JUNE 18, 2007
A Regular Meeting of the McHenry City Council was called to order by Mayor Low at
7:30 P.M. on Monday, June 18, 2007 in the Council Chambers of the Municipal Center. At
roll call the following Aldermen were present: Santi, Glab, Schaefer, Murgatroyd, Wimmer,
Peterson and Condon. Absent: None. City Staff in attendance were: City Administrator
Maxeiner, City Attorney McArdle, City Clerk Jones, Deputy City Administrator Martin,
Assistant City Administrator Hobson, chief of Police O'Meara, Director of Community
Development Napolitano, Director of Finance Black, Director of Parks and Recreation
Merkel, Director of Public Works Schmitt. Absent: None.
Mayor Low welcomed newly-appointed Director of Public Works Jon Schmitt to his
first Council meeting in that capacity.
PUBLIC HEARING: FIFTH AMENDMENT TO BUSCH-KNOX ANNEXATION
AGREEMENT: AND AMENDMENT TO CONDITIONAL USE PERMIT, 3300 CHARLES
MILLER ROAD
Director of Community Development Napolitano stated Council considered and
approved the Fourth Amendment to the Busch-Knox Annexation Agreement in August
2006. The Fourth Amendment, along with a conditional use permit, allowed the
construction of a 36-bed memory care facility on the property located at 3300 Charles
Miller Road. The building plans submitted for the memory care facility show 40 beds and
the overall size of the facility is larger than originally planned by 790 square feet. The
increased size of the building requires the building location nine feet closer to Charles
'- Miller Road and also requires some adjustments to the drive aisle in front of the building.
Director Napolitano stated, as a result of the building changes, an amendment to the
annexation agreement is needed as well as an ordinance expanding the existing
conditional use permit. In order to consider an amendment to the annexation agreement a
Public Hearing is required.
Alderman Condon departed Council Chambers at 7:35 p.m.
Mayor Low opened a Public Hearing for the consideration of the Fifth Amendment to
the Busch/Knox Annexation Agreement and amendment to the existing conditional use
permit for the property located at 3300 Charles Miller Road at 7:35 p.m.
Mayor Low invited questions or comments from Council regarding this matter. There
were none. Mayor Low requested comments or questions from the audience. There were
none. In response to Mayor Low's inquiry, City Clerk Jones reported there were no written
or oral comments or questions received with regard to this matter.
Motion by Wimmer, seconded by Santi, to close the Public Hearing at 7:36 p.m.
Voting Aye: Santi, Glab, Schaefer, Murgatroyd, Wimmer, Peterson.
Voting Nay: None.
Absent: Condon.

Motion by Wimmer, seconded by Murgatroyd, to pass an ordinance authorizing the
Mayor and City Clerk's execution of the Fifth Amendment to the Busch-Knox Annexation
Agreement as presented.
Voting Aye: Santi, Glab, Schaefer, Murgatroyd, Wimmer, Peterson, Low.
Voting Nay: None.
Absent: Condon.
Motion carried.
Alderman Glab commented on the landscaping and asked Staff to research
placement in consideration of future development.
Motion by Santi, seconded by Schaefer, to accept Staffs recommendation to pass
an ordinance approving the amendment of the existing conditional use permit to allow a
40-bed memory care facility at 3300 Charles Miller Road.
Voting Aye: Santi, Glab, Schaefer, Murgatroyd, Wimmer, Peterson.
Voting Nay: None.
Absent: Condon.
Motion carried.
Alderman Condon returned to Council Chambers at 7:40 p.m.

There was no one who signed in to speak during the Ten Minute Public Input
Session.

TRANSFER OF CLASS B-3 LIQUOR LICENSE FROM WHITE HEN PANTRY INC TO 7-
ELEVEN, INC. —3808 WEST ELM STREET
Mayor Low announced the owner, Stephanie Watts, of the new 7-Eleven facility was
in attendance.
Mayor Low stated the former White Hen Pantry is being sold to 7-Eleven effective
July 3, 2007. A request for liquor license transfer has been submitted. Mayor Low stated
the transfer fee has been paid and all appropriate paperwork submitted.
Mayor Low recommended approval of the request for transfer of the liquor license
subject to satisfactory fingerprint results and BASSET training for all employees involved in
the retail sale of packaged beer and wine.
Motion by Schaefer, seconded by Santi, to accept the Mayor's recommendation to
approve the transfer of the Class B-3 liquor license from White Hen Pantry Inc to 7-Eleven
Inc, located at 3808 West Elm Street, subject to satisfactory fingerprint results and
BASSET training for all employees involved in the retail sale of packaged beer and wine.
Voting Aye: Santi, Glab, Schaefer, Murgatroyd, Wimmer, Peterson, Condon.
Voting Nay: None.
Absent: None.

MAYOR— STATEMENT AND REPORT
Mayor Low announced a record crowd in attendance for the season's first regular
band concert. She recognized City employees and Assistant City Administrator Hobson for
their efforts.
COMMITTEE REPORTS
Chairman Alderman Peterson stated a Parks and Recreation Committee has
tentatively been scheduled for Wednesday, July 11, 2007.
STAFF REPORTS
City Administrator Maxeiner noted the Miss McHenry Pageant is scheduled for
Saturday, June 23, 2007 at McHenry High School West Campus auditorium. The doors
open at 6:15 p.m.
City Administrator Maxeiner announced this year's fireworks display will be held on
Tuesday, July 3`d at dusk at the Petersen Park Beach Area.

FUTURE AGENDA ITEMS
Alderman Glab inquired when the emergency entrance to Evergreen Park will be
designated as such. Director of Community Development Napolitano stated the developer
is completing the punch list and the emergency entrance should be marked in the near
future.
Alderman Glab noted the lack of landscape maintenance and high weeds along
Routes 31 and 120. He suggested Staff send out letters encouraging property owners to
better maintain their properties.
