RESOLUTION AUTHORIZING CITY TO
ENTER INTO EASEMENT AGREEMENT
WHEREAS, LA SALLE NATIONAL BANK, a national banking
association, as Trustee , under the provisions of a Trust
Agreement dated the 20th day of December , 1972 , known as
Trust No. 45196, holds title in fee simple to a certain par-
cel of real estate described as follows :
That part of Lots 2 and 3 in Block 24 on the West
side of the Fox River of the plat of the Town of
McHenry as recorded in the Recorder ' s Office of
McHenry County, Illinois in Book B of Deeds , Page
160 (hereinafter referred to as the "Premises") ;
the same having been conveyed to Trustee by THE NORTHERN TRUST
COMPANY, an Illinois corporation, as Trustee , under Trust No.
24302 (hereinafter referred to as "Northern") ; and
WHEREAS , on the 28th day of May 1962 , Northern did by
a certain document entitled "Easement Agreement" , such docu-
ment having been recorded in McHenry County, Illinois in
Book 695 , Page 95, as Document No. 404861, grant to City of
McHenry an easement across the Easterly 16 feet of the Premises
for purposes of providing ingress and egress to the public for
entry into the municipal parking lot situated Southeasterly
of the Premises and further provided in said document that as
a condition to the easement, City undertake certain obligations
with respect to the exercise thereof; and
WHEREAS, City and LaSalle National Bank are desirous of
the further continuous use of the Easterly 16 feet of the Pre-
. mises for ingress and egress of the public into said municipal
parking lot.
NOW THEREFORE , be it resolved by the City Council of the
City of McHenry, Illinois as follows :
That the Mayor and the City Clerk, are hereby authorized
and directed to execute and attest, respectively, the "Easement
Agreement" between LaSalle National Bank, a national banking
association, as Trustee , under the provisions of a Trust Agree-
.
ment dated the 20th day of December, 1972 , known as Trust
No. 45196, and the City of McHenry, a copy of which "Easement
Agreement" is attached hereto and made a part hereof .
