbe Marketing team to refine the
existing logo rather than starting over. The logo and slogan evolved into the image being
presented this evening to Council for consideration. Overall the update provides a more
progressive image and logo associated with the City and its economic development efforts.
Assistant City Administrator Hobson noted, since the logo and slogan will be the
cornerstone of the City's marketing efforts, Staff is asking for the approval of the new
design by the City Council.

Alderman Schaefer stated he is in favor of the updated logo and new terminology.
Alderman Murgatroyd opined the new logo is bolder than the original.
Alderman Wimmer inquired if the logo would have to be changed on the City water
towers and City vehicles. Assistant City Administrator Hobson responded there would be a
gradual transition taking place during normal maintenance and the vehicle replacement
process.
Alderman Peterson inquired if there were other designs Staff reviewed and
considered. Assistant City Administrator Hobson responded Staff focused on updating and
tweaking the current design.
Alderman Condon stated she likes the concept but prefers the old fox design.
Regarding the "Heart of the Fox River", she opined the letters need to be more visible.
Alderman Santi stated he likes the new typeface and concept.
Alderman Glab stated he does not care for the new fox character. He expressed
concern the "Heart of the Fox River' might be lost on a small surface.
Mayor Low noted she does not care for the lines of water shown on the fox's tail.
Mayor Low concurred the "Heart of the Fox River' should be larger. She stated that overall
she really likes the logo and slogan.
Alderman Peterson stated he would have preferred to have seen more options to
review and consider.
Motion by Schaefer, seconded by Santi, to accept Staffs recommendation to
approve and adopt the new fox logo and "Heart of the Fox River' slogan as the official logo
and slogan for the City of McHenry.

Voting Nay: Glab, Peterson, Condon.

COMMITTEE REPORTS
McHenry Area Youth Commission Council Liaison Alderman Condon reported the
Commission's red ribbon kick-off is next week and encouraged all to wear their red ribbons
in support of the Commission's efforts.
