JUNE 11, 2007
A Regular Meeting of the McHenry City Council was called to order by Mayor Low at
-- 7:30 P.M. on Monday, June 11, 2007 in the Council Chambers of the Municipal Center. At
roll call the following Aldermen were present: Santi, Glab, Schaefer, Murgatroyd, Wimmer,
Peterson and Condon. Absent: None. City Staff in attendance were: City Administrator
Maxeiner, City Attorney McArdle, City Clerk Jones, Assistant City Administrator Hobson,
Director of Community Development Napolitano, Director of Finance Black. Absent:
Deputy City Administrator Martin, Chief of Police O'Meara, Director of Parks and
Recreation Merkel.
INTRODUCTION OF MCHENRY POLICE SERGEANT BRIAN J. MCKEEN
Mayor Low announced the introduction of Police Sergeant Brian McKeen is being
postponed to a future Council meeting.

FENCE VARIANCE— 305 TRALEE LANE
Director of Community Development Napolitano stated the residents of 305 Tralee
Lane, Chris and Julie Wegener, have requested a fence variance to allow a five-foot high
board-on-board fence set back ten feet from their Dartmoor Drive property line. The City's
fence ordinance requires a 30-foot setback from the right-of-way and allows for only a split
rail fence with a maximum height of 42 inches. Director Napolitano noted Staff has viewed
the site and supports the applicants' request.
Alderman Murgatroyd stated he has no problem in granting the variance as long as
sight lines are not impaired.
Alderman Peterson questioned whether Legend Lakes Subdivision covenants allow
for the fence. Director Napolitano stated the Home Owners' Association has approved the
request.
Alderman Condon concurred with Alderman Murgatroyd stating she supports the —
request provided there would be no sight line issues.
Alderman Glab commented on the number of fence variances being requested on
Council Agendas. He noted for the last several years Council has considered and

approved a large number of fence variances. Alderman Glab suggested Council review the
fence ordinance provisions and regulations for consideration at a future meeting.
Alderman Murgatroyd suggested residents be informed they are still responsible for
maintenance of their property located outside of the fenced-in area.
Motion by Murgatroyd, seconded by Wimmer, to accept Staffs recommendation to
approve a fence variance allowing the installation of a five-foot high board-on-board fence
set back ten feet from the Dartmoor Drive property line at 305 Tralee Lane.
Voting Aye: Santi, Glab, Schaefer, Murgatroyd, Wimmer, Peterson, Condon.
Voting Nay: None.
Absent: None.

FENCE VARIANCE— 206 CROSS TRAIL
Director Napolitano stated residents Cameron and Stacey Willis of 206 Cross Trail
have requested a fence variance allowing the installation of a four-foot high decorative
aluminum fence along their Dartmoor Drive property line. There would be no impact on
sight lines for vehicular traffic. Staff supports the request.
Motion by Condon, seconded by Glab, to accept Staffs recommendation to approve
a fence variance allowing the installation of a five-foot high aluminum fence along the
Dartmoor Drive property line at 206 Cross Trail.

REQUEST TO CONNECT TO MUNICIPAL SANITARY SEWER SYSTEM — 1632 NORTH
RIVERSIDE DRIVE
Director Napolitano stated a request was received from Nancy Porstner, property
owner of 1632 North Riverside Drive. Ms. Porstner is requesting connection to the
Municipal Sanitary Sewer System. At the present time, the subject property is not
contiguous to the City. It is Staffs recommendation to allow Ms. Porstner to connect to the
system with the understanding the subject property will be annexed within ninety days of
becoming contiguous to the City.
Alderman Schaefer stated he supports the request provided the property owner
understands her responsibility to annex to the City once the property becomes contiguous.
Motion by Schaefer, seconded by Santi, to accept Staffs recommendation to
approve the connection to the Municipal Sanitary Sewer System of the property located at
1632 North Riverside Drive subject to the payment of non-resident fees, with the
understanding the property be annexed to the City within ninety days of becoming
contiguous to the City.

SIGN VARIANCE — HOME STATE BANK, 4401 PRIME PARKWAY
In attendance was Jim Zambon of Home State Bank.
Director Napolitano stated a request was received from Penny Hughes of Hughes
Signs, on behalf of Home State Bank, seeking a sign variance to allow a 52 square foot
free-standing sign with a height of 8'4" for their facility located at 4401 Prime Parkway. The
sign ordinance allows a 32 square foot free-standing sign with a maximum height of six
feet. Staff has reviewed the request and supports the variance.
Alderman Santi inquired if there would be a negative impact on sight lines as a
result of the installation of the sign. Director Napolitano responded there would be no
impact. The new sign would have the same setback as the existing sign.
Alderman Glab noted the sign proportions seem to be off when reviewing the photo
and dimensions. Mr. Zambon responded noting the dimensions provided are those of the
actual sign.
Alderman Condon expressed concerns that the sign ordinance was recently revised
and yet Council seems to constantly be deluged with requests for variance. Alderman
Condon noted while the Home State Bank sign would appear to be a nice sign, she has
some issues with its installation.
Motion by Santi, seconded by Wimmer, to accept Staffs recommendation to
approve a variance allowing a 52 square foot free-standing sign with a height of 8'4" for
the property located at 4401 Prime Parkway.

REQUEST FOR TEMPORARY ADVERTISING SIGNS FOR FIESTA DAYS — MCHENRY
AREA CHAMBER OF COMMERCE
Director Napolitano stated the McHenry Area Chamber of Commerce is seeking
permission to install temporary advertising signs for its annual Fiesta Days Celebration
which will take place in July. Director Napolitano noted the Chamber is requesting
permission to place the temporary signs in front of participating establishments and
sponsors of the Fiesta Days events. The signs are approximately two feet by two feet in
size. The signs would be erected from July 61h through July 161h and July 20th through July
29th
Director Napolitano stated this would be a good way to support local businesses

that are participating in or sponsoring an event. Staff believes the signs are of low impact
and will be posted for a very limited time and, therefore, supports the request.
Alderman Santi state he likes seeing businesses getting recognition for their
involvement in a community event.
Alderman Glab opined the list of locations for the signs is extensive, but the signs
will only be posted for a brief period of time and he could support the request.
Alderman Schaefer inquired how signs could be posted when there is no grass
parkway in front of their business. Director Napolitano responded Staff would work with
property owners when a grassy area does no exist and a sign would be attached to the
front of the building.
Alderman Condon stated it is nice to recognize business participation in the
community-wide events.
Motion by Santi, seconded by Schaefer, to accept Staffs recommendation to
approve the installation of temporary advertising signs announcing participation or
sponsorship in Fiesta Days events as requested by the McHenry Area Chamber of
Commerce as follows:

RECOMMENDATION TO ACCEPT PROPOSAL FOR ARCHITECTURAL SERVICES
FOR RECONSTRUCTION OF HISTORIC PETERSEN FARM HOMESTEAD
FOUNDATION —ASPECT DESIGN ARCHITECTS INC.
Assistant City Administrator Hobson stated the Historic Petersen Farm Homestead,
acquired by the City in 1998, is in need of refurbishing. Despite routine maintenance the
structural integrity of the building has slowly deteriorated. The refurbishing/repair of the
home was identified as a priority in this year's Capital Improvement Program and $150,000
was allocated to begin making the repairs. Subsequently, Staff sought a request for
proposal from an architectural firm having expertise in the renovation/repair in historic —
structures. A proposal was submitted by Aspect Design Architects which includes the
following services:
1. Research of the existing condition of the foundation of the home
2. Recommendation on the types of materials and construction techniques to be used
in restoring the foundation of the home
3. Preparation of plan and construction documents
4. Preparation of bid plans and specifications
5. Construction management.
Assistant City Administrator Hobson noted there is a potential for grant money to
assist with renovations on the first and second floor of the home. However, without the
foundation restoration and stabilization, work on the remainder of the home would be
pointless.
Assistant City Administrator Hobson stated the proposal submitted by Aspect
Design Architects is in the amount of $14,900. It is Staffs recommendation to accept the
proposal as submitted.
Alderman Condon stated the Petersen Farm is a jewel in the community and she
fully supports Staffs recommendation.
Alderman Schaefer concurred with Alderman Condon.
Alderman Murgatroyd noted the Petersen Farm and Homestead was purchased in
order to continue the community's heritage. He noted he is glad to see steps are being

taken to preserve and maintain it for future generations.
Mayor Low noted she was in attendance at the farm during a recent filming requiring
its use as a period farm. She stated it was an interesting process.
Motion by Condon, seconded by Peterson, to accept Staffs recommendation to
approve an architectural services proposal for the restoration of the Petersen Farm
Homestead foundation as submitted by Aspect Design Architects in the amount not-to-
exceed $14,900.

MAYOR— STATEMENT AND REPORT
Mayor Low recognized Boy Scout Troop 131 member Tim Rasmussen who was in
attendance working toward his citizenship badge.
Mayor Low expressed pride in McHenry being a Character Counts! community and
noted the pillar focus for June is Fairness.
COMMITTEE REPORTS
--- Chairman Alderman Peterson announced a Parks and Recreation Committee
Meeting is scheduled for Wednesday, June 13, 2007 at 7 p.m. in the Aldermen's
Conference room.
Chairman Alderman Murgatroyd announced a Finance and Personnel Committee
Meeting is scheduled for Monday, June 18, 2007 at 6:30 p.m. in the Aldermen's
Conference Room.
STAFF REPORTS
City Administrator Maxeiner announced the Kiwanis Soap Box Derby will be held
Saturday, June 16, 2007. The parade begins at 9 a.m. Races will be held throughout the
day with the finale scheduled around 4 p.m.
City Administrator Maxeiner noted he has some issues with the boat and
recreational vehicle exhibit at the Illinois State Bank last weekend. A report to City Council
would be forthcoming.
FUTURE AGENDA ITEMS
Alderman Glab opined that the filming at the Petersen Farm should have come
before Council for consideration and approval. He recalled that Mr. Bob Petersen had
great pride in his property.

Mayor Low noted when the film company contacted the City it was thought they
were just scoping out the property. However, the film company actually began filming.
Mayor Low noted Assistant City Administrator Hobson was on site during the entire filming.
Council will be apprised of the date the film will be aired.
