JANUARY 29, 2007
A Regular Meeting of the McHenry City Council was called to order by Mayor Low at
7:30 P.M. on Monday, January 29, 2007 in the Council Chambers of the Municipal Center.
At roll call the following Aldermen were present: Santi, Glab, Schaefer, Murgatroyd,
Wimmer, Peterson and Condon. Absent: None. City Staff in attendance were: City
Administrator Maxeiner, City Attorney McArdle, City Clerk Jones, Deputy Administrator
Martin, Assistant Administrator Hobson, Chief of Police O'Meara, Director of Community
Development Napolitano, Director of Parks and Recreation Merkel, Director of Finance
Black. Absent: Director of Public Works Marcinko.
PUBLIC INPUT SESSION — 10 MINUTE LIMITATION
There was no one who signed in to speak during the Ten Minute Public Input
Session.
CONSENT AGENDA
Motion by Santi, seconded by Condon, to approve the Consent Agenda as
presented:
A. Approve final pay request for demolition of barn/silo at 312 South Green Street —
Langos Corporation, $13,500;
B. Approve final pay request for demolition of vacant houses at 4312 Lakewood
Road and 312 South Green Street —CornerStone Material Recovery,
$37,700;
C. Approve recommendation for reduction of Legend Lakes Neighborhood 4 Bond
#5001806 contingent upon receipt of Maintenance Bond in the amount of

APPROVE REQUEST FOR:
1. CLASS A LIQUOR LICENSE - BURRITO EXPRESS INC. D/B/A FERNANDO'S
MEXICAN GRILL, 1237 NORTH GREEN STREET
2. ORDINANCE INCREASING THE NUMBER OF CLASS A LIQUOR LICENSES FROM
25 TO 26
Mayor Low reported she met with Fernando Perez who is requesting a Class A
Liquor License for his restaurant Fernando's Mexican Grill located at 1237 North Green
Street. Mr. Perez has submitted all appropriate paperwork and paid the required fee. Mr.

Perez has been fingerprinted and has stated all of his staff will attend BASSETT training
classes. Mayor Low stated she recommends awarding a liquor license to Mr. Perez and
passing an ordinance increasing the number of Class A Liquor Licenses from 25 to 26.
Motion by Murgatroyd, seconded by Schaefer, to accept the Mayor's
recommendation to approve a Class A Liquor License for Burrito Express d/b/a Fernando's
Mexican Grill located at 1237 North Green Street; and to pass and approve an ordinance
increasing the number of Class A Liquor Licenses from 25 to 26, pending satisfactory
fingerprinting results and attendance by Fernando's Mexican Grill' staff at BASSETT
training.

APPROVE ORDINANCE GRANTING A USE VARIANCE AND CONDITIONAL USE
PERMIT TO ALLOW A RELIGIOUS ESTABLISHMENT AT 2742 BARNEY COURT IN
BUSINESS PARK ZONING DISTRICT— LIGHTHOUSE ASSEMBLY OF GOD CHURCH
Director of Community Development Napolitano stated members of the Lighthouse
Assembly of God congregation have requested a Use Variance and Conditional Use
Permit to allow the operation of a religious facility in a business park. The proposed
location of the church would be 2742 Barney Court in Adams Commercial Centre. Director
--- Napolitano noted the Planning and Zoning Commission at a Public Hearing held on
January 18, 2007, unanimously recommended approval of the request. Staff has reviewed
the request and has determined the church would not be required to make any external
modifications to the site in order to maintain compliance with City code and ordinance
requirements. Staff supported the request.
Motion by Schaefer, seconded by Santi, to accept the unanimous recommendation
of the Planning and Zoning Commission, and to approve an ordinance granting a Use
Variance and Conditional Use Permit allowing the operation of a religious facility in Adams
Commercial Center located at 2742 Barney Court.

2. WAIVING BID REQUIREMENTS FOR THE REHABILITATION OF WELL #9:
3. ACCEPTING PROPOSAL FROM WATER WELL SOLUTIONS DRILLING
DIVISION, LLC IN AN AMOUNT NOT-TO-EXCEED $34,486.40

ORDINANCE REGARDING APPLICATION FEES AND RETAINED PERSONNEL FEES
AND OTHER PERTINENT CHANGES
Director Napolitano summarized the proposed text amendments to the Municipal
Code, Zoning Ordinance and Subdivision Control and Development Ordinance. The
amendments were initially considered and discussed at the Community Development
Committee in October and November 2006. The amendments largely relate to application
fees and retained personnel fund deposits, including:

Director Napolitano noted all proposed text amendments were presented to the
Planning and Zoning Commission at a Public Hearing held on January 18, 2007. The
Commission unanimously recommended approval of the proposed amendments.
Alderman Santi expressed his appreciation for Staff efforts in regard to proposing
the text amendments.

recommendation of the Planning and Zoning Commission, and to pass an ordinance
providing for text amendments to the City's Municipal Code, Zoning Ordinance and

APPROVE RECOMMENDATION:
1 FORM AND CONTENT OF REDEVELOPMENT AGREEMENT REGARDING 1110
NORTH GREEN STREET;
2 PASS AN ORDINANCE AUTHORIZING THE SALE OF PROPERTY BY BID
PROCESS, 1110 NORTH GREEN STREET
Deputy City Administrator Martin summarized the content of a proposed
Redevelopment Agreement regarding the City-owned property located at 1110 North
Green Street. He noted Curtis Commercial, the firm which submitted the accepted
redevelopment plan for this property, has agreed to all of the terms and content of the
Redevelopment Agreement.
Deputy Administrator Martin stated in order for the City to sell surplus property, i.e.
the former Medical Arts Building property located at 1110 North Green Street, an
�-- ordinance must be passed and approved by Council. In addition, Notice of Public Bid must
be published once per week for three consecutive weeks, with the first notice occurring at
least 30 days prior to the date of the bid opening.
City Attorney McArdle requested Council initiate two motions regarding this matter:
1. pass and approve an ordinance authorizing the sale of City property located at 1110
North Green Street by bid process; and
2. approve as presented the form and content of the Redevelopment Agreement for the
property located at 1110 North Green Street.
Alderman Murgatroyd stated the Redevelopment Agreement is a good agreement.
He stated he looks forward to the project's completion.
Motion by Wimmer, seconded by Murgatroyd, to accept Staffs recommendation, to
pass and approve an ordinance authorizing the sale of City property located at 1110 North
Green Street by bid process.

approve as to form and content a Redevelopment Agreement for the property located at
1110 North Green Street, formerly known as the Medical Arts Building site.

MAYOR—STATEMENT AND REPORT
Mayor Low opined the approval of the Redevelopment Agreement is very exciting.
Mayor Low reminded Council of the Chamber's State of the City luncheon
scheduled for Wednesday, January 31, 2007 at the McHenry Country Club.
Mayor Low stated she is recommending the appointment of Tyler Franzen as the
student representative on the City's Landmark Commission. She requested a motion of
ratification from Council of the appointment.
Motion by Condon, seconded by Santi, to accept the Mayor's recommendation to
appoint Tyler Franzen as the student representative on the Landmark Commission.

COMMITTEE REPORTS
Chairman Alderman Peterson announced a Parks and Recreation Committee is
hosting a public input meeting on Wednesday, January 31, 2007 at 7 p.m. in the Council
Chambers. The purpose of the meeting is to obtain input regarding the draft Parks and
Recreation Master Plan.
Alderman Condon, the City's liaison to the McHenry Area Youth Commission,
distributed minutes of the Commission's January 25, 2007 meeting, in an effort to keep
Council apprised of the Commission's activities and events.
STAFF REPORTS
City Administrator Maxeiner recognized Deputy Administrator Martin and City
Attorney McArdle for their efforts in creating the Redevelopment Agreement for the City's
property located at 1110 North Green Street.
