WHEREAS, it has come to the attention of the corporate ,
authorities of the City of McHenry that the County Board of
McHenry County, Illinois may be considering the adoption of
a County Ordinance which would impose a duty upon the County
Recorder not to record any subdivision plats which do not have
county approval, eventhough the land in question might be locat-
ed within municipal boundaries of some municipality; and,
WHEREAS, it believes that the County of McHenry is without
lawful authority to impose the aforesaid duty upon the Recorder
of Deeds; and,
WHEREAS, in any event, the City of McHenry believes that
it is better qualified and equipped, than is the County of Mc-
Henry, to effectuate an orderly plan for growth, development and
improvement within its own City limits and to enforce its own
Subdivision Control Ordinance, as amended; and,
WHEREAS, the City of McHenry did, on April 17, 1961, adopt
its own Subdivision Control Ordinance which, among other things,
established minimum design standards for subdivision improvements
as well as procedures for the review and approval of proposed new
subdivisions; and,
WHEREAS, the City believes that the imposition of County
subdivision design standards upon land located within the City
limits would impose an element of uncertainty upon orderly develop-
ment, would dilute the ability of the City to negotiate annexation
agreements, would unjustifiably increase land development costs
within the City, would allow non-representatives of the City's
residents to determine its destiny and would place the City in a
posture of continuing conflict with the County,
NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL
OF THE CITY OF MCHENRY, MCHENRY COUNTY, ILLINOIS, as follows: ,
1. That the corporate authorities of the City of McHenry
are opposed to the passage, by the County Board of McHenry County,
of any ordinance, resolution or other regulation which would pro-
hibit the Recorder of Deeds from recording any subdivision plat
of lands located within the City limits of the City of McHenry
unless such plat had County approval; that the County Board be
and it is hereby requested to refrain from taking such action.
2. That the City Clerk is hereby directed to deliver a cer-
tified copy of this Resolution to the County Board of McHenry.

3. That the Chairman of the County Board of McHenry County
is requested to read this Resolution in its entirety to the members
of the County Board at the next meeting of the County Board.
