HomeMy WebLinkAboutResolutions - R-78-18 - 06/14/1978 - Martin-Anderson Farm annexations R-78-18 RESOLUTION WHEREAS, Harding Real Estate has requested that it be allowed to deposit a sum of money less than that required by Section 28-3 of the Municipal Code, City of McHenry, Illinois, in connection with the pro- posed annexation of certain territory (Martin-Anderson Farm) to the City; and WHEREAS, good cause has been shown to reduce the amount of such initial deposit. WHEREAS, a check in the amount of $10,000 based on the total acre- age of 360 which is included in Martin-Anderson Farm will be deposited with the City. WHEREAS, Harding Real Estate has agreed to maintain a balance of $5,000 in the deposit account at all times with respect to the develop- ment of the subdivision. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF McHENRY, McHENRY COUNTY, ILLINOIS, AS FOLLOWS: SECTION 1 . That pursuant to the authority contained in Section 28-10 of the Municipal Code, and upon good cause shwon, the initial de- posit requirements of Section 28-3 aforesaid be and the same are hereby partially waived as to the pending Harding Real Estate annexation pro- ceedings and in lieu of the requirement thereof, Harding Real Estate be and it is hereby authorized to deposit the initial sum of $10,000. SECTION 2. This Resolution shall be in full force and effect im- mediately upon its passage and approval . PASSED this 14th day of June, 1978.
