JULY 9, 2007
A Regular Meeting of the McHenry City Council was called to order by Mayor Low at
7:30 P.M. on Monday, July 9, 2007 in the Council Chambers of the Municipal Center. At
roll call the following Aldermen were present: Santi, Glab, Schaefer, Wimmer, Peterson
and Condon. Absent: Murgatroyd. City Staff in attendance were: City Administrator
Maxeiner, City Attorney McArdle, Deputy City Clerk Kunzer, Deputy City Administrator
Martin, Assistant City Administrator Hobson, Chief of Police O'Meara, Director of
Community Development Napolitano, Director of Finance Black, Director of Parks and
Recreation Merkel, Director of Public Works Schmitt. Absent: City Clerk Jones.
INTRODUCTION: MCHENRY POLICE SERGEANT BRIAN MCKEEN
Chief of Police O'Meara introduced Sergeant Brian McKeen who was sworn in as
sergeant on June 4, 2007. Chief O'Meara noted Sergeant McKeen has been a McHenry
Police Officer since 1997. He is currently completing his bachelor's degree. Also in
attendance were Sergeant McKeen's wife, Cassie, and son John, as well as his parents
and parents-in-law.
Mayor Low expressed her appreciation for the efforts and dedication of all officers of
the McHenry Police Department and noted the City Council is very proud of its officers.
Mayor Low congratulated Sergeant McKeen on his promotion and wished him well in his
career.

CONSENT AGENDA
Mayor Low stated Consent Agenda Item C, Final pay request for Creekside Park
and Malibu Tot Lot playground renovations to Reil Construction in the amount of $94,500,
is being pulled from consideration on this evening's agenda.
Motion by Santi, seconded by Wimmer, to approve the Consent Agenda as
amended:
A. Request to waive bid requirements and approve proposal to install dump body
and hydraulic accessories on recently purchased Public Works trucks — R.A.
Adams, in the amount of$74,606.06;
B. Final pay request for Riverwalk Landscaping — Landscape Concepts
Construction Inc, in the amount of$47,596.51;
D. Request for use of Knox Park Barn, temporary sign permit, and waiver of all
associated fees—Annual McHenry Area Jaycees Haunted House;
E. Award of bid for purchase of Compact Excavator — McCann Industries, in the
amount of$40,072;
F. Ordinance approving various amendments to Municipal Code Chapter 4;

REQUEST FROM MCHENRY AREA CHAMBER OF COMMERCE TO TEMPORARILY
WAIVE HORSEPOWER RESTRICTIONS ON MCCULLOM LAKE TO ALLOW A JET SKI
SHOW IN CONJUNCTION WITH FIESTA DAYS ON SUNDAY, JULY 15, 2007
Assistant City Administrator Hobson stated the McHenry Area Chamber of
Commerce, as part of their Fiesta Days activities, is seeking approval to host a Jet Ski
�-- Show on Sunday, July 15�' on McCullom Lake at Petersen Park Beach area. He indicated
there would be two twenty minute shows. As the jet skis operate at higher horsepower than
is currently allowed by City ordinance, a temporary waiver on the allowable horsepower

restrictions is required. Assistant City Administrator Hobson also noted the jet skis have -�..
performed in the past between watercross events and no problems have resulted in their
use. Assistant City Administrator Hobson noted the Jet Ski Show would be coupled with a
BMX Bike Show on Sunday afternoon between the hours of 2 p.m. and 5 p.m. He stated it
is Staffs recommendation to approve the request.
Alderman Condon stated the Jet Ski Show and BMX Show would be a good draw
for Fiesta Days. She noted it would be a great addition to the Fiesta Days events.
Alderman Glab noted he is not in favor of increased horsepower use on McCullom
Lake. He expressed concerns regarding ecological effects on the lake bottom. He does not
condone increased horsepower usage on the lake and he cannot support the request.
Alderman Peterson stated he has no problem with the Jet Skis, especially as they
have performed in the past during watercross events.
Motion by Condon, seconded by Schaefer, to accept Staffs recommendation to
approve the McHenry Area Chamber of Commerce's request for a temporary waiver of
horsepower restrictions on McCullom Lake, to allow the use of personal watercraft as part
of the Jet Ski show on Sunday, July 15, 2007 at the Petersen Park Beach Area, between
the hours of 2 p.m. and 5 p.m.
Voting Aye: Santi, Schaefer, Wimmer, Peterson, Condon.
Voting Nay: Glab.
Absent: Murgatroyd.

ORDINANCE GRANTING A PARKING VARIANCE FOR 364-382 BANK DRIVE
In attendance were Mark Ignas and Christopher Ignas of MEI Properties, developer
of the subject property.
Director of Community Development Napolitano stated MEI Properties is proposing
to lease a portion of their strip mall located at 364-382 Bank Drive to a carry out
restaurant. In doing so there would be a shortage of five parking spaces. The applicant
appeared before the Planning and Zoning Commission at a Public Hearing held on June
21, 2007 and received a recommendation for approval of a request for variance to allow a
reduction in required parking from 70 spaces to 65 spaces.
Director Napolitano stated Staff believes as the restaurant is carryout only, there
would be minimal impact on parking demands. Staff believes granting the request is
appropriate.
Alderman Santi requested verification that the restaurant would be carryout and
there would be no sit-down area. Director Napolitano confirmed this was correct.
In response to Alderman Glab's inquiry, Mr. Mark Ignas stated he believed there
would likely be two or three employees of the restaurant. Alderman Glab suggested the

employees would utilize all parking spaces available to the restaurant if the reduction of
five spaces is granted. Director Napolitano clarified parking for carryout restaurants is
calculated at the rate of 10 spaces/1,000 square feet floor area. The restaurant is
comprised of 900 square feet which requires 8 parking spaces. Alderman Glab noted if the
number of spaces required is reduced from 8 to 3, the restaurant staff would utilize all
available parking spaces designated for the restaurant's use.
Alderman Glab suggested spaces be reserved for carryout customers in front of the
restaurant. Some discussion occurred regarding the difficulty in determining in advance
the parking required for strip malls. The uses change periodically and parking needs are
often difficulty to calculate.
Alderman Schaefer inquired which space in the mall the carryout restaurant would
be located. Mr. Mark Ignas responded space "F". Alderman Schaefer stated he was glad
the restaurant would not be situated in one of the end spaces (A or 1) as they might wish to
add a drive-thru facility.
Alderman Peterson inquired if yet another restaurant sought to lease space in the
center, how would the City handle the parking requirements. Director Napolitano
responded the applicant would be required to seek a parking variance.
Motion by Santi, seconded by Wimmer, to accept the unanimous recommendation
of the Planning and Zoning Commission, to pass an ordinance granting a parking variance
-- for the property located at 364-383 Bank Drive, to reduce the number of required parking
spaces from 70 to 65.
Voting Aye: Santi, Glab, Schaefer, Wimmer, Peterson, Condon.
Voting Nay: None.

ORDINANCE GRANTING A CONDITIONAL USE PERMIT FOR A DRIVE-THRU AND
VARIANCE REDUCING THE NUMBER OF STACKING SPACES FROM FIVE TO FOUR
— MEIJER STORES, 2253 NORTH RICHMOND ROAD
In attendance was Robert Petco of Progressive AE representing the applicant,
Meijer Stores.
Director Napolitano stated Meijer Stores is in the process of renovating all of its
stores nationwide. As part of the renovation, the store pharmacies are being relocated to
the front of the building. The McHenry store's drive-up pharmacy is currently situated on
the northeast corner of the building and would be relocated to the southeast corner of the
building. To accomplish the change, an expansion of the store's conditional use permit is
required. Additionally, the new site allows for only four stacking spaces for the pharmacy
drive-up window. As the City ordinance requires five stacking spaces, a variance is being

Director Napolitano stated Staff initially had concerns regarding pedestrian safety

and traffic flow due to the relocation of the drive-up window. Meijer Stores has provided -�
evidence that more than 60 stores have been converted to the new format and no
difficulties have been encountered regarding pedestrian safety or traffic flow.
Director Napolitano noted the Planning and Zoning Commission at a Public Hearing
held on June 7, 2007 considered the request and voted 6-1 to recommend its approval. If
Council concurs, a ordinance granting the conditional use permit and variance to reduce
the stacking space requirements would need to be passed.
In response to Alderman Peterson's inquiry, Mr. Petco responded the existing drive-
up window has been used minimally, chiefly as it is located in an obscure location not
readily visible to shoppers.
Alderman Condon stated she is struggling with the request noting she has concerns
regarding pedestrian crossing in the area. She stated while it is a good feature to have a
drive-up window for the pharmacy, she still has concerns regarding the additional traffic
which would be present at the front of the store.
Responding to Alderman Santi's inquiry, Director Napolitano stated the drive-up
window would be located adjacent to the store's outside garden center area. Director
Napolitano noted the garden center fence would be moved back approximately 10 feet to
accommodate the stacking area for the drive-up window. He stated there would be clear
access to the northbound entry to the drive-up lane as well as for traffic going northbound
leaving the drive-up window.
Alderman Glab noted there is presently no curb line along the front of the building.
He stated he does not believe Meijer would install a curb to protect the pedestrians from
the drive-up lane or garden center shoppers entering or leaving the outside garden center
area. He opined there is nothing to prevent Meijer from stacking garden center
merchandise in the 10-foot area between the fence and the drive-up lane. Noting the
striping shown on the site plan which indicated "no driving or parking area", he suggested
motorists are not required to obey the striping. Alderman Glab further noted he has
concerns regarding traffic flow issues. He contacted the McHenry Walgreen's and
determined 70% of their pharmacy business is attributed to drive-up window customers.
Alderman Glab indicated several communities have already denied Meijer's request to
relocate their drive-up pharmacy window to the front of their store. He encouraged Council
to deny this request.
Responding to Alderman Glab's concerns, Mr. Petco stated Meijer would install
concrete bollards to prevent drivers crossing/entering the striped areas. Mr. Petco also
stated the garden center fence would be moved back 21 feet. The width of the drive-up
lane is 1010". Mr. Petco stated overall in Meijer's Stores 1.5% of its total business is
attributed to its pharmacies. Of that 1.5%, 15% of its customers utilize the drive-up window.
A very small percentage of Meijer's business is attributed to the pharmacy. The pharmacy
is incidental to shopping for food and other merchandise.
Alderman Glab expressed concern regarding Council approving something which

could be detrimental to the community in the future, particularly if pharmacy drive-up
business really picks up at the store. The proposed relocation of the drive-up window is in
a much more visible location, and could precipitate a much greater volume of customers
for its use. Alderman Glab stated there should be curbing along the drive-up lane to
protect garden center shoppers as well as shoppers entering/leaving the store.
Restrictions should be in place regarding the storage of garden center merchandise
outside of the fenced-in area, i.e. how much and where it can be placed.
Alderman Schaefer stated he has some reservations regarding the request. He
opined curbing should be installed rather than just striping the pavement.
Alderman Glab inquired if the City had any police jurisdiction to prevent speeding in
the Meijer parking lot or on the private street, Blake Boulevard. Chief O'Meara responded
there is currently no means of issuing citations on private property. Alderman Glab
suggested the City investigate entering into an intergovernmental agreement to allow
enforcement of speeding on Blake Boulevard.
In response to Alderman Peterson's inquiry, Director Napolitano stated the 26' aisle
width between the drive-up lane and the parking islands is more than adequate. The City
ordinance requires an aisle width of 24 feet.
Alderman Condon noted the pharmacy use figures provided were system-wide. She
inquired if there were figures based on the McHenry store usage. Mr. Petco stated he had
no figures specific to McHenry Meijer's Store. Alderman Condon noted moving the drive-up
pharmacy to the front of the store would provide more visibility and potential for use. She is
glad for the striping along the drive-up lane as it affords quick emergency exit from the
drive-up lane. Alderman Condon inquired if there was a way to increase the stacking area
if business improves and the need exists. Mr. Petco responded the entry to the drive-up
lane could be modified to remove the curve and thereby increasing the number of available
stacking spaces. Alderman Condon noted she is more comfortable after hearing the
information provided this evening.
Alderman Peterson inquired if the only entry to the garden center area was the one
adjacent to the drive-up window. Mr. Petco responded garden center access is chiefly from
within the store. There is no access from the south side of the garden center fence.
Alderman Glab preferred to entertain more thoughts on garden center merchandise
storage restrictions outside of the fenced-in area. If Council supports the request,
conditions should be in place to make it as safe as possible. Even though the applicant
claims the fence would be moved 21 feet back from the drive-up lane, there is nothing in
writing which would cause that to happen. Storage in front of the fence of garden center
merchandise should be restricted by quantity and location.
Motion by Wimmer, seconded by Schaefer, to accept the recommendation of the
L Planning and Zoning Commission, to pass an ordinance granting the following;
1. conditional use permit to allow relocated of the drive-up pharmacy for Meijer
Store located at 2253 North Richmond Road;

2. grant a drive-up stacking space variance to permit four stacking spaces for the �-
drive-up pharmacy.

2007/2008 MCHENRY COUNTY MUNICIPAL RISK MANAGEMENT AGENCY RENEWAL
Deputy City Administrator Martin stated the McHenry County Risk Management
Agency annual premium renewal is due at this time. This insurance pool serves seven
municipalities regarding issues of workers compensation claims, property loss, general
liability, and public officials insurance. The premium for this year is $518,676 payable in
two equal installments.
Motion by Santi, seconded by Schaefer, to accept Staffs recommendation, to
approve the 2007/2008 McHenry County Municipal Risk management Agency renewal in
the amount of$518,676.
Voting Aye: Santi, Glab, Schaefer, Wimmer, Peterson, Condon.

MAYOR—STATEMENT AND REPORT
Mayor Low expressed her gratitude to the McHenry Area Jaycees for the wonderful
Independence Day celebration and fireworks. Mayor Low particularly thanked Assistant
City Administrator Hobson and Director of Parks and Recreation Merkel for all of their
efforts.
COMMITTEE REPORTS
Chairman Alderman Peterson announced a Parks and Recreation Committee is
scheduled for Wednesday, July 11, 2007 at 7 p.m.
STAFF REPORTS
Assistant City Administrator Hobson reported the annual Fiesta Days celebration at
Petersen Park begins on Friday, July 13'h. The gates for the Food Fiesta open at 4 p.m.
and close at 11 p.m. The Food Fiesta events continue on Saturday, July 14' , from 2 p.m.
until 11 p.m. and on Sunday, July 15`h, from noon until 10 p.m. The Landmark Commission
is hosting an antique sale at the Petersen Farm Homestead on Saturday, July le from 9
a.m. until 1 p.m.
