APRIL 16, 2007
' A Regular Meeting of the McHenry City Council was called to order by Mayor Low at
7:30 P.M. on Monday, April 16, 2007 in the Council Chambers of the Municipal Center. At
roll call the following Aldermen were present: Santi, Glab, Schaefer, Murgatroyd, Wimmer
Peterson and Condon. Absent: None. City Staff in attendance were: City Administrator
Maxeiner, City Attorney David McArdle, City Clerk Jones, Deputy City Administrator Martin,
Assistant City Administrator Hobson, Chief of Police O'Meara, Director of Community
Development Napolitano, Director of Parks and Recreation Merkel, Director of Finance
Black. Absent: None.
PUBLIC HEARING TO:
1) COMPLY WITH BOND ISSUANCE NOTIFICATION ACT FOR ISSUANCE OF
GENERAL OBLIGATION BONDS (ALTERNATE REVENUE SOURCE): AND
2) APPROVE AUTHORIZING ORDINANCE FOR ISSUANCE OF $3.4 MILLION IN
GENERAL OBLIGATION BONDS (ALTERNATE REVENUE SOURCE) FOR THE
PURCHASE OF 1415 INDUSTRIAL DRIVE
Mayor Low at 7:33 p.m. opened the Public Hearing providing an opportunity for
public comment on the proposed issuance of $3.4 million in General Obligation Bonds to
purchase the property located at 1415 Industrial Drive.
Director of Finance Black noted the Public Hearing is required in order for the City
to comply with the Bond Issuance Notification Act. Director Black stated following the close
_- of the Public Hearing, it is Staffs recommendation to pass an ordinance authorizing the
issuance of$3.4 million in General Obligation Bonds (Alternate Revenue Source). Director
Black noted the bond proceeds would be utilized to purchase the property located at 1415
Industrial Drive which would be used as a Public Works Garage.
Alderman Glab expressed his pleasure with the acquisition of the property.
In response to Mayor Lows inquiry, there were no public comments or questions.
City Clerk Jones informed the Mayor there were no written or oral inquiries submitted to
the City Clerk's Office.
Motion by Murgatroyd, seconded by Santi, to close the Public Hearing at 7:34 p.m.
Voting Aye: Santi, Glab, Schaefer, Murgatroyd, Wimmer, Peterson, Condon.
Voting Nay: None.
Absent: None.
Motion carried.
Motion by Murgatroyd, seconded by Condon, to accept Staffs recommendation to
pass an ordinance authorizing the issuance of $3.4 million in General Obligation Bonds
(Alternate Revenue Source) for the purchase of the property located at 1415 Industrial
Drive.

PROCLAMATION: DECLARING MAY 1 2007 AS VETERANS OF FOREIGN WARS
LOYALTY DAY
Mayor Low reported she received a request from the City's Veterans of Foreign
Wars to proclaim May 1, 2007 as Veterans of Foreign Wars Loyalty Day in the City of
McHenry.
Mayor Low read into the record a proclamation declaring May 1, 2007 as Veterans
of Foreign Wars Day in McHenry. Mayor Low commended all veterans and noted a copy of
the proclamation will be forwarded to the local VFW organization.

There was no one who signed in to speak during the Ten Minute Public Input
Session.

REQUEST FOR USE VARIANCE TO ALLOW CERTAIN NON-OFFICE USES — GIZMO
PROPERTIES, 3601-3637 MUNICIPAL DRIVE
In attendance was Attorney Robert Roth representing the applicant.
Director of Community Development Napolitano stated the applicant, Gizmo
Properties, is requesting a use variance to allow specific non-office uses for their building
located at 3601-3637 Municipal Drive. Director Napolitano noted the Planning and Zoning
Commission at a Public Hearing held on February 1, 2007 recommended approval of
certain non-office uses, subject to specific restrictions on building signage and the
applicant's contribution of$80,000 towards the cost of Municipal Drive road improvements.
Director Napolitano stated it is Staffs recommendation to approve a use variance to
Gizmo Properties for their property located at 3601-3637 Municipal Drive to allow the
following uses:
- Beauty shop, barber shop, and hair styling salon
- Coffee shop, not-to-exceed 1,500 square feet in area and having limited hours of
operation (5:00 a.m. until 6:00 p.m.)
- Florist shop
- Laboratory, medical, dental, research and testing associated with each
- Orthopedic and medical appliance store (retail sales only)
- Veterinarian offices (domestic animals only)
- Postal packaging
- Physical and massage therapy
- Eye glasses, sales and repair
- Schools, commercial for music, dance, business or trade.
City Attorney McArdle suggested the matter regarding the applicant's contribution
toward the Municipal Drive improvements be addressed in a separate contract.
Alderman Peterson stated he is not in favor of a veterinarian office on the premises.
He also stated beauty shop and/or coffee shop are more commercial-type uses.
Alderman Condon expressed concerns regarding some of the uses.
Alderman Santi inquired if the postal packaging business might have to allow
consideration for larger trucks on the premises.

Alderman Glab envisioned a more upscale commercial structure to complement the
Municipal Building. He stated a coffee shop or veterinarian's office would not be
appropriate for the venue. Alderman Glab stated he would like to see uses more restricted.
Alderman Schaefer stated he would like to see more limitation on the uses. He
concurs with the other Aldermen. He has some reservations regarding the proposed uses.
Mayor Low stated a coffee shop might be a nice amenity to the Municipal Center.
Mayor Low stated she doesn't believe the applicant is seeking a drive-thru establishment
on the premises.
Alderman Murgatroyd inquired if one of the owners would be a tenant. Attorney
Roth responded Applicant Dr. Cannizzo would relocate his office to the site. His office
would occupy a 3,500 square foot office on the premises. Alderman Murgatroyd stated he
does not believe the owner would accept bad neighbors on the premises. He opined traffic
would not be an issue.
Attorney Roth requested Council's consideration of the applicant's request. He
thanked Council for addressing the matter.
Alderman Glab stated any use restrictions should be imposed by Council prior to
ordinance approval.
Alderman Peterson stated the veterinarian's office and coffee shop are not
appropriate for this venue. If permitted, they would be a deal-breaker as far as he is
concerned.
Attorney Roth stated the applicant is willing to eliminate the veterinarian's office.
The applicant is also willing to limit the size of the postal packaging unit to a maximum of
3,500 square feet.
City Administrator Maxeiner stated there would not be a drive-thru facility at the
coffee shop. He also noted no alcoholic beverages would ever be served.
Alderman Glab suggested the coffee shop be allowed to remain open later than
6:00 p.m. Aldermen Condon and Peterson concurred with Alderman Glab. Attorney Roth
suggested the coffee shop hours of operation be 5:00 a.m. until 9:00 p.m.
Motion by Murgatroyd, seconded by Condon, to pass an ordinance granting a use
variance to allow the following non-office uses to Gizmo Properties for their property
located at 3601-3637 Municipal Drive:
- Beauty shop, barber shop, and hair styling salon
- Coffee shop, not-to-exceed 1,500 square feet in area and having limited hours of
operation (5:00 a.m. until 9:00 p.m.)

REQUEST FOR TEMPORARY USE OF VETERANS MEMORIAL PARK AND WAIVE ALL
ASSOCIATED FEES FOR GARDEN QUARTER NEIGHBORHOOD RESOURCE
CENTER FAMILY DAY ON SUNDAY, MAY 20. 2007
In attendance was Meghan Sullivan of the Garden Quarter Neighborhood Resource
Center(GQNRC).
Assistant City Administrator Hobson stated the Garden Quarter Neighborhood
Resource Center has requested permission to host a Family Day on Sunday, May 20,
2007 at Veterans Memorial Park. The event would last from 2 p.m. until 7 p.m. In addition,
the request includes waiver of all associated fees. Assistant City Administrator Hobson
stated the GQNRC is organizing the event to raise money for the Center and to celebrate
achievements of the children who attend the Center. It is Staffs recommendation to
support the request.
Mayor Low stated she is looking forward to the event.
Motion by Condon, seconded by Santi, to accept Staff s recommendation to approve
the request for a temporary use of Veterans Memorial Park and waive all associated fees
for Garden Quarter Neighborhood Resource Center Family Day on Sunday, May 20, 2007
from 2 p.m. until 7 p.m.

REQUEST FOR USE OF PETERSEN PARK FOR THE ANNUAL FLAUNTED HAYRIDE IN
OCTOBER 2007, TEMPORARY ADVERTISING SIGNS, AND WAIVER OF ALL
ASSOCIATED FEES—WONDER LAKE WATER SKI TEAM
In attendance were Safety Director Jim Schmidt and his daughter Jenna Schmidt of
the Wonder Lake Water Ski Team.
Assistant City Administrator Hobson stated the Wonder Lake Water Ski Team is
requesting permission to use Petersen Park for its 10=h Annual Haunted Hayride on

October 13, 19, 20, 26, 27, 2007. The request includes posting of temporary advertising
signs at the following locations in the City:
1. 302 North Front Street - Gerstad Property
2. Bull Valley Road and Crystal Lake Road— Northwest Corner
3. Chapel Hill Road— Liberty Trails
4. Lincoln Road— Liberty Trails
5. McCullom Lake Road & Riverside Drive— Southwest Corner

Mr. Schmidt, on behalf of the Wonder Lake Water Ski Show Team, presented a
$500 check to the City's Parks and Recreation Department. He noted similar presentations
would be made to four other organizations.
REQUEST FOR USE OF PETERSEN HISTORIC FARM FOR ANTIQUE

In attendance was applicant Darick Franzen.
Assistant City Administrator Hobson stated a request has been submitted by Darick
Franzen to use Petersen Historic Farm for an Antique Truck/Tractor Show on October 13
and October 14, 2007. A $2 admission fee will be charged at the gate to be donated to
FISH Food Pantry.
Assistant City Administrator Hobson stated the request includes posting of

temporary signage and waiver of all associated fees. A new element to the event this year
is live music on Saturday. Assistant City Administrator Hobson noted the Police
Department has agreed to provide a Community Service Officer to assist with traffic
control. It is Staff s recommendation to support the request.
Alderman Condon stated her family has attended the event in the past and has
enjoyed it.
Alderman Schaefer inquired as to the venue for the music. Assistant City
Administrator Hobson responded the staging area would be behind the bam.
Motion by Condon, seconded by Schaefer, to accept Staff s recommendation to
approve the request submitted by Darick Franzen for use of Petersen Historic Farm for
Antique Truck/Tractor Show, Live Music, Temporary Signage, CSO services for traffic
control, and Waiver of all associated fees on October 13 and October 14, 2007

Mayor Low reminded everyone to vote on Tuesday, April 17, 2007.
COMMITTEE REPORTS
Chairman Alderman Condon rescheduled the Community Development Committee
Meeting from Tuesday, April 24, 2007 to Wednesday, April 25, 2007 at 7 p.m. in the
Aldermen's Conference Room.
Chairman Alderman Murgatroyd announced a Finance and Personnel Committee
Meeting has been scheduled for Monday, April 23, 2007 at 6:30 p.m. to continue
discussion regarding the 2007-2008 budget.
STAFF REPORTS
Director of Parks and Recreation Merkel announced a prescribed bum will be
conducted on Wheeler Fen Park on Wednesday, April 18, 2007, weather permitting.
City Administrator Maxeiner reported Alderman Glab requested construction on
Municipal Drive have minimal effect on voters. City Administrator Maxeiner stated Staff has
made every effort to address this matter.

Alderman Santi noted John Street has been patched and it is greatly appreciated by
the area residents.
