HomeMy WebLinkAboutMinutes - 10/01/2007 - City Council REGULAR MEETING OCTOBER 1, 2007 A Regular Meeting of the McHenry City Council was called to order by Mayor Low at 7:30 P.M. on Monday, October 1, 2007 in the Council Chambers of the Municipal Center. At roll call the following Aldermen were present: Santi, Glab, Schaefer, Murgatroyd, Wimmer, Peterson and Condon. Absent: None. City Staff in attendance were: City Administrator Maxeiner, City Attorney McArdle, City Clerk Jones, Deputy City Administrator Martin, Assistant City Administrator Hobson, Chief of Police O'Meara, Director of Community Development Napolitano, Director of Finance Black, Director of Parks and Recreation Merkel, Director of Public Works Schmitt. Absent: None. PROCLAMATION: STAFF RECOGNITION AND AWARENESS MONTH, OCTOBER 2007 Mayor Low read into the record of the meeting a proclamation declaring October 2007 as Staff Recognition and Awareness Month in the City of McHenry. PUBLIC INPUT SESSION — 10 MINUTE LIMITATION There was no one who signed in to speak during the Ten Minute Public Input Session. ' October 1, 2007 Page 3 REQUEST FOR CONDITIONAL USE PERMIT TO SERVE ALCOHOL IN CONJUNCTION WITH A RESTAURANT AND TO ALLOW OUTDOOR SEATING — LAS PALMAS RESTAURANT, 209 NORTH FRONT STREET Director of Community Development Napolitano stated the applicant, John Abt, is seeking a conditional use permit to serve alcohol in conjunction with a restaurant and to allow outdoor seating at Las Palmas Restaurant to be located at 209 North Front Street. The site is the former location of Truszkowski's Restaurant. Director Napolitano stated the request was considered by the Planning and Zoning Commission at a Public Hearing held on September 20, 2007. The Commission unanimously recommended approval of the request subject to the following conditions: 1) the conditional use permit shall expire and become null and void if the restaurant (Las Palmas) closes (defined by being operational, i.e. serving customers) for a period of six continuous months; and 2) the dumpster enclosure shall be relocated to be adjacent to either the principal or accessory building. Director Napolitano stated the restaurant would be a nice addition to the City. The building has been vacant for a long time and it would be good to have the Las Palmas Restaurant located on the premises. Alderman Condon noted it is a beautiful building and it is good to have it being used. Alderman Santi concurred. Alderman Glab inquired as to the duration of the conditional use permit. Director Napolitano responded the conditional use permit remains in effect until the use no longer exists or is revoked by Council. Alderman Peterson inquired as to the amount of available parking. Director Napolitano stated more than adequate parking exists for the premises. Motion by Condon, seconded by Wimmer, to accept the unanimous recommendation of the Planning and Zoning Commission to pass an ordinance granting a conditional use permit for the service of alcoholic beverages in conjunction with a restaurant and to allow outdoor seating at Las Palmas Restaurant to be located at 209 North Front Street subject to the following conditions: 1) the conditional use permit shall expire and become null and void if the restaurant (Las Palmas) closes (defined by being operational, i.e. serving customers) for a period of six continuous months; and 2) the dumpster enclosure shall be relocated to be adjacent to either the principal or accessory building. October 1, 2007 Page 4 AWARD OF BID FOR HOLIDAY TREE LIGHTING IN VETERANS MEMORIAL PARK TO TEMPLE DISPLAY IN THE AMOUNT OF $15,700 WITH AN OPTION TO INSTALL ADDITIONAL LIGHTS AT A COST OF $215.36 PER 1,000 LIGHTS Assistant City Administrator Hobson stated specifications were prepared and bids were sought for the installation of holiday tree lighting in Veterans Memorial Park. Bids were opened on September 25, 2007. The lowest responsible bidder was Temple Display of Oswego, Illinois in the amount of$15,700. Assistant City Administrator Hobson noted an option to install additional lights, if needed, was included in the amount of $215.36 per 1,000 lights. Assistant City Administrator Hobson noted the lights would be installed by Saturday, November 17, 2007 in preparation for the Downtown Christmas Walk and Toys for Tots Parade scheduled for November 18, 2007. The contract includes maintenance of the lights during the season as well as removal at the end of the holiday season. It is Staffs recommendation to award the bid for the holiday tree lighting in Veterans Memorial park to Temple Display. Alderman Schaefer stated the holiday lighting enhances the park. Alderman Peterson noted he would like to see more lights along the Riverwalk during the holiday season. He stated he was not impressed with the parks decorations last year. Alderman Glab inquired about the method of advertisement for the bids. He stated he was curious as to why only two bidders came forward. Assistant City Administrator Hobson responded the bid was advertised in the Northwest Herald. Alderman Glab stated with regard to the additional lighting, who would determine if more lights are needed. Assistant City Administrator Hobson responded Staff would make the determination. Motion by Schaefer, seconded by Santi, to accept Staffs recommendation to award the bid for the installation of holiday lighting at Veterans Memorial Park to Temple Display of Oswego, Illinois in the amount of $15,700 with an option to install additional lights at a cost of$215.36 per 1,000 lights. REQU EST TO: 1) WAIVE BIDDING REQUIREMENTS FOR THE PURCHASE OF PUMPING EQUIPMENT FOR WELL NO. 8: 2) ACCEPT PROPOSAL FROM WATER WELL SOLUTIONS FOR ACQUISITION AND INSTALLATION OF NEW PUMPING EQUIPMENT FOR WELL NO. 8 IN AN AMOUNT NOT-TO-EXCEED $28,169 Director of Public Works Schmitt stated, as Council will recall, Well No. 8 located at the Malibu Court Tot Lot failed on July 22, 2007. At that time Council authorized October 1, 2007 Page 5 rehabilitation of the well by Water Well Solutions. The rehabilitation is complete. Director Schmitt stated Staff is now seeking authorization to purchase the necessary equipment to bring the well back online and to increase its pumping capacity. Director Schmitt noted as Water Well Solutions has been working on the well and is familiar with its operation, Staff is recommending waiving the bid process and to accept the proposal submitted by Water Well Solutions to purchase and install new pumping equipment in the amount of $25,303. Director Schmitt informed Council the amount of the proposal was reduced from $28,169, as stated in the Agenda Supplement, to $25,303, reflecting a reduction in the cost of epoxy coating from $8,886 to $5,620. Alderman Murgatroyd inquired how long the application of epoxy would extend the life of the piping. Director Schmitt responded the normal life-span of the pipe with epoxy application in place is approximately twenty years. Motion by Santi, seconded by Wimmer, to accept Staffs recommendation to: 1) waive the bid requirements for the purchase of pumping equipment for Well No. 8; and 2) accept the proposal for the purchase and installation of new pumping equipment for Well No. 8 in an amount not-to-exceed $25,303. Voting Aye: Santi, Glab, Schaefer, Murgatroyd, Wimmer, Peterson, Condon. Voting Nay: None. Absent: None. Motion carried. REQUEST FOR APPROVAL OF A SOLE SOURCE PROPOSAL TO FURNISH AND INSTALL STAINLESS STEEL REPLACEMENT WEIRS AND BAFFLE PLATES AT THE SWWTP —TRIPLE R EQUIPMENT SERVICES INC. IN THE AMOUNT OF $38,750 Director Schmitt informed Council the aluminum weirs and baffle plates used to regulate flow at the South Wastewater Treatment Plant (SWVV7P) from the clarifiers are not currently functioning correctly and need to be replaced. The only distributor of the type of equipment used at the plant is Triple R Equipment Services, Inc. of Mark, Illinois. Director Schmitt stated Triple R Equipment has submitted a proposal for purchase and installation of replacement parts from stainless steel, in order to provide a longer life expectancy, in the amount of $38,750. It is Staffs recommendation to accept the proposal from Triple R Equipment. Motion by Murgatroyd, seconded by Condon, to accept the proposal for purchase and installation of stainless steel weirs and baffle plates for SVW TP from Triple R Equipment Services, Inc. in an amount not-to-exceed $38,750. Motion carried. ti October 1, 2007 Page 6 MAYOR— STATEMENT AND REPORT Mayor Low commented the Snowmobile Watercross Event held this past weekend at Petersen Park was well run and well attended. The weather was perfect for the event. Mayor Low announced the Character Counts! pillar for the month of October is Respect. COMMITTEE REPORTS Chairman Alderman Murgatroyd reported a Finance and Personnel Committee meeting was held this evening prior to the Council meeting. Minutes will be forthcoming. Chairman Murgatroyd also announced another Finance and Personnel Committee Meeting has been scheduled for Monday, October 29, 2007 at 6:30 p.m. in the Aldermen's Conference Room. STAFF REPORTS City Administrator Maxeiner reminded Council of the upcoming Wine Festival scheduled for Sunday, October 7, 2007 from 1 p.m. until 5 p.m. at Veterans Memorial Park. FUTURE AGENDA ITEMS Alderman Murgatroyd announced the Antique Tractor Show is scheduled for October 13 and October 14, 2007 at the Petersen Historic Farm. Alderman Glab inquired if any headway had been made regarding ascertaining if a "for sale" on Crystal Lake Road conforms to the sign ordinance, particularly regarding its size and if it is an appropriate advertisement. City Administrator Maxeiner responded Staff is working with the realtor regarding the size of the sign. He noted the realtor had contracted for the construction of the sign based upon misinformation provided by Staff. The realtor has not been asked to remove the sign. Alderman Glab opined the sign should have some time constraints imposed upon it.
