DECEMBER 3, 2007
A Regular Meeting of the McHenry City Council was called to order by Mayor Low at
7:30 P.M. on Monday, December 3, 2007 in the Council Chambers of the Municipal Center.
At roll call the following Aldermen were present: Santi, Glab, Schaefer, Murgatroyd,
Wimmer, Peterson and Condon. Absent: None. City Staff in attendance were: City
Administrator Maxeiner, City Attorney Cahill, City Clerk Jones, Deputy City Administrator
Martin, Assistant City Administrator Hobson, Director of Finance Black, Director of Public
Works Schmitt, Chief of Police O'Meara, Director of Community Development Napolitano,
Director of Parks and Recreation Merkel. Absent: None.
Mayor Low welcomed McHenry Webelos Pack 131 and noted the scouts were
working on their Citizen Badge. Mayor Low invited the scouts to lead the assembly in the
Pledge of Allegiance.
PUBLIC HEARING: 2007 CITY OF MCHENRY TAX LEVY AND APPROVAL OF TAX
LEVY ORDINANCE
Mayor Low at 7:32 p.m. opened the Public Hearing regarding the 2007 Tax Levy.
Director of Finance Black stated at its November 12, 2007 regularly scheduled
meeting Council approved a resolution establishing the date of December 3, 2007 for this
year's Tax Levy Public Hearing. Director Black noted the Truth in Taxation Act requires the
City to hold a public hearing to provide an opportunity for public input prior to the adoption
of the City's 2007 Tax Levy. Notice of the hearing was published in the Northwest Herald
on November 20, 2007. All publication requirements have been met. Director Black stated
his office had received no questions or comments regarding the proposed 2007 Tax Levy in
the amount of $4,565,388. Following the Public Hearing, Staff is requesting Council
consider passing an ordinance adopting the 2007 Tax Levy. Director Black noted a certified
copy of the ordinance must then be filed with the McHenry County Clerk by the last
Tuesday in December.
In response to Mayor Low's inquiry, City Clerk Jones stated no written or verbal
comments had been received in the City Clerk's Office regarding the City's 2007 Tax Levy.
Motion by Santi, seconded by Condon, to close the Public Hearing regarding the
City of McHenry 2007 Tax Levy,
Voting Aye: Santi, Glab, Schaefer, Murgatroyd, Wimmer, Peterson, Condon.
Voting Nay: None.
Absent: None.
Motion carried.
Motion by Murgatroyd, seconded by Schaefer, to accept Staffs recommendation to
approve an ordinance providing for the City of McHenry 2007 Tax Levy in the amount of
$4,565,388.

Voting Nay: None.
Absent: None.

REQUEST FOR CLASS G1 LIQUOR LICENSE FROM TOLUCA'S III D/B/A TOLUCA'S
Ill, 921 NORTH FRONT STREET AND ORDINANCE INCREASING NUMBER OF CLASS
G1 LIQUOR LICENSES FROM TWO TO THREE
In attendance was Attorney Steve Cuda representing applicant Armando Ortiz
Lagunas, President of Toluca's III.
Mayor Low stated a request was submitted by Mr. Lagunas for a Class G1 Liquor
License for his new restaurant to be located at 921 North Front Street. Mayor Low stated
Mr. Lagunas is aware of the regulations associated with the Class G1 liquor licenses. The
applicant has submitted all paperwork, paid the required fees and has been fingerprinted.
Mayor Low stated it is her recommendation to approve a Class G1 Liquor License as
requested by the applicant.
Attorney Cuda noted his client is aware of the regulations regarding the Class G1
license and has no objection to complying with them.
Motion by Murgatroyd, seconded by Wimmer, to accept Mayor Low's
recommendation to approve a Class G1 Liquor License for Toluca's III located at 921 North
Front Street, and to pass an ordinance increasing the number of Class G1 Liquor Licenses
from two to three.
Voting Aye: Santi, Glab, Schaefer, Murgatroyd, Wimmer, Peterson, Condon.
Voting Nay: None.

REQUEST FOR ANNEXATION OF 1.97 ACRES LOCATED AT 3320 BULL VALLEY
ROAD
In attendance was Attorney Mark Saladin representing applicants David and Sherri
Kotiw.
Director of Community Development Napolitano stated a Petition for Annexation of
1.97 acres located at 3320 Bull Valley Road was submitted by David and Sherri Kotiw. The
�-- request is to annex the property as is without benefit of an annexation agreement. The
property would be zoned E-Estate Residential pursuant to the City's Zoning Ordinance. The

subject property is currently improved with a single-family home, shed and detached
garage. The Applicants have indicated there are no current plans to redevelop the property.
It is Staff s recommendation to annex the property as requested.
Alderman Santi inquired if the property would remain single-family residential.
Director Napolitano responded in the affirmative.
Alderman Glab noted no restrictions were being placed upon the applicants to
connect to City water and sewer. Director Napolitano stated no request to connect to City
utilities was received. Responding to Alderman Glab's inquiry, Director Napolitano stated
the City would not lose any leverage regarding the potential redevelopment of the property.
Should the owner seek redevelopment, the plans would be subject to review by the
Planning and Zoning Commission and ultimately require Council approval. City Attorney
Cahill noted the City could impose conditions on the redevelopment of the property when it
is presented before Council for approval.
Motion by Santi, seconded by Schaefer, to accept Staffs recommendation to pass
and approve an ordinance providing for the annexation of the 1.97-acre parcel located at
3320 Bull Valley Road as requested by David and Sherri Kotiw.
Voting Aye: Santi, Glab, Schaefer, Murgatroyd, Wimmer, Peterson, Condon, Low.
Voting Nay: None.
Absent: None.

ORDINANCES PROVIDING FOR THE ABATEMENT OF VARIOUS BOND ISSUES
Director Black stated the City has issued various bonds to provide for funding of
projects in the City. The bond ordinances require the County Clerk to levy property taxes
for the debt service required on the bonds unless an abatement of the property tax by the
local municipality is approved and filed with the County Clerk. Each year the City considers
and approves ordinances providing for the abatement of the property taxes for the issued
bonds.
Director Black stated the following abatements require action by Council:
1. GO Bonds (Alternate) Series 2000A $463,050.00
2. GO Bonds (Alternate) Series 2002 $383,500.00
3. GO Bonds (Alternate) Series 2005 $153,078.76
4. GO Bonds (Alternate) Series 2006 $238.750.00
5. GO Bonds (Alternate) Series 2007 $244,192.50
6. SSA#1A Route 31/Shamrock Lane Signal $ 25,000.00.
Director Black noted it is Staffs recommendation to pass ordinances providing for the
referenced property tax abatements.

MAYOR— STATEMENT AND REPORT
Mayor Low announced the City of McHenry is hosting the Annual McHenry County
Council of Governments Christmas Dinner on Wednesday, December 12, 2007 at the
McHenry Country Club and urged Council to attend.
COMMITTEE REPORTS
Parks and Recreation Committee Chairman Alderman Peterson announced the
January meeting date has been changed to January 23, 2008 at 7 p.m. in the Aldermen's
Conference Room.
STAFF REPORTS
City Administrator Maxeiner announced the Annual Employee Christmas Events are
scheduled for Friday, December 14, 2007. Breakfast will be served at 7 a.m. and the
luncheon will begin at 11:30 a.m.
City Administrator Maxeiner reminded Council to provide his office with feedback
regarding some access issues regarding a potential development in the City.

There were no Future Agenda Items discussed.

Motion by Wimmer, seconded by Santi, to go into Executive Session to discuss
Potential Litigation at 7:45 p.m.
