NOVEMBER 10, 2008
A Regular Meeting of the McHenry City Council was called to order by Mayor Low at
7:30 P.M. on Monday, November 10, 2008 in the Council Chambers of the Municipal
Center. At roll call the following Aldermen were present: Santi, Glab, Schaefer, Murgatroyd,
Wimmer, Peterson, and Condon. Absent: None. City Staff in attendance were: City
Administrator Maxeiner, City Clerk Jones, City Attorney McArdle, Deputy City Administrator
Martin, Director of Finance Black, Director of Public Works Schmitt.
Mayor Low welcomed Boy Scout Adam Murgatroyd and his father David. She noted
Adam is working on his Citizenship in the Community Badge.
PUBLIC INPUT SESSION: 10 MINUTE LIMITATION
There was no one who signed in to speak during the Ten Minute Public Input
Session.

Motion by Peterson, seconded by Wimmer, to approve the Consent Agenda as
presented:
A. Proposed amendment to Zoning Ordinance regarding the regulation of neon
signs;
B. Request from McHenry Garden Club for temporary signs advertising the Holiday

Discussion on the Motion:
Alderman Peterson opined the snowplowing of Feger Subdivision should be billed at
the higher overtime rate. He noted he would like to go on record indicating his opinion on
this matter.
Alderman Glab stated the City has been providing this service and has been
compensated in the same manner for the past 13-14 years.
Alderman Schaefer inquired if the snowplowing of Feger Subdivision is completed in
the same manner as City subdivisions in general. Director of Public Works Schmitt
responded it is easier to plow the roads in Feger Subdivision, as opposed to creating dead
ends at the City boundary. He noted it takes approximately 15 minutes to plow Feger
Subdivision.
Responding to an inquiry, Director of Finance Black clarified that the first 20
snowplowing passes are covered in the initial amount of $2,097 for the season. After that
point, the overtime rate applies.
City Administrator Maxeiner stated, if the salt situation continues, it is likely that next
year Staff would request that the City no longer plow Feger Subdivision in order to
conserve salt for City streets.

PROPOSED 2008 TAX LEVY
Director Black noted each year the City is required to estimate revenues required to
operate the City for the following year. Included in the revenues are those amounts funded
through the property tax. The City must estimate the amounts required for the property tax
levy so that the funds generated through this tax will become available during the 2009-
2010 fiscal year. Director Black stated the estimated levy must be approved by the City
Council and submitted to the McHenry County Clerk by the last Tuesday in December.

Director Black stated this year's levy request is in the amount of $4,853,283 which
represents an increase of 15% over the prior year's property tax extension of $4,220,246. .�
Since the tax levy estimate shows an increase of more than 5% when compared to the
previous year's property tax extension, a public hearing must be held to meet the
requirements of the Truth in Taxation Act. It is therefore Staffs recommendation to:
• Establish the date of December 1, 2008 for the Public Hearing for the 2008 Tax Levy
(collected in 2009) as required by the Truth in Taxation Act;
• Pass a resolution setting the 2008 Tax Levy request to be collected in 2009 at
$4,853,283.
Motion by Glab, seconded by Murgatroyd, to accept Staffs recommendation to
establish the date of December 1, 2008 for the Public Hearing for the 2008 Tax Levy to be
collected in 2009 as required by the Truth in Taxation Act, and to pass a resolution
establishing the 2008 Tax Levy request to be collected in 2009 in the amount of
$4,853,283.

TEMPORARY SIGN VARIANCE — THE OLIVE GARDEN ITALIAN RESTAURANT, 3451
SHOPPERS DRIVE
Deputy City Administrator Martin stated a request was submitted by Olive Garden ---
seeking a variance to display temporary banners at its new facility located at 3451
Shoppers Drive. As the request involves 39 consecutive days of banner display, a variance
is required from Council. The proposed banners are as follows:
• Banner#1 "Now Hiring" from December 31, 2008 to January 14, 2009
• Banner#2 "Open at 4:00 p.m." from January 15, 2009 to February 1, 2009
Banner#3 "Now Open for Lunch and Dinner" from February 2, 2009 to February
8, 2009.
Deputy City Administrator Martin noted Staff has reviewed and supports the request
as presented.
Motion by Condon, seconded by Santi, to accept Staffs recommendation to approve
a temporary sign variance for The Olive Garden Italian Restaurant located at 3451
Shoppers Drive to allow the following:
• Banner#1 "Now Hiring" from December 31, 2008 to January 14, 2009
• Banner#2 "Open at 4:00 p.m." from January 15, 2009 to February 1, 2009
Banner#3 "Now Open for Lunch and Dinner" from February 2, 2009 to February
8, 2009.

MAYOR— STATEMENT AND REPORT
Mayor Low announced the Holiday Christmas Walk is scheduled for Sunday,
r November 16th from 10 a.m. until 5 p.m. The Jaycees Toys for Tots Parade begins at 1
p.m. Anyone wishing to participated should be at the Metra station by 12:30 p.m. The
Holiday Tree Lighting Ceremony will occur at approximately 4-4:30 p.m. at Veterans
Memorial Park.
Mayor Low also announced there would be a Veterans' Day Ceremony at 10:00 a.m.
at the McHenry VFW Post 491 on Tuesday, November 11, 2008.
Mayor Low stated there would be a public presentation of the "Presenting McHenry,
Illinois" promotional DVD at the McHenry County College Shah Center on Wednesday,
November 12, 2008 from 4:30 p.m. until 5:30 p.m.
COMMITTEE REPORTS
Parks and Recreation Committee Chairman Alderman Peterson announced a
meeting has been scheduled for Wednesday, November 12, 2008 at 7 p.m. in the
Aldermen's Conference Room.
Community Development Committee Chairman Alderman Condon announced the
regular committee meeting has been scheduled for Tuesday, November 25, 2008 at 7 p.m.
in the Aldermen's Conference Room.
Additionally, Chairman Alderman Condon announced a Community Development
Committee meeting has been scheduled for Tuesday, December 2, 2008 at 7 p.m. to
consider a concept plan for a proposed development.
STAFF REPORTS
There were no Staff Reports.
FUTURE AGENDA ITEMS
Alderman Glab recalled that the snowplowing issue in non-City subdivisions has
been discussed in the past. He suggested the City review this matter at the Committee
level if Council chooses to opt out of this program next year.
Alderman Glab noted leaves are really falling throughout the City and great amounts
of them are being piled in City streets. He requested the City Newsletter include an article
requesting the leaves not be piled in City streets. He opined the leaves could clog the storm
water drainage system.
Alderman Schaefer inquired as to the status of Comcast coverage of Council
meetings. City Administrator Maxeiner responded the City is pursuing other options. He
noted the City received a couple of responses to the City Newsletter request for video
operators for Council meetings. However, nothing has materialized at this point.
