HomeMy WebLinkAboutMinutes - 11/12/2007 - City Council REGULAR MEETING NOVEMBER 12, 2007 A Regular Meeting of the McHenry City Council was called to order by Mayor Low at 7:30 P.M. on Monday, November 12, 2007 in the Council Chambers of the Municipal Center. At roll call the following Aldermen were present: Santi, Glab, Schaefer, Murgatroyd, Wimmer, Peterson and Condon. Absent: None. City Staff in attendance were: City Administrator Maxeiner, City Attorney McArdle, City Clerk Jones, Deputy City Administrator Martin, Assistant City Administrator Hobson, Director of Finance Black, Director of Public Works Schmitt, Chief of Police O'Meara, Director of Community Development Napolitano. Absent: Director of Parks and Recreation Merkel. Mayor Low welcomed McHenry Webelos Pack 214 and noted the scouts were working on their Citizen Badge. Mayor Low invited the scouts to lead the assembly in the Pledge of Allegiance. APPROVE RESOLUTION SETTING THE LEVY REQUEST FOR 2007 AND ESTABLISHING THE DATE FOR THE PUBLIC HEARING FOR PROPOSED 2007 TAX LEVY Director of Finance Black stated each year the City is required to estimate the revenues needed to operate the City and all of its various functions. The first step in the process is to pass a resolution estimating the proposed levy for the current tax year. The amount of this year's levy is $4,565,388 which represents a 15% increase over the 2006 extension of $3,969,903. In March 2008 the County Clerk will provide the limiting tax ~ extension and, if the City's request has exceeded the tax extension limitation, the levy amount will be reduced accordingly. Director Black noted it is important that the original levy request be considerably higher than the anticipated actual levy in order to capture all November 12, 2007 Page 4 new growth in the community and all of the property tax revenue the City is entitled to ^- under tax cap legislation. Director Black stated it is Staffs recommendation to approve a resolution setting the tax levy request for 2007 in the amount of $4,565,388 and to establish the date for the Public Hearing as mandated by the Truth in Taxation legislation. The Public Hearing must be held in order to give the public an opportunity to be heard. This years Public Hearing will be held on December 3, 2007. Notice will be published in the Northwest Herald between November 19, 2007 and November 26, 2007. Alderman Condon commended Director Black on the format of the tax levy presentation, noting it was easily comprehend and understand. Motion by Murgatroyd, seconded by Schaefer, to accept Staffs recommendation to establish the date of December 3, 2007 for the Public Hearing regarding the 2007 Tax Levy as required by the Truth in Taxation Act; and to pass and approve a resolution setting the 2007 Tax Levy request at $4,565,388; and authorize Staff to publish notice in the Northwest Herald between November 19, 2007 and November 26, 2007. AMENDMENT TO NORTHERN ILLINOIS SPECIAL RECREATION ASSOCIATION (NISRA) BYLAWS City Administrator Maxeiner stated in Fiscal Year 2005/2006 the Northern Illinois Special Recreation Association (NISRA) amended its bylaws to establish a dues structure for participating entities. The agreed-upon rate was $0.0175 per $100 equalized assessed valuation (EAV) of the member communities. It has been Staffs concern that the NISRA dues increase at a much greater pace than property tax proceeds due to the tax cap limitations. City Administrator Maxeiner noted in Fiscal Year 2006/2007 NISRA dues rose more than 11% over the previous year's dues assessment. City Administrator Maxeiner stated NISRA is aware of the concerns expressed by participating entities and has agreed to amend their bylaws in order to reduce the rate for the current fiscal year from $0.0175 to $0.0165. City Administrator Maxeiner stated in the long term the City needs to look at another way to address the NISRA dues issue. It is Staffs recommendation to approve the NISRA bylaws amendment as presented to at least provide relief for the coming year. Alderman Murgatroyd stated the proposed rate reduction will help in the coming year, but concurred a long-term solution needs to be sought. Motion by Murgatroyd, seconded by Schaefer, to accept Staffs recommendation to approve the NISRA bylaws amendment decreasing the NISRA dues rate structure for participating entities for the coming year from $0.0175 to $0.0165 per $100 equalized assessed valuation. MINOR ADJUSTMENTS TO ORGANIZATIONAL STRUCTURE IN THE COMMUNITY DEVELOPMENT DEPARTMENT City Administrator Maxeiner stated Council in December 2006 considered and approved significant organizational restructuring that included three divisions in the Community Development Department: Community Development Department Director of Community Development Construction Services Neighborhood Services Planning/Economic Development [Supt] [Supt.] Planner Construction Inspections Minor Permits Code Compliance City Administrator Maxeiner noted since that time, the Superintendent of Neighborhood Services has resigned. Discussion occurred with departmental personnel, seeking their input as to the best way to structure the department in order to fulfill the needs of the community in the most efficient manner. City Administrator Maxeiner noted suggestions included bringing the construction services and neighborhood services together into a single component in order to provide for better work flow and flexibility in addressing the needs of the community. To that end a proposal is before Council this evening which would structure the department as follows: Community Development Department Director of Community Development Superintendent of Neighborhood&Construction Services Planning/Economic Development Assist.Superintendent City Planner Plan Reviewer Construction Inspections Code Compliance City Administrator Maxeiner stated the proposed restructuring would streamline work flow and provide more flexibility in addressing code compliance and minor permit issuance.. The proposal includes reclassifying the Superintendent of Neighborhood Services to an Assistant Superintendent of Construction/Neighborhood Services, reporting to the Superintendent. The Assistant Superintendent would continue working as a field inspector but would add overseeing the inspectors to the list of duties. In addition, the Assistant Superintendent would be the supervisor in charge of code compliance issues. The proposal also includes reclassification of an inspector position to a Plans Examiner which would be an in-office position providing for the internal plan review necessary to building and minor permit applications. 1 City Administrator Maxeiner noted the restructuring addresses Staff concerns while maintaining the line on department personnel expenditures. It is Staffs recommendation to approve the restructuring of the Community Development Department as presented. November 12, 2007 Page 6 Alderman Santi stated he appreciated the fact that Staff s concerns were addressed. --`. Responding to Alderman Glab's inquiry, City Administrator Maxeiner stated the restructuring would be effective immediately. MAYOR— STATEMENT AND REPORT -- Mayor Low expressed her gratitude to those who participated in yesterday's Veteran's Day ceremony at Veterans Memorial Park. COMMITTEE REPORTS Chairman Alderman Condon announced the 2008 Community Development Committee schedule would be provided to the committee members prior to the end of the year. Chairman Alderman Condon requested committee members provide suggestions for agenda items to Director Napolitano for inclusion at a future meeting. Chairman Alderman Peterson announced a Parks and Recreation Committee Meeting is scheduled for Wednesday, November 14, 2007 at 7 p.m. in the Aldermen's Conference Room. STAFF REPORTS Assistant City Administrator Hobson announced the Toys for Tots Parade is scheduled for Sunday, November 18, 2007. He noted the following events are also scheduled for that day: 11:00 a.m. Downtown Christmas Walk begins; 1:00 P.M. Toys for Tots Parade 5:00 p.m. Holiday Tree Lighting Ceremony at Veterans Memorial Park. FUTURE AGENDA ITEMS There were no Future Agenda Items discussed.
