RESOLUTION
WHEREAS, Kildan III has requested that it be allowed to deposit a
sum of money less that that required by Section 28-3 of the Municipal
Code, City of McHenry, Illinois, in connection with the proposed anne-
xation of certain territory (Woodcreek Subdivision) to the City; and
WHEREAS, good cause has been shown to reduce the amount of such
initial deposit.
WHEREAS, a check in the amount of $10,600 based on the total acre-
age of 101.33 which is included in Woodcreek Unit I will be deposited
with the City.
WHEREAS, Kildan III has agreed to maintain a balance of $5,000
in the deposit account at all times with respect to the development of
the subdivision.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
McHENRY, McHENRY COUNTY, ILLINOIS, AS FOLLOWS:
SECTION 1. That pursuant to the authority contained in Section
28-10 of the Municipal Code, and upon good cause shown, the initial de-
posit requirements of Section 28-3 aforesaid be and the same are hereby
partially waived as to the pending Kildan III annexation proceedings
and in lieu of the requirement thereof, Kildan III be and it is hereby
authorized to deposit the initial sum of $10,600.
SECTION 2. This Resolution shall be in full force and effect im-
mediately upon its passage and approval .
