HomeMy WebLinkAboutMinutes - 02/19/2007 - City Council REGULAR MEETING FEBRUARY 19, 2007 A Regular Meeting of the McHenry City Council was called to order by Mayor Low at 7:30 P.M. on Monday, February 19, 2007 in the Council Chambers of the Municipal Center. At roll call the following Aldermen were present: Santi, Glab, Schaefer, Murgatroyd, Wimmer, Peterson and Condon. Absent: None. City Staff in attendance were: City Administrator Maxeiner, City Attorney McArdle, City Clerk Jones, Deputy Administrator Martin, Assistant Administrator Hobson, Chief of Police O'Meara, Director of Community Development Napolitano, Director of Parks and Recreation Merkel, Director of Finance Black. Absent: None. Mayor Low welcomed McHenry Cub Scout Pack 351 Wolves who led the Pledge of Allegiance. RECOGNITION OF CITY EMPLOYEES GARY MERTZ AND PAT GORNIAK Mayor Low requested Council approve a resolution recognizing City employees Gary Mertz and Pat Gorniak for their assistance given to a Wal-Mart employee on February 6, 2007 when they came to her aid. Mayor Low stated the victim's brother Terry Traina called her to express his appreciation to the City and its employees on behalf of the family. Mayor Low read the resolution and requested a motion passing and approving it so that it can be made a part of the record of tonight's meeting. Motion by Condon, seconded by Murgatroyd, to pass and approve a resolution recognizing City employees Gary Mertz and Pat Gorniak for their assistance provided to a Wal-Mart employee on February 6, 2007 when they came to her aid. Voting Aye: Santi, Glab, Schaefer, Murgatroyd, Wimmer, Peterson, Condon. Voting Nay: None. Absent: None. Motion carried. February 19, 2007 Page 5 APPROVE SIGN VARIANCE FOR BIMBO'S GRILL 1318 NORTH RIVERSIDE DRIVE In attendance was Penny Hughes of Hughes Signs who represented the owner in this matter. Director of Community Development Napolitano stated he was contacted by Jim Archos, owner of Bimbo's Grill located at 1318 North Riverside Drive, who is requesting a sign variance to allow a second wall sign on his building. The proposed sign would be located on the south side of the building. Director Napolitano stated Mr. Archos is hoping to attract vehicular traffic from Route 120 as well as boat traffic from the river. As there is no place to attach a sign on the river side of the building, the only possible means of posting an additional sign is along the south elevation. Director Napolitano stated, while Staff is concerned about setting a precedent by allowing a second wall sign on the building, the need for a means to attract boat and vehicular traffic is great. Director Napolitano stated from an economic development standpoint, allowing the sign is appropriate. Ms. Hughes addressed Council confirming the owner's need for additional signage on the property. Alderman Santi stated he is comfortable with the sign variance as requested. Alderman Glab noted it is understandable why the owner is unable to comply with the sign code without a variance. Alderman Murgatroyd stated he understands the need, but would not want to establish a precedent. Alderman Peterson stated he would like to see coordinated signage throughout the downtown areas. He does not want to see too many variances. He does understand the owner's need in this case. Alderman Condon stated she does not believe additional signage will improve business. She noted if the sign is tastefully done, she would reluctantly support the variance. Mayor Low commented downtown revitalization is a goal of Council. Council must therefore help downtown businesses to stay in business. She noted it is important to send that message to the business community. Alderman Wimmer noted it is important to do what can be done to support businesses in the community. Motion by Santi, seconded by Schaefer, to accept Staffs recommendation to �... approve a variance for Bimbo's Grill located at 1318 North Riverside Drive, to allow a second wall sign comprised of 76 square feet, to be placed on the south elevation of the building. APPROVE ORDINANCES GRANTING APPROVAL OF ANNEXATION AND ZONING MAP AMENDMENT— 1630 NORTH RIVERSIDE DRIVE, CARLSTEN In attendance were applicants Roy and Janice Carlsten. Director Napolitano stated the applicants are seeking annexation of their property located at 1630 North Riverside Drive. They intend to build a house on the property and would connect to municipal water and sanitary sewer. The applicants are also seeking RS- 4 zoning upon annexation. Director Napolitano noted the Planning and Zoning Commission at a Public Hearing held on February 1, 2007 unanimously recommended approval of the request. Motion by Schaefer, seconded by Murgatroyd, to accept Staffs recommendation to authorize the Mayor and City Clerk's execution of an ordinance annexing the property located at 1630 North Riverside Drive to the City of McHenry. Voting Aye: Santi, Glab, Schaefer, Murgatroyd, Wimmer, Peterson, Condon, Low. Voting Nay: None. Absent: None. Motion carried. Motion by Wimmer, seconded by Schaefer, to accept the unanimous recommendation of the Planning and Zoning Commission to pass an ordinance granting RS-4 High Density Single-Family Zoning for the property located at 1630 North Riverside Drive. Voting Aye: Santi, Glab, Schaefer, Murgatroyd, Wimmer, Peterson, Condon. Voting Nay: None. Absent: None. Motion carried. AWARD OF BID FOR PLAYGROUND RENOVATIONS AT CREEKSIDE PARK AND MALIBU TOT LOT—TEAM REIL. $94,580 Director of Parks and Recreation Merkel stated bid specifications were prepared; bids were sought and opened on January 23, 2007 for the playground renovations at Malibu Tot Lot and Creekside Park. The lowest responsible bid was submitted by Team Reil of Union, Illinois, in the amount of $94,580 which includes replacement of the wood retaining wall at the entrance to Malibu Tot Lot. Director Merkel noted the 2006-2007 Fiscal Year Budget included $100,000 for this item. It is Staffs recommendation to award the contract for this project to Team Reil. February 19, 2007 Page 7 Alderman Santi inquired as to the time table for completion of this project. Director Merkel responded completion should occur by the end of May. Motion by Condon, seconded by Santi, to accept Staffs recommendation to award the bid for the playground renovations at Creekside Park and Malibu Tot Lot to Team Reil in an amount not-to-exceed $94,580. Voting Aye: Santi, Schaefer, Murgatroyd, Wimmer, Peterson, Condon. Not Voting: Glab. Voting Nay: None. Absent: None. Motion carried. APPROVE ENGINEERING SERVICES AGREEMENT FOR MUNICIPAL SANITARY SEWER SYSTEM MODELING/ANALYSIS—SEC INC City Administrator Maxeiner stated the City's Public Works Department regularly utilizes a utility atlas to identify the location of utilities within the rights-of-way or easements. The department is currently using documents which were prepared in 1981. City Administrator Maxeiner noted in order to bring the City's utility atlas up-to-date would be the acquiring of a GIS system to provide the modeling analysis for the City's infrastructure. City Engineer SEC Inc. has submitted an engineering services agreement to create the sanitary sewer system hydraulic modeling/analysis for the City system. City -- Administrator Maxeiner noted hydraulic modeling provides a means of analyzing the overall performance of a system as the interaction of all system components is illustrated. Hydraulic modeling also allows the comparison of competing options for system optimization and the evaluation of best management practices. The study will aid the City in determining the optimal location for new lift stations and sewers for proposed developments. It is Staffs recommendation to approve the engineering services agreement with SEC Inc. in an amount not-to-exceed $234,680. Alderman Peterson inquired if the City should not wait to conduct the study until the new Director of Public Works has been hired. City Administrator Maxeiner responded this information would not primarily be used by the Director. Responding to further inquiry from Alderman Peterson, City Engineer Robert Wegener of SEC Inc., who was in attendance, stated the systems will be constantly updated. There would be a software system in conjunction with hard copy for Staff review. Motion by Murgatroyd, seconded by Santi, to accept Staff s recommendation to enter into an Engineering Services Agreement with SEC Inc. for municipal sanitary sewer system modeling/analysis in an amount not-to-exceed $234,680. February 19, 2007 Page 8 APPROVE TWO (2) CHANGE ORDERS FOR MUNICIPAL DRIVE PROJECT City Administrator Maxeiner stated the Municipal Drive Expansion Project which was awarded in July 2006 to Berger Excavating Contractors was for an estimated cost of $1,337,570. Currently two change orders are being proposed regarding this project: 1. Additional electrical items not included in the original contract in the amount of $10,864; 2. Upgrading fiberglass light standards to aluminum light standards in the amount of $4,136. It is Staff s recommendation to approve Change Orders No. 1 and 2 which would add $15,000 to the original contract amount. City Administrator Maxeiner noted Change Order No. 3 is on the way. It will result in a savings to the City of several thousand dollars. Motion by Schaefer, seconded by Santi, to accept Staffs recommendation to approve Municipal Drive Expansion Project Change Orders No. 1 and 2 with Berger Excavating Contractors for a total contract increase of$15,000 for the following: 1. Additional electrical items not included in the original contract in the amount of $10,864; 2. Upgrading fiberglass light standards to aluminum light standards in the amount of $4,136. COMMITTEE REPORTS Chairman Alderman Peterson reminded Council of the Parks and Recreation Committee meeting scheduled for Wednesday, February 21, 2007 at 6 p.m. in the Aldermen's Conference Room. STAFF REPORTS Assistant City Administrator Hobson announced equipment has been mobilized for the dismantling and relocation of the old Pearl Street Bridge. The bridge should be moved to its storage location at the South Wastewater Treatment Plant by the end of the week. Director of Community Development Napolitano announced work on the Pacini Property along Route 31 is wetland mitigation taking place to allow for future development of the property. FUTURE AGENDA ITEMS Alderman Glab stated it is difficult to make left hand turns from side streets onto Route 120. He suggested traffic flow be addressed at a future Public Works Committee meeting.
