HomeMy WebLinkAboutMinutes - 09/10/2007 - City Council REGULAR MEETING SEPTEMBER 10, 2007 A Regular Meeting of the McHenry City Council was called to order by Mayor Low at 7:30 P.M. on Monday, September 10, 2007 in the Council Chambers of the Municipal Center. At roll call the following Aldermen were present: Santi, Glab, Schaefer, Murgatroyd, Wimmer, Peterson and Condon. Absent: None. City Staff in attendance were: City Administrator Maxeiner, City Attorney McArdle, City Clerk Jones, Assistant City Administrator Hobson, Chief of Police O'Meara, Director of Community Development Napolitano, Director of Public Works Schmitt. Absent: Deputy City Administrator Martin, Director of Parks and Recreation Merkel, Director of Finance Black. PUBLIC HEARING: BROOKE ESTATES ANNEXATION AGREEMENT, MAP AMENDMENT AND VARIANCE Mayor Low opened the Public Hearing to consider the following regarding the Brooke Estates Property located on the east side of Ridge Road: 1. Annexation agreement; 2. Annexation; 3. Map amendment; and 4. Variance to allow a reduced front yard setback and the continued use of an existing home on the premises. In attendance were Applicants Andreas and Deborah Szechowycz, owners of the subject property and their attorney Mark Saladin. Director of Community Development Napolitano stated applicants Andreas and Deborah Szechowycz are requesting the annexation of their property located on the east side of Ridge Road. The subject property is comprised of approximately 6.45 acres and is contiguous to the City of McHenry as it is adjacent to Deerwood Estates Subdivision. Director Napolitano noted the applicants intend to develop the property which would have 6 lots in conformance with RS-1 zoning district requirements with the exception of a front yard lot variance to permit the continued use of their residence on proposed Lot 6 of the Brooke Estates Subdivision. The use of the existing residence would expire in 10 years, by which time the applicants plan to construct a new residence on the premises. Director Napolitano stated all residences would have private well and septic. Access to the residences would be via a cul-de-sac exiting on Ridge Road. A preliminary plat of subdivision has been reviewed and accepted by City Engineers. The Planning and Zoning Commission at a Public Hearing held on July 19, 2007 considered the request and unanimously recommended approval of the applicants' requests. Alderman Santi inquired if the existing residence situated on Lot 1 would be removed. Mr. Szechowycz stated he would take down the home on Lot 1 (which is currently vacant) when the subdivision roadway is built. Attorney Saladin noted the existing residence located on Lot 6 is currently being occupied by the applicants. The house would be removed from the site once the applicants have constructed their new home. Attorney Saladin stated the applicants would like to remain in their current home on Lot 6 for no longer than 10 years. September 10, 2007 Page 2 Alderman Glab, referencing the preliminary plat, inquired if the dotted line along the southeast corner along Deer Run Trail indicated a right-of-way. Alderman Glab also inquired if the small park shown on the plat should be dedicated to the City in order to make the subject property contiguous to the City. Attorney Saladin responded the property would be dedicated to the City. Alderman Glab inquired if there would be a homeowner's association for the subdivision. Director Napolitano responded because the subdivision was so small, a homeowner's association would not be necessary. Attorney Saladin stated language could be incorporated into the annexation agreement concerning a homeowner's association. Alderman Glab stated he does not wish to see the house on Lot 6 become a rental property. He requested language be added to the annexation agreement specifying the residence be owner occupied. Alderman Glab, referencing the drainage easement shown on the east side of the plat, inquired if there would be no utilities going through the easement. Attorney Saladin responded stating the designation would be for a drainage easement only. Electric power to the subdivision would come from Ridge Road. Alderman Glab stated he would be more comfortable with a five-foot utility easement shown on the plat in the event it would be necessary in the future. City Administrator Maxeiner stated the City currently has no plans to provide water and sanitary sewer service to this area. Alderman Schaefer inquired if the City determines the architectural standards of new homes being built. Director Napolitano replied because this is a very small subdivision comprised of only six homes, and the large size of the lots, Staff thought it unnecessary to provide architectural standards. Custom homes will be constructed in the subdivision. Responding to an inquiry, Attorney Saladin stated the homeowner's association will maintain the berm and outlot. Alderman Peterson stated he liked the subdivision plan. Alderman Peterson inquired about potential availability of water and sanitary sewer to the property. City Administrator Maxeiner noted the area soil composition is conducive to septic systems. Alderman Condon, referencing the existing residence and garage, noted it appears the existing garage encroaches on Lot 5 of the subdivision. Mr. Szechowycz responded the garage would be removed. Alderman Glab mentioned transportation safety concerns along Ridge Road. Director Napolitano responded Staff inquired of the City Engineers if there were traffic safety issues with the development. The City Engineers determined it was unnecessary to require deceleration or acceleration lanes for this project. In response to Mayor Low's inquiry, there were no questions or comments from the audience regarding this matter. Motion by Santi, seconded by Schaefer, to close the Public Hearing at 7:47 p.m. September 10, 2007 Page 3 Voting Aye: Santi, Glab, Schaefer, Murgatroyd, Wimmer, Peterson, Condon. Voting Nay: None. Motion by Wimmer, seconded by Santi, to accept the unanimous recommendation of the Planning and Zoning Commission to approve an ordinance authorizing the Mayor and City Clerk's execution of an annexation agreement for Brooke Estates Property located on the east side of Ridge Road, adjacent to Deerwood Estates Subdivision, and comprised of 6.45 acres, subject to the inclusion of language in the agreement: 1. Requiring the maintenance of common areas by a homeowner's association which is to be created for this purpose; and 2. Limiting the continued use of the existing residence on Lot 6 for a period not-to- exceed ten years provided the residence is owner occupied. Voting Aye: Santi, Schaefer, Murgatroyd, Wimmer, Peterson, Condon, Low. Voting Nay: Glab. Absent: None. Motion carried. Motion by Santi, seconded by Schaefer, to accept the unanimous recommendation of the Planning and Zoning Commission to approve an ordinance annexing the Brooke Estates Property located on the east side of Ridge Road, adjacent to Deerwood Estates Subdivision, and comprised of 6.45 acres. Voting Aye: Santi, Glab, Schaefer, Murgatroyd, Wimmer, Peterson, Condon, Low. Voting Nay: None. Absent: None. Motion carried. Motion by Schaefer, seconded by Wimmer, to accept the unanimous recommendation of the Planning and Zoning Commission to approve an ordinance granting a zoning map amendment to RS-1 Low Density Single Family Zoning District and granting a variance to allow the continued use of the existing residence on Lot 6, as long as it is owner occupied, for a period not-to-exceed ten years. Voting Aye: Santi, Glab, Schaefer, Murgatroyd, Wimmer, Peterson, Condon. Voting Nay: None. Absent: None. Motion carried. PUBLIC INPUT SESSION — 10 MINUTE LIMITATION There was no one who signed in to speak during the Ten Minute Public Input Session. 1 September 10, 2007 Page 4 CONSENT AGENDA Mayor Low noted a change to the Block Party Request for 201 Driftwood Trail, stating it has been changed from September 29th to September 22"d. All other information remains the same. Alderman Schaefer inquired about the advisability of having two block parties on the same date within the same subdivision. City Administrator Maxeiner stated there should be no issue as long as traffic flow in the area is not restricted. Motion by Murgatroyd, seconded by Condon, to approve the Consent Agenda as amended: A. Authorization to advertise for bids for installation of holiday lighting in Veterans Memorial Park; B. Voting Nay: None. Absent: None. Motion carried. REQUEST FOR USE OF VETERANS MEMORIAL PARK AND SPECIAL EVENT LIQUOR LICENSE FOR ANNUAL OKTOBERFEST ON SATURDAY, SEPTEMBER 29, 2007 —ST. PATRICK'S CATHOLIC CHURCH Assistant City Administrator Hobson stated St. Patrick's Catholic Church has requested the use of Veterans Memorial Park to host their annual Oktoberfest on Saturday, September 29, 2007. In the past, the church has held the event on the church premises. This year in order to make room for attendees and parking, the church is intending to move the event to the City's park. The church is also requesting a special event liquor license for the event. Alderman Schaefer noted he has been involved with the event for a long time. He opined it is a good event for the parish. Alderman Peterson inquired if there would be an agency handling the wrist banding for the event.Assistant City Administrator Hobson responded volunteers would be doing the wrist banding. Alderman Condon stated she would be more comfortable if a separate organization was handling the wrist banding. Alderman Condon inquired how this was handled with other events encompassing the sale of alcoholic beverages in Veterans Memorial Park. Assistant City Administrator Hobson responded that other events provide alcoholic beverages; however, the sale of alcoholic beverages is regulated. Alderman Glab inquired if anyone could attend the event. Assistant City Administrator Hobson stated the event is not restricted to parishioners, but it has not been "~ publicly advertised. Alderman Glab inquired if alcoholic beverages would be served in plastic cups. Assistant City Administrator Hobson responded in the affirmative. September 10, 2007 Page 8 Motion by Schaefer, seconded by Santi, to accept Staff s recommendation to approve a request to use Veterans Memorial Park on Saturday, September 29, 2007 by St. Patrick's Catholic Church for their annual Oktoberfest and to approve a Special Event Liquor License for the event. Voting Aye: Santi, Glab, Schaefer, Murgatroyd, Wimmer, Peterson. Voting Nay: None. Abstain: Condon Absent: None. Motion carried. REQUEST FOR TEMPORARY USE PERMIT AND WAIVER OF ALL ASSOCIATED FEES TO HOST MUM SALE IN THE OLD MILL BUILDING PARKING LOT ON CRYSTAL LAKE ROAD —WOMEN IN MANAGEMENT ORGANIZATION Director Napolitano stated a request was submitted by Elizabeth Musial of Women in Management. The organization is seeking a temporary use permit to host a mum sale at the Old Mill building parking lot, on Saturday, September 29, 2007 from 10 a.m. until 3 p.m. The organization is also seeking a waiver of all associated fees for the temporary use. Director Napolitano noted the property owner has granted permission for the use on his site. A rain date of September 3dh has been set should it become necessary. Alderman Glab expressed concern regarding flower sales on the street, and suggested this matter could set a precedent. He opined the City has an ordinance in place ' preventing curb-side flower sales. Motion by Condon, seconded by Santi, to accept Staffs recommendation to approve a temporary use permit and waiver of all associated fees to the Women in Management Organization to host a mum sale in the Old Mill Building parking lot on Crystal Lake Road on Saturday, September 29, 2007 from 10 a.m. until 3 p.m. with a rain date of Sunday, September 30, 2007. Voting Aye: Santi, Schaefer, Murgatroyd, Wimmer, Peterson, Condon. Voting Nay: Glab. Absent: None. Motion carried. REQUEST FOR CLASS G1 LIQUOR LICENSE FOR NATHAN RYAN D/B/A CAFE AEON LOCATED AT 3918 WEST MAIN STREET AND ORDINANCE INCREASING NUMBER OF CLASS G1 LIQUOR LICENSES FROM ONE TO TWO Mayor Low stated she received a request from Nathan Ryan, owner of Cafe Aeon, for a Class G1 Liquor License for his facility located at 3918 West Main Street. Mayor Low noted Mr. Ryan would like to expand the offerings at his cafe to include a formal dining area offering alcoholic beverages. Mayor Low noted she and City Administrator Maxeiner met with the applicant and , have no reservations with awarding the license to Mr. Ryan. All appropriate paperwork and fees have been submitted. Mr. Ryan has submitted to fingerprinting and understands that all employees involved with the service of alcohol must attend BASSET training classes. September 10, 2007 Page 9 Mayor Low stated she recommends approval of the granting of a Class G1 Liquor License to Nathan Ryan d/b/a Cafe Aeon located at 3918 West Main Street, as well as the approval of an ordinance increasing the number of Class G1 Liquor Licenses from one to two. Motion by Schaefer, seconded by Condon, to accept Mayor Low's recommendation to approve the request for a Class G1 Liquor License for Nathan Ryan d/b/a Cafe Aeon located at 3918 West Main Street and to pass an ordinance increasing the number of Class G1 Liquor Licenses from one to two. Voting Aye: Santi, Glab, Schaefer, Murgatroyd, Wimmer, Peterson, Condon. Voting Nay: None. Absent: None. Motion carried. REQUEST FOR A SIGN VARIANCE FOR NORTH DIAMOND DRIVE — NORTHGATE WEST DEVELOPMENT In attendance representing the applicant was Penny Hughes of Hughes and Son Signs. Director Napolitano stated the developers of Northgate West Development had previously been granted a variance to allow two free-standing identification signs at their development located at the intersection of Diamond Drive and Richmond Road. The first sign was installed on the southwest corner of the intersection. It advertises the tenants on the south side of Diamond Drive. The second sign (102 sq ft in area and 15 ft high) was never installed but was intended to advertise the tenants on the north side of Diamond Drive. Director Napolitano noted Home State Bank will soon be opening their facility on the north side of Diamond Drive and have proposed installation of a different sign which would be 115 sq ft in area and 12 ft high. The sign would primarily advertise the bank, but would include two panels to advertise other uses. Director Napolitano stated if the proposed sign is approved, no other free-standing signs would be allowed on the Home State Bank site. Staff recommends approval of the request. Alderman Murgatroyd expressed concern with approving the sign variance when other tenants have not even built a facility on the property. He worried other tenants would be prohibited from having advertising signs on the property due to the variance having been granted to the bank. Alderman Murgatroyd stated he would rather leave the sign as previously approved rather than grant the variance for the Home State Bank sign. City Administrator Maxeiner stated an entity cannot be restricted from requesting a variance at a future date. He noted if the City approves the sign subject to no further sign variances being granted to the development, future tenants might have an issue with the matter and the bank would be placed in a position of limiting future variance requests. City Administrator Maxeiner noted to put a condition on future sign variances at this time would be premature. September 10, 2007 Page 10 Motion by Glab, seconded by Wimmer, to approve the request for a sign variance submitted by Home State Bank for the Northgate West Development permitting a 115 sq ft sign 12 feet in height including an electronic changing message sign and two panels to allow the advertisement of other uses on the site, subject to the installation of no other free- standing signs in the development and no future sign variances. Motion was withdrawn. Alderman Condon stated she does not care for the sign. Home State Bank overwhelms any space that any other tenants might have. Alderman Glab stated he cannot support the variance request as presented. Alderman Schaefer inquired as to the exact location of the sign. Ms. Hughes responded it would be sited directly opposite the Northgate Center sign. Alderman Murgatroyd stated he cannot support the sign in its current configuration. Motion by Wimmer, seconded by Peterson, to accept Staffs recommendation to approve a sign variance allowing a 115 sq ft sign, 12 feet in height, including advertising for Home State Bank, an electronic changing message board, and two panels to advertise other uses, to be placed along Diamond Drive in Northgate West Development directly opposite the Northgate Center sign. Voting Aye: Santi, Glab, Schaefer, Murgatroyd, Wimmer, Peterson. Voting Nay: Condon. Absent: None. Motion carried. MAYOR— STATEMENT AND REPORT Mayor Low reminded everyone of the memorial service scheduled in commemoration of 9/11. It will be held at Veterans Memorial Park at 9 a.m. tomorrow morning. The McHenry Police Department color guard will present the colors at the event. COMMITTEE REPORTS Chairman Alderman Peterson announced a Parks and Recreation Committee Meeting is scheduled for Wednesday, September 12, 2007 at 7 p.m. in the Aldermen's Conference Room. Chairman Alderman Murgatroyd requested a Finance and Personnel Committee Meeting be scheduled for Monday, October 1, 2007 at 6:30 p.m. in the Aldermen's Conference Room. STAFF REPORTS Assistant City Administrator Hobson announced there would be an Open House at the Historic Petersen Farm on Sunday, September 16, 2007 from 1 p.m. until 3 p.m. Tour of the home and barns will be available. September 10, 2007 Page 11 Assistant City Administrator Hobson also announced the Historic Petersen Farm is one of 25 nominees to receive grant funding from Partners in Preservation. Voting began September 6tn and will continue until October 10tn FUTURE AGENDA ITEMS Alderman Glab noted there are Jazzercise advertisement signs in the City right-of- way. Mayor Low stated Staff is aware and doing their best to keep up with illegal sign removal. She noted it could be a fulltime job keeping the rights-of-way litter free. Alderman Glab suggested another notice be published in the newspaper advising of the illegality of placing signs in public right-of-way.
