HomeMy WebLinkAboutMinutes - 04/02/2007 - City Council REGULAR MEETING APRIL 2, 2007 A Regular Meeting of the McHenry City Council was called to order by Mayor Low at 7:30 P.M. on Monday, April 2, 2007 in the Council Chambers of the Municipal Center. At roll call the following Aldermen were present: Santi, Glab, Schaefer, Murgatroyd, Wimmer Peterson and Condon. Absent: None. City Staff in attendance were: City Administrator Maxeiner, City Attorney David Rogers, City Clerk Jones, Deputy City Administrator Martin, Assistant City Administrator Hobson, Chief of Police O'Meara, Director of Community Development Napolitano, Director of Parks and Recreation Merkel, Director of Finance Black. Absent: City Attorney McArdle. PRESENTATION: COMMUNITY SERVICE AWARDS Mayor Low announced Director of Parks and Recreation Merkel would be making a presentation to four services clubs in recognition of their contributions to the community. Director Merkel presented plaques of gratitude to the following representatives of community service organizations: 1) to McHenry Area Jaycees representative Bill Belpedio — Haunted House, Kid's Fishing Derby, Easter Egg Hunt, Jaycee Day Fireworks, Toys for Tots. 2) to McHenry Lion's Club representatives John Perske, Jim Bart and Curt Bremmer- Lion's Club Carnival. 3) to McHenry Rotary Club representative Diana Mark— Rotary Park Shelter, Walkway and Landscape Renovations. 4) McHenry Kiwanis Club representative Ken Veen — Kiwanis Tot Lot Playground Renovations. Council joined Director Merkel in expressing its appreciation to the community service clubs for their generous contributions to the community. Mayor Low stated the City of McHenry is blessed with volunteers. PROCLAMATION: SENIOR SERVICES ASSOCIATES DAY, APRIL 15, 2007 Mayor Low acknowledged Kay Hatcher of Senior Services of McHenry in attendance. Ms. Hatcher addressed Council providing a brief presentation of Senior Services programs and accomplishments during the last two decades. She noted there has been a 20% growth rate in people reaching 60 years of age during that time span. Mayor Low presented a proclamation to Ms. Hatcher acknowledging the past accomplishments and contributions of Senior Services of McHenry to the community and proclaiming April 15, 2007 as Senior Services Associates Day in McHenry, PUBLIC INPUT SESSION — 10 MINUTE LIMITATION There was no one who signed in to speak during the Ten Minute Public Input Session. April 2, 2007 Page 2 CONSENT AGENDA --` Motion by Wimmer, seconded by Schaefer, to approve the Consent Agenda as presented: A. Ratification of 2007/2008 NISRA budget; B. REQUEST TO BLOCK CERTAIN PORTIONS OF GREEN STREET AND PROVIDE CITY SUPPORT SERVICES FOR THE FIFTH ANNUAL SOAP BOX DERBY EVENT ON SATURDAY, JUNE 16, 2007— MCHENRY KIWANIS CLUB Assistant City Administrator Hobson stated the McHenry Kiwanis Club is seeking _ approval to host its 51" Annual Soap Box Derby at Green Street and Waukegan Road on Saturday, June 16, 2007 between the hours of 7:00 a.m. and 6:00 p.m. In conjunction with the event, Assistant Administrator Hobson noted the Kiwanis are seeking the following: 1. Intermittent Street Closing: Waukegan Road from Third Street to East Campus on the day of the event and from 9:00 a.m. until noon on practice day, June 3rd; 2. Police Support: during the event to assist in Street Closing and rerouting traffic; 3. Signage, Barricades and Cones: to alert drivers of closed roads; cones to be used to mark the course; 4. Bleachers and Garbage Cans: bleachers for spectators along Waukegan Road and garbage cans along event route; 5. Reviewing Stand and PA System: reviewing stand and PA System will be set up at the finish line. Assistant City Administrator Hobson noted the only significant change is that the parade will be held at 9:30 a.m. rather than at the end of the race. Assistant City Administrator Hobson stated it is Staffs recommendation to approve the request. Motion by Santi, seconded by Wimmer, to accept Staffs recommendation to approve the McHenry Kiwanis Club's request to hold its ! th Annual Soap Box Derby on Saturday, June 16, 2007 from 7:00 a.m. until 6:00 p.m. with a practice event scheduled for June 2, 2007 between 9:00 a.m. and noon, and that the City will grant the following: 1. Intermittent Street Closing: Waukegan Road from Third Street to East Campus on the day of the event and from 9:00 a.m. until noon on practice day, June 3rd; 2. REQUEST FROM MCHENRY AREA JAYCEES FOR: 1) USE OF PETERSEN PARK, CITY SUPPORT SERVICES AND WAIVER OF ALL ASSOCIATED FEES FOR ANNUAL JAYCEE DAYS FOURTH OF JULY EVENT: 2) AWARD OF CONTRACT FOR ANNUAL JAYCEE DAYS FOURTH OF JULY FIREWORKS PROGRAM — MELROSE PYROTECHNICS IN THE AMOUNT OF $15,000 Director Merkel noted this year's Fireworks Program is scheduled for Tuesday, July 3, 2007. Director Merkel stated the Jaycees have sent out a number of letters to the business community seeking contributions toward this year's Fireworks Display. Contributions to date have fallen below previous years' totals donations. Consequently, the Jaycees have had to reduce the donation towards this year's event. The contribution will be $5,000 and the City's usual budgeted amount .for this event is $10,000. This would result in a $15,000 display. Director Merkel stated requests for proposals were sought with two firms responding. It is Staffs recommendation to approve the Jaycees' request to use Petersen Park, provide support services and waive all associated fees for Jaycees Day on July 3, 2007, and to approve a contract with Melrose Pyrotechnics for the 2007 Fireworks Program in the amount of$15,000, Alderman Condon requested clarification regarding the difference between a $15,000 show and a $20,000 show. Director Merkel responded the reduction in show cost would not reduce the quality of the show. Responding to Alderman Glab's inquiry, Director Merkel noted two proposals were received. Alderman Glab opined if other proposals were pursued the City might be able to provide a better quality show for its money. He also stated the contract is rather broad. Assistant City Administrator Hobson noted most of the information was contained in the Request for Proposals. Motion by Schaefer, seconded by Condon, to accept Staffs recommendation to: 1) Approve the use of Petersen Park on July 3, 2007 for the Annual Jaycee Day Event; 2) Provide City Support Services; 3) Waive all associated fees for the event; -�" 4) Approve a contract with Melrose Pyrotechnics in the amount of $15,000 for the 2007 Fireworks Display Program with the City's contribution not-to- exceed $10,000. ANNEXATION AND ZONING MAP AMENDMENT — TIMOTHY AND MARGARET ADAMS 2918 WEST LINCOLN ROAD In attendance were applicants and property owners, Timothy and Margaret Adams of 2918 West Lincoln Road. Director of Community Development Napolitano stated the applicants have requested permission to connect to the City's sanitary sewer system. Staff informed them in order to do so, annexation of their property is required as their property located at 2918 West Lincoln Road is contiguous to the City. Director Napolitano noted the Planning and Zoning Commission at a Public Hearing held on March 15, 2007 unanimously recommended approval of the applicants' request for zoning map amendment to RS-4 High Density Single Family Zoning District upon annexation to the City. Alderman Glab inquired about the requested zoning and whether Lot 1 met the zoning requirements on its own. Director Napolitano noted there are separate lots. The 25' -- setback requirements would not facilitate building a comfortable home. Motion by Wimmer, seconded by Santi, to accept Staffs recommendation to pass an ordinance annexing the property located at 2918 West Lincoln Road to the City. Voting Aye: Santi, Glab, Schaefer, Murgatroyd, Wimmer, Peterson, Condon, Low. Voting Nay: None. Absent: None. Motion carried. Motion by Wimmer, seconded by Murgatroyd, to accept the unanimous recommendation of the Planning and Zoning Commission to pass an ordinance granting a zoning map amendment to RS4 High Density Single Family Residential District as requested by Timothy and Margaret Adams for their property located at 2918 West Lincoln Road. Voting Aye: Santi, Glab, Schaefer, Murgatroyd, Wimmer, Peterson, Condon. Voting Nay: None. Absent: None. Motion carried. _ AMENDMENT TO CONDITIONAL USE PERMIT FOR OUTDOOR DISPLAY AND SALE OF UTILITY TRAILERS—THE HOME DEPOT, 2461 NORTH RICHMOND ROAD Director Napolitano stated correspondence was received from The Home Depot located at 2461 North Richmond Road seeking permission to add outdoor display and sale April 2, 2007 Page 5 of utility trailers to its existing conditional use permit granted by City Ordinance No. ORD- 00-990. Director Napolitano noted the conditional use permit currently allows the outside .— display, sale and storage of garden materials. The garden center is located at the southern end of the store. Director Napolitano stated the applicant has the right to first seek an expansion of an existing conditional use permit before Council which may grant the proposed amendment or refer the applicant to the Planning and Zoning Commission for a new Public Hearing. Director Napolitano noted Staff has no concerns with the request and recommends approval. In response to an inquiry from Alderman Peterson, Director Napolitano stated The Home Depot would be licensed for the sale of trailers through the State of Illinois. Alderman Peterson expressed his concern that a precedent would be set. He would like to discuss the taxes, when the trailers would be sold, what days would they be sold, etc. Alderman Santi concurred with Alderman Peterson, particularly as this might be precedent-setting. Alderman Glab stated he does not believe there is a restriction regarding the sale of trailers on Sundays. He does not think the City has the authority to regulate sales. Alderman Glab further stated Staff did a good job outlining the requirements and authority as it pertains to sale and display of trailers on the premises. Director Napolitano stated he would provide Council with information in this week's Friday Report regarding State regulations pertaining to the sale of trailers. Motion by Glab, seconded by Condon, to accept Staffs recommendation to pass an ordinance amending City Ordinance No. ORD-00-990 to allow the outdoor display and sale of utility trailers at The Home Depot located at 2461 North Richmond Road. Voting Aye: Santi, Glab, Schaefer, Murgatroyd, Wimmer, Condon. Voting Nay: Peterson. Absent: None. Motion carried. USE VARIANCE TO ALLOW CERTAIN NON-OFFICE USES — GIZMO PROPERTIES 3601-3637 MUNICIPAL DRIVE Mayor Low indicated the agenda item regarding the request for use variance to allow certain non-office uses by Gizmo Property for the property located at 3601-3637 Municipal Drive was pulled from consideration at this evening's meeting at the applicant's request. April 2, 2007 Page 6 REQUEST TO WAIVE BID REQUIREMENTS AND ACCEPT PROPOSAL FRONT COUNTRY CRAFTSMAN FOR REPAIR AND RESTORATION OF TWO SILOS AT PETERSEN HISTORIC FARM - $23.078 City Administrator Maxeiner noted the repair and restoration of the silos at Petersen Historic Farm is a project which is governed by the Prevailing Wage Act. Both contractors who have submitted proposals must be contacted to ascertain their intent to comply with the Prevailing Wage Act. City Administrator Maxeiner stated this matter will be brought before Council for consideration once the contractors' wage rates have been verified. CHANGE ORDER NO. 4 DECREASING THE CONTRACT AMOUNT FOR CENTRAL WASTEWATER TREATMENT PLANT IMPROVEMENTS PROJECT — KENO AND SONS. $4, 167 Deputy City Administrator Martin stated Change Order No. 4 regarding the Central Wastewater Treatment Plant Improvements Project represents a decrease in the amount of the project by $4,157. This is the final change order for this project which was completed $120,696 below the original contract amount of$834,000. Deputy City Administrator Martin stated it is Staffs recommendation to approve Change Order No. 4 decreasing the contract amount for the Central Wastewater Treatment Plant Improvements Project with Keno and Sons in the amount of$4,157. Motion by Murgatroyd, seconded by Schaefer, to accept Staffs recommendation to approve Change Order No. 4 decreasing the contract amount for the Central Wastewater Treatment Plant Improvements Project with Keno and Sons in the amount of$4,157. Voting Aye: Santi, Glab, Schaefer, Murgatroyd, Wimmer, Peterson, Condon. Voting Nay: None. Absent: None. Motion carried. MAYOR—STATEMENT AND REPORT Mayor Low announced the CHARACTER COUNTS! Coalition has declared April as Respect" month. COMMITTEE REPORTS Chairman Alderman Murgatroyd announced Finance and Personnel Committee Meetings have been scheduled for Wednesday, April 4, 2007 at 7 p.m. and Monday, April 9, 2007 at 7 p.m. to discuss the 2007-2008 budget. STAFF REPORTS There were no Department Head Reports. Council went back into Open Session at 8:50 p.m. OPEN SESSION: ITEMS DISCUSSED IN EXECUTIVE SESSION Motion by Wimmer, seconded by Condon, to increase the salary of City Administrator Maxeiner to Step 10 Grade 29 at $116,428 annually, with retroactive pay '- from May 1, 2006 to May 1, 2007 at the difference between Grade 29 Step 7.5 and Grade 29 Step 8.5. Voting Aye: Santi, Glab, Schaefer, Murgatroyd, Wimmer, Peterson, Condon. Voting Nay: None. Absent: None. Motion carried.
